V B Diesem Mangel, der sowohl die Forschung als auch die universitäre Lehre betrifft, soll durch die Publikation bedeutsamer Quellenstücke in (8. MÄRZ – 24. JUNI 1946) einer praktikablen, preisgünstigen Form begegnet werden. Angestrebt ist ein verläßlicher Text als Grundlage für wissenschaftliche Arbeiten. Zum Inhalt dieses Bandes Die Bayerische Verfassung vom 8. Dezember 1946 entstand in mehre- ren Phasen. Den Auftakt bildeten die Beratungen des Vorbereitenden Verfassungsausschusses, der unter Vorsitz von Ministerpräsident Wil- helm Hoegner in 15 Sitzungen vom 8. März bis 24. Juni 1946 in der Münchner Staatskanzlei tagte. Im Unterschied zu den Protokollen des Verfassungsausschusses und des Plenums der Bayerischen Verfas- sunggebenden Landesversammlung lagen sie bisher nicht gedruckt vor. Die durch Einleitung, Sachkommentar und Personenregister erschlosse- ne Edition der Protokolle des Vorbereitenden Verfassungsausschusses komplettiert die Quellengrundlage zur bayerischen Verfassungsge- schichte der Nachkriegszeit. In dem neunköpfigen Ausschuß, dem Vertreter von CSU, SPD und KPD angehörten, wurden bereits wesentliche Grundzüge der späteren Ver- fassung festgelegt: so der Verzicht auf ein konstruktives Mißtrauens- votum oder die 10%-Sperrklausel auf Regierungsbezirksebene. Die leb- haften Debatten in diesem Gremium, dem auch der spätere Ministerprä- sident Hans Ehard sowie der Staatsrechtler Hans Nawiasky angehörten, zeigen auch bereits deutlich die unterschiedlichen Positionen von CSU und SPD in den zentralen Streitpunkten der Verfassungsberatungen: Staatspräsident und Zweite Kammer. Die Argumentation wird dabei – un- abhängig von Pro oder Contra – von den unterschiedlichen Erfahrungen der Mitglieder mit der gescheiterten Demokratie von Weimar geprägt. Zum Autor Dr. Karl-Ulrich Gelberg (geb. 1962) studierte Geschichte und Romanistik in Würzburg und Clermont-Ferrand. Er ist seit 1990 wissenschaftlicher Eingeleitet und kommentiert von Mitarbeiter der Historischen Kommission bei der Bayerischen Akademie Karl-Ulrich Gelberg der Wissenschaften und Bearbeiter der Edition „Die Protokolle des Bayerischen Ministerrats 1945–1954“. Dezember 1946. Nach Kriegsende entstanden zuerst in der amerikanischen Besatzungszone, in Bayern, Hessen und Württemberg-Baden, demokratische Verfassungen. Den Auftakt der Beratungen bildeten in Bayern die 15 Sitzungen des Vor- bereitenden Verfassungsausschusses, der unter Vorsitz von Ministerpräsi- dent Wilhelm Hoegner von März bis Juni 1946 in München tagte und be- reits wesentliche Grundzüge der späteren Verfassung fixierte. Dessen Protokolle, ein Schlüsseldokument für die Entstehungsgeschichte und das Verständnis der bayerischen Verfassung, lagen im Unterschied zu den Nie- derschriften der Verfassunggebenden Landesversammlung sowie ihres zentralen Verfassungsausschusses bisher nicht gedruckt vor. Der dritte Band der Quellentexte zur bayerischen Geschichte schließt diese zentrale Lücke und komplettiert damit die Quellengrundlage zur bayerischen Ver- fassungsgeschichte der Nachkriegszeit. Verschiedene Personen und Institutionen haben zur Entstehung des Bandes ganz wesentlich beigetragen. Der Generaldirektor der Staatlichen Archive Bayerns, Prof. Dr. Hermann Rumschöttel, hat die Herausgeber von Anfang an wohlwollend und unbürokratisch unterstützt. Frau Claudia Wöllert hat die Texte der Protokolle und Anlagen erfaßt. Herr Ernst Vögel von der Firma Druck+Verlag Ernst Vögel GmbH (Stamsried) hat die Daten der für eine andere Publikation bereits erfaßten Texte des Hoegnerschen Vorent- wurfs (Nr. 1) sowie des Ergebnisses der Beratungen des Vorbereitenden Verfassungsausschusses (Nr. 19) für diese Publikation kostenlos zur Verfü- gung gestellt. Gegenstand der Edition Nach Kriegsende entstanden zuerst in den Ländern der amerikanischen Be- satzungszone, in Bayern, Hessen und Württemberg-Baden, demokratische Verfassungen.1 Die Initiative zur Verfassunggebung in der US-Zone ging von der amerikanischen Militärregierung aus. Der Auftrag, demokratische Verfassungen zu erarbeiten, war ein zentrales Element ihrer Demokratisie- rungspolitik.2 Anfang des Jahres 1946 legte der stellvertretende Militärgouverneur und Chef des Office of Military Government of the United States for Germany (OMGUS), General Lucius D. Clay, einen präzisen Zeitplan vor, nach dem bis zum Jahresende in den Ländern der US-Zone Verfassungen entstehen und parlamentarisch legitimierte Regierungen gebildet werden sollten. Die Entstehung der Bayerischen Verfassung fand in mehreren Schritten statt. Auf Befehl der Amerikaner berief Ministerpräsident Wilhelm Hoeg- ner zunächst im Februar 1946 einen Ausschuß, der Vorarbeiten für die im Sommer zu wählende Bayerische Verfassunggebende Landesversammlung leisten sollte. Dieser „Vorbereitende Verfassungsausschuß“ legte seinen von der Militärregierung erteilten Auftrag sehr weit aus und präsentierte am 9. Juli 1946 dem Präsidenten der Verfassunggebenden Landesversammlung einen vollständigen Verfassungsentwurf, der die Beratungen der Landesver- sammlung, vor allem von dessen Verfassungsausschuß, wesentlich bestim- men sollte. Im Unterschied zu den gedruckt vorliegenden Beratungsniederschriften des Plenums der Bayerischen Verfassunggebenden Landesversammlung3 sowie den noch wesentlich umfangreicheren des Verfassungsausschusses der Lan- desversammlung4 sind die Protokolle der 15 Sitzungen des Vorbereitenden 1 Vgl. Juni 1946 bisher nicht publiziert worden.5 1963 widmete Hoegner der Arbeit des Ausschus- ses eine erste knappe juristische Analyse.6 In den beiden einschlägigen Ar- beiten zur Entstehungsgeschichte der Bayerischen Verfassung von Barbara Fait7 und Eduard Schmidt8 wird die Arbeit des Ausschusses gewürdigt. Al- lerdings werden seine Beratungen nicht in ihrer ganzen thematischen Breite betrachtet. Die Analyse konzentriert sich vielmehr auf die großen Streitfra- gen Zweite Kammer, Staatspräsident und Wahlrecht. Für die bald 60 Jahre alte Bayerische Verfassung vom

    WITNESS TO HISTORY A book by Michael Walsh This book will not break your heart, it will crush your heart in sorrow and compassion for all mankind. This one book, ABOVE ALL OTHERS I've read, puts together information using statements from historical figures in a way that, I believe, will erase doubts from any doubting Thomas that one of the biggest lies -- or mass of massive lies -- we've ever been told involve WWII, German National Socialism; its Chancellor, Adolf Hitler; and in fact WHO made that war happen. As I was reading this book to the listeners of our Sweet Liberty radio broadcast, we discovered the REAL hot-button. I received a phone call from WWCR questioning my 'motives' for presenting this information. THAT was a first, and reinforced my desire to share the information with as many as will listen/read/hear/see through the biggest lie. I continued to read until finally it became nearly impossible for listeners to hear the broadcast on a once-crystal clear frequency; on two occasions we were actually knocked off the air-waves. When the subject matter changed, the reception cleared up. From this I've realized that the lie must be maintained at all costs; we MUST hate Adolf Hitler with all the venom a serpent can muster or the perpetrators of the lie begin frothing at the mouth. Although the material presented on the broadcast is always controversial, and although the quality of our short-wave reception seems to be manipulated depending upon the topic at hand, this one subject is taboo, period.

    1933/34 CANTONAL HOSPITAL ZURICH STATE TECHNICAL SCHOOL MANNHEIM COMPETITION ENTRIES Cantonal hospital Zurich, 1933/34 The ideas competition for a new cantonal hospital in Zurich was put out to tender in 1933 among Swiss architects. The architects' offices Steger in Zurich employed Pius Pahl to take part in the design for their entry. Pius Pahl did all the drawings. The project was placed 6th. From the Jury protocol: "The project is an independent solution for the greater hospital complex. The centralization of administration and all poly-clinics in a 470m long and approximately 50 m wide saw-tooth roofed building with rectangular treatment tracts connected and the four in- patient high rise buildings receiving maximum light because of their oblique position. This organisational arrangement emphasizes the importance of the poly-clinics within the entire complex. It is a setting that creates strongly centralized operational possibilities [...] The forecourts, main entrance portal with porter's lodge and traffic flow are well designed. The administration and reception offices are well structured. The general administrative areas and neatly arranged reception and counter halls are appropriately connected. The inner connections to the in-patient areas run smoothly. The connecting corridors are perfectly fitting, short and directly lit [...]." State Technical School Mannheim, 1933 Pius Pahl had successfully concluded his Bauhaus training, when he, together with Bauhaus graduate Max Enderlin, participated in the competition for a State Technical College in Mannheim.
