Prof. Catherine Sandoval, Santa Clara University School of Law, Co-Director, BBIC 1 The Impact of the FCC’s TV Duopoly Rule Relaxation on Minority and Women Owned Broadcast Stations 1999-20061 Executive Summary This study was commissioned to ascertain the impact of the Television Duopoly Rule (TVDR) on minority and female ownership of television broadcast stations. Currently, the only FCC rule deemed to be favorable to minority and female broadcast ownership is the Failed Station Solicitation Rule (FSSR) of the TVDR. The TVDR originally prohibited the ownership of more than one television broadcast station in a market. In 1996, due to industry efforts to protect market gains realized through the use of local management agreements (LMAs)2, the TVDR was amended to allow the ownership of two stations in certain markets provided only one of the two was a VHF station and the overlapping signals of the two owned stations originated from separate albeit contiguous markets. In addition, the acquired station was required to be economically “failing” or “failed” or unbuilt. In an effort to afford market access to potential minority and female owners, the FCC required the owners of the station to be acquired to provide public notice of its availability for acquisition. -

Proposed Exchange of Allotments: Phoenix and Holbrook, Arizona Statement of Hammett & Edison, Inc., Consulting Engineers The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained by NBC Telemundo License Co. ("NBC Telemundo"), licensee of TV Station KPHZ, Channel 11, Holbrook, Arizona, and Class A TV Station KDRX-CA, Channel N48, Phoenix, Arizona, to prepare an engineering statement in support ofits proposed redesignation ofChannel 39, Phoenix, as a commercial allotment (presently used by non-commercial educational TV Station KDTP) and redesignation ofChannel 11 , Holbrook, as a non-commercial allotment. High Use of Indoor Antennas by Hispanic Viewers Presently, the Phoenix metropolitan area receives over-the-air Telemundo network programming from Class A TV Station KDRX-CA, Channel N48, Phoenix. Telemundo is one of the two major Spanish language television networks in the U.S.! and Phoenix is the sixth largest Hispanic market in the U.S. 2 with about one-third ofthe total population being ofHispanic origin. The use of a Class A TV station having perhaps one-tenth the radiated power of a full-service NTSC station places the network at a technical disadvantage, and practically makes reception of the Telemundo network difficult or impossible for the many Hispanic viewers who rely upon indoor antennas for over-the-air reception. A strong, reliable over-the-air signal is particularly important for reaching Hispanic viewers in the Phoenix area because these viewers are less likely to use cable television or direct broadcast satellite for television reception, tending to rely exclusively upon indoor receiving antennas for over-the-air reception. -

Table of Station Assignment and Service Information October 7, 2004 NTSC and DTV facilities are identified in the following order on this table. First, the table lists facilities authorized by a construction permit (CP), if the station has one. Second, if the station does not have a CP, the table lists facilities authorized by a license, if the station has one. Third, if the station does not have either a CP or a license, the table lists DTV facilities as authorized by its DTV allotment, either in the initial DTV Table of Allotments or in an individual rule making proceeding. Data for single-channel DTV and NTSC stations appear at the end of the report. The ERP columns are effective radiated power in kilowatts. The HAAT columns are antenna height above average terrain in meters. For both NTSC and DTV facilities, if the authorized antenna height above average terrain (HAAT) is zero or negative, the value in the table has been rounded up to a positive 01 (stations in this situation should not consider this to be an error). The location columns are latitude over longitude, expressed in degrees, minutes and seconds as DDDMMSS.S. DTV pop and area columns are the population and area (people and square kilometers) within the DTV service contour where service is predicted based on consideration of intervening terrain and interference from other DTV and NTSC stations. Some changes will continue to be made to reflect data base error corrections that have been submitted to Video Division. In addition, changes will be made to reflect grant of applications for construction permits or modification of construction permits, including applications to implement DTV channel changes approved in rule making proceedings. -

Collins, Executive Director Date: November 3, 2014 Subject: MUR 14-007 (Legacy Foundation Action Fund) I am writing in reference to the Citizens Clean Elections Commission’s (the Commission) finding that there is reason to believe Legacy Foundation Action Fund (LFAF or Respondent) may have committed violations of the Citizens Clean Elections Act and Commission rules (collectively, the Act). I recommend that the Commission find probable cause that the Respondent violated the Act. I. Question Presented and Brief Answers Question: Did Respondent’s activities constitute express advocacy and require filings under the Act? Answer: Because LFAF’s advertisements expressly advocate for the defeat of Scott Smith for Governor and it filed no reports, LFAF violated A.R.S. §§ 16-941(D), -942(B), -958 and A.A.C. Factual and Procedural Background On January 9, 2014, Scott Smith, then Mayor of the City of Mesa, established his candidate campaign committee, Smith for Governor 2014, with the Secretary of State’s office. At the time, Smith was also the President of the U.S. Conference of Mayors (the Conference). Before Smith resigned as mayor and thus ended his term as president of the Conference, LFAF aired over $260,000 in television advertisements in the Phoenix market. -

INTRODUCTION 1. Television has played a critical role in the United States in the second half of the twentieth century. A technological breakthrough -- digital television -- now offers the opportunity for broadcast television service to meet the competitive and other challenges of the twenty-first century.1 2. The Telecommunications Act of 1996 ("1996 Act") provided that initial eligibility for any advanced television licenses issued by the Commission should be limited to existing broadcasters, conditioned on the eventual return of either the current 6 MHz channel or the new digital channel.
