Their major products are aluminium, copper, diamonds, gold, industrial minerals, iron ore, thermal and metallurgical coal and uranium. Rio Tinto has been in business for more than 140 years with a current workforce of about 50,000 in around 35 countries. http://www.riotinto.com/ Oyu Tolgoi Copper and Gold Mine, Mongolia Situated in the southern Gobi desert of Mongolia, approximately 550 kilometres south of the capital, Ulaanbaatar, and 80 kilometres north of the Mongolia-China border, Oyu Tolgoi is jointly owned by the Government of Mongolia (34 per cent) and Turquoise Hill Resources (66 per cent, of which Rio Tinto owns 51 per cent). Since 2010, Rio Tinto has also been the manager of the Oyu Tolgoi project. Summary of action Mongolia’s mining sector is a significant contributor to the economy as well as a key water user. The Rio Tinto managed Oyo Tolgoi copper and gold mine located in the water scarce South province has recognised the importance of optimizing the use of the scarce water resources and taking a stewardship approach in order to ensure the long-term future of mine, natural environmental systems and local herder livelihoods. In response to the situation, Oyu Tolgoi surveyed the area seeking a suitable underground water supply and identified the Gunii Hooloi aquifer, a 150 meter deep resource holding around 6.8 billion cubic metres of non-drinkable saline water. The operation goes to great lengths to use its allocation from this water source efficiently with the water recycle target of greater than 80% of the water used in production being achieved for the last 5 years. Recycling and conservation practices implemented throughout the operation have seen Oyu Tolgoi using around 420 litres of water to process a tonne of ore (based on 2016 performance), that is around half of the industry average. Water savings measures implemented have helped the mine reduce its overall water consumption to less than half of the global average for comparable mines Program rationale The Oyu Tolgoi Mine is located in an arid, water scarce region of Mongolia that is already being impacted by climate variability and increased desertification. With water being a critical resource for both the livelihoods and the culture of the local herders and as well as an input to the mine operations, Rio Tinto quickly recognised the imperative of optimising the efficient use of the scarce water resources. “If we were wasteful with water, our mine would have a short life. I know our mine has a potential life that will go generations, many generations, and I would hate to think that decisions that we were making today at a time of plenty could actually cause the mine to not have that really wonderful long term future. Things get more challenging, I feel, when you have a number of entities that are utilizing the same resource and that’s where it becomes particularly important that none of them are wasteful...” Mark Newby Principal Advisor, Tailings and Water Strategy, Oyu Tolgoi Program approach The Oyu Tolgoi mine has deployed a number of technologies and measures to reduce its water consumption and enhance its water reuse and resource recovery, including: • Use of an advanced tailings thickener that reduces water consumption within the tailings transfer and deposition process • Placement of a plastic cover on the water lagoon to reduce evaporative water loss. • Operational awareness and education on the importance of recycling and conservation practices. • Complete treatment and reuse of all domestic wastewater • Established efficiency target and zero water discharge commitment to the environment • Comprehensive water monitoring program • Implementation of an external assurance program supporting the above Oyu Tolgoi has also collaborated with the International Finance Corporate, 2030 Water Resources Group and 7 other mining companies operating in the Southern Gobi region committing to a voluntary ‘Code of Practice’ for improving water management practices at the catchment level. This platform has enabled the mining companies to engage collaboratively with the Mongolian Government and community resulting in the support of training and awareness raising on groundwater protection, and work towards a catchment water accounting framework. Other actions implemented by the mine to address water-related challenges include participatory monitoring of wells with the local herders to assess the mines impact on water levels, as well as restoration of existing and establishment of new herder wells. Main challenges that have been encountered include: • Perception that mining companies and the government were not doing enough to preserve and protect the water supply • General lack of understanding about the positive water management practices employed by mining companies • Recognition by the mining companies that an understanding of the cumulative impacts of water use by the mining sector would require a comprehensive and consistent approach to water accounting, along with a better approach to sharing data with government authorities and affected stakeholders. Results & Benefits Savings quantified by Rio Tinto over the period 2014 to 2016 include: ~75,000 million litres (of natural groundwater saved/not used compared to the industry average) 85% average water recycling rate ~1.97 tonnes of CO2 emissions per ton of copper produced (compared with an industry average of 2.5) • Climate change in the region (recorded above the global average) and its impact for the local community; • Substantial groundwater water consumption increase in the region due to other mining and infrastructure projects and growth in local livestock numbers, which can cause water shortages in some areas. These initiatives mean the mine uses approximately 0.42 cubic metres of water per tonne of ore processed, which is less than half the global average for comparable mines. Lessons learned • Value of partnering with local communities, regulatory departments and other industry users • Confirmation of site operations processes with regard to water efficiency • Importance of water stewardship approach within Rio Tinto What next? As the global population has continued to increase, so has the demand for natural resources. Developing countries richly endowed with natural resources have begun to realize that harnessing them presents a rare opportunity to fuel broader socioeconomic change and may, potentially, catalyze wholesale transformation.1 In this vein, countries have begun to increase their taxes and royalties on mining;2 and, to a greater extent, a “more indirect or insidious form of government intervention referred to as ‘creeping expropriation’”3 has begun to appear, whereby a “foreign investor is substantially deprived of the use or benefit of their investment even though formal title may continue to vest.”4 This emerging tension is encapsulated in what is known as “resource nationalism.” In essence, resource nationalism broadly refers to governmental “dissatisfaction about the distribution of revenues from mining between company shareholders and the host nation.”5 Even after agreeing with foreign investors about the rights, royalties, taxes, and terms for a mining project, governments subsequently will attempt to renegotiate or even possibly breach their bargain in an effort to extract more control and * Batkhuu Dashnyam is a member of the Class of 2018, at the University of Pittsburgh School of Law.

    Mongolia: The Oyu Tolgoi Copper & Gold Mine Project Comments on Chapter D1 of the ESIA: “Environmental and Social Management Plan Framework” 32 pages, dated 31st July 2012 Prepared by Robert Goodland October 2012 1. The ESIA is about one decade overdue Oyu Tolgoi mine exploration began in 1997. This chapter and elsewhere states that construction is on line to be completed by December 2012 and operations will begin in January 2013. This means construction is 94% complete so practically all the decisions have been taken without having the benefit of the mandatory ESIA. The 2012 ESIA is about one decade late. The ESIA is a design tool process that needs to run in parallel with the Feasibility Study and to feed into the Feasibility Study throughout its often 24 month duration. The ESIA is dated 31st July 2012, which means it could not have fed into the Feasibility Study. The ESIA cannot run retroactively. In some ways even more serious is that not only is the ESIA late in terms of the construction having already taken place, but it also doesn’t include the final information on implementation of operational impacts/management plans, and therefore the operational phase ESIA will also be late. Making the ESIA into a useless sham is consistent with Ivanhoe CEO Robert Friedland’s knowledge of OT’s environment in his claim: "The nice thing about (Oyu Tolgoi) is that there are no people around, the land is flat, there's no tropical jungle, there are no NGOs." (Jan. 21st 2012, The Economist) IFC’s PS1 Para 6 states: The environmental assessment process may recommend alternative (higher or lower) levels or measures, which, if acceptable to IFC, become project- or site-specific requirements.

Along one of the tunnels, a minibus makes its way slowly to a huge cavern. This, a young Australian engineer explains, will house one of the mine’s biggest pieces of equipment — a 300 tonne crushing machine, which will pulverise copper bearing rocks blasted from an ore body the size of central Manhattan. Capable of processing 4,000 tonnes of copper-bearing rock per hour, the machine is a key part of a near $7bn expansion project that will see Oyu Tolgoi emerge as the world’s third largest source of copper by 2027, producing more than 500,000 tonnes a year.     A Review of the Oyu Tolgoi Copper/Gold Mine Environmental and Social Impact Assessment 2012 December 2012 Prepared by: Oyu Tolgoi Watch, Accountability Counsel, Urgewald, CEE Bankwatch, London Mining Network, and Bank Information Center Executive Summary We are an international network of civil society organizations that have been following the development of the Oyu Tolgoi copper/gold mine in southern Mongolia for many years. The mine is classified as a Category A project by the International Finance Corporation (IFC) and the European Bank for Reconstruction and Development (EBRD) because of the significant adverse social and environmental impacts posed by project activities. An Environmental and Social Impact Assessment (ESIA) conducted by Oyu Tolgoi LLC, the Rio Tinto/Turquoise Hill subsidiary that manages the mine, was released in August 2012, as required by the IFC and the EBRD for projects of this nature, after eight months of delay during which time construction of the mine proceeded apace. We have determined that the Oyu Tolgoi project’s ESIA is a non-starter and deeply flawed based on our own research as well as that of expert reviewers. The ESIA does not comply with fundamental provisions of the IFC’s Performance Standards, as it is incomplete and retroactive; lacks a robust risk assessment; ignores the health, safety, and livelihood security of the affected communities; fails to establish the protection of the South Gobi’s scant water resources and biodiversity; and omits critical assessments of cumulative impacts or impacts from associated facilities such as infrastructure, the international airport, or the planned coal-powered plant. Failure to comply with the Performance Standards undermines the development objectives of the project.

Exploration by Ivanhoe Mines has thus far defined total con- tained metal exceeding 92 billion pounds (41.7 million metric tons) of copper and 49.8 million troy ounces (1,549 metric tons) of gold. The deposits are related to multiple intrusions of Late Devonian (~372 Ma) quartz monzodiorite, emplaced within juvenile calc-alkaline basalts that belong to the Gurvansayhan island-arc terrane. The tectonic setting is part of the Central Asian orogenic belt, a zone of arc-continent collision, active from the Silurian to Early Car- boniferous. Porphyry Cu-Au deposits and exploration targets occur along a 26 km-long, north-northeast belt termed the Oyu Tolgoi trend. All deposits are related to phenocryst-crowded quartz monzodiorite intrusions and contorted anastomosing A-type quartz veins. The individual deposits have varied characteristics in regard to host rock, quartz monzodiorite morphology, alteration assemblages, sulfide mineralogy, grade, and Au/Cu ratios. The pre-Carboniferous stratigraphy of Oyu Tolgoi consists of the Oyu Tolgoi sequence, consisting of massive augite basalt, conglomerate, dacitic tuffs, and siltstones, which is overthrust by the Heruga sequence, com- prising basaltic flows, volcaniclastic rocks, and siltstones. Only the lower parts of the Oyu Tolgoi sequence host porphyry mineralization and associated alteration.
