Saya Nazliyah Binti Mansor hadir bagi pihak Badan Peguam Kedah pada hari ini untuk prosiding memperingati ahli-ahli Badan Peguam Kedah yang telah meninggal dunia. Hari ini merupakan hari yang bersejarah kepada Badan Peguam Kedah kerana Berjaya meneruskan tradisi mulia Badan Peguam Malaysia dalam memperingati dan menghargai para peguam yang telah terlebih dahulu pergi meninggalkan kita. 2. Saya mohon merekodkan setinggi-tinggi penghargaan dan terima kasih kepada Yang Arif Dato‟ Haji Ghazali Bin Cha, Yang Arif Puan Chan Jit Li, Yang Arif Tuan Abu Bakar Bin Katar dan pihak Mahkamah yang Mulia ini di atas kesudian dan persetujuan mengadakan prosiding ini pada hari ini.Tidak lupa juga kepada Yang Arif Dato' Hashim Bin Hamzah yang telah banyak memberi sokongan dan dorongan kepada kami dalam merealisasikan prosiding ini. 3. Saya juga mengucapkan ribuan terima kasih dan berbesar hati di atas kehadiran YB Dato‟ Hajah Nor „Azura bt Haji Mohamed Zohdi, Penasihat Undang-Undang Negeri Kedah yang hadir mewakili Peguam Negara pada prosiding ini. 4. Saya juga ingin merakamkan ucapan terima kasih kepada sekretariat Badan Peguam Malaysia terutamanya Encik Rajen Devaraj, Ketua Pegawai Eksekutif Badan Peguam Malaysia yang telah banyak membantu kami mendapatkan butiran maklumat mengenai latar belakang rakan-rakan peguam yang telah meninggal dunia untuk direkodkan di dalam buku memorial ini. 6. Setinggi-tinggi terima kasih kepada barisan peguam yang telah sudi menjadi penyampai di dalam Prosiding ini, begitu juga sekalung tahniah kepada Ahli-ahli Jawatankuasa Badan Peguam Kedah yang telah bertungkus lumus berusaha gigih bagi menjayakan Prosiding ini. Tidak lupa juga ucapan terima kasih saya kepada kakitangan Badan Peguam Kedah dan para pelatih dalam kamar yang telah memberi sumbangan masa dan tenaga untuk menjayakan Prosiding Memperingati pada hari ini. 7. Prosiding ini yang julung kali dilaksanakan di Negeri Kedah bertujuan memperingati 22 orang Peguam yang pernah beramal di negeri Kedah yang telah meninggal dunia sejak 24 tahun yang lalu iaitu dari tahun 1994 sehingga 2018. Prosiding ini merupakan penghormatan dan penghargaan kepada rakan-rakan peguam yang telah pergi dahulu, agar ahli-ahli Badan Peguam Kedah terutamanya para peguam muda dapat mengenali dan menghargai para peguam senior yang telah meninggal dunia serta mengambil contoh kebaikan yang ditunjukkan oleh mereka. 8. Bagi pihak Badan Peguam Kedah, saya ingin merekodkan ucapan takziah kepada semua ahli keluarga di atas pemergian para rakan Peguam yang dikasihi sekelian. Sungguh pun kita masih terasa sedih dan berdukacita dengan pemergian mereka, kami yang masih meneruskan perjuangan menghargai jasa mereka dan merakamkan setinggi-tinggi penghargaan di atas khidmat mereka dalam bidang perundangan serta sumbangan bakti mereka kepada masyarakat. 9. Adalah diharapkan Prosiding Memperingati ini dapat diteruskan di masa akan datang dan dijadikan amalan berterusan Badan Peguam Kedah dengan kerjasama pihak Mahkamah Yang Mulia ini demi mengingati dan menghargai para Peguam yang pernah berjasa di Negeri Kedah Darul Aman. 2 10. Saya akhiri dengan peribahasa yang berbunyi: “Harimau mati meninggalkan belang, manusia mati meninggalkan nama” yang bermaksud kita perlulah berusaha untuk meningkatkan tahap profesionalisme agar segala yang kita lakukan dapat dijadikan suri tauladan oleh generasi akan datang dan dikenang sehingga ke akhir hayat. 11. Yang Arif, saya dengan hormatnya mengusulkan supaya Rekod Prosiding Memperingati ini disimpan di Arkib Mahkamah yang Mulia ini dan sesalinan diserahkan kepada setiap keluarga mereka yang kita kenang dan ingati pada prosiding hari ini. Terima Kasih. NAZLIYAH BINTI MANSOR PENGERUSI BADAN PEGUAM KEDAH 3 SPEECH BY DATO’ ABDUL FAREED BIN ABDUL GAFOOR VICE PRESIDENT OF MALAYSIAN BAR Dengan Izin Yang Arif, 1. I am ABDUL FAREED BIN ABDUL GAFOOR, and I appear for the Bar Council and the Malaysian Bar in today‟s reference proceedings. 2. May I begin by thanking your Lordship for agreeing to this reference and making time to preside over the proceedings. This is a solemn and meaningful occasion that is unique to the legal profession. It is a time when the Bar recognizes, as a matter of formal record, our own members who are no longer with us. 3. I would also like to thank the Kedah Bar Committee under the able leadership of Puan Nazliyah Binti Mansor for reviving this time honoured tradition in remembrance of our departed colleagues. 4. May I also acknowledge the presence of YB Dato‟ Hajah Nor„Azura bt Haji Mohamed Zohdi, Kedah State Legal Adviser on behalf of the Honorable Attorney General, who has taken time off her busy schedules to be with us this morning. 5. In the finest traditions of the Bar, we gather to pay tribute and commit to posterity the achievements of our learned friends and colleagues at the Bar that should be emulated and forever cherished. 4 6. My learned friends will speak in great length on the many achievements and contributions of our departed members. Each one of them has had illustrious careers, both within and outside the legal fraternity and they have been revered by their families and acquaintances. 7. On a personal note, I have known the following late members in the course my work as an advocate and solicitor, a) PATHMANATHAN S/O SUNDRAM – he was slightly senior in practice and was an up and coming lawyer before his untimely death; b) VEERASAMY @ RAJENDRAN A/L AMS PERIASAMY – he is much senior in practice but puts younger members at ease due to his jovial character. Perhaps it runs in his family as I later came to know of his younger brother Vivekananda, who is equally jovial, who was a former Perak Bar Chairman and Council Member of the Malaysian Bar; c) RAO SURYANA BINTI ABDUL RAHMAN – despite her diminutive figure, RAO was a strong character who is known to articulate her thoughts very well. Unknown to many, she has also played football for the Penang Bar‟s ladies team in the early part of her career. 8. With the departure of these 22 of our collagues, the Malaysian Bar has not only lost outstanding lawyers, but respectable personalities whose voids are difficult to fill. 9. Although we grieve and mourn their deaths, we also acknowledge their many contributions, service and dedication to the Bar and society which is evident in all of us being here today paying tribute to them. We believe that the marks left behind by each and every one of the 22 will continue to serve as an inspiration to members of the Bar, whether from the current or future generations. 5 10. On behalf of the Bar Council and Malaysian Bar, I express our sincere condolences to the family and friends of the 22 departed members, as we mourn their loss. We pray that their souls rest in peace. 11. Lastly, may I ask your Lordship to direct that a Record of this Reference be kept in the Archives of the Court and a copy sent to the families of our departed brothers and sister-at-law. 12. In terms of electoral politics, there have been six by-elections at the time of writing; one resulted from the untimely death of Karpal Singh, the veteran Democratic Action Party (DAP) politician, and another from the death of the Pan-Malaysian Islamic Party (PAS) Menteri Besar of Kedah. The by-elections were held in Kuala Besut (Terengganu state seat) on 24 July 2013; Sungai Limau (Kedah state seat) on 19 October 2013; Kajang (Selangor state seat) on 23 March 2014; Bukit Gelugor (Penang parliamentary seat) on 25 May 2014; Teluk Intan (Perak parliamentary seat) on 31 May 2014; and Pengkalan Kubor (Kelantan state seat) on 25 September 2014. Barisan Nasional (BN) retained the Kuala Besut seat, thus holding on to its thin two-seat majority in the state. Rajanthiran Abstract e brave and controversial declaration of Malaysia as an Islamic state by YABhg Tun Dr. Mahathir Mohamad on the 29 September 2001, was vehemently opposed by the DAP. is paper analyses and explores the justifi cation of the said declaration as well as the pattern and rationale for DAP’s oppositionism. e DAP had specifi cally highlighted and protested via its “929” campaign that YABhg Tun Dr. Mahathir Mohamad’s declaration of Malaysia as an Islamic state was unconstitutional, undemocratic and arbitrary. e DAP party stalwarts maintained that Malaysia was a secular state since Independence and ought to continue remaining so in the best interests of a pluralistic Malaysia. e primary focus of this paper therefore is to identify and discuss the fl aws in the DAP’s said claim, and instead highlight the fact that Malaysia is rightfully an Islamic state from Independence and beyond.     AMNESTY INTERNATIONAL Public Statement AI Index: ASA 28/003/2009 6 May 2009 Malaysia: Government Crackdown on Freedom of Expression Amnesty International calls on the Malaysian authorities to release five government critics arrested in the last two days, or charge them with recognizable criminal offences. This wave of arrests is part of a crackdown on dissent by the new government of Prime Minister Najib Abdul Razak. The authorities appear to have arrested people merely for expressing their political views or gathering peacefully to protest government actions. On 5 May 2009, police arrested university lecturer and activist Wong Chin Huat under Section 4(1) of the Sedition Act. Wong represents the Coalition for Free and Fair Elections (BERSIH), a group of civil society organizations and political parties campaigning for reforms to the electoral process in Malaysia. Police arrested him on the same day BERSIH called on Malaysians to wear black on 7 May as a mark of protest against the ruling government’s takeover of the Perak state government. Political tensions have increased in Perak state since the Perak Sultan ordered its Chief Minister, Mohd Nizar Jamaluddin, a member of the People’s Alliance (PA), the opposition coalition, to resign in February, following three defections from the PA to the ruling party. The government’s representative, Zambry Abdul Kadir was then appointed as the new Chief Minister. A state assembly session will take place on the 7 May when Zambry is expected to formally take up his position. Within 24 hours of Wong’s arrest, police arrested Mohamad Sabu, the Vice President of the Pan- Malaysian Islamic Party (PAS), part of the opposition coalition.

It was a highly emotional scene at the MP Karpal Singh house when his body arrive at his home around 3.30pm this afternoon. His wife Gurmit Kaur was inconsolable, as she wailed, "why, why." Karpal's son, Puchong MP Gobind Singh Deo, who was holding his mother when the body arrive at his house. Both of theme were killed when the Toyota Alphard which they were travelling in collided with a lorry near Gua Tempurung, here at about 1am on early thursday morning. Karpal Singh´s funeral this Sunday morning will be accorded the Penang state honours, announced Chief Minister Lim Guan Eng here today. “This means the state flags would be flown half-mast until the funeral day on Sunday. “The state flag will be accorded to cover Karpal´s casket. “Finally a public ceremony will be held in Dewan Sri Pinang for the lay public to pay their last and final respects to Karpal. This is the last respect being accorded to a Penang MP and a statesman by the state government,“ Lim told a press conference at Karpal´s house in Jalan Utama here today .He said the state executive council decided this afternoon to honour Karpal, a son of Penang, a funeral with state honours. Also present were Karpal´s sons Gobind and Jagdeep Singh Deo, and Penang DAP chairman Chow Kon Yeow.

    Karpal: Mahathir is being mischievous Malaysiakini.com June 10, 2011 DAP national chairperson Karpal Singh today accused former Prime Minister Dr Mahathir Mohamad of trying to tear open old wounds by saying Karpal is the winner in PAS' decision to drop its Islamic state agenda. Calling Mahathir's statement "mischievous", Karpal said the former premier and others in Umno are merely trying to distract PAS from its new objective of establishing a welfare state in Malaysia. "It should not be forgotten that in 2001, when Mahathir was prime minister, he had, in utter contempt for the constitution, publicly announced that Malaysia was an Islamic state and went further, a few days later, to say that Malaysia was not only an Islamic state, but an extremist Islamic state...," he said in a statement. Mahathir had said in his blog recently that Karpal should be happy that PAS' new leadership line-up has changed its course towards adopting a similar cause as DAP's "welfare state" proposal instead of pushing for an Islamic state. Karpal acknowledged that he had from the start opposed PAS' goal of installing an Islamic state in Malaysia, on grounds that the federal constitution provided for a secular state and the Reid Commission, which included Islamic jurists, had "carefully provided for this position when presenting the constitution to the country on Merdeka Day". Umno panicked and has gone on vicious trip He also admitted that his controversial "Islamic state over my dead body" statement during the 1990 general election had backfired, though he withdrew and apologised for the statement nine years later, during the 1999 general election when DAP joined forces with PAS and Semangat 46 to form Barisan Alternatif.
