415. CHAIRMAN'S ANNOUNCEMENTS

The Chairman welcomed Councillor Mrs. V. Grigg to her first full Council Meeting and expressed pleasure at Councillor I.R. Godfrey's excellent recovery from his recent operation.

lie advised Council that he had been involved in entertaining the guests from Haltern who had visited Rochford last weekend and who had been delighted with the reception they had received. Members admired the standard of Haltern which had been presented to the Council as a memento of the visit.

416. PRESENTATION TO MRS. EVE BAXEWELL

At the invitation of the Chairman of the Council the Leader of the Council advised Members that Mrs. Bakewell the Chief Executive's Secretary was retiring at the end of the month having joined the Authority in 1974 immediately prior to merging of the two former Councils. She had gone to work for Mr. Cooke in 1976 and had been directly involved in all of the many changes that had taken place since then. During that time she had also acted as the Chairman's Secretary for a period, dealing with his official engagements and the protocol which that involved. She had always been present at elections to assist the Chief Executive in his role as Returning Officer for the District.

tier husband had recently taken retirement and they had purchased a new house in the Midlands and would be moving there shortly. In wishing her well for the future Councillo-r Harvey thanked Mrs. Bakewell not only for the work she had undertaken on the Chief Executive's behalf but also personally for the assistance which had always been readily forthcoming to him and other Members. He then presented her on behalf of the Council with a pair of matching table lamps.

In thanking Members for that presentation Mrs. Bakewell said although she had joined the Council nearly 15 years ago it did not seem such a long time since there had never been a dull moment. When Mr. Cooke had become Chief Executive and selected her as his Secretary she knew very little

of what had been required but with his guidance it had become a way of life, whilst she would miss the environment of a busy office she and her husband were looking forward to their move to fresh fields. She expressed her thanks to the Council for the gift which she displayed to Members.

417. ALLOTMENT COMPETITION 1988 (Minute 318/88)

The Chairman announced that the Allotment Shield and first prize in this year's Allotment Competition had been won by Mr. F. Dupree for the third year running, the second prize and Certificate of Merit by Mr. R. Harris and the third prize by Mr. P. May. In making the presentations he thanked the Rayleigh Rorticultural SocieEy for their continued assistance with this annual event.

A Member suggested that since Mr. Dupree had won the Competition for three consecutive years he should be permitted to retain the Shield and it was

418. PRESENTATION TO COUNCILLOR A.J. HARVEY

The Chairman of the Council advised that over a period of time the Leader of the Council had donated a total of 50 pints of blood and at his invitation Mr. J. Dawson the Regional Organiser for the North East Thames Regional Health Authority presented Councillor Harvey with a Certificate and a gold badge to mark that achievement.

Minute 385 — Transfer of Houses to the Crouch Valley Housing Association

Note: Councillors Mrs. E.M. Hart and A.J. Harvey declared a non—pecuniary interest by virtue of membership of the Crouch Valley Housing Association but remained in the Meeting and participated in the discussion and the voting thereon.

A Member was advised that any question as to the accuracy of the Minute should normally be dealt with at the next Meeting of the Committee concerned, but Council accepted that Lt reflected the outcome of a lengthy debate. It was proposed by CouncilLor O.F. Flack and seconded by Councillor C. Stephenson;—

'That an independent firm of consultants be instructed to produce a report on alternative policies to the present transfer arrangements to Crouch Valley housing Association and that their terms of reference be neutral. This is to examine:

(i) the transfer to any Housing Association

(ii) the transfer to a tenants' co—operative (either local or District— based).

both to include a model programme for a housing build programme, and retention by Rochford District Council of all housing, including the option of overcoming restrictions on house building."

In support of that motion Members argued that since the intention of the Housing Bill was to provide tenants with a choice of landlord the Council should enable them to evaluate various alternatives and not merely a a transfer to the Crouch Valley Rousing Association. They saw the provision W of alternative strategies as being a necessary contingency arrangement against the possibility of the tramsfer being rejected. A contrast was drawn with other areas where several companies were invited to tender for a contract or where assets were disposed of at their market value. Some Members indicated that they would support the motion on the basis that it did not exclude Touche Ross, who had already carried out the necessary groundwork and whose independent status was beyond question.

Other Members argued that Touche Ross had fulfilled the remit which had been set by Council, that there had been adequate time for any other alternatives to have been evaluated and that to endeavour to do so at this late stage was designed to delay rather than assist the exercise. The current proposals had the virtue of clarity, whereas a range of options would confuse the issue and not produce the clear—cut result which the Council required.

in response to questions raised the Chairman of the Policy and Resources Committee advised Members that the Department of the Environment had been involved from the end of 1987 and reminded them that a letter had been • circulated to that effect on 15th January 1988. If the proposal to transfer the housing stock was rejected then it would stay with the Council and he foresaw that tenants would then be approached piecemeal by outside agencies. Re had endeavoured to amend the voting system at the Policy and Resources Committee Meeting but that had not been supported. As regards the new build programme the report to the last health and Rousing Services Committee on the RIPS Programme for 1989/90 had set out the most far—reaching proposals in the Council's history and all of the sites involved had been identified.

Minute 387 — Deemed Planning Consents

The Chairman of Policy and Resources Committee asked for it to be noted that the application for the development on land off Doggetts Close, Rochford had been advertised as a minor departure from the Approved Review Development Plan and not the Rochford District Local Plan as shown in the Minute.

With regard to the the new first resolutions required for various housing schemes, the Chairman of Policy and Resources Committee agreed in view of Members! uncertainty that, with the exception of the development at .

Minute 389 — Resolution to adopt the Rochford District Local Plan

A Member was advised that a prepared statement which he read out, on the need for the District Plan Working Party to address certain specific problems, would be circulated to all Members and that the issues involved would need to be addressed in the first instance by the Development Services Commit tee.

420. NOTICES OF MOTiON RECEIVED PURSUANT TO STANDING ORDER 5

With the consent of the Chairman pursuant to Standing Order 5.5 the Motions set out under Agenda Item 7 of the Meeting having been duly moved and seconded were dealt wIth as follows:

Public Car Park! Pooles Lane, Uullbridge

Councillor Mrs. L. Walker advised Council that the use of this site as a bus turning area had been subject to an assurance from the County Council which had not been fulfilled, that there was a constant hazard to other users of the car park including childred being bussed to school, and that the surface of the car park was becoming rutted because it was inadequate to bear the loads involved. It was felt that the County did not appreciate the seriousness of the situation and that if it could not be persuaded to construct the new turning spsce earlier then with the road safety hazard which existed accidents were inevitable. Members were shown photographs to illustrate those problems and Council accepted that an urgent approach should be made to the County Council for the immediate implementation of the bus turning bay scheme. Members also asked for a report to be made to the appropriate Committee on the condition of the car park.

Resolved (1) that this Council deplores the decision of the Minor Schemes Panel of the Highways Committee of Essex County Council to postpone the contruction of the proposed bus turn—round in part of the public car park in Pooles Lane, Hullbridge to the financial year beginning 1st April 1989, and urges Essex County Council to urgently reconsider its decision.

(2) that a report be made on the condition of the car park. (905) (HES)

(ii) Privatisation of Leisure Services

The Motion which had been received pursuant to Standing Order 5 was moved by Councillor C.I. Black and seconded by Councillor Mrs 8.J. Lemon as follows: —

"That this Council instructs the Treasurer and the Chief Executive that the 1989—90 budget should be prepared on the basis that part of the anticipated savings from the privatisation of leisure services should be used to:—

1) Expand the concessionary fares scheme to allow all pensioners to benefit;

2) Reduce the overall charges for playgroups using Council premises to l984—85 levels;

3) Increase the salaries budget for the Development Directorate to allow more town planning officers to be employed to cope with the rapid increase in planning applications in our District;

— and that the remaining savings should be used to reduce the District Rate for the benefit of all domestic Ratepayers and local businesses."

The following amendment was moved by Councillor A.J. harvey and seconded by Councillor Miss B.GJ. Lovett:

"That in the next two to three months the Council identifies all of the potential savings arising from its successful contractorisation and its cost saving initiatives in leisure, refuse collecton, parks maintenance and the transfer of housing stock. This Council also, through the medium of Rochford News and other outlets, seeks the views of the people of Rochford as to how that money should be spent, and on what services. Do they want more services, better services, money going by way of grant to voluntary organisations? Do they want extra staff to carry out extra services, or do they want a reduction in their rates, or both?"

In speaking to that amendment he reminded those proposing the motion that their party had opposed parks maintenance contractorisation and refuse and street cleansing contractorisation, as well as leisure management, all of which had given financial savings to which they now referred. He felt it would be irresponsible to allow Members who had opposed improvement within the District to now suggest how the resultant savings should be spent, which should be a matter for the public.

The amendment was carried and it was

did not commend itself to Members who regarded it as an unnecessary addition to an area already clearly covered by statute and the National

Councillor D.F. Flack had given notice of a number of questions which were answered as follows by the Chairman of the PolIcy and Resources Committee but who declined because of the lateness of the hour to answer a number of supplementary questions. qption 1

"1ould the Director of Finance indicate the approximate capital loan which would be required at the normal rates of interest to produce a return equivalent to the expected income generated by the second element of the provisional purchase price offered to Crouch Valley Limited (75% of all the RTB sale prices over and above original purchase price from the Council for 25 years)."

"The District Council can expect to receive a sum in the region of £22.5 million over a period of 25 years in respect of Right to Buy Sales. This is assuming that house prices increase over that period between 5 and .0%. At current long term interest rates, the Council would need to invest approximately £10 million to receive the equivalent £22.5 million over 25 years. There is no evidence that house prices have gone down, nor is there any evidence to suggest that there has been a big reduction in the demand for mortgages, and in any event, that is totally irrelevant."

"What contingency plans does the Council have if the transfer to Crouch Valley does not proceed?"

Answer

"In September 1987, the Council began to receive reports on the likely impact of new housing legislation, and all of the action taken in the last twelve months has been with the intention of improving the situation on housing, rather than wait and see. All of the predictions made by myself and the Chief Executive in October and November have come to be, and the Council is now in the almost unique position of being able to work with the Housing Association it has sponsored, rather than attempt to strike up relationships with housing associations who in the past, have never been prepared to provide houses for homeless persons. What Councillor Flack is attempting to do is to remove that opportunity from us in Rochford, and he will fail, because he is wrong. Of course the Council needs to have contingency plans, especially when it is dealing with opposition parties, who between them, attempted to block every action taken by this Council to build new homes for rent. Many Councillors of both the Labour and SLD parties are recorded as having voted against various housing schemes. There was even opposition from the Labour party for the release of land for house building in Doggetts at Rochford. The Council faced with opposition such as that, needs to have contingency plans.

The most ambitious housing programme was agreed by a Housing Committee in July, against opposition from Councillor Flack. Fortunately that polIcy was approved, and the Officers have been working together with the Department of the Environment and Officers of the [lousing Corporation to get approval for a large building programme, commencing next year. Not content with that, the Councilts Architect's Section has continued to push ahead with the Council house building programme in order that it would be achieved, subject to finance being made available.

there is a clear demonstration that the Council has done everything possible to deal with housing, despite opposition from people like

Cowacillor Flack. The Council's Officers are currently talking to the Ministry of Defence and the Health Authority, with a view to using units within their ownership for the homeless. Regrettably, the Council is now having to use bed and breakfast accommodation for some homeless families, and the supply of suitable facilities is limited and will soon end. When that happens, the Council will be presented with the choice between using less suitable accommodation if available, and placing homeless families into accommodation designed for elderly people; for example sheltered accommodation schemes. It is because the Council wishes to avoid this ultimate course, that it has gone to such lengths to promote a Housing Association to avoid that occurring. There are therefore many good reasons why tenants should vote "yes" to the Crouch Valley Housing Association. They would have lower rents and people living in sheltered accommodation schemes will not have to face the risk of some of the neighbouring flats and bungalows being used to house homeless families.

It is time that Councillor Flack and those others who support him, were honest to the people of this District in owning up to the fact that they have attempted to do nothing which would help the people of Rochford.'

423. CONSiDERATION OF QUESTIONS UNDER STANDING ORDER 7.2 RELATTNG TO URGENT BUSINESS

Councillor Miss B.G.J. Lovett had submitted a number of questions which had been raised by various tenants and with the permission of the Chairman these were answered as follows by the Chairman of the Policy and Resources Committee:—

"I have been a tenant of Rochford Council for many years and I do not want to change. Why should I?"

Answer

"Two important trends have combined to create a very real crisis in Council Housing. First the right to buy. Whatever you may think of this it has had the effect of reducing the housing stock, and — most significantly — it tends to be the better properties which are bought by tenants. Secondly, it is clear that the Government does not want Local Authorities to build any more Council houses.

The combination of these two things means that we have a reduced housing stock which is getting older. As you know, the older a property gets the more expensive it is to maintain. The level of rents will have to reflect this.

In addition to these points, the Government has made it clear that it wants Council housing to be "privatised". One of the ways it intends to do this is to cut down the total amount of subsidy it pays to Local Councils. In our view this means that Rochford Council are going to be forced to increase rents more than in the private sector."

Question 2

"I have been told that if I wait until the Housing Act comes into effect my "No" vote means that I can stay with the Council. Why should I rush into making a decision now?" , /

"Rochford Council has a duty to those young people, elderly people and others on the waiting list. Some of them may be your children or relatives. By transferring before the Housing Act comes into effect it can ensure that the housing stock is kept in one unit. By doing this it can ensure that your new landlord will be large enough and strong enough to build enough houses, flats, and sheltered accommodation to cope with the ever increasing demand. Basically, the Council feels that this is the best way of protecting all tenants — both present and future. If we wait until the Housing Act comes into effect the housing stock will gradually be sold off to lots of different landlords."

Question 3

"Surely there are other Housing Associations who are big enough to build lots of houses?"

Answer

"Of course there are, but those other Housing Associations are based miles away. Do you really want to have to go to some other part of the country if you have a complaint about the way your Landlord is behaving. There are two other reasons why I feel that an outside Rousing Association will not be good for Rochford. It will mean that the local community spirit between Council tenants will be gone for ever and — more important — it will mean chat the present employees of Rochford Council who have worked in the Housing Department for many years will lose their jobs — and we certainly do not want that to happen."

Question 4

"Why can't I be offered a choice between Crouch Valley Housing Association and other Housing Associations?"

Answer

"?es, we could have offered you a choice and we have thought very carefully about this. We have come to the conclusion that there really is no choice between C.V.H.A. and other Associations. Just look at the facts. C.V.R.A. offers you;—

(i) The same secure tenancy conditions that you have at the present tine.

(ii) A guarantee that rents will not increase at a faster rate than they have in the past.

(iii) An Association run by local people who are only interested in the residents of Rothford.

(iv) A chance for tenants to actually participate in the running of the Association by being members of its Management Committee.

(v) A chance to vote out the Management Committee if tenants are not satisfied with its performance at the end of each year.

'i) Charitable status. C.V.H.AT must use all profits for the benefit of tenants and it can only provide properties at affordable rents.

"I have been told that C.V.H.A. have no experience. Is this true?"

Answer

"The Secretary of C.V.H.A. is the Rousing Manager of Sanctuary Housing Association which runs 7000/8000 propertIes. He has many years of experience with [lousing Associations. C.V.H.A. will also take over the staff of the present Rochford Council Housing Department. These two factors alone will give C.V.R.A. the experience and expertise necessary to do the job.

In addition to that, C.V.H.A. has adopted all of the tried and tested policies of Rochford Council, and its other Management Committee members have a great depth of experience in the walks of life which will help theta in their task.

Finally, of course, C.V.H.A. has all the established and tried and tested policies and guidelines issued by the Housing Corporation to work to. They are ready and able to do the job. Otherwise the Housing Corporation would not approve them for registration."

'Some people agree that Mrs. Thatcher is going to make sure that Council housing is going to be privatised, but they say that I should vote "No' because I have a much greater choice under the Housing Act. Is this true?"

Answer

"In theory they are right. In practice they could not be more wrong. Council Rouse rents are going up. As far as we can tell at the moment they are going to go up very dramatically. The Housing Act will allow you to choose a. new Landlord. In fact the procedure is know as 'Pick a Landlord'

Under the Housing Act, these new Landlords will give you assured tenancies and they will be able to charge you much higher rents than you will be paying at the moment.

You may, therefore, be wondering why we have a Housing Act at all — everyone is going to stay with the Council! To find the answer you will find the true intention of the Government's Policy. The fact is that by the time you come to have your 'choice' Council rents will have gone up to more than the other rents.

That is the truth of the matter. You should know by now that if the Government decide to do something — they will do it. I am sure that within a very short time after the Housing Act is in force Council housing will be 'privatised'. You will then have an assured tenancy and a much higher rent.

91108 The other point1 of course, is that there will be no real 'choice'. What will happen is that you will have a succession of difference landlords pestering you and asking whether you want to be their tenant. You will not be able to compare one with the other.

You will be asked to say 'Yes' or 'No' to one landlord, and then, some time later, you will be asked to say 'Yes' or 'No' to the next landlord and so on. Remember, none of them will offer you the unique set of advantages that C.V.H.A. offers."

Question 7

"What is ali this about assured and secure tenancies? Will I be an assured or a secure tenant with C.V.R.A.?"

Answer I

"The new assured tenant under the Housing Act will have slightly less security than you have at the moment because that Act of Parliament will bring in new tenancy conditions. These mainly affect the grounds for obtaining possession.

With C.V.H.A. you will have to be called assured tenants but C.V.H.A. are going to give you written contract terms which will guarantee that you have the same secure tenancy conditions as you have at the moment."

Question B

"Is my property going to be used as security for all these new developments?'

Answer

"No. C.V.H.A. will take over the existing stock of houses, etc., by obtaining a loan which will be repaid from the rents.

When they develop new properties, each development will have to stand on its own feet. In other words, a new loan will be obtained to carry out the new development. Your security will not be affected in any way."

Question 9

"How should 1 vote?'4

Answer

"You should vote 'Yes'! Everyone agrees that Rochford Council has a very good relationship with its tenants and a very efficient and well liked Housing Department. There is no way that we would want to upset that but the Government's expressed intentions to privatise Local Authority Housing have forced us to consider the future in great depth.

The only way we can see to achieve our two objectives — to protect you and to provide new housing — is to transfer the whole housing stock to CV.H.A. before the J-Iousing Act comes into effect.

The Committee concurred with the suggestion of the Chairman that this matter should be deferred for consideration in the light of information regarding that Meeting.

427. DELEGATED POWERS AND AUTHORITIES

The Head of Environmental Services reported that there was a range of enforcement functions which sometimes required detailed investigations into the ownership or occupancy of laud or buildings.

The Committee noted that Local Government (Miscellaneous Provisions) Act 1976, Section 16, enabled a Local Authority to serve notice on landowners, occupiers and other interested persons, requiring them to provide particulars of their interest in the land, within a specified period.

RECOMMENDED (1) That the Head of Environmental Services be authorised to serve notice under the provisions of the Local Government (Miscellaneous Provisions) Act 1976, Section 16.

(2) That the Secretary to the Council be authorised to institute legal proceedings, where the Head of Environmental Services advises that the person on whom the notice was served has failed to provide the required information within the time specified. (4500) (HES/SEC)

428. ENVIRONMENT AND SAPETY INFORMATION ACT 1988

The Head of Environmental Services reported that this legislation èomes into force on 1st April 1989 and requires the Council to:—

(a) Maintain an indexed register of Health and Safety at Work Etc. Act 1974 Enforcement Notices which have been served, other than those imposing requirements solely for the protection of persons at work.

(b) Ensure that the register is open to inspection by the public free of charge at all reasonable hours.

(c) On request and upon payment of a reasonable fee, supply copies of entries into the register to any prson inspecting.

RECOMMENDED (1) That the Head of Environmental Services maintains the register required by the Environment and Safety Information Act 1988.

(2) That a charge of £2 including V.A.T. be made for each copy of the register supplied. (646) (liES)

429. A127/A129 RAYLEIGH WEIR IMPROVEMENT

The Head of Environmental Services reported that the Rayleigh Weir Improvement Scheme was expected to commence in Spring 1989 and that informal discussions had taken place with the Department of Transport and the Consulting Engineers appointed for the scheme on measures needed to reduce environmental nuisance from noise, vibration, dust and odours during the construction period.

A detailed survey had been completed to establish the existing noise levels in the area and information was currently awaited from the Department of Transport on the phasing of the scheme and ancillary proposals.

Residents on the south side of the A127 Arterial Road would be affected also and there had been close liaison with Officers of District Council.

Owners of residential properties affected by construction noise or increased traffic noise could be eligible for noise insulation and they would be identified by the Department of Transport who would meet the costs of the work. I

Members noted that the Council might be appointed to act as an agent of the Department of Transport to oversee noise insulation work, for which an agreed fee would be paid thus enabling regular supervision of the work and good liaison with residents concerned.

RECOW4ENDED (1) That discussion with the Department of Transport, their agents and contractors, on measures to reduce environmental nuisance, be continued.

(2) That the Council apply to the Department of Transport to be appointed as agent for noise insulation works. (16728) (lIES)

The Committee had before them the report of the Bead of Environmental Services on a statutory consultation from Essex County Council on an application by Cory Sand & Ballast Co. Ltd. For a Waste Disposal Licence at Churchfield.

Members noted that arrangements had been made for a representative from County Council to attend the Meeting of the Development Services Committee on 18th October 1988 and it was felt appropriate to defer the matter to that Committee to allow for a more informed discussion. This would still allow time for the Chief Executive & Director of Finance to exercise his authority under Standing Order 18 to enable return of comments within the statutory consultation period.

RECOMMENDED That consideration of the statutory consultations on Churchfleld, Barling be referred to the next Meeting of the Development Services Committee. (120) (HFIS)

ii) Unit 13, Rawreth Industrial Estate, Rayleigh

The Committee considered the appended report of the Head of Environmental Services on the statutory consultation from Essex County Council on an application by Acleland Ltd. for a Waste Disposal Licence at this site. A Member expressed concern about the need for the company concerned to adhere to the conditions attached to the planning permission particularly with reference to the construction of the road and it was agreed that this matter should. be brought to the attention of the County Council.

RECOMMENDED That Essex County Council be advised that the Council has no objections to the issue of a Licence for waste transfer at Unit 13, Rawreth Industrial Estate, Rayleigh, subject to the conditions specified in the report and the comment on the planning conditions. (2161) (HES)

Members were pleased to note the acknowledgement received on the improved standards of litter removal, cleansing and grass cutting, not only from Individual ratepayers but also from the Rayleigh Ratepayers' Association who had invited the Assistant Chief Executive t? attend one of their meetings in this connection when particular attention had been given to the difficulties involved in the Town Centre with sites in private ownership. The Head of Environmental Services reported that the vacant plot of land at the junction of Mercer Avenue and Twyford Avenue which had been included in the 1989/90 Capital Programme was suitable for bungalow development. A scheme for two aged persons' units had been prepared and was on display in the Members' Room. 001201 Health and Housing Services Committee

The Committee were aware that in seeking deemed consent it was now necessary to ensure by means of a different resolution that Council owned sites could if necessary be sold on to a Rousing Association with the benefit of planning permission.

RECOMMENDED (1) That for the purposes of Regulation 4 of the Town and Country Planning (General) Regulations 1976, permission be sought for the above development.

(2) That for the purposes of Regulation 5 of the Town and Country Planning (General) Regulations 1976, permission be sought for the above development. (1398) (HES)

436. CONTRACT PROGRESS REPORT

The Committee noted the report of the Health of Environmental Services on the progress of a number of contracts.

A Member expressed grave concern at the lack of progress on Contract No. 1230 for an extension to Spa Court, Hockley and at the length of time taken to render a Final Account for Contract No. 923 the Wedgwood Court scheme and asked that a report on these matters be made to the next Policy and Resources Committee Meeting.

437. CONCESSIONARY TELEVISION LICENCES FOR THE ELDERLY

The Chief Housing Manager reported on the effect of recent advice from the National T.V. Licence Records Office (NTVLRO) that the concessionary T.V. Licence for retired persons living in sheltered accommodation was to be increased from 5 pence per person to £5 per unit of accommodation forthwith. The Committee noted that the sum of S pence per head had previously been collected by the Wardens concerned from the residents once a year, but that three schemes had been caught by the increase although the residents had already paid their individual subscriptions and considered that it would be inequitable to ask them to make futher payment this year and that a one—off payment should be made by the Council, the cost of which could be funded from existing budgets. Members also felt that collection of the increased fee should be achieved by adding 10 pence per week to the service charge for each unit with the commencement of the new financial year.

RECOMMENDED (1) That a one—off payment of £525 be made to meet the cost of the Licence fee at Wedgwood Court, Hardwick House and Coodmans.

(2) That the cost of the Licence fee be collected with the service charge from April 1989 for all sheltered schemes. (59) (ClIM)

440. SPACING OF CARAVANS — PROGRESS REPORT (Minute 449/87)

The Head of Environmental Services reported in confidence on the progress towards compliance with the standard condition that there should be at least 6 metres between caravans. Following the annual survey the Committee noted that seven of the sites in the District remained satisfactory, but that on four sites although some progress had been made, there still remained insufficient distance between certain caravans. The Committee accepted that except in the case of Site Licence No. 24 where the site had recently changed hands, sufficient time had elapsed for full compliance with this condition and that the way forward was for the Council to institute legal proceedings against the Site Licence holders involved. They accepted the suggestion of a Member that the Council should write to all residents of the sites concerned explaining why the Council was taking this action. Regard was paid to the fact that there was a draft revision of the Model Standards and that a further report would be made if revised Model Standards were issued to enable any further action necessary to be taken at that time, but that in any case a further report would be made in March 1989.

Resolved (1) that the Secretary to the Council be authorised to institute legal proceedings against Caravan Site Licence holders for contraventions of Condition 1.2, in accordance with the Caravan Sites and Control of Development Act 1960, Section 9 as specified in the report.

(2) that the Secretary to the Council be authorised to seek revocation of Caravan Site Licences by a Magistrates' Court on securing a third conviction, in accordance with the Caravan Sites and Control of Development Act 1960, Section 9, on the recommendation of the Head of Environmental Services.

(3) that letters be sent to all the residents of the sites concerned notifying them of the intended action and the reasons therefor.

(4) that the holder of Site Licence No. 24 be afforded additional time to satisfy Licence Condition 1.2.

REPORT OF THE HEAD OF ENVIRONMENTAL SERVICES

STATUTORY CONSULTATION WASTE DISPOSAL LICENCE — UNiT 13 RAWRETH INDUSTRIAL ESTATE, RAYLEIGH

The site comprises a yard and office building towards the southern end of Rawreth Industrial Estate. It is proposed to use two bins to consolidate waste materials generated during the course of the applicant's building business, pending removal to a licensed disposal site.

Planning permission was granted on 25th July 1988 (ROC/l74/88). A site plan is appended.

The Head of Environmental Services considers that the following conditions should be attached to the Waste Disposal Licence which will be issued and enforced by Essex County Council:—

1. Waste handled at the site shall be limited to the following types of categories:—

Solid non—hazardous commercial and industrial wastes.

2. No clinical waste shall be deposited at the site.

3. No liquids, slurries, sludges or oils shall be deposited, either alone or in admixture with any solid materials.

4. A permanent roadway shall be provided within the site. The road shall run from the site entrance to the operational area and shall be maintained to the satisfaction of the County Council.

5. The operational area of the site shall be properly surfaced and maiptained in good order at all times.

6. A site control office shall be provided on or near the site.

7. A site identification board of durable materials shall be erected in a prominent position at the site entrance. This board shall display the following information:—

(a) the name of the site;

(b) the name, address and telephone number of the operator and his local agent;

(c) the hours when the site is open; and

(d) the address and telephone number of the County Council.

8. Gates and fencing shall be provided and maintained to the reasonable satisfaction of the County Council, and all reasonable precautions shall be taken to prevent unauthorised access to the site.

9. Suitable and sufficient lighting shall be provided on the site to facilitate the use of the site during the hours of darkness.

LO. No discharge of surface or waste water shall be made to any watercourse without the prior consent of the Anglian Water Authority.

11. The site shall be adequately manned and supervised during transfer operations.

12. The operational area of the site shall be screened and covered to the satisfaction of the County Council to retain materials likely to be blown from the site during adverse weather conditions.

13. All vehicles delivering waste to or removing waste from the site shall be properly covered or sheeted to ensure that no spillage occurs.

14. The transfer operation shall be carried out in a clean and efficient manner. All waste shall be placed in a container by the end of each working day and, not less frequently that once each day, loose waste which may be lying on the site shall be collected and disposed of in such a way as to keep the site tidy.

15. No waste materials shall be burnt within the site and a fire at the site shall be regarded as an emergency and immediate action shall be taken to extinguish it. All outbreaks of fires shall forthwith be notified to the County Consumer and Public Protection Officer.

16. Precautions shall be taken to prevent the breeding and harbouring of insects and vermin on the site and immediate steps shall be taken to secure the destruction of any discovered.

17. The site road and operational area shall in dry weather, be sprayed with water to suppress dust and sufficient water points shall be provided on site for this purpose.

18. All reasonable precautions in addition to those specifically mentioned shall be taken to prevent nuisance arising on or from the site as a result of the use thereof for the reception of waste and to ensure that the site is kept in a tidy condition.

19. A record shall be kept of the types and quantities of waste handled.

20. A record shall be maintained to the satisfaction of the County Council of all incidents which occur on the site whereby tchcre is a material risk to the health or safety of any person.

21. This licence shall expire on 3ist December 1989.

443. ROCUFORD DISTRICT LOCAL PLAN- PuBLIC OPEN SPACE (Minute 319/88)

The Secretary to the Council reported that the Council's Landscape Architect in preparation for the design of the new areas of open space had extolled the value of aerial photographs in producing layouts that were in sympathy with the surrounding terrain. The Director of Development could supply photographs of some of the sites and after consultation with the Chairman of the Committee, photographs of the remainder had since been commissioned. The Committee noted that all the photographs would be on display when they came to consider the designs and the cost would be charged to the estimate approved for fees. (23043) (SEC ,DD)

444. FLYING OF POWERED MODEL AIRCRAFT (Minute 461/87)

The Secretary to the Council reported that subsequent to the Committees conditional authorisation of the flying of model aircraft at Rawreth Playing Field, it had come to light that when the Pleasure Grounds Bye-Laws were confirmed in 1975, the land over which it was proposed to fly was not part of the Rawreth Playing Field and was not therefore subject to the Bye-Laws. In those circumstances, the Committee considered that flying of model aircraft should be permitted over the northern and north-east sections of Rawreth Playing Field, subject to the conditions set out in the recommendations.

RECOMMENDED That flying of powered model aircraft be permitted on the northern and north-eastern sections of Rawreth Playing Field for a trial period of 12 months subject to the following conditions:-

(a) All flying activities to be supervised by the appointed Officers for the time being of the South East Essex Model Aircraft Society.

(b) The South East Essex Model Aircraft Society to provide third party insurance cover up to El million and the policy to be made availabfç. to the Treasurer prior to the flying taking place.

445. CHILDREN'S PLAYGROUND RE-EQUIPMENT (Minute 537/87)

The Committee considered the appended report of the Director of Development regsrding the progress in the re-equipment of children's playgrounds within the District and seeking agreement to the programme for the next 2 years. S RECO}DIENDED (1) That the proposed programme for 1989/90 be approved and provision be made for £65,000 in the 1989/90 draft Capital Estimates.

(2) That a further £20,000 be made available for improvement of safety surfaces and fencing in the 1989/90 draft Capital Estimates. (91) (DF,DD)

446. RELOCATION OF PLAY EQUIPMENT - CANEWDON PLAYING FIELD

The Director of Development reported on the need to relocate the above equipment on Canewdon Playing Field from the rear of houses in Aithorne Way, where its presence caused considerable disturbance to local residents. The Committee noted that although it was less well drained and involved the same access through the garage court, there was a preferred alternative site in the north-west of the playing field away from the houses. Because of increased building costs Members noted that it was estimated that the relocation of the equipment would cost £8,000.

RECOMMENDED That provision of £8,000 be made in the 1989/90 draft Capital Estimates to relocate the equipment at Canewdon. (11) (DF,DD)

447. LABURNUM GROVE PLAYSPACE (Minute 354/88)

The Secretary to the Council reported that at their July Meeting and following consultation with immediate neighbours, Council agreed that the decision to dispose of the above site, as set out in Minute 180 be rescinded and the site retained as a playspace. In order to establish the views of residents of the area as to how the site should be used in future, the Committee considered that the Secretary to the Council should canvass opinion on the following aspects;-

(a) Whether the site should be identified as a formal playspace with the play equipment provided or an informal area with no equipment.

If a formal play area was to be provided

(b) what range of equipment was thought acceptable.

(c) Should the site be secured by gates and if so which of any neighbours would be prepared to act as keyholders?

The Committee were mindful that if play equipment was provided that could attract youths and could result in a return to the earlier problems. It was felt important to have the benefit of the views of local residents before coming to any decision. .

448. CLEMENTS HALL - ALTERNATIVE MEANS OF VENTILATION

The Assistant Chief Executive'reported that CIRCA Leisure had recently been advi8ed by the Divisional Fire Officer that alternative means of ventilation needed to be provided in various parts of Clements Ball and that the Head of Environmental Services shared the view that, in the office area, the most effective solution was to install air-conditioning units. -

The estimated cost of these works was £6,800 which could be met by way of virement within the current years special items plus a contribution of £500 by CIRCA Leisure as follows:—

Great_Wakering Sports Centre:

Clements Hall Leisure Centre:

The Committee noted that because of the urgency and absence of Meetings during the summer recess, the Chief Executive had given approval under Standing Order 18 for the works to be carried out. (611)

COFFEE MILL - SUNDAY OPENING (Minute 317188)

The Assistant Chief Executive reported that at the last Meeting of the Committee and arising out of the review of the Council's existing leisure policies, it had been suggested that discussions be held with Rochford Leisure to assess the viability of opening the Coffee Mill on a Sunday.

Members noted the basis on which CIRCA Leisure had since estimated a shortfall of income over expenditure for a six month period, of between £1,100 and £1,200.

RECOMMENDED That no further action be taken on this matter. (6643)

450. INFORMATION KIOSK (Minute 244/88)

The Committee had before them the appended report of the Assistant Chief Executive reviewing the operation to date of the Information Kiosk in Rayleigh High Street, and setting out certain options for the future. Members were pleased with the success of this exercise and considered a more attractive permanent structure on the present siting should i c ease public use.

451. HAWKWELL ATHLETIC BOYS FOOTBALL CLUB

The Committee considered a report of the Secretary to the Council on a request from the Club to make available for their use a room at the Clements flail Playing Field pavilicrn. Members suggested that this work be included in the draft Capital Programme.

RECOMMENDED That approval in principle be given to a room being made available to the 1-lawkwell Athletic Boys Football Club in the Clements Hall Playing Field pavilion when that building is extended and that this work be included in the draft Capital Programme. (31036) (SEC)

452. EASTERN COUNCIL FOR_SPORT AND RECREATION LIAISON MEETING

The Committee noted the report of the biannual liaison meeting between the District Council and the Eastern Council for Sport and Recreation held on 23rd August 1988. (700)

453. ESSEX HERITAGE YEAR 1989

The Assistant Chief Executive reported that having designated 1989 as "Essex heritage Year", the County Council had set up a Committee with representatives of Essex Local Authorities, business and commerce, societies and organisations to put together a programme of events, activities and initiatives in all parts of the County, the aim being to demonstrate both within and beyond Essex the extent of the County's rich historical heritage and the part that could play in the life of the community. The Committee noted the programme of events compiled to date and that consideration would be given to Rochford's participation in the Heritage Year, and in particular in the "Blue Plaque" scheme for buildings and sites with special historical connections. Members suggested that Parish Councils might be asked to submit designs for Parish boundary signs for their villages.

RECOMMENDED (1) That an approach be made to the Parish Councils for participation in the "Heritage Year" by provision of appropriate Parish boundary signs.

(2) That further consideration be given to the nomination of suitable buildings for participation in the "Blue Plaque" scheme. (131) (ACE)

454. ARTS DEVELOPMENT THROUGHOUT ESSEX "ARTS FORUM FOR ESSEX"

The Committee noted the report of the Assistant Chief Executive on a meeting of the County and District Councils in July to discuss the development of the arts throughout Essex, which had been attended by the Chairman of the Committee. Members were pleased to note that the County Council had asked for submission of the Postcard Wall as part of the Rochford entry in th'e Arts Forum in the new County Council buildings on 26th November, together with the "Doomsday Tapestry" prepared by pupils at the Glebe County Primary School and admired postcards produced from photographs of the tapestry which had been commissioned jointly by the Council and Glebe School. The Assistant Chief Executive reminded Members that this TTophy was presented annually to the individual or team who contributed most to that year's Essex Games. The Chairman of the Committee advised Members that the Rochford Sports Council had nominated the representative Rugby Team for consideration since they had obtained the only Rochford first place in this year's Games.

455. ALLOTMENT COMPETITION 1988 (Minute 417/88)

The Secretary to the Council reported that at the Council Meeting on 4th October, a Member drew attention to the fact that Mr. F. Dupree had now won the Allotment Competition for three consecutive years and suggested that in accordance with normal practice he be permitted to retain the shield. Members were pleased to support that principle and it was suggested that it would be appropriate to provide a separate shield recording Mr. Dupree's success for his retention, because the present shield recorded the names of numerous other former prize winners. The cost of providing a duplicate memento trophy would be approximately £25 for which funds could be made available.

— Provision of Play Equipment 1989/91. The Final Two Years

Midway through the programme is an opportune time to evaluate existing work to ensure the final two years programme is as effective as possible. It is suggested that the programme should achieve-'

(i) an even provision of play equipment throughout the District (ii) safe attractive areas for play (iii) play areas for both toddlers and older children.

The replacement of play equipment on remaining sites should ensure that most parts of the District have easy access to playgrounds. Exceptions to this are the south west of Rayleigh and the Villages of Stambridge and Paglesham.

Priority during the first three years has been given to providing I equipment for younger children. Consequently there is now demand in some areas for adventurous play equipment for older children. Grove Park Residents Association have requested an adventure playground in Grove Road Open Space and suggested this is a suitable site.

Safey Surfacing and Fencing

Concern for standards of safety has increased during the course of the last three years, especially the problems caused by dogs and the need for impact absorbing surfaces. New equipment is now being installed with safety surfacas but improved surfaces are required at Clements Hall, Ashingdon Playing Field, Tylney Avenue, Rochford, Rochford Playing Field and Hullhridge Playing Field. Fencing is required to keep dogs out of play areas at Clements Hall, Plumberow Mount, Little Wakering, Rawreth Playing Field, St. John Fisher Playing Field and Hartford Close, Rayleigh. It is recommended that a further £20,000 is made available to improve surfaces and provide fencing for play areas.

INFORMATION KIOSK The Information kiosk which opened n Rayleigh on 6th June at the start of its six months trial period, has now been in operation for over half of that time. The hours of opening have been from 10 a.m. to 4 p.m. Mondays to Saturdays and have produced an average daily number of calLers as detailed below: —

Monday Tuesday Wednesday Thursday Friday Saturday 31 28 41 29 37 53 Detailed records have been maintained throughout and show that with poor weather proving a major deterrent, it to conjecture as to what the response wilt be overis open the remaining weeks of the trial period. Staff themselves feel that numbers will drop during the bad weather, as that has been experienced during poor days in the summer. It suggests that a year round service would not be justified. The autumn figures will perhaps give !a clearer indication. The pubLic has been encouraged to comment and the overall view is that the idea of an information facility is a good one, as can be seen from the appended extracts (App.t) from the detailed log of enquiries. Obviously, any objectors to -the scheme are unlikely to use the kiosk and would not have an opportunity to express an opposing view. The commenis should, therefore, be treated with some degree of circumspection. From the outset, the main items of interest have been the Woodlands Walk pamphlets and the brochure "150 PLaces to Visit in Essex. Supplies of these popular Lines have been exhausted on a number of occasions and, as a result, additional expenditure has been incurred in the reprints. Experience of four months working, whilst not totally conclusive, provides sufficient information, and comment from the public, for Members to consider the future of this scheme. Would the Council wish to see the introduction of a permanent information service and, if so, would this be year round or seasonal (April to October)9 If such a service were to be provided, would it be within a custom built structure or portable° It would not necessarily follow that because a seasonaL facility were provided that the kiosk should be temporary. A permanent structure could stilt be provided to allow static poster dispty throughout the year, and occasional winier use for speciaL events by Local groups or organ isations. 001217 II II I ''p I I! If Members accepted the'principle of the need for provision of an information serice throughout the District, then the "ideal" sotution suggested is as follows'-

2. A mobile unit for use in Rochiord town centre two or three days (April to October) and available for static advertising and special events throughout the ['istrict,at any time The capital costs for the prdvision of the kiosk and caravan are estimated at £10,000, with fixings, etc. , and revenue costs of approximately £6,COO. In view of the Council's strategy to become more customer— orientated, it is suggested that the principle of a more. permanent siting of the information kiosk shoulo be supported. If Council accepts the principle, then more detailed investigatIons of costings, etc. could be carried out in order that appropriate provision could be made within the capital and revenue programmes for 1989790. This would give Members a further opportunity to consider the detailed costing and to assess these against other prio-ities within the capital progi amine RECOMMENDED That a more permanent siting of the information kiosk be suported in principle subject to more detailed costings and to the necessary provision of, funds within, the 1989/90 draft capital and revenue estimates. The public are constantly saying it is "just what is wanted" in Rayleigh and 1 believe that they will demand (now they have sampled a free kiosk) that the subject range is extended to incorporate more subjects etc. just as you were anticipating.

457. MINUTES

Resolved that the Minutes of the Meeting of 31st May 1988 be approved as a correct record and signed by the Chairman, subject to it being noted that Minutes 255 and 260 were amended by Minute 296 of Council on 21st June 1988,

458. MONITORING OF PERFORMANCE - MEETINGS OF 26TH NOVEMBER 1987 AND 29TH MARCH 1988

The Committee were satisfied that all necessary action had been taken. Minutes 741/84 (SEC), 741/85 (DD), 356/86 (SEC) and 324/87 (DD) were carried forward.

459. STATUTORY CONSULTATION - WASTE DISPOSAL LICENCE; CI-IURCUFIELD, ZARLING (Minute 430/88)

Members had before them the appended report of the Head of Environmental Services regarding a statutory consultation by Cory Sand and Ballast Co. Ltd. for a waste disposal licence in respect of the above site, which had been referred from the Health and Housing Services Committee to enable a representative from the County Council to be in attendance.

The Chairman welcomed Mr. J. Harrison, the County Consumer and Public Protection Officer, who advised the Committee of the normal incidence of monitoring on a fortnightly basis, that the licensing procedure was subject to appeal, that the grounds for refusal were 1,imited and could be difficult to defend and of the history of the site in question.

A Member expressed concern that a number of conditions set out in the report were not being adhered to by the company concerned and it was agreed that this matter should be investigated by the County Officer and a further report made thereon as a matter of urgency. In considering the conditions to be attached to the Waste Disposal Licence it was proposed by Councillor R.S. Allen and seconded by Councillor Miss B.G.J. Lovett:

"That Condition 4 be amended by the addition of the following words:

'... and facilities shall be installed to automatically wash vehicles leaving the site and an exit from the tipping area formed to make the cleaning of vehicles compulsory.'

That Condition 23 be amended by the addition of the following words:

'... and all skip lorries using the site shall be sheeted or netted to allow no waste to be deposited on the public highway, and any vehicles not conforming will be refused entry to the site.'

That Condition 28 be amended so as to read:

'The hours of working shall be as already displayed at the site entrance, namely from 7.30 a.m. to 4.00 p.m., Monday to Friday.'"

Those amendments were accepted by the Committee and it was

RECOMMENDED (1) That Essex County Council be advised that this Council has no objection to the issue of a licence for waste di,sposal at Churchfield, Barling, subject to the conditions specified in the report as amended above.

(2) That a further report be made following County's investigation into the alleged coutraventions at the Churchfield site. (120) (HES)

Note: The Chief Executive & Director of Finance exercised his authority under Standing Order 18 to enable the return of comments within the statutory consultation period.

460. BRITISH RAIL LIAISON (Minute 416187)

The Chairman welcomed Mr. M.A. Robson, the Area Manager for British Rail, who having attended the Meeting of the Committee in October 1987 to report on proposals for investment under a five year development programme, had been invited back to update Members on progress and answer any questions.

Mr. Robson informed the Meeting that during the last twelve months there had been a programme of refurbishment at many of the stations on the Liverpool Street to Southend Victoria Line embracing such facilities as pasaenger information, car parking, buffet, toilets, platform surfacing, lighting, public address and ticket sales and he gave details of the effect of those schemes on the various local stations involved. Turning to the Liverpool Street terminus he advised Members with the aid of slides of the major modernisation taking place to increase platform capacity, improve signalling and streamline the concourse to rati-onalise the interchange facilities with the bus and tube train services. That would culminate in the complete shut down of Livexpool Street Station during the next Easter break to enable the necessary track work on the approaches to be completed.

Finally, he displayed photographs of the latest model of high speed train incorporating sliding doors and toilet facilities which was currently on test and which it was intended to introduce on the Southend line next May. There would be a total of 21 4-carriage units which would replace the earliest rolling stock and the single compartment trains currently still in use during peak hours.

Mr. Robson then answered questions relating to fare levels, catering concessions, station toilet facilities, control of vermin, fire precautions, loading capacity, car parking facilities, access to coaches

and storage of luggage, weekend suspension of services and the prime causes of train disruption. In reponse to specific requests from Members he said arrangements could be made again this year to cut back the growth from the approach to 1-lockley Station, that he would maintain the exit to Plumberow Avenue for the time being and look again at ways of maintaining the alternative exit at Rayleigh beyond 10.00 p.m.

The Chairman thanked Mr. Robson on behalf of the Committee for his attendance and for the improvements which were being achieved.

461. LOWER WYBURNS FARM PUBLIC OPEN SPACE, DAWS HEATh ROAD, ItAYLEIG1I

Note: Couricillor S.A. Skinner declared a non-pecuniary interest in this item by virtue of holding an allotment plot, but remained in the Meeting and participated in the discussion and the voting thereon.

The Director of Development reported on the planning history of Wyburns Farmhouse and approximately 20 acres of adjacent farmland between Daws Heath Road and the 4127 which was annotated in the Local Plan as public open space and that a formal approach had now been received identifying approximately 13 acres for potential disposal to the District Council with around 6.7 acres of land, the farmhouse and adjacent buildings to be retained. During the preparation of the Local Plan it had been envisaged that part of the site could be used to relocate the allotments from Whitehouse Chase and Kenilworth Gardens which together totalled around 3 acres and had been identified in the Local Plan for development post 1990 and an indication was given of how that relocation might be achieved together with arrangements for access and car parking.

As regards the farmhouse which was still occupied by the former farmer, the tenants' had claimed that it required extensive repair and suggested as an alternative that it be demolished and rebuilt. It did not, however, carry an agricultural habitation condition and the Committee accepted that there were no grounds to justify that course of action as an exception to normal Green Belt policy.

RECOMMENDED (1) That the Secretary to the Council be authorised to negotiate for the purchase of the land identified on the plan appended to the report at a valuation to be agreed by the District Valuer.

(2) That the principle of the demolition and rebuild of the adjacent farmhouse be resisted and the Agents be informed that normal Green Belt policy considerations should apply. (6235) (SEC,DD)

I 462. COUNTY HIGHWAYS MATTERS

Mr. A. Cook, the County Highways representative, advised Members that he had investigated complaints about conditions at South Fambridge where litter was being tipped to reinforce the sea defences and was satisfied that the screen fencing which had been required to be provided as a condition of the permission was effective in trapping blown litter.

An exhibition was to be mounted to advise the public of the South East Essex Traffic Study and to gauge their reaction and that would be on display in the Pullman Suite at the Freight House on Monday, 7th November and at Mill. Hall on Thursday, 10th November 1988.

Development Services Committee There had been a site inspection of the bus turn round area at the Pooles Lane Car Park in Hulibridge, but the Minor Schemes Papel had subsequently recommended that the scheme which had been prepared should be deferred until the next financial year. A bid was, however, being made for an additional £1.2 million to cover the various short-term traffic improvement measures that had been identified as necessary and should that be successful it would be the intention to appropriate the necessary funds from that sum to enable the Pooles Lane scheme to be implemented earlier.

Finally, Mr. Cook identified a number of minor schemes that had been carried out or were in course of progress and answered questions from Members about the various points raised.

463. CAR PARKiNG - HdCKLEY VILLAGE CENTRE

The Secretary to the Council reported growing concern, by both the Police and the highway authority, at increasing traffic congestion in 1-lockley village. The establishment of a Doctors' Surgery had caused increased use of the Southend Road Car Park, part of which would soon be lost when work commenced on the Old People's Day Centre. Essex County Council had recently published traffic regulation proposals for no waiting at any time on the west side of Spa Road and in most of Bramerton Road which would displace a considerable number of vehicles each day. Provision had been made for 14 new spaces at Southend Road Car Park, but overall there would be a net loss of available parking space in the village.

The Committee noted that a recent survey of possible sites for additional parking space in the village had shown that the only suitable land available was the site of the former Railway Cottages at Rockley Railway Station, which was approximately 380 yards from the Spa Hotel. They considered that if British Rail were agreeable to use of the land for parking purposes, they might agree to operate a car park themselves or it could be operated by the Council under the existing Off Street Parking Order.

RECOMMENDED That the Secretary to the Council be authorised to make an approach to British Rail to seek their views on use of their land at Hockley Railway Station for public car parking purposes. (49) (SEC)

464. HIGHWAYS - DISCUSSiON PAPER ON CRANCING THE RIGHTS OF WAY NETWORK

The Committee considered the report of the Secretary to the Council regarding certain proposals published by the Countryside Commission in a recent discussion paper entitled "Changing the Rights of Way Network". Members were particularly opposed to the proposal to give freedom to landowners to change the route of a right of way at will and the Committee agreed that this ought to be reflected in the response which was made.

RECOMMENDED That the Consultation Paper be noted and that the observations set out in the report as amplified above be conveyed to the Countryside Commission. (45) (SEC)

465. SOUTH EAST ESSEX TRAFFIC STUDY (Minute 255(88)

They noted the report of the Director of Development regarding the Meeting at County Hall on 8th November 1988 which had been concerned with the public consultation exercise, the terms of the Consultant's study brief and a situation report on the various short-term measures proposed. (TP1L2) (DD)

466. VARIOUS TRAFFIC MEASURES

The Head of Environmental Services reported details of the following proposals from the County Council.

(i) A127 Slip Road/Brook Road (Eastern End) and A129 High Road/Classeys Lane/Weir Farm Road - Proposed Waiting Restrictions

To impose waiting restrictions on the above roads so as to remove the potential road safety hazard which could otherwise arise during the construction of the Rayleigh Weir Underpass.

(ii) ALOlS Eastwood Road, Rayleijh - Proposed Urban Clearway

To introduce an Urban Clearway Order so as to overcome the considerable delays caused by parked cars and delivery vehicles to the traffic flow of approximately 15,000 vehicles per day.

RECOMMENDED That the foregoing proposals of the County Council be supported. (933) (MES)

461. FLAT CONVERSIONS POLICY

The Director of Development reported that during the Meeting of Planning Services Committee on 21st July 1988, clarification was sought on the Council's policy with regard to flat conversions to existing properties in the District. (Minute 63, Para. 40 refers).

Since that Meeting Members had been issued with a copy of the Rochford District Local Plan which had been formally adopted by the Council on 4th October 1988. The Committee noted that Section 2.12.0 of the Plan contained the preamble on policy relating to flat conversions which was self-explanatory, that a separate policy had recently been approved in respect of sheltered housing accommodation and that a new policy was currently in course of preparation regarding purpose-built flats. 468. ISOLATION DISTANCES BETWEEN DWELLINGS (Minute 368/88)

The Committee had before them a report of the Director of Development reviewing the Council's policy on the minimum space permissible between dwellings as requested by the Planning Services Committee at a recent Meeting and accepted the suggestion of the Chairman that the matter be referred to the District Plan Working Party for consideration.

RECOMMENDED That arrangements be made accordingly. (2081) (SEC)

469. CABLE TELEVISION

The Secretary to the Council reported that as requested at the Policy and Resources Committee Meeting on 27th September 1988, a report by the Director of Development regarding the consultation from the Cable 09 228 Development Services Committee

Authority under the terms of the Cable and Broadcasting Act 1984 on applications received from Essex Cable Network PLC. and North Estuary Cable Ltd. for the North Thames Estuary franchise had been referred to this Committee for consideration.

RECOMMENDED That the Consultation Document be noted. (DD)

470. SOUTH FAMBRIDGE VILLAGE PLAN (Minute 363/88)

The Director of Development reported that following discussion at Planning Services Committee of the application for residential development on the old Engineering Works site, when Members had cxpressed support for the preparation of a Village Plan, informal contact had been made with the South Fambridge Village Residents Group.

The Committee were mindful that the preparation of the Plan would need to proceed under their guidance and that of the District Plan Working Party and that in addition to the residents, consultation would be necessary with the Parish Council, the County Council, statutory undertakers and all other interested parties. It was therefore

RECOMMENDED lhat the Director of Development be authorised to prepare a brief for the Working Party with a view to the production of a draft South Fambridge Village Plan and carry out any consultations considered necessary to assist in the formulation thereof. (TP63) (DO)

471. EIIJLLBRIDGE FORESHORE (Minute 581/86)

The Secretary to the Council reported on the completion of a detailed land survey of the Hullbridge Foreshore between Ferry Road and Alfreda Avenue. The Committee noted that investigations were progressing to establish ownership of the land on the river bank with a view to its acquisition for public open space purposes as designated in the District Plan in the interests of the proper planning of the area. Whilst Compulsory Purchase Powers existed in that respect, planning permission would need to be obtained first for the use of the foreshore as a public open space.

In that connection the Leisure Services Committee had instructed the Council's Landscape Architect to prepare schemes for all the areas of open space included in the Local Plan. A design for the foreshore would be reported at that Committee in the next Cycle of Meetings when they would be asked to pass the first resolution in the deemed consent procedure and details of the likely timetable involved, depending upon whether or not there was any objection to Compulsory Purchase, were noted.

Some Members expressed concern that the Council were not acting with sufficient despatch to prevent the erosion of the foreshore, but the Committee accepted that it was essential that the Council should not jeopardise the prospect of resolving this long standing problem by exceeding its powers and that the proper course should be pursued as proposed. 472. BUILDING PRESERVATION NOTICES - K6 TELEPHONE K1OSKS (Minute 329/87)

The Director of Development reported that in accordance with the earlier decision of the Committee, Building Preservation Notices had been served in respect of kiosks at Market Square, Rochford and High Street, Rayleigh,

that the former had been added to the list of Buildings of Special Architectural or Historic Interest in June and that a decision was awaited on the Rayleigh kiosk.

The Roach Group Parish Council had since requested that preservation of the kiosk at Paglesham Church End be sought also. This kiosk and the one at Paglesham East End were the only others which satisfied the criteria for consideration. The Committee accordingly considered that Building Preservation Notices should be served on those two remaining 1(6 telephone kiosks.

RECO1IMENDED That arrangements be made accordingly. (TP9) (DO)

473. BOVIS DEVELOPMENT, THORPE CLOSE, HOCKLEY

The Secretary to the Council reported that Bovis Homes Ltd. were required by the County Council to undertake bridge strengthening works in Thorpe Close before the County would agree to adopt the estate roads, The developer had been anxious to undertake this work as soon as possible and had sought the District Council's permission to locate a contractor's compound on a small piece of the Council land at Spencers Nursery.

The Committee noted that to enable the matter to proceed without delay, the Chief Executive & Director of Finance had exercised his powers under Standing Order 18 to authorise the completion of a temporary licence and the company had agreed to make a contribution of tSOO to the Council's tree planting fund in lieu of site rent. 475. NAMING AND NUMBERING OP STREETS

The Secretary to the Council reported as follows:—

(ii Sheltered Housing at 66-76 Downhall Road, Rayleigh

The developers of this scheme had given notice, pursuant to Section 17 of the Public Health Act 1925, of their intention to name the development "Sheriton Square". Due to an oversight on the part of the developer's agent it had not been possible to bring this matter to Comuu.ttee previously and the development was now at an advanced stage and being promoted under that name.

RECOMMENDED That the Council raise no objection to the adoption of the name "Sheriton Square" for the new development now under construction by Thomason Builders Ltd. on the site of 66-76 Downhall Road, Rayleigh. (923) (SEC)

(ii) Development at Home Farm, Great Wakering

477. DISTRICT PLAN WORKING PARTY

The Committee considered the appended Minutes of the Meeting held on 18th July 1988 which contained the following recommendations:-

RECOMMENDED (1) That this Council place on record its thanks to the stiflKvolved in bringing the District Plan to its culmination. (Minute 64 — Progress on Preparation of the Local Plan Document) S (2) That the document be noted. (Minute 65 - Local Plan: Draft Planning Policy Guidance Notes)

(3) That arrangements be made as set out in the Minute. (Minute 66 - Notice of Motion Received Pursuant to Standing Order 5: Further Large Scale Development within the Rochford District)

It was proposed by Councillor Skinner:

"That the District Plan Working Party give detailed consideration to the amendment set out below to the motion concerning large scale development printed in the Minutes of the District Plan Working Party of 18th July 1988 -

That this Council, the Rochford District Council, refuse planning permission for any further large scale development within the Rochford District area until such time as the infrastructure, public utilities, community services and shopping areas are improved. Large scale development in this context is defined as developments involving more than 22 dwellings or dwelling units.

This policy will apply immediately to aLl new applications submitted for Green Bait areas and areas of special restraint as listed in the Rochford District Plan. This policy will additionally apply to applications submitted after 31st December 1990 anywhere in the District.

This Council will systematically examine all communities of the District to determine where infrastructure, community facilities and amenities are currently lacking, and before 31st December 1990 will publish a document containing its findings-.

The provision of leisure facilities will be examined by the Leisure Services Committee, and all other aspects by the Development Services Committee. Ward Councillors and Parish Councils will be specifically consulted."

The Committee agreed that the matter should be referred back to the District Plan Working Party for consideration. 5

The Committee considered the appended Minutes of the Meeting of the Hackney Carriage Panel held on 19th September 1988 which contained the following recommendation:-

RECOMMENDED That the proposed arrangements for routine medical examination of drivers be approved. (Minute 28 - Hackney Carriage/Private Hire Vehicle Drivers - Medical Examinations) (897) (SEC)

480. TOWN AND COUNTRY PLANNING ACT 1971 - SECTION 210; PROPOSED DIVERSION OF FOOTPATH 25 ROCHFORD

The Secretary to the Council reported that the site of the Council's proposed development at Doggetts Close, Rochford was crossed by Public Footpath 25, Rochford which could be diverted onto the highway footways and internal estate footpaths. All of those paths would eventually be adopted as public highways, but some time could elapse before adoption was achieved and diversion would be necessary to provide a path in the intervening period.

RECOMMENDED That the diversion proposals as now presented be approved in principle, and that the Secretary to the Council be authorised to carry out the statutory consultation procedure. (8345) (SEC)

481. RESOLUTION TO ADOPT THE ROCEIFORD DISTRICT LOCAL PLAN (Minute 419/88)

Members had before them the submission on the future role of the Working Party which had been made by Councillor M.J. Randford at Council when the Local Plan had been adopted and which had been directed in the first instance to the parent Committee.

It was moved by Councillor S.A. Skinner:

"That the District Plan Working Party be asked to consider —

(i) formulating a policy to encourage the development of new businesses within the Rochford District - with particular attention being paid to ensuring that Industrial Estates within the District are used to their full potential;

(ii) seeking to institute and encourage constructive discussions between the District Plan Working Party (together with the Economic Development Panel), the Airport Authority and Southend Council over the future development of Rochford Airport. These discussions could include the possibility of resiting the Airport Terminal Buildings to incorporate a new Rail Terminal;

(iii) the formulation of a policy requiring that whenever possible the development of large sites be considered as a whole - to prevent or deter the submission of piecemeal planning applications covering only a small part of a large site. The aim of this policy would be to ensure a hatmonious overall design for each site, and not necessarily to prevent individual stages from being built sequentially; 001222 — —rc91 ii ''ir ri r ' ' '' r' r

(iv) reviewing Rochford DistrLct Council's policy regarding flats, and in particular the conversion of houses into flats, to see whether there is scope for improving the policy;

(v) reviewing Rochford District Council's policy regarding backland developments, with due consideration being given to the problems such developments can cause in overLoading the existing infrastructure, to see whether there is scope for amending the policy to alleviate or prevent at least some of the problems;

(vi) formulating a policy to prevent new development on areas abutting ancient monument sites."

REPORT OF TRE READ OF ENVIRONMENTAL SERVICES

STATUTORY CONSULTATION - WASTE DISPOSAL LICENCE - CELURCHFIELD1 BARLING

The site is a small, recently quarried area to the east of All Saints Church. It is proposed to tip excavated materials in their natural state and brick rubble. Planning permission was granted on 3rd September 1975 (ROC/684/74). Site plans are appended..

The Head of Environmental Services considers that the following conditions should be attached to the Waste Disposal Licence which will be issued and enforced by Essex County Council:-

1. Waste handled at the site shall be limited to the following types or categories:

Soil, excavated materials in their natural state and clean brick and concrete rubble.

2. No liquids, slurries, sludges or oils shall be deposited, either alone or in admixture with any solid materials.

3. No deposit shall take place unless a road has first been provided within the site. This shall run from the site entrance to the site control office. The road shall be maintained to the satisfaction of the County Council.

4. All due precautions shall be taken to ensure that no mud or waste is deposited onto the public highway by vehicles leaving the site.

5. No deposit shall take place until a site control office has been provided.

6. No deposit shall take place untLl a site identification board of durable materials has been erected in a prominent position at the site entrance. This board shall display the following information:-

(a) the name of the site;

(b) the name, address and telephone number of the operator and his local agent;

(c) the hQurs when the site is open; and

(d) the address and telephone number of the County Council.

1. No deposit shall take place until subsidiary site roads have been provided to the tipping area. These shall be maintained to a reasonable standard and extended as necessary.

8. No deposit shall take place until suitable facilities have been provided for storing and maintaining equipment used.

9. No deposit shall take place until gates and fencing have been S provided. They shall be maintained to the reasonable satisfaction of the County Council and all reasonable precautions shall be taken to prevent unauthorised access to the site.

10. No tipping or work associated therewith shall take place during the hours of darkness.

ii. The site shalL be adequately manned and supervised during tipping Operations.

12. Solid waste shall be compacted and formed into'a layer as soon as possible after deposit and not later than at the end of the working day on which the waste is received.

13. The layer of waste shall be formed by a tractor or other suitable compaction machine equipped with a blade or some other appropriate levelling device.

14. The depth of a layer of waste shall not, after initial compaction, exceed 2 metres.

15. Before covering, working faces and flanks shall be compacted to form gradients not steeper than 1 in 3.

16. Deposited waste shall be covered progressively to a depth of not less than 15 centimetres (6 inches) with earth or similar materials at intervals not exceeding 14 days or such time as may be determined by the County Consumer and Public Protection Officer in writing.

17. No waste or other materials shall be deposited on the site other than at the tipping face, except (a) earth and similar materials to be used for covering the waste, (b) hardcore and similar materials to be used for road marking on the site, (c) salvaged materials or (d) any loads of waste received on the site which appear likely to cause an outbreak of fire if mixed with other waste.

lB. Each layer of waste and covering material shall be laid to a fall to encourage surface water run-off, but no openings or discharge to any surface watercourse shall be made without the prior approval of the Anglian Water Authority.

19. Not less frequently than once a week any loose waste which may be lying on the site shall be collected and disposed of in such a way as to keep the site tidy.

20. No waste materials shall be burnt within the site and a fire at the site shall be regarded as an emergency and immediate action shall be taken to extinguish it. All outbreaks of fire shall forthwith be notified to the County Consumer and Public Protection Officer.

21. Precautions shall be taken to prevent the breeding and harbouring of insects and vermin on the site and immediate steps shall be taken to secure the destruction of any discovered.

22. Site roads shall in. dry weather, be sprayed with water to suppress dust. .

23. ALl reasonabLe precautions in addition to those specifically mentioned shall be taken to prevent nuisance arising on or from the site as a result of the use thereof for the reception of waste and to ensure that the site is kept in a tidy condition.

24. A record shall be kept of the types and quantities of waste deposited.

25. Until final restoration, completed areas of landfilling shall be graded and maintained in a tidy condition, and where necessary action shall be taken to control or destroy weeds.

26. The final layer deposited shall be subject to the minimum compaction and shall, to a depth of not less chsn 1 metre be kept free of materials likely to intefere with final restoration or subsequent cuLtivation.

27. The terms of the site licence shall be made known to any person who is given responsibility for the management or control of the site.

28. Tipping in the site and the work associated therewith shall not take place on Sundays and Bank Holidays or outside the hours of 7 a.m. to 6 p.m. Monday to Friday and 7 a.m. to 12.30 p.m. Saturday.

29. A record shall be maintained to the satisfaction of the County Council of all incidents which occur on the site whereby there is a material risk to the health or safety of any person.

RECOMMENDED That Essex County Council be advised that the Council has no objections to the issue of a licence for waste disposal at Churchfield, Barling, subject to the conditions specified in the report. (120) (lIES)

67. ESSEX COUNTY COUNCIL RIGHTS OF WAY PROJECT OFFICER

The Chairman welcomed Mr. Peter Wilkinson, Rights of Way Project Officer, Essex County Council, who was in attendance to explain his role in the improvement and provision of rights of way in Essex. By way of introduction, Mr. 'Wilkinson said that his post and that of his colleagues had been born out of the recognition by Essex County Council of the lack of riding facilities in many areas of the County, coupled with the increasing road safety hazards due to horse riders being forced to ride on busy roads and roadside verges. His role was not however restricted to bridleways, as he was also involved in improvements to the footpath network. This aspect of the work included the establishment of long distance paths, conversion of disused railway lines and increasing publi awareness of the existence of public rights of way.

The main priority in Mr. Wilkinson's work was however the improvement of the bridleway system and the creation of new routes. The biggest effort S would be made where the need was the greatest, including all South East Essex areas and some East Essex Districts. The Rochford District had been surveyed, and some potential schemes were being examined. It was County Council policy to establish definitive bridleways as opposed to permissive routes, although the establishment of permissive routes would not be entirely ruled out in certain conditions. It was also County policy to establish definitive routes in Country Parks and this aspect was also being pursued. The work entailed co-operation between the County Highways, Planning and Estates Departments, and, good progress was being made in identifying areas where advances could be made. Suggestions for improvements were however welcome, although it should be borne in mind that factors such as benefit to the public, demand for the facility, suitability and cost of the route and timescale would be taken into account when assessing priorities.

In answering members' questions, Mr. Wilkinson stated that County policy was to establish definitive bridleways by agreement with landowners, and that a route would only be compulsorily established in exceptional circumstances. He would not support any proposals which would put in jeopardy any arrangements being negotiated by the local Council. In reply to a question, the Chairman stated that although the District Council would give the County Council every help and encouragement in their efforts to provide additional bridleways, it might prove difficult to permit definitive bridleways on land owned by the District Council. Other matters discussed included private sponsorship for establishment of bridleways, which would be welcomed, and the adoption of a standard specification for surfacing works. During discussion of this last item, Mr. Efde mentioned the value of waste material from concrete plants and cockleshells for surfacing and use of scrap pLastic pipe for drainage, all of these materials being available free. The Chairman thanked Mr. Wilkinson for his attendance, and for a most interesting description of his work.

68. PROPOSED BRIDLEWAY ROUTE - BLOUNTSWOQD ROAD TO CENTRAL AVENUE, HDLLBRIDGE

Mr. Wilkinson reported that a meeting hed taken place between Mr. Efde, Mr. Wood and himself to discuss this proposal further. There were difficulties in linking the proposed route to Central Avenue as the County Council were unsure of the status of Central Avenue over and above the existing right of way on foot, and in view of recent litigation relating to encroachment onto the street it was felt unwise to encourage use by horse riders at this time. Another route was being investigated, and a further report on this would be made when negotiations had reached a firm basis.

69. PROGRESS ON IMPLEMENTATION OF' PERMISSIVE ROUTES

Mr. Wood reported that the culvert at the Gusted Hall Lane end of the Main Road, }lawkwell route had been constructed, and Mr. Smith said that work on the surfacing of the ride could commence at the end of August after the harvest. Funds for the work had bean raised by RORSTE. With regard to the proposed northerly extension of the Clements Hall route, evidence had been passed to Essex County Council that bridleway rights might exist around Clements Hall into Victor Gardens, although the County Council had stated that they were not at present in a position to consider the evidence. It might therefore be the way ahead to continue negotiations with the owner with a view to establishment of a permissive

route, and resolve the legal difficulties at a later date. A site meeting had been arranged with Mr. Keddie to explore the possiblity of this route being established on Mr. Keddie's land. It was proposed to fence of the east to west route across Mr. Keddie's land which linked Windsor Gardens to Clemerics Hall Playing Field, and it was suggested that if the Essex Bridleways Association could assist by providing materials, HORSE would carry out the work.

It was also noted that an extension of the Cletnents Ball route west across the former Spencer's Nursery was being examined. This would allow riders to use Thorpe Close and Thorpe Road, by-pass a further section of the busy Rectory Road and allow easier access from the east to the Main Road ride.

70. OTHER EUSINESS

It was noted that the Public Inquiry into the diversion of bridleway 38 Rochford would take place at Rayleigh Council Chamber on 20th July 1938 starting at 10.00 a.m.

A Member again raised the question of conditions on the A127 trunk road, and painted out that places where horse riders and indeed pedestrians could cross safely were becoming very few and far between. The construction of anti—crash barriers on long stretches of this road was forming an impenetrable barrier for horses and pedestrians and the road could be said to be forming a "Berlin Wall" between Rochford and Castle Point and . The situation would be worsened when the Rayleigh Weir roundabout and underpass scheme was completed. It was appreciated that crossing facilities would be provided at Rayleigh Weir, but to reach those facilities it would be necessary to negotiate the A129, which would be if anything busier when the underpass was completed. A bridge or underpass would be the answer, but had been ruled out on cost grounds.

RECOMMENDED That the lack of proper provision for horse riders to cross file K117 trunk road be brought to the attention of the Department of Transport, and Essex County Council., with the recomexendation that urgent consideration be given to the provision of a bridge or underpass to be sited in such a position as to give maximum benefit.

64. PROGRESS ON PREPARATION OF THE LOCAL PLAN DOCUMENT

The Director of Development, showed Members colour proofs of the proposals maps incorporating all of the modifications which had been prepared as part of the final stage prior to submission of tha definitive document to the DoE early in August. The Working Party noted the grounds on which the Secretary of State could call in the Plan, that it was otherwise envisaged that notice of intention to adopt the Plan could be given at the end of August and that after the statutory period had elapsed its adoption could be publicised.

The Working Party were pleased to note that they were in sight of achieving their purpose and it was

RECOMMENDED That this Council place on record its thanks to the staff involved in bringing the District Plan to its culmination. (2081)

65. LOCAL PLANS: DRAFT PLANNING POLICY GUIDANCE NOTES

The Director of Development advised Members that the guidance notes which were being issued were important and that a planning authority needed to have regard to them since failure to comply could be cited at Appeal. Members were mindful that the current consultative document reinforced the status of local plans within the planning process.

66. NOTICE OF MOTION RECEIVED PURSUANT TO STANDING ORDER 5: FURTHER LARGE a SCALE DEVELOPMENT WITHIN THE ROCRFORD DISTRICT (Minute 190/87)

Members had before them the following Motion standing in the names of Councillors Mrs. E.M. 1-Tart and C.J.B. Faherty which had been referred to the Working Party for consideration by the Development Services Committee on 31st May 1988:

"That this Council, the Rochford District Council, does not permit any further large scale development within the Rochford District area until such time as the infrastructure, public utilities, community services and shopping areas are improved."

In speaking to the Motion Councillor Mrs. Hart said that whilst acceptng the importance of the District Plan it was necessary also to recognise the problems being experienced as a corollary to preservation and protection of the Green Belt. In drawing the boundaries of the Green Belt to the end of the century regard had been paid to the factor of intensification as a means of meeting the housing target from land within the existing residential areas. She expressed concern that this could lead to over- development which would be detrimental to those areas and erode the qualities which had attracted many residents to live there in the first instance. She stressed that it was important to safeguard the character of all of the District by holding the balance fairly between residential areas, rural settlement areas and Green Belt land. Attention should be given to the long term implications of intensification to ensure that resources were available for the infrastructure to keep pace with the increasing demands being placed upon it.

In support Councillor Faherty said that responsibility for many of the services — in particular highways — resided with the County Council, but that the agencies concerned were remote from the day—to--day problems encountered by the residents and often appeared to accord them a lower priority than they merited. The Working Party also considered the suggestion of a Member that permission should be refused for all large scale development, that is, exceeding 22 dwellings and that a study should be carried out to identify those areas where infrastructure, community facilities and amenities were currently lacking.

Whilst having every sympathy with the views expressed by the mover and seconder of the Motion, Members were mindful that the District Plan had been produced after extensive consultation with local residents and statutory bodies and laid down a framework of policies within which planning applications could be determined. If the Motion proposed were to be adopted it would give rise to a conflicting policy, the effect of which would be to negate the District Plan. This could render the position of the local planning authority untenable and strengthen representations by appellants against unfavourable decisions. The end result could thus be counter—productive.

Members were also mindful that demands from house builders for sites to be identified for development as part of the District Plan process had been tempered by the fact that Rochford was a Green Belt Authority. As regards the factor of intensification it was apparent that if it were to be discounted the argument would be re—opened for the release of further large sites for development.

A Member commented that responsibility for the infrastructure was divided between a number of different agencies which were constrained by lack of resources from keeping pace with demand. He suggested that where a problem could be foreseen the local planning authority should endeavour to obtain a contribution from the developer. It was acknowledged that this could offer some potential for improvement albeit of a limited nature.

Some Members pointed out that in considering the delays which occurred on roads within the District, it was necessary to retain a sense of proportion. The situation wa's by no means as bad as could be encountered elsewhere when traffic came to a standstill for long periods. Furthermore, some of the problems were caused by drivers themselves who preferred to park on the road in main shopping areas rather than, as in Hockley, making use of the car park that was available. It was the case however that as a separate process arising out of consideration of the 81013 access to Southend, the County Surveyor's Department had been made to recognise the need to improve the road system generally, as a result of which a number of thort term measures had been put in hand and the South East Essex Traffic Study had been commissioned.

For all of the foregoing reasons Members felt unable to support the Motion that had been put forward. It was suggested as an alternative that the imminent adoption of the Local Plan would enable the Working Party to turn its attention on a formal basis, to considering ways of pursuing the improvements required through regular monitoring of the progress of develoment together with the effectiveness of the Plan policies. Individual areas or policies could be examined in detail with the appropriate Ward Members being able to contribute directly to the discussions. The Working Party favoured that approach, which would enable any potential problems to be identified and brought to the attention of the parent Committee for appropriate action. On that basis the Motion was withdrawn and it was

42. PROPOSED FOOTPATH ROUND WALLASEA ISLAND

Members were pleased to note that following an approach by the Secretary to the Council to Mr. John Brown, a Wallasea Island landowner, he had given permission for public access onto his land which would enable the sea wall to be reached and a footpath to be provided all round the island.

43. HEATH FRITILLARY BUTTERFLY

Members were advised that the introduction of this species of butterfly into coppiced areas of Hockley Woods appeared to have been successful.

44. CRAFT RESIDENCY -HOCKLEY MOODS

The Director of Development reported that the sculptor/craftsman who had been appointed for a short residency in Hockley Woods would be based there between October 1988 and March 1989.

45. ENJOYING THE COIJNTRYSIDE: PATHS, ROUTES AND TRAILS

The Director of Development referred to the lengthy nature of the existing procedure for the diversion of rights of way and the recent suggestion of the Countyside Commission for it to be simplified and streamlined. Members noted that comments and suggestions would be welcomed by the a Countryside Commission and that in view of the fundamental changes W proposed it would be more appropriate for the matter to be reported direct to the Development Services Committee. 0011 • — 1 !F!! 46. NEW RIGHTS OF WAY PROJECT: STRATEGY

Members noted the report of the Director of Development on the County Councilts strategy for a new rights of way project. Members were aware that the County Council were responsible for the oversight and upkeep of public footpaths and bridleways within the District and welcomed this scheme which would create new opportunities for access to the countryside and heighten public awareness of the rights of way network.

A Member suggested that a sign should be placed on the Ashingdon Road to warn vehicle drivers of the possible- emergence of horse riders from the Ironwell Lane bridlepath

47. ESSEX HERITAGE YEAR

The Director of Development reported on correspondence received from Essex County Council regarding the formation of a project to promote awareness of the historical and environmental assets of the County. Members considered their role within the District and how as a Group they could become involved in making a noteable contribution to Heritage Year. Various suggestions were put forward including the promotion of noteworthy local sites coupled with an exhibition and possibly amplified by a lecture illustrated by slides and the Director of Development agreed to pursue those ideas.

48. APPLICATION BY CORY FOR EXTENSION TO EXISTING WORKINGS AND STJBSEQ!JENT BACKFILLING OF SITE,• BARLING MAGNA

A Member expressed concern about the above proposal which was to be the subject of a report to a future Meeting of the Planning Services Committee as a consultation by the Waste Disposal Authority and that was echoed by the Meeting.

The Minutes of the Meeting held on 24th February 1988 were approved as a correct record subject to the inclusion of Councillor Mrs R.Brown's name amongst those present.

28 • HACKNEY CARRIAGE/PRIVATE HIRE VEHICLE DRIVERS—MEDICAL EXAMINATIONS

The Chief Trading Standards Officer reported that in place of the requirement for each driver to produce a medical certificate from a doctor in addition to completing a questionnaire when the driver's licence was first granted or on triennial renewal, it was proposed to achieve uniformity of standards by providing for the District Occupational Health Physician to assume responsibility for all routine medical examinations. The Panel noted that this would be in line with the arrangement already a approved for the Southend licensing area, that all the licences fell due for renewal from 1st January 1989 and that there would not be any cost involved to the Council.

RECOMMENDED That the proposed arrangements for routine medical examination of drivers be approved. (897)

29. PROGRESS REPORT

The Panel noted the report of the Chief Trading Standards Officer on licensing carried out since the last Meeting. A Member expressed concern that although mini—buses could now be employed on bus routes they were not subject to P.S.V. licensing regulations.

30. REVOCATION OF HACKNEY CARRIAGE LICENCE NO. 40

Further to Minute 25, the Panel noted that when the case had come to Court the appeal which was to have been heard against the Panelts decision to revoke Hackney Carriage Licence No. 40 had been withdrawn, that the Magistrates had accepted the case as presented on behalf of the licensing authority and that the licence plate had been duly surrendered.

31. EXCLUSION OF THE PUBLIC

Resolved that under Section lOO(A)(4) of the Local Government Act 1972, the public be excluded from the bleeting for the following items of business on the grounds that they involve the likely disclosure ot Exempt Information as defined in paragraph 7 of Part I of Schedule l2A of the Act.

32 • HACKNEY CARRIAGE LICENCE APPLICATIONS

The Panel had before them a renewed application for Hackney Carriage Licence which had not been granted at the previous Meeting, as the applicant fell short at that date of the three years minimum taxi driving experience required and which was now supported. They considered an application for a licence from a driver who although having held a driver's licence only since May 1986 was an experienced and competent driver who was engaged full time in the trade. Members were reluctant as a general rule to waive the pre—licensing standards but were prepared exceptionally to look favourably on this request since the applicant drove on the Andrews circuit which had recently lost a taxi. They also considered two applications from existing Hackney Carriage Licence holders to be granted a second licence to enable them to operate private hire cars as taxis, which was in line with the Council's policy to permit an operator to hold up to three licences. In supporting those two applications the Panel considered that it was preferable for demand to be met by licensed hackney carriages rather than by private hire cars.

Arising out of that process the Panel took the view that unless the Chief Trading Standards Officer was satisfied that there were exceptional circumstances, applications for Hackney Carriage Licenses should not be entertained until such time as the applicant met all the pre—licensing conditions.

Resolved (1) that approval be given to the issue of new Hackney Carriage Licence plates to Messrs J.R. Ivison and A. Thacker.

(2) that approval be given to the issue of a second Hackney Carriage Licence plate to Messrs B.J. Garrod and P.N. Richmond.

(3) that save in exceptional circumstances applications for a Hackney Carriage Licence be not entertained until the applicant is able to meet all the pre—licensing standards.

33. APPLICATION FOR RESTRICTED HACKNEY CARRIAGE LICENCE

The Chief Trading Standards Officer reported in confidence on an application from Mr McGowan for a restricted Hackney Carriage Licence to enable him to operate a local service within the Rochford flistrict. The Panel had before them details of the route and timetable and noted that although he had only held a taxi driver's licence since August 1986 the application was in conformity with the requirements of the Transport Act, that he held a Public Service Vehicle licence and had been awarded a tender for the route by the County Council.

They took the view that the licence should be issued on a similar basis to that which had applied to the previous local service, namely that the Chief Trading Standards Officer should obtain an agreement from Mr McGowan to restrict the use of the licensed vehicle to the provision of the local bus service only, and that the normal transfer fee should be waived iii the

event of an alternative approved vehicle having to be used on a temporary basis to maintain the service. The Panel subsequently advised Mr McGowan of the outcome of his application.

Resolved that approval be given to the issue of a Hackney Carriage Licence Plate to Mr S. McGowan, to be conditioned to the provision of a local bus service, and that the Chief Trading Standards Officer be authorised to waive the normal licence transfer fee in the event of a replacement vehicle being required to maintain the service.

34. APPLICATIONS TO TRANSFER HACKNEY CARRIAGE LICENCES TO PARTNERSHIPS

The Chief Trading Standards Officer reported in confidence on the circumstances of two applications from existing Hackney Carriage Licence holders to transfer the Licence to a partnership arrangement.

Tte Panel considered that there were compassionate grounds for supporting the first request from a husband and wife, which would regularise the position whereby because of the licence holder's serious illness his wife had qualified to drive his taxi, and safeguard the couple's interests for the future0 They were unable to find merit in the second application, noting that the existing licensee had made his vehicle available to another driver who was not yet eligible to apply for a licence in his own right.

Resolved (1) that the request from Mr D.J. Major for his Hackney Carriage Licence to be transferred to a partnership arrangement with his wife be granted.

(2) that the request from Mr I. Seiffert for his Hackney Carriage Licence to be transferred to a partnership arrangement with Mr P. Bencroft be not granted.
