Call to Order The Board of Education of the Ventura Unified School District met on Tuesday, May 26, 2015 in the City of Ventura, Council Chamber, and 501 Poli Street, Ventura, . President Debbie Golden called the meeting to order at 6:30 p.m. Dr. Arriaga called roll and noted that Board Member Lomax is attending an award presentation for one of her students and reason arrival delayed.

Public Comment on Closed Session Items - None

Closed Session It was moved by Mr. Walker, seconded Ms. Fitzgerald and carried that the Board adjourn to closed session to discuss conference with legal counsel anticipated litigation, public employee discipline/dismissal/release, conference with labor negotiators, and pupil matters. Aye 4, Nay 0, Absent 1/Lomax.

At 7:15 p.m., President Golden called the regular meeting to order and led the pledge of allegiance. Student Board member Evan Askar from Foothill read the Vision, Misael Rodriguez from Pacific High School read the Mission and Kayla Mangum from Ventura Adult and Continuing Education read the Governing Principals.

Report of Action taken in Closed Session

Good News Dr. Arriaga and Board members thanked the Student Board members; Evan Askar from Foothill Technology High School, Misael Rodriguez from Pacific High School and Kayla Mangum from the Ventura Adult Continuing Education for their excellence, poise and ability to articulate the sharing of school site news.

Dr. Arriaga announced the 5th annual, 2014-15 Ventura Unified School District Volunteer of the Year: Ms. Georgia Perry. Ms. Perry no longer has students in the district but continues to volunteer in events like Summerfest, Festival of Talent, BRAVO Employee Event, School Attendance Review Board, and led the District in raising over $5,000 for the National Alliance on Mental Illness. Dr. Arriaga presented Ms. Perry with a gift symbolizing that Volunteers are love in motion. Ms. Perry’s name will be added to the perpetual plaque that hangs proudly at the Education Service Center. The Board of Education personally thanked Ms. Perry for her service.

Ms. Pattie Braga, Steve Brown, and Cary Swift representing the Ventura Commerce and Education Foundation were proud to present to the Board the Teacher of the Month recipients. This monthly recognition recognizes outstanding teachers that make a difference in the lives of VUSD students. The awardee’s present: Month of September-Carly Starn Cabrillo Middle School, October-Mike Stewart Buena High School, November-Talynn Pedroza Elmhurst Elementary School, December–Craig Michels Sheridan Way Elementary School, January-Petra Somar Sunset Elementary February-Shannon Paulis Juanamaria Elementary, March-Laurie Adams Montalvo Elementary, April-Angie Rodriguez Junipero Serra Elementary, May-Lu Anne Smith ATLAS Elementary and the June recipient will soon be surprised at their school.

Public Comments Fourteen public speakers present to voice both negative and positive concerns over the recent resignation of Ms. Nancy Grubb, Buena High School faculty cheerleader advisor and the caustic state of the cheerleading squad.

Ms. Gaby Rivas was one of the students appointed as captain and then within days dismissed as one of the varsity cheerleading captains. She noted appreciation and guidance of Ms. Nancy Grubb throughout her student years as a cheerleader and sadden that Ms. Grubb resigned as faculty advisor. She stated there is a lot of discontent, drama between the team and she does not understand. The current state of the team has affected her emotionally to the point she does not want to go to school. In her opinion, the principal of the school is not handling the current situation within the squad fairly nor does the principal seem to care.

Mr. Brian Jaramillo parent is concerned over the rash decisions that are being made and the emotional affect to the team. The administration rescinded Ms. Grubb’s selection of captains based on a few parent complaints causing the team to be split and has fractured their spirit. He feels that the Coach is not responsible for the current state of the team and blames the school administration. He asked the Board to reconsider and revoke Mrs. Grubb’s resignation and allow her to continue as the faculty advisor for the team.

Ms. Carmen Luna thanked Mrs. Grubb for her leadership, guidance and successfully guiding the team. She is very upset that principal Irving revoked Ms. Grubb’s selection of captains based on two parent complaints. His decision has negatively impacted the emotional well being of her daughter.

Ms. Jade German noted this to be her second year on cheerleading squad and noted the many positive contributions Ms. Grubb has made to the team. She does not feel that having a new coach is in the best interest of the team and that administration should rescind Ms. Grubb’s resignation and allow her back as the team faculty advisor.

Ms. Theresa Pollara is a concerned citizen and friend of Ms. Grubb. It upsets her that Ms. Grubb’s decision to resign is based on the lack of support from her school principal. He overturn her decision on captain selection based on a few parent concerns. She feels that the Board has the power to rescind her resignation and allow her to return to work and continue to do what she does best.

Ms Nancy Grubb shared that supervising a squad of 30 to 40 students can be challenging but has enjoyed being the the faculty advisory for the past seven years without issues and has led a very strong squad. Her resignation is a result of the impass between administration. She is asking that the Board rescind her resignation as it is not in the best interest of the squad for her to leave. She explained that the Impass issue was due to her selection of captains based on academics and attendance. She noted that Principal Irving told her that a couple of parents complained and that changing her new process of captain selection was not in the best interest of the squad, nor was it approved by administration. The captains that she choose, one to be her daughter, were questioned by administration with questions about boyfriend and attractive appearance rather than on academics and leadership skills.

Ms. April Poole’s daughter, Aimee Poole is a current varsity cheerleader. Ms. Poole is one of the many parents that spoke to Mr. Irving regarding the waste of time taken by squad team to complete a detailed package of questions referring to selection of new squad captains, when in fact Mrs. Grubb had already made the selection. She clarified that parents did not ask for Ms. Grubb’s resignation, they just wanted a fair process in selection of squad captains.

Ms. Aimee Pool, varsity cheerleader clarified that the process was not fair. The girls that wanted to be captains were deceived thinking that they had an equal opportunity to be selected. The night before they were given a thick packet of questions to complete, and after they turned them in, were informed by the selected captains that they already knew they would be the team captains.

Ms. Whitney Grubb, noted that she ran for captain during her sophomore year, and if Ms. Grubb wanted her to be captain she would have changed the process at that time. She noted that administration has no business getting involved in their process as they do not supervise other sport issues. She mentioned that administration claims they spoke to other students, but they did not. Mr. Irving questioned her regarding personal relationship with her older boyfriend instead of leadership skills needed to be captain. She noted that the team is falling apart because of the girls that were not chosen as captains and their drama.

Ms. Haile Browneller was the past captain of the squad. In her opinion, Mrs. Grubb is not fully committed to support the best interest of the program and reason she resigned.

Ms. Megan Banales also participates on squad and noted Mr. Grubb favors certain students and reason for current hostile environment. Mrs. Grubb is not a positive role model, and therefore Board should not rescind her resignation. She noted that at least 20 members of the squad felt the process was not fair.

Ms. Amy Rhoden parent of a former cheerleader involved in the Buena program spoke in support of Ms. Grubb.

Mr. Dan Pollara spoke in support of Ms. Grubb’s ability to lead the cheerleading program and asked the Board to rescind Ms. Grubb’s resignation.

Ms. Bianca Barajas noted that the process in choosing the cheerleading captains was not made in the best interest of the entire program. She noted that Mrs. Grubb changed the process because she wanted her daughter to be one of the captains. In conversation with the principal, Ms. Barajas was told that Mrs. Grubb should have had a second person help make the decision in order to keep process impartial and fair for all who applied.

CONFERENCE AGENDA

Recognition of Retiring School District Personnel Members of the Board of Education, Dr. Arriaga and the entire District would like to extend their warmest wishes to Certificated and Classified staff members that are retiring, or have retired this school year. Certificates of appreciation were presented after the multi-media presentation was shared with the Board. The Board took a 30 minute break for reception in honor of retirees present.

2015-16 May Revise and the Ventura Unified School District Budget Outlook Report Mr. Richards, Assistant Superintendent of Business Services presented the May Revise and District Budget Outlook Report. The May revision is the Governor’s final statutory opportunity to amend his January state budget proposal to the legislature. This budget increase is the highest educational funding in years. The Governor’s May revision provides an additional $3.1 billion for education funding in 2014-15 in the form of onetime money. This is on top of the $4.75 billion already provided in the enacted budget for the local control funding formula. The combination of the rapidly recovering California economy and Proposition 30 temporary taxes drive the increased state revenues and growth in Proposition 98 for 2014-15. The Governor proposes adding $2.1 billion to the $4 billion proposed in January for 2015-16 Local Control Funding Formula growth for a total of $6.1 billion. The gap closure rate goes from 32.19% to 53.08%. The average increase is 14.13% or $1,088 per average daily attendance. The state is making rapid progress toward full implementation.

Notice of Public Hearing Regarding Local Control Accountability Plan (LCAP) Dr. Jenifer Robles, Assistant Superintendent of Educational Services noted that a public hearing to review the Local Control Accountability Plan will be held at a regularly scheduled Board of Education Meeting on June 16, 2015 at 7:30 p.m., Ventura City Hall, 501 Poli Street, Ventura, CA. This public hearing is held to solicit the recommendations and comments of the public regarding the proposed LCAP. The LCAP was made available for review on the Ventura Unified School District website.

California Interscholastic Federation (CIF) Applications for Renewal of Multi-School Membership (Action Requested) It was moved by Mrs. Haffner, seconded by Ms. Fitzgerald and carried unanimously to approve the California Interscholastic Federation (CIF) application to allow students in grades 11 - 12 at Foothill Technology High School and students in grades 9 – 12 at El Camino High School to participate in CIF sports at the student’s boundary school – either Buena or Ventura High School.

2015 Summer Feeding Program Kara Muniz, Director of Food and Nutrition Services (FNS) provided information regarding the Summer Feeding Program that provides free healthy meals to children ages 1 – 18 at various locations throughout the county. This program is federally funded by the National School Lunch Program and also provides employment opportunity for VUSD food and nutrition staff.

Paid Lunch Equity Requirement – Healthy Hunger-Free Kids Act Under the provision of the United States Department of Agriculture National School Lunch Program, VUSD Food and Nutrition Services is required to comply with Section 205 of the Healthy Hunger-Free Kids Act of 2010 which stipulates that a district can adjust paid lunch prices upward so that the difference between the federal reimbursement rate and the paid meal rate are equitable. This requirement is intended to ensure that USDA NSLP Program participants provide sufficient funds, to cafeteria funds, for paid lunches. The result of this year’s calculation requires no increase in meal costs for the 2015-16 VUSD school year.

ACTION AGENDA

Administrative Recommendation for Student Expulsion: It was moved by Mrs. Lomax, seconded by Mr. Walker and carried unanimously to approve the administrative recommendation regarding Student Expulsion #15/11.

Request for Approval of a New Course – Mathematics 8 Honors Common Core It was moved by Ms. Fitzgerald, seconded by Mrs. Haffner and carried unanimously to approve the new course as listed below.

Title: Mathematics 8 Honors Common Core Grade level: 8 Type of Credit: Mathematics Prerequisite: Grade 7 mathematics and student meets district criteria for placement. Length: One year Need: This course is the companion course to follow Mathematics 7 Honors Common Core. Course In grade 8, students will formulate and reason about expressions and Description: equations, including modeling an association in bivariate data with a linear equation. They will solve linear equations and systems of linear equations. They will understand the concept of a function and use functions to describe quantitative relationships. And, they will analyze two- and three- dimensional space and figures using distance, angle, similarity, and congruence; understand and apply the Pythagorean Theorem. In addition, students will have an opportunity to apply the mathematics in Common Core aligned projects and/or pursue enrichment by extending topics above and beyond current grade level. Request for Approval of a Revised Course – Mathematics 7 Honors Common Core It was moved by Mr. Walker, seconded by Ms. Fitzgerald and carried unanimously to approve a revised course as listed below. Current Title: Advanced Math 7 Common Core Revised Title: Mathematics 7 Honors Common Core Prerequisite: Grade 6 mathematics and student meets district criteria for placement. Course Description: In grade 7, students will develop their understanding of and will apply proportional relationships. They will develop their understanding of operations with rational numbers and work with expressions and linear equations. They will work with two- and three-dimensional shapes to solve problems involving area, surface area, and volume. And, they will draw inferences about populations based on samples. In addition, students will have an opportunity to apply the mathematics in Common Core aligned projects and/or pursue enrichment by extending topics above and beyond current grade level. 5. Disposal of Obsolete, Surplus, or Unusable Books Will Rogers, Citrus Glen Elementary Schools and Buena High School have a variety of books that have become obsolete/unusable. The Board approved the disposal in accordance with Education Code Section 60510. Local organizations that have expressed an interest in discarded books will be notified that the books are available. 9. Approval of Variable Term Waiver for English Language Learner Authorization The District has employed the following individual with culinary skills. The individual is qualified for the Designated Subjects Career Technical Education (CTE) Credentials and has enrolled in the Ventura County Office of Education (VCOE) Designated Subjects Program. The Preliminary CTE Credential does not cover the English Language Learner, which necessitates this waiver. 12. 2014-15 City of Ventura School Resource Officers Agreement Ventura Unified School District has renewed the agreement with the City of Ventura in order to provide School Resource Officers at District secondary schools. The agreement is effective July 1, 2014 through June 30, 2015. A copy of the agreement was made available for review in the Business Services Department.

13. 2015-16 Contracts for Meal Service for Boswell, Penfield, and Ventura Charter School The Board approved request from the Food and Nutrition Services to continue meal service at Boswell, Penfield and Ventura Charter School for the 2015-16 school year. Copies of agreements was made available for review in the Business Services Department.

14. Request for Waiver of Board Administrative Regulation 6153 Pacific High School will be participating in an overnight field trip to Santa Cruz Island on May 29-30, 2015. Approximately 12 students and 4 chaperones will be attending. Transportation will be provided by private automobile to the harbor and by a licensed, commercial watercraft to the island. All appropriate paperwork will be on file at the school before departure.

Board Administrative Regulation 6153 (trips involving watercraft) states: “3. The teacher must obtain a Certificate of Insurance naming the district as an additional insured. Under unique circumstances, a letter of coverage may be submitted in lieu of the Certificate of Insurance, provided that the letter of coverage is acceptable to the Assistant Superintendent of Business Services.”

This policy generally applies to commercial watercraft, not kayaks. Pacific High School has been unable to rent kayaks and obtain a certificate of insurance naming the District as an additional insured. This field trip is an important event for Pacific High School graduating seniors. The use of kayaks when at the Island is integral to the trip. The site principal supports the trip and an experienced kayaker will be present. The students will wear life preservers while kayaking, have already passed a swimming test, and will complete swimmer ability forms prior to the trip. All additional guidelines and policies for fieldtrips involving watercraft will be followed.

The Board approved the ratification of Pacific High School’s request to waive a portion of Board Administrative Regulation 6153 for this field trip. Business Services and Risk Management support this request.

15. Resolution #15-16, 2015-18 Transition Partnership Project (TPP) The Transition Partnership Project is designed to jointly serve Department of Rehabilitation clients through the Ventura Department of Rehabilitation office and VUSD through the combining of resources. By approving this resolution, the District accepts Agreement #29634, in the amount of $1,063,095.00, with the Department of Rehabilitation. This agreement will be effective July 1, 2015 through June 30, 2018. A copy of the agreement was made available for review in the Business Services Department.

16. Resolution #15-17, Approval of Temporary Loans Between District Funds) Revenues from Federal, State and local sources are not always timely, which causes cash flow deficiencies in District funds. The Board of Education authorized the temporary transfer of cash between District funds for the 2015-16 school year, which will be reimbursed when appropriations are received by the District.

17. Resolution #15-18, Approval for Appropriation Transfers The Ventura Unified School District may have a need during the fiscal year to make appropriation transfers to permit the payment of obligations of the District incurred during the 2015-16 school year.

18. Resolution #15-19, Authority for the Board of Education to Adjust Compensation for Certain Categories of Employees After July 1, 2015 Annually, the Board of Education adopts policy and resolution that allows them to provide confidential, supervisory, or management positions retroactive salary adjustments in the next fiscal year by declaring those salaries indefinite. This action is not necessary for represented employees because their salaries become indefinite upon expiration of the collective bargaining contract on the salary provisions of the contract. As a result of financial uncertainties, negotiations, legislation and other factors, the Governing Board hereby declares that all management, confidential and other unrepresented employee salaries are declared indefinite for 2015-16.

BOARD UPDATE Mrs. Golden attended the Arts Collaborative meeting. The group reviewed phase II of the Arts Master Plan. She thanked retiring Chairperson, Ms. Kathy Asher for her passion in sustaining Arts education for all students. Julie Judd, Chief Technology Officer will be chairing the committee.

Mrs. Golden also attended the Wellness Collaborative meeting and discussed grant opportunities and the requirement to review and update the federally mandated Wellness policy.

Ms Fitzgerald attended the oversight committee meeting regarding vocational opportunities at the Ventura Adult Continuing Education. She acknowledged VACE for the excellent work!

Mrs. Lomax also attended the VACE vocational advisory oversight committee. She also had the opportunity to meet with the VC Innovate group, that included a speaker on promoting classes on gender equity.

Mr. Walker attended the California School Board Association (CSBA) Delegate meeting with primary discussion on the positive news regarding the Governor May Revise Budget. CSBA
