The Board of Education encourages the public to attend board meetings and they are normally held on the second and fourth Tuesdays of each month at 7:00 p.m. in the City Council Chamber, City Hall, 501 Poli Street, Ventura.

The Board may consider and act on an agenda item in a different order or an item may be considered earlier or later than the estimated time. Additionally, discussion of the agenda items may be postponed to a future meeting.

PUBLIC COMMENTS

Public comments are welcomed and encouraged by the Board. A member of the public who would like to address the Board they will be encouraged to fill out a "Speaker Card" prior to the item being called, on the evening of the meeting. No additional speaker cards will be accepted after the item being called, on the evening of the meeting. As stated in Board Bylaw 9323, a person wishing to be heard by the Board shall first be recognized by the president and shall then proceed to comment as briefly as the subject permits. Individual speakers shall be allowed three minutes on any agenda item with a cumulative total of five minutes for all agenda items. The Board shall limit the total time for public input on each item to 20 minutes. With Board consent, the president may increase or decrease the time allowed for pubic presentation, depending on the topic and the number of persons wishing to be heard. The president may take a poll of speakers for or against a particular issue and may ask that additional persons speak only if they have something new to add. Also, speakers will not be allowed to give their time to other speakers. The Board is prohibited from taking action on any item that is not part of the published agenda. POSTING INFORMATION

The agenda for regularly scheduled board meetings will be posted 72 hours prior to the meeting. CONFERENCE AGENDA Conference items are those appearing on the Board agenda, usually for the first time, to recognize people and programs, provide reports, request operational actions, discuss proposals and make recommendations. Isom Advisors Financial Consultant Update on Bond Measure The District contracted with Jon Isom for consulting services regarding a bond measure and for other financial services. He will be updating the Board on bond measure work to date. Recommendation to Award After School Education and Safety CASES) Program Service Provider A Request for Proposals (RFP) was issued for professional and qualified agencies to administer after school programs at various sites district-wide starting August 2020-21. The District received three (3) RFPs from agencies desiring to operate an ASES program within VUSD, and these proposals were evaluated using criteria such as program components, firm experience, budget, staffing and community partnership. Approval to award the ASES contract will be requested at the next regularly scheduled board meeting. Resource Person(s): Ms. Betsy George, Assistant Superintendent, Business Services d. Preliminary 2019-20 Second Interim Financial Report Presentation Staff will provide the Board with an overview of the preliminary Second Interim Financial Report. The finalized Second Interim Financial Report will be submitted for the board's consideration at the March 10, 2020 board meeting. Parcel Tax Oversight Committee (PTOC) New Appointments (Action Requested) The District is required to conduct an application process when there are vacancies on the PTOC. The application process closed February 19, 2020. Staff will make recommendations to the Board tonight, and request that the Board appoint new committee members from candidates who submitted applications to the Business Services Department.

WHEREAS, Education Code Section 44954 requires a governing board to notify temporary employees before the end of the school year of the District's decision to not reelect the employee for the next succeeding year; WHEREAS, the individuals listed in Exhibit A are presently employed as temporary certificated employees by the Ventura Unified School District and the Board of Education desires to not reelect these employees for the next succeeding school year in any certificated position within this District. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the employees listed in Exhibit A will not be reelected for employment for the next succeeding school year; BE IT FURTHER RESOLVED AND ORDERED that the Superintendent or designee, provide notice to each of the named individuals on Exhibit A in accordance with the Education Code that the Board has determined to release and to not reelect him or her for the 2020-2021 school year and that his or her employment is thereby ended upon the close of this current 2019-2020 school year, and that the notification be provided prior to the end of the school year. Ventura USD Administrative Regulation Complaints Concerning District Employees

AR 1312.1 Community Relations

Complaint Procedures

The Superintendent or designee shall determine whether a complaint should be considered a complaint against the district and/or the individual, and whether it should be resolved by the district's process for complaints concerning personnel, other district procedures, or both.

(cf. 1312.2 - Complaints Concerning Instructional Material) (cf. 1312.3 - Uniform Complaint Procedures)

The complaint shall be initiated no later than six months from the date when the incident(s) occurred. or six months from the date when the complainant first obtained knowledge of the facts of the incident(s).

In order to promote fair and constructive communication, the following procedures shall govern the resolution of complaints against district employees:

l. Every effort should be made to resolve a complaint at the earliest possible stage. Whenever possible, complaints concerning school personnel should be made directly by the complainant to the person against whom the complaint is made. Parents/guardians are encouraged to attempt to orally resolve concerns with the staff member personally.

2. If a complainant is unable or unwilling to resolve the complaint directly with the person involved, he/she may submit an oral or written complaint to the employee's immediate supervisor or the principal.

3. When a written complaint is received, the employee shall be notified in accordance with collective bargaining agreements.

4. All complaints related to district personnel other than administrators shall be submitted in writing to the principal or immediate supervisor. If the complainant is unable to prepare the complaint in writing, administrative staff shall help him/her to do so. Complaints related to a principal or central office administrator shall be initially filed in writing with the Superintendent or designee. Complaints related to a Board member or to the Superintendent shall be initially filed in writing with the Board. Agenda, February 25, 2020 Page D8

5. A written complaint must include: a. The name of each employee involved,

b. A brief but specific summary of the complaint and the facts surrounding it, and

c. A specific description of any prior attempt to discuss the complaint with the employee and the failure to resolve the matter.

6. The person responsible for investigating complaints will attempt to resolve the complaint to the satisfaction of the person(s) involved within 30 days.

7. The complainant may appeal a decision by the principal or immediate supervisor to the Superintendent or designee, who will attempt to resolve the complaint to the satisfaction of the person(s) involved within 30 days. Complainants should consider and accept the Superintendent or designee's decision as final. However, the complainant, the employee, or the Superintendent or designee may ask to address the Board regarding the complaint.

8. Before any Board consideration of a complaint, the Superintendent or designee shall submit to the Board a written report concerning the complaint, including but not be limited to: a. The name of each employee involved.

b. A brief but specific summary of the complaint and the facts surrounding it, sufficient to inform the Board and the employee(s) as to the precise nature of the complaint and to allow the employee(s) to prepare a defense.

c. A copy of the signed original complaint.

d. A summary of the action taken by the Superintendent or designee, together with his/her specific finding that the problem has not been resolved and the reasons. 9. The Board may uphold the Superintendent's decision without hearing the complaint.

l 0. All parties to a complaint may be asked to attend a Board meeting in order to present all available evidence and allow every opportunity for explaining and clarifying the issue.

11. Before the Board holds a closed session to hear complaints or charges brought against an employee, the employee shall receive written notice of his/her right to have the complaints or charges heard in open session rather than closed session. This notice shall be delivered personally or by mail at least 24 hours before the time of the session, and the employee may request that the complaints or charges be heard in open session. Complaints concerning Board members shall be addressed in open session unless a closed session is warranted pursuant to Education Code 35146 or 48918 or Government Code 54957 or 54957 .6. 12. Any decision of the Board shall be final.

Complaints Regarding Child Abuse

When a complaint of child abuse is alleged, the district shall provide parents/guardians procedures for filing a child abuse complaint with the appropriate child protective agencies. Upon request, such procedures shall be written in the primary language of the parent/guardian, and the Superintendent or designee shall provide an interpreter if needed. (Statutes Other than Code, Ch. 1102, Statutes of1991)

Providing the above procedures to parents/guardians does not relieve mandated reporters from their duty to report susp_ected child abuse in accordance with law.

2. Consideration for Disposal of Obsolete, Surplus or Unusabl,e Books - Pierpont Elementary School Pierpont Elementary School has a variety of books that have become obsolete. It is recommended that they be disposed of in accordance with Education Code Section 60510. Due to Education Code, we are obligated to donate or sell "usable" books. The Business Services Department is currently storing obsolete books until they can make appropriate accommodations for recycling.

3. Consideration of Poinsettia Elementary School "We are the Lion Pride" Mural The staff at Poinsettia Elementary School is requesting permission to paint a mural. The mural will be 13 feet 6 inches x 10 feet and will be painted on the outside wall of building E facing Victoria Avenue. Andrew Rodriguez, professional muralist will be painting this mural. The project has been coordinated with the Facilities Services Department and the funding source is a VEP Grant, PTO, and site funds.

4. Overnight, Out of the Tri-County and Ratification Field Trips Ratification of the Superintendent's approval for students from Ventura High School's wrestling team to travel overnight and out of the tri-county to a CIF Individuals Wrestling Competition on February 13-15, 2020 is requested. This event was held at the Etiwanda High School, Etiwanda, CA, San Bernardino County. Fourteen students and two chaperones attended. At least one teacher or other certificated personnel accompanied students on this trip according to Administrative Regulation 6153. Transportation was provided by district vans. All required paperwork was on file at the school before departure.

Ratification of the Superintendent's approval for students from Ventura High School's music class to travel overnight and out of the tri-county to an All State Convention on February 20-23, 2020 is requested. This event was held at the Fresno Convention Center, Agenda, February 25, 2020 Page F2

Fresno, CA, Fresno County. Five students and two chaperones attended. At least one teacher or other certificated personnel accompanied students on this trip according to Administrative Regulation 6153. Transportation was provided by district vans. All required paperwork was on file at the school before departure.

Ratification of the Superintendent's approval for students from Foothill Technology High School's boys soccer team to travel out of the tri-county to a CIF Round 2 playoff game on February 14, 2020 is requested. This event was held at Hamilton High School in Anza, CA, Riverside County. Twenty-five students and four chaperones attended. At least one teacher or other certificated personnel accompanied students on this trip according to Administrative Regulation 6153. Transportation was provided by charter bus. All required paperwork was on file at the school before departure.

Balboa Middle School is requesting permission to send students from their music class to travel out of the tri-county to the Percussion Ensemble Competition to be held at Rancho Cucamonga High School, Rancho Cucamonga, CA, San Bernardino County. The trip will take place on March 1, 2020. Board approval is requested to send sixteen students and three chaperones to this field trip. At least one teacher or other certificated personnel shall accompany students on all trips according to Administrative Regulation 6153. Transportation will be provided by district vans. All required paperwork will be on file at the school before departure.

Mound Elementary School is requesting permission to send students from their 5th grade class to travel overnight for an Outdoor Education field trip to Catalina Island Marine Institute (CIMI) Camp Fox, Catalina Island. The trip will take place on March 23-25, 2020. While on this field trip the students will study island and marine environments. The components of this program include: Marine ecology, island ecology, nature hikes, snorkeling, and astronomy observations. Board approval is requested to send ninety-three 5th grade students and fourteen chaperones to this field trip. At least one teacher or other certificated personnel shall accompany students on all trips according to Administrative Regulation 6153. Transportation to the Long Beach Harbor will be provided by district bus and a van and transportation to Catalina Island will be provided by Catalina Classic Cruises. All required paperwork will be on file at the school before departure.

Buena High School is requesting permission to send students from their colorguard team to travel out of the tri-county to a Winterguard Competition to be held at El Toro High School in Lake Forest, CA, Orange County. The trip will take place on March 28, 2020. Board approval is requested to send sixteen students and two chaperones to this field trip. At least one teacher or other certificated personnel shall accompany students on all trips according to Administrative Regulation 6153. Transportation will be provided by private vehicles. All required paperwork will be on file at the school before departure.

Ventura High School is requesting permission to send students from their track and field team to travel overnight and out of the tri-county to the Trabuco Hills Invitational and Distance Carnival to be held at Trabuco Hills High School in Mission Viejo, CA, Orange County. The trip will take place on April 3-4, 2020. Board approval is requested to send forty­ five students and five chaperones to this field trip. At least one teacher or other certificated personnel shall accompany students on all trips according to Administrative Regulation 6153. Transportation will be provided by charter bus and private vehicles if needed. All required paperwork will be on file at the school before departure.

Loma Vista Elementary School is requesting permission to send students from their 5th grade class to travel overnight for an Outdoor Education field trip to Catalina Island Marine Institute (CIMI} Toyon Bay, Catalina Island. Current statutes and regulations recognize that there may be situations of a temporary nature in which a teacher with the appropriate credential is not available to the School District or the assignment is part-time and not conducive for recruitment. Senate Bill 435 has made it possible to assign staff with their permission to these areas in several ways:

Education Code 44258.7(b) allows full-time teacher who holds a credential in a subject other than physical education to coach a competitive sport for which the students receive physical education credit for one period a day. Education Code Section 44861 allows a credentialed teacher to substitute as a principal for up to five months, if the teacher's credential is for the same grade as the school to be administered. The employing agency determines the definition of 'emergency' for this section. This option is limited to a substitute principal only. The Board is asked to approve the individual listed below as per' the Education Code noted.
