The Civil Rights Act of 1964: an Overview The Civil Rights Act of 1964: An Overview September 21, 2020 Congressional Research Service https://crsreports.congress.gov R46534 SUMMARY R46534 The Civil Rights Act of 1964: An Overview September 21, 2020 The Civil Rights Act of 1964, comprised of eleven titles and numerous sections, has been called the “most comprehensive undertaking” to prevent and address discrimination in a wide range of Christine J. Back contexts. Legislative Attorney From discriminatory voter registration practices to racial segregation in business establishments and public schools, the Civil Rights Act of 1964 enacted new prohibitions and protections targeting discriminatory conduct in different forms and diverse contexts. The act not only created new statutory rights, but also designed distinct methods of enforcing these rights, and established federal entities responsible for the enforcement or facilitation of these protections as well. “In our time,” the Supreme Court has stated, “few pieces of federal legislation rank in significance.” Although the titles address discrimination based on race, color, religion, national origin, or sex, the Civil Rights Act of 1964 was principally a legislative response to ongoing and pervasive conditions of racial segregation and discrimination in the United States. Such conditions included the enforced exclusion of black citizens from a host of services and establishments affecting much of daily life: public libraries, public parks and recreation systems, public schools and colleges, restaurants, hotels, businesses, performance halls, hospitals and medical facilities, and any other setting designated as “white-only.” Legislative history reflects that Titles II, III, IV, and VI, for example, were enacted to address these forms of race-based segregation and discrimination. Though its titles share a thematic focus on discrimination, the 1964 Act—from a legal perspective—is perhaps best understood as a series of unique and distinct statutes. The titles vary in terms of the actions and practices they prohibit, whether and how an individual may seek relief for the violation of a title’s requirements, and available remedies for particular violations. Relatedly, where provisions of a title are enforced in federal courts, they have given rise to distinct lines of case law, questions of interpretation, and application. Federal courts have also interpreted the titles as having been enacted on different constitutional bases—the Commerce Clause, the Spending Clause, and the Fourteenth and Fifteenth Amendments. The eleven titles differ in other respects as well. Some, such as Titles II and VI, enacted altogether new laws while others, such as Titles I and V, amended earlier federal civil rights laws. Among the titles which enacted new laws, one finds further differentiation: some, such as Titles II and VII, created new statutory rights and protections against private actors, while others, such as Titles III and IV, addressed the federal enforcement of constitutional rights and protections against state actors. These differences may have unique legal implications when amending one particular title or another.     Introduction It shall be an unlawful employment practice for an employer— (1) to fail or refuse to hire or to discharge any individual, or other- wise to discriminate against any individual with respect to his com- pensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin; or (2) to limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, re- ligion, sex, or national origin (Title VII of the Civil Rights Act of 1964). In 1964 the U.S. Congress enacted, and President Lyndon Johnson signed, the Civil Rights Act. Although it was not the first or the last legislative mo- ment of the civil rights movement, it was a pivotal one. The act outlawed segregation and discrimination by race, ethnicity, and religion in public education, public accommodations, voting, and federal assistance. Title VII of the act extended the equal opportunity principle to employment and for the first time explicitly mentioned “sex” as a protected category. It is this extension of rights to equal opportunity in employment, freedom from discrimination in employment, and the erosion of race and gender employment segregation as a legitimate and expected practice that is at the heart of this book. The passage of the Civil Rights Act is without question one of the most monumental achievements in the history of the United States, perhaps even the world.

CASHIN* Professor Days began his Childress Lecture by recounting his personal experience with Jim Crow segregation. I too have such a story. I was born and raised in Hunstville, Alabama, a city that is notable, among other things, for having desegregated its public accommodations in 1962, two full years before the passage of the Civil Rights Act of 1964. The turning point in the non-violent sit-in movement in Hunstville was when a young, African- American woman was arrested with a four-month-old baby in her arms, along with a friend who was eight months pregnant. This caused some outrage and widespread press coverage. The mother was Joan Carpenter Cashin and the baby was me. I am proud to have played a role, however small, in the most important social movement of the twentieth century in the United States. In the past year we have celebrated a number of civil rights milestones.

    CASE NOTE CIVIL RIGHTS-SuPREmE COURT HEARS CHALLENGES TO SOUTHERN VOTER REGISTRATION SYSTEMS The Supreme Court has noted probable jurisdiction in two critical actions I brought by the United States under the Civil Rights Act of 1960 2 in an endeavor to halt two states' continued resistance to court attempts to enforce the fifteenth amendment.3 In United States v. Louisiana, 225 F. Supp. 353 (E.D. La. 1963), a three-judge district court held 4 unconstitu- tional the Louisiana provisions which require a prospective voter to inter- pret reasonably a section of the state or federal constitution if so requested by the parish registrar.5 The holding of invalidity was rested on the 'Louisiana v. United States, 377 U.S. 987 (1964) (No. 1073, 1963 Term; renum- bered No. 67, 1964 Term) ; United States v. Mississippi, 377 U.S. 988 (1964) (No. 1097, 1963 Term; renumbered No. 73, 1964 Term). The paucity of positive results from the voter registration drive in Mississippi during the summer of 1964 increases the importance of these actions. See N.Y. Times, Aug. 20, 1964, p. 13, col. 1. The extent of Southern white opposition and one of the major problems with enforcing the right to vote through county-by-county legal actions are illustrated by federal District Judge Cox's sentiments. At a hearing in which he refused to issue an injunction to speed up the registration in Canton, Mississippi, this jurist stated that he was interested in eliminating discrimination but not in whether "the registrar is going to give a registration test to a bunch of niggers on a voter drive."     THE CIVIL RIGHTS ACT OF 1964 AND THE FULCRUM OF PROPERTY RIGHTS 1 Alfred L. Brophy During the fiftieth anniversary of the Civil Rights Act of 1964, much of the discussion is about the origins of the Act in the ideas and actions of the African American community and of the future possibilities of the Act. This essay returns to the Act to look seriously at those who opposed it and at their critique of the Act’s effect on property rights. That is, this looks at the property law context of the Act and the criticism that the Act would dramatically affect property rights. In contrast to those who favored the Act and, thus, wanted to make the Act look as modest as possible, this retrospective suggests that, in fact, the Act had an important effect on property rights in the United States. That is, it was part of democratizing property and rebalancing the rights of property owners and of non-owners in ways that are long-lasting and important. The supporters of the Civil Rights Act of 1964's guarantee of equal treatment in public tried to make it look like a modest extension of principles that had existed from time out of mind.2 Yet, the Act’s requirement of equal access to public accommodations brought outcries, in particular from its opponents, that it would dramatically restrict the right to exclude from private property.3 Legal historians who have assessed the long history of the Civil 1 Judge John J. Topic Overview Central to the American ideal is equality. But equality is an illusive goal that requires vigilance. At the same time, the unit illustrates that gender equality has become, in recent years, a major source of friction in several aspects of American life. Similarly, the unit points out the rising demand by the disabled for equal treatment and the difficulties that society has had in meeting these demands. The Declaration of Independence, written in 1776, boldly proclaims: “All men are created equal; that they are endowed by their Creator with certain inalienable rights; that among these, are life, liberty, and the pursuit of hap- piness.”Yet for much of American history, the guarantee of equality applied exclusively to white men. That is no longer the case. But the struggle for political and social equality is often long and difficult. The problem is that although Americans support equality in the abstract, the guarantee of equality requires government action— action that often limits the liberty of some people.

    Keeping the Faith: AFRICAN AMERICANS RETURN TO CONGRESS, 1929–1970 With his election to the U.S. House of Representatives from a Chicago district in 1928, Oscar De Priest of Illinois became the first African American to serve in Congress since George White of North Carolina left office in 1901 and the first elected from a northern state. But while De Priest’s victory symbolized renewed hope for African Americans struggling to regain a foothold in national politics, it was only the beginning of an arduous journey. The election of just a dozen more African Americans to Congress over the next 30 years was stark evidence of modern America’s pervasive segregation practices. The new generation of black lawmakers embarked on a long, methodical institutional apprenticeship on Capitol Hill. Until the mid- 1940s, only one black Representative served at any given time; no more than two served simultaneously until 1955. Arriving in Washington, black Members confronted a segregated institution in a segregated capital city. Institutional racism, at turns sharply overt and cleverly subtle, provided a pivotal point for these African-American Members— influencing their agendas, legislative styles, and standing within Congress. Pioneers such as Adam Clayton Powell, Jr., of New York, Charles C. Diggs, Jr., of Michigan, and Augustus (Gus) Hawkins of Adam Clayton Powell, Jr., of New York, a charismatic and determined civil rights proponent in the U.S. House, served as a symbol of black political activism for millions of African Americans.
