Proposed Contractual Arrangement

The project will be under a Build-Transfer-Operate (BTO) arrangement for a concession period of 20 years (inclusive of the construction period). As per R.A. 7718 or the Amended BOT Law and its 2012 Implementing Rules and Regulations (IRR), the private sector Proponent will design and construct the facility on a turnkey basis. After construction, ownership and title over the facilities will be transferred to the City Government of Talisay (CGT), but the private sector will retain possession for the purposes of operating and maintaining the facility throughout the concession period. However, the CGT will retain control of the New Public Market’s operations to best facilitate/manage leasing out stalls to market vendors/stallholders, including Project Site Information charging and collecting fees.
