MARQUETTE LAW SCHOOL: THE FIRST TWENTY YEARS WILLIAM D. MILLER On May 5, 1844, a Swiss-German Bishop named John M. Henni arrived in Milwaukee to head the city's newly created Catholic diocese. In the win- ter of 1848-49, Bishop Henni returned to Europe seeking funds with which to complete St. John's Cathedral and to begin a program of higher educa- tion. One may suppose that the Bishop believed that Milwaukee would be- come one of the gleaming cities of the New World - a focal point for the infusion into American frontier life of those great accomplishments in sci- ence and art which imparted a special grace to European life. In the winter of 1849, a recital of life in an American frontier town, where Indians still strolled the streets in their native garb, must have been a prime listening fare for Europeans.

WALLAT_24JAN20 (DO NOT DELETE) 1/24/2020 4:59 PM RECONCEPTUALIZING ACCESS TO JUSTICE KATHERINE S. WALLAT* This Article argues that the assumptions that underlie how we currently conceptualize equal access to justice ensure that we will never achieve it. Much scholarly attention has been paid to the problem of access to justice for low- income people, which is typically defined as unmet legal need. Most of this attention focuses on the crisis in civil courts of unrepresented parties. These scholars suggest court-focused solutions centered on providing more lawyers and legal advice to help deal with this pro se crisis. But the vast majority of justiciable civil problems are resolved (or not) without any contact with the legal system or the use of lawyers. In the current access to justice framework, lawyers are solely providers of legal advice, guiding people through the legal system but with no role in ameliorating the underlying issue that caused the legal crisis in the first place.

UMBREIT Numerous studies have examined the psychological sequelae that result from the murder of a loved one. Except for the death penalty, however, sparse attention has been paid to the impact of the murderer’s sentence on homicide survivors’ well-being. Given the steadfastness of the public’s opinion that the death penalty brings satisfaction and closure to survivors, it is surprising that there has been no systematic inquiry directly with survivors about whether obtaining the ultimate punishment affects their healing. This Study used in-person interviews with a randomly selected sample of survivors from four time periods to examine the totality of the ultimate penal sanction (UPS) process and its longitudinal impact on their lives.

KEARNEY* One might state the question provocatively: Is there yet more that might usefully be said about Abraham Lincoln, and is there any particular reason to expect it to be said at Marquette University Law School? The answer, in each respect, is yes. So much—indeed, more— is demonstrated by the symposium that the Law School organized, together with the Department of History, to commemorate the bicentennial of Lincoln’s birth and the sesquicentennial of his visit to Milwaukee, on September 30, 1859, to address the Wisconsin state fair. The points merit elaboration, and they provide an opportunity as well for a reflection concerning Marquette Law School and a life in the law. I. THIS SYMPOSIUM We assembled leading historians and lawyers to speak at a symposium entitled “Legacies of Lincoln,” held on October 1 and 2, 2009, primarily in Sensenbrenner Hall, Marquette University Law School’s longtime home.

THE RISE AND FALL OF PART-TIME LEGAL EDUCATION IN WISCONSIN: 1892-1924 I. INTRODUCnION In the fall of 1923, Max Schoetz boarded a train for Chicago bearing a bombshell. The dean of the Marquette University Law School was on his way to a meeting of the executive committee of the Association of American Law Schools (AAJS), and he carried a surprising announce- ment with him as the train rolled out of Milwaukee. His school, a recent victor in the bitter war over part-time legal education and the sole pro- vider of such services in the state, had decided to close its night law school.' At the meeting, Dean Schoetz vowed to open the night program again, and soon. As it turned out, however, he never did, and neither did any of the next five men who succeeded him as dean of the Mar- quette Law School.

This is not intended to be a historical or factual chronology of the Law School. The history of the Law School would be a worthwhile project covering the six phases of the School: (1) its beginning in 1892; (2) its affiliation with Marquette University in 1908 and the World War I years; (3) its move into Sensenbrenner Hall in 1924 and its acquisition of the Diploma Privilege in the 1930s; (4) the World War II era and the return of the veterans of that war; (5) the postwar era and the period of stability; and (6) the era from the 1960s to the present. Each phase had its own successes and problems, and each contributed to the School's growth and improvement.
