ORDER Sri Mohd Ashraf has filed 2nd appeal dated 18-05-2018 which was received by this Commission on 28-05-2018 for not getting the information sought by him from the Public Information Officer/ O/o the District Tribal Development Officer, Komaram Bheem District at Asifabad and the 1st Appellate Authority/ The District Tribal Development Officer, Komaram Bheem District at Asifabad.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 10-02-2018 before the Public Information Officer requesting to furnish the information under Sec. 6(1) of the RTI Act, 2005TSIC on the following points mentioned:

Stating that the appellant did not get any response from the Public Information Officer, he filed 1st appeal dated 02-04-2018 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

Stating that the appellant did not get any response from the Public Information Officer, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005.

Basing on the material papers available on record, the appeal is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 18-07-2019 at Hyderabad.

The case is called on 18.07.2019. The appellant is absent. Sri Ch. Ravinder/ Asst. Public Information Officer O/o the District Tribal Development Officer, Komaram Bheem District is present.

Heard the Asst. Public Information Officer and perused the records.

On perusal of the material papers available in the case file, it is seen that the Appellant filed 6(1) application under RTI Act, 2005 dated 10-02-2018. There is no record of any information/reply furnished by the then/present Public Information Officer to the Appellant.

Thus, the action of the then/present Public Information Officer is not in accordance with RTI Act. Hence, the then/present Public Information Officer is hereby warned not to repeat such lapses in future in attending the applications filed under RTI Act.

In view of the above, the present Public Information Officer/ O/o the Deputy Director (Tribal Welfare), I.T.D.A., Utnoor, District is directed to furnish the information to the appellant within (7) days from the date of receipt of this order through Registered Post with Acknowledgement Due under intimation to this Commission. The Public Information Officer also directed to submit compliance report to this Commission. Explanation is called for not furnishing the information within the stipulated time.

With the above directions, the Appeal is closed.
