The process involved examination of events from the initial restraint or other circumstances preceding the death, through the investigation and Inquest to the outcome of these formal investigative processes. I am very grateful to the great many individuals and representatives of organisations who met me or provided information or submissions. I am particularly indebted to those who attended the many focus group meetings. The ability to listen to the experiences and advice of the families of those who have died in custody or shortly thereafter was of enormous assistance. My heartfelt thanks go to the many families who attended the INQUEST Listening days or individual meetings with me and who allowed me to hear their personal experiences of the system. Sadly, too many of the Family members have become unwilling experts on the issues and at great emotional and personal cost. A great number of police officers and members of the Police Federation also made very valuable and constructive contributions during the Review. I am also indebted to Giles Lindon and Stephen Roe of the Home Office for their research and review of the international evidence. Their report accompanies this Review. Throughout the Review I benefitted greatly from the advice, guidance of, and discussion with, a Reference Group. Elish Angiolini 6 January 2017 Acknowledgments | 5 Executive Summary Executive Summary Background 1. On 23 July 2015 the then Home Secretary, the Rt. Hon Theresa May MP announced a major review into deaths and serious incidents in police custody. 2. The review has looked at the major issues surrounding deaths and serious incidents in police custody. This included the events leading up to such incidents, as well as existing protocols and procedures designed to minimise the risks. It looked at the immediate aftermath of a death or serious incident, and the various investigations that ensue. Most importantly it examined how the families of the deceased are treated at every stage of the process. 3. It has also identified areas for improvement and developed recommendations to ensure humane institutional treatment when such incidents occur. There are several recommendations that will have to be considered by Government, the police, the Independent Police Complaints Commission (IPCC), the Crown Prosecution Service (CPS) and the Coroner as well as other agencies with an involvement in these issues. While acknowledging that it would not be possible to entirely eradicate deaths and serious incidents in police custody, these recommendations are, I believe, necessary in order to minimise as far as possible the risks of such incidents occurring in future. They will also ensure that when such incidents do occur, the procedures in place are efficient, effective, humane, and command public confidence. Key findings 4. The creation of the Independent Police Complaints Commission (IPCC) was a result of many years of campaigning for an independent body to investigate police actions. Such a body was floated as far back as the 1981 Scarman Report.1 5. There is still a view among many families of those who have died in custody and of campaigners, lawyers and police officers who spoke to this review that the IPCC does not always feel truly independent of the police or of police culture. This is in part because of the numbers of former police officers employed by the IPCC. If an independent investigative body is to succeed, it must have the trust of families, and the full cooperation of police forces. 1 https://openlibrary.org/books/OL20761127M/The_Scarman_report Executive Summary | 7 6. To ensure that the IPCC can achieve a mature and patent independence from the influence and culture of those it investigates, ex–police officers should be phased out as lead investigators within the IPCC.To the extent that the IPCC still consider this expertise is required, ex-police staff should act only as formal consultants or as a training source within and, more appropriately, outwith the organisation. 7. Cases involving a death or serious incident in police custody are likely to be among the most serious and complex cases the IPCC have to investigate.

BACKGROUND 1.1 In 2018 a delegation of the CPT made an ad hoc visit to Scotland to examine the situation in police and prison establishments and to assess the progress made since their previous visit in 2012. A report was published in 2019 which generated twelve recommendations for Police Scotland. (Appendix A) 1.2 Police Scotland have undertaken significant work to address the recommendations within the report and continue to prioritise work in this area ensuring at all times our organisational values of fairness, integrity, respect and human rights are at the heart of our approach. 1.3 In 2020 the UK National Preventive Mechanism (NPM) conducted a desk based review of progress against some of the recommendations made in 2018.     Analysis UK: Police force “more than minimally” contributed to Sean Rigg’s death Trevor Hemmings The jury condemned a catalogue of police failings and refuted the findings of the Independent Police Complaints Authority. The circumstances of Rigg's death highlight the disproportionate treatment of black people by police and the difficulty of holding officers accountable for their actions. At the beginning of August 2012 a jury at Southwark Coroners Court delivered a highly critical narrative verdict at the inquest into the death of Sean Rigg, a black musician who died following contact with the police on 21 August 2008. After listening to seven weeks of evidence the jury unequivocally rejected the account given by police officers and in so doing refuted the findings of an investigation by the Independent Police Complaints Authority (IPCC). The jury found that the 40-year died at Brixton police station as the result of a cardiac arrest (and acute arrhythmia, ischemia and partial positional asphyxia) following a series of errors by the South London and Maudsley (SLAM) NHS Trust and the Metropolitan police. Coroner Dr Andrew Harris had ruled out verdicts of unlawful killing and neglect, but the jury said that the inaction of the NHS Trust and the actions of Brixton police had “more than minimally contributed to Sean Rigg’s death.” [1] The jury’s findings were greeted with spontaneous applause from the public gallery and praised by the Coroner who told its members: “You have demonstrated perspicacity and attention to detail in exercising your duty.” On the Inquisition form, the jurors had crossed out King’s College Hospital as the place of death and replaced it with Brixton police station – confirming the argument made by Sean’s family over the last four years that he had died on the floor of the police station [2].

I was also privileged to witness the creation of The Lambeth Black Families Forum (LBFF) this year chaired by our very own Sandra Moodie and Vince McBean from The West Indian and ex Service Personnel (WASP) and supported by Lambeth Police and the Council. An Inspirational moment In April 2011 saw: Ivelaw Bowman, Cheryl Sealy and Wesley Stephenson honoured by Operation Trident Occupational Command Unit with Commendations for work above and beyond the call. This was a moment where we all publicly acknowledged CPCG for Lambeth and the work we do as we believe: 'the group is the group and we stand for something together' I have seen the tears and despair of families coping with the loss of loved ones gunned down or tragically stabbed in their prime due to gang or area code issues or death following police contact. More alarmingly, is the on-going question of our youth service and the youth clubs available to them as their environment seems to be vanishing right before their eyes.

BACKGROUND 1.1 The purpose of this paper is to provide an update in respect of the Body Worn Video (BWV) work stream following the last meeting of the Scottish Police Authority (SPA) Policing Performance Committee on 9 March 2021. 2. FURTHER DETAIL ON THE REPORT TOPIC 2.1 In 2016, the National Police Chiefs Council (NPCC) recommended that BWV should be rolled out to Authorised Firearms Officers within all Home Office forces. Although not a Home Office force and therefore not bound by the recommendation, Police Scotland now has the only armed policing unit in the UK without BWV. 2.2 The Dame Elish Angiolini Independent Review into complaints handling, investigation and misconduct issues, published on 11 November 2020, does not make specific reference to armed policing but recommends that Police Scotland should accelerate its plans to expand the use of body worn video technology.
