7 In the event of failure of any trees or shrubs, planted in accordance with any scheme approved by the Local Planning Authority, to survive for a period of five years from the date of the completion of implementation of that scheme, such trees or shrubs shall be replaced by the developer with such live specimens of such species in such number as may be approved by the Local Planning Authority.

8 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site until the access to the site have been set out and constructed in accordance with the published Specification of the Highway Authority and the following requirements:

(ii)(c) The crossing of the highway verge and/or footway shall be constructed in accordance with the Standard Detail number E6

The local office of the Highway Authority will also be pleased to provide the detailed constructional specification referred to in this condition.

9 There shall be no access or egress by any vehicles between the highway and the application site (except for the purposes of constructing the initial site access) until splays are provided giving clear visibility of 2.4 metres x 20 metres along the public highway measured along both channel lines of the major road. Visibility splay within the private road shall be the maximum splays that can be achieved. Once created, these visibility areas shall be maintained clear of any obstruction and retained for their intended purpose at all times

2 No development of a phase shall take place without the prior written approval of the Local Planning Authority of all details of the following reserved matters for that phase:-

Thereafter the development of that phase shall not be carried out otherwise that in accordance with the approved details. 3 Prior to the commencement of development a phasing plan setting out the proposed phasing of the construction of the development shall be submitted to and approved in writing by the Local Planning Authority. Thereafter each reserved matters application for a phase submitted pursuant to Condition 2 above shall be accompanied by an updated phasing plan for the approval of the Local Planning Authority. The updated phasing plan shall set out any proposed changes from the phasing plan previously approved pursuant to this Condition. The development shall be carried out in accordance with the phasing plan as approved and updated unless otherwise agreed in writing with the Local Planning Authority or required by other conditions of this permission. For the purposes of this permission all references to a "phase" shall be interpreted as being a reference to a phase as defined on the phasing plan approved pursuant to this condition.

4 The development shall be carried out in substantial accordance with the following approved plan: Scheme Parameters Plan (Drawing No 496A-33G).

5 The development shall not be commenced prior to the substantial completion of all of the dwellings situated within the shaded land on Drawing Reference IL20912-021 REV A pursuant to either planning permission 14/00854/OUTMAJ and the relevant reserved matters approval thereunder in or any such further planning permission(s) and/or reserved matters approvals relating to such land as may be agreed in writing with the Local Planning Authority.

6 The development shall comprise of no more than 135 dwellings.

7 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks within a phase, except for investigative works or the depositing of material on the site for any phase of the development until, the following drawings and details for the phase have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority: (1) Detailed engineering drawings to a scale of not less than 1:500 and based upon an accurate survey showing: (a) the proposed highway layout including the highway boundary (b) dimensions of any carriageway, cycleway, footway, and verges (c) visibility splays (d) the proposed buildings and site layout, including levels (e) accesses and driveways (f) drainage and sewerage system (g) lining and signing (h) traffic calming measures (i) all types of surfacing (including tactiles), kerbing and edging. (3) Full highway construction details including: (a) typical highway cross-sections to scale of not less than 1:50 showing a specification for all the types of construction proposed for carriageways, cycleways and footways/footpaths (b) when requested cross sections at regular intervals along the proposed roads showing the existing and proposed ground levels (c) kerb and edging construction details (d) typical drainage construction details.

(4) Details of the method and means of surface water disposal. (5) Details of all proposed street lighting. (6) Drawings for the proposed new roads and footways/footpaths giving all relevant dimensions for their setting out including reference dimensions to existing features. (7) Full working drawings for any structures which affect or form part of the highway network. (8) A programme for completing the works. (9) Details of an emergency access onto B6161 Otley Road. The development of each phase shall only be carried out in full compliance with the approved drawings and details for that particular phase unless agreed otherwise in writing by the Local Planning Authority in consultation with the Highway Authority. The completion of all road works within a phase shall be in accordance with a programme approved in writing with the Local Planning Authority in consultation with the Highway Authority before any dwelling within that phase is occupied.

8 No dwelling to which this planning permission relates shall be occupied until the carriageway and any footway/footpath from which it gains access is constructed to basecourse macadam level and/or block paved and kerbed and connected to the existing highway network with street lighting installed and in operation.

9 No dwellings shall be occupied until the improvements to the Jenny Field Drive/Ripon Road junction (including the provision of MOVA) have been completed and opened to traffic (subject to any further maintenance period) in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority in consultation with the Highways Authority. The detailed scheme shall be in broad accordance with Drawing No. 14/297/TR/003 Rev A and shall include: a A programme for the completion of the proposed works; and b An independent Stage 2 Safety Audit. The Safety Audit should be carried out in accordance with HD19/03 Road Safety Audit or any superseding regulations. The recommendations in the Stage 2 Road Safety Audit should be implemented thereafter.

10 No dwelling within a phase shall be occupied until the parking facilities which are to serve that dwelling have been constructed in accordance with the relevant reserved matters approval for that phase. Once created these parking areas shall be retained clear of any obstruction and for their intended purpose at all times.

11 No development for any phase of the development shall take place until a Construction Method Statement for that phase has been submitted to, and approved in writing by, the Local Planning Authority. The approved Statement shall be adhered to throughout the construction period for that phase. The statement shall provide for the following in respect of the phase under consideration: i. the parking of vehicles of site operatives and visitors ii. loading and unloading of plant and materials iii. storage of plant and materials used in constructing the development iv. erection and maintenance of security hoarding v. wheel washing facilities vi. measures to control the emission of dust and dirt during construction viii. advisory HGV routing ix the best practice measures to be implemented with respect to construction noise during the construction phase

12 All doors and windows on elevations of the building(s) adjacent to the existing and/or proposed highway shall be constructed and installed such that from the level of the adjacent highway for a height of 2.4 metres they do not open over the public highway and above 2.4 metres no part of an open door or window shall come within 0.5 metres of the carriageway. Any future replacement doors and windows shall also comply with this requirement.

13 No dwellings shall be occupied until the improvements to the A59/B6161 roundabout have been completed and fully opened to traffic (subject to any further maintenance period) in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority in consultation with the Highways Authority. The detailed scheme shall be in broad accordance with drawing 08-168-TR-016 REV B and shall include: a. A programme for the completion of the proposed works; and b. An independent Stage 2 Safety Audit. The Safety Audit should be carried out in accordance with HD19/03 Road Safety Audit or any superseding regulations. The recommendations in the Stage 2 Road Safety Audit should be implemented thereafter.

14 No dwellings shall be occupied until the improvements to the A59/A61 roundabout have been completed and fully opened to traffic (subject to any further maintenance period) in accordance ) in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority in consultation with the Highways Authority. The detailed scheme shall be in broad accordance with Drawing no. 08- 168-TR-015 Rev A and shall include: a. A programme for the completion of the proposed works; and b. An independent Stage 2 Safety Audit. The Safety Audit should be carried out in accordance with HD19/03 Road Safety Audit or any superseding regulations. The recommendations in the Stage 2 Road Safety Audit should be implemented thereafter.

15 Prior to the commencement of any phase of development a detailed Travel Plan for that phase, which finalises the measures to be put in place in accordance with the Framework Travel Plan dated July 2014 shall be submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. The Travel Plan for each respective phase shall be implemented and the development of a phase shall thereafter be carried out and operated in accordance with the approved Travel Plan for that phase.

16 No development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a Strategic Landscape Plan for the areas of landscaping (including the areas of structural tree planting) within the development shown on the Approved Scheme Parameters plan (Drawing No 496A-33G). The Strategic Landscape Plan shall detail the landscape mitigation measures to be provided as part of the Development which are set out in Section 4 of the Randall Thorp Landscape Appraisal (15th July 2014) and such mitigation measures shall accord with the Scheme Parameters Plan (Drawing No 496A-33G). The Strategic Landscape Plan shall also include a programme of implementation which may provide for the phased implementation of the mitigation measures, having regard in particular to the phasing plan approved pursuant to Condition 3. The development shall be carried out in accordance with the approved details.

17 No development shall take place until a surface water drainage strategy for the site based on sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development, has been submitted to and approved in writing by the local planning authority. The drainage strategy should demonstrate the surface water run off generated up to and including the 1 in 100 critical storm will reduce the run off from the undeveloped site following the corresponding rainfall event. The scheme shall subsequently be implemented in accordance with the approved details before the development is completed. The strategy shall also:

Allow for phased development of the site to proceed without compromising the holistic approach to dealing with surface water across the whole site; Include a maximum surface water discharge rate. Include attenuation and long term storage provision to accommodate at least a 1 in 30 year storm. The design should ensure that storm water resulting from a 1 in 100 year event (plus 30% to account for climate change) and drainage system surcharge can be stored on-site without risk to people or property and without overflowing into the watercourse.

Include details of how the strategy shall be maintained and managed after completion.

The development should be designed to incorporate the principles of SuDS for the disposal of surface waters.

18 No piped discharge of surface water from the application site shall take place until works to provide a satisfactory outfall for surface water have been completed in accordance with details to be submitted to and approved in writing by the local planning authority before development commences.

19 No development shall take place within a phase until details of the proposed means of disposal of foul water drainage for that phase, including details of any balancing works and any off-site works which are reasonably necessary in order to facilitate the drainage of foul water from the phase to the 300mm foul sewer in Skipton Road in accordance with the Yorkshire Water letter dated 2nd September 2014, have been submitted to and approved by the local planning authority.

20 Unless otherwise approved in writing by the local planning authority, no buildings within any phase of the development shall be occupied or brought into use prior to completion of the approved foul drainage works for that phase including a foul water connection to the 300mm diameter foul sewer in Skipton Road.

21 The site shall be developed with separate systems of drainage for foul and surface water.

22 Prior to the commencement of development of any phase of the development affecting the 18" water main which crosses the site, the applicant shall agree in writing with the local planning authority, in consultation with Yorkshire Water, details of any water mains diversions. Thereafter the development shall be carried out in accordance with the approved details.

23 Unless otherwise agreed in writing by the local planning authority, no building or other obstruction shall be located over or within 3.0 (three) metres either side of the centre line of the existing 18" water main, which crosses the site or any diverted water main agreed under condition No.22.

24 No new tree planting shall be located over or within 5.0 (five) metres either side of the centre line of the existing water main, which crosses the site or any diverted water main agreed under condition No. 22.

25 Unless otherwise agreed by the Local Planning Authority, development within a specific phase, other than that required to be carried out in the phase as part of an approved scheme of remediation must not commence until sections 1 to 4 have been complied with. If unexpected contamination is found after development of a phase has begun, development within this phase must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until section 4 has been complied with in relation to that contamination.

1. SITE CHARACTERISATION An investigation and risk assessment for each phase of development, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination;

(ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * groundwaters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring each phase of the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme for a particular phase must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme for each phase must be carried out in accordance with its terms prior to the commencement of development of that phase other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development of a particular phase that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken for that phase in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme for that phase must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report for that phase must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section 3.

26 Prior to the commencement of a phase written details shall (to the extent that such information has not already been provided as part of a reserved matters submission) be submitted which demonstrate how the dwellings (including garden areas) within that phase will be protected against noise exposure. The written details shall demonstrate how the measures set out in Section 5.0 of the SLR Noise Assessment dated July 2014 (SLR Ref: 415.01465.00011) have been incorporated into the development of the phase in order to ensure that the requirements of BS 8233:2014 are achieved in respect of internal noise levels and noise levels for external amenity areas which form part of the dwellings.

Following incorporation of the approved sound attenuation measures and before the occupation of a dwelling, a Validation Test of the sound attenuation measures incorporated to protect that dwelling shall be carried out and the results submitted to and approved by the Local Planning Authority (LPA).

The Validation Test for a dwelling shall:

• be carried out by a competent person in accordance with an approved method statement • demonstrate that the required noise levels (BS 8233:2014) have been achieved in accordance with the details submitted pursuant to this condition for the phase within which the dwelling is situated.

If the Validation Test confirms that the required noise levels have not been achieved in respect of a dwelling then a further scheme of sound mitigation measures to protect the dwelling in question, in order to achieve the required noise levels, shall be submitted to the local planning authority for approval. The further scheme of measures to protect the dwelling shall be implemented as approved and suitably validated prior to occupation of the dwelling.

27 Prior to the commencement of the development of a phase details shall be submitted for the written approval of the local planning authority which show the provision to be made at all properties within the phase for the storage and containment of refuse prior to collection and access for collection of refuse. Thereafter the development of the phase shall be carried out in accordance with the approved details.

28 Prior to the commencement of development of each phase the construction dust mitigation measures outlined in section 6.1.1, of the air quality assessment, SLR reference: 415.01465.00011, dated July 2014, shall be implemented on site for that phase unless otherwise agreed by the Local Planning Authority.

29 Prior to any soil being reused within or brought onto the site in respect of a phase of the development, it shall be adequately assessed having regard to, Yahpac Guidance 'Verification Requirements for Cover Systems' with a validation report for the particular phase submitted for approval of the Local Planning Authority to demonstrate that the soil is suitable for use in a residential site.

30 Unless otherwise agreed in writing by the Local Planning Authority any construction works shall be restricted to the following hours; 08:00 to 18:00 Mondays to Fridays 08:00 to 13:00 Saturdays with no work on Sundays or Bank Holidays. 31 The development shall not begin until a scheme for the provision of affordable housing as part of the development has been submitted to and approved in writing by the local planning authority. The affordable housing shall be provided in accordance with the approved scheme and shall meet the definition of affordable housing in Annex 2 of NPPF or any future guidance that replaces it. The scheme shall include: i. the numbers, type, tenure and location on the site of the affordable housing provision to be made which shall consist of not less than 40% of housing units; ii. the timing of the construction of the affordable housing and its phasing in relation to the occupancy of the market housing; iii. the arrangements for the transfer of the affordable housing to an affordable housing provider; iv. the arrangements to ensure that such provision is affordable for both first and subsequent occupiers of the affordable housing; and v. the occupancy criteria to be used for determining the identity of occupiers of the affordable housing and the means by which such occupancy criteria shall be enforced.

32 Reserved matters submitted for landscaping of each phase of the development, shall include details of the planting of trees, hedges and shrubs and the use of hard and soft surfacing materials within the phase shall be submitted to and approved in writing by the local planning authority. Such details shall specify the materials, species, tree and plant sizes, numbers and planting densities, and the timing of implementation of the details, including any earthworks required for the phase. Thereafter development of the phase shall be carried out as approved.

33 In the event of the failure of any trees or shrubs planted in accordance with the approved landscaping scheme for a phase of the development to survive for a period of five years from the date of completion of the scheme; such trees or shrubs shall be replaced by the developer with such live specimens of the same species of that originally planted and in the same location unless otherwise approved in writing by the local planning authority.

34 A comprehensive ecological and landscape management plan, shall be submitted to and approved in writing by the local planning authority prior to the occupation of the first phase of the development. The ecological and landscape plan shall include a geodiversity assessment of the former quarry area of the site (identified on the Scheme Parameters Plan (Drawing No 496A-33G), and long term design objectives, management responsibilities and maintenance schedules for all landscape areas, other than privately owned, domestic gardens and may provide for the phased delivery of the matters addressed therein. The ecological and landscape management plan shall be carried out as approved.

35 No trees identified as supporting bat roost potential in the Ecological Surveys (BSG, March 2014 and July 2014) (including any such trees in the quarry area) shall be removed or have tree surgery undertaken on them until a further tree inspection for bats has been undertaken and submitted for the written approval of the local planning authority. Thereafter the development shall be carried out in accordance with the approved details. 36 A reptile survey of the quarry area identified on the Scheme Parameters Plan (Drawing No 496A-33G), including proposed mitigation, if required, shall be submitted for the written agreement of the local planning authority prior to the commencement of development of any phase which includes works to the quarry area.

37 Should Himalayan balsam (which occurs on the adjacent land (Phase 1) which has the benefit of planning permission 14/00854/OUTMAJ) be discovered on the site, a scheme for the removal of Himalayan balsam shall be submitted for the written approval of the local planning authority prior to the commencement of any works (including access, site investigation, preparation etc.) which may be likely to cause its spread. Thereafter the development shall be carried out in accordance with the approved details.

38 No removal of shrubs or hedges shall be undertaken (for access or any other purposes) during the main birds nesting season (March-August inclusively) unless a survey by a suitably qualified ecologist demonstrates that no actively nesting birds are present.

39 Prior to the commencement of development of any particular phase a detailed Arboricultural Implications Assessment (AIA) for that phase, must be submitted to, and approved in writing by, the LPA. The AIA must consider: a Light loss to the main living rooms of proposed property b Room for developers to implement plans without conflicting on retained trees c Site lines d CCTV site lines e Proposed tree planting and future impacts on the site - right tree in right place f Satellite and solar panel locations g Areas identified for planting and its protection during development (large areas for proposed tree planting will need to be protected from construction traffic and storage in order to retain the soil structure and sustainability).

40 Prior to commencement of each phase of development a Tree Protection Plan (TPP) and Arboricultural Method Statement (AMS), in line with the recommendations of BS5837:2012, for that phase, should be submitted to and approved in writing by the Local Planning Authority. No operations shall commence on site in connection with a particular phase of development (including any demolition work, soil moving, temporary access construction and/or widening or any operations involving the use of motorised vehicles or construction machinery) until such time as the TPP and AMS for that phase has been formally agreed and any root protection scheme for that phase are in place.

41 No development within a phase shall commence until the Local Planning Authority has approved in writing the details of, and arrangements for the setting out of the Public Open Space on-site, including where appropriate, play facilities as part of that phase of the development, such arrangements shall address and contain the following matters:

(i) The delineation and siting of the proposed public open space. (ii) The type and nature of the facilities to be provided within the public open space, including where appropriate the provision of play equipment within a play area, which shall be supplied and installed to a specification as agreed by the local planning authority. (iii) The arrangements to ensure that the Public Open Space is laid out and completed during the course of the development. (iv) The arrangements for the future management and maintenance of the Public Open Space. The open space in a phase shall be completed in accordance with the approved details for that phase as agreed by the local planning authority in accordance with this Condition.

42 Prior to the commencement of any phase of the development hereby approved details of how Secure by Design principles have been incorporated into the design of that phase shall be submitted for the written approval of the local planning authority. Thereafter the development shall be carried out in accordance with the approved details.

43 No development within any phase shall commence until a Design Stage Code for Sustainable Homes Certificate issued by BRE or STROMA for each dwelling type comprised in the phase has been submitted to and approved in writing by the Local Planning Authority. The Code Level to be achieved will be a minimum of Code Level 4.

Thereafter the development shall be carried out in accordance with the approved details.

44 For each dwelling or dwelling type within a particular phase which is assessed pursuant to Condition 43, a Post Construction Stage Certificate shall be provided in writing to the Local Planning Authority. The Post Construction Stage Certificate shall:

(a) confirm that the appropriate Code Level Required by Condition 43 has been achieved in respect of the dwelling or dwelling type; and

(b) be provided to the Local Planning Authority either on a dwelling by dwelling basis prior to the first occupation of the dwelling or, where the Condition 43 assessment relates to dwelling types, prior to the first occupation of any dwelling of that dwelling type which is within the phase .

10 There shall be no access or egress by any vehicles between the highway and the application site (except for the purposes of constructing the initial site access) until splays are provided giving clear visibility of 160 measured along both channel lines of Otley Road from a point measured 4.5 metres down the centre line of the access road. The eye height will be 1.05 metres and the object height shall be 0.6 metres. Once created, these visibility areas shall be maintained clear of any obstruction and retained for their intended purpose at all times.

11 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site in connection with the construction of the access road or building(s) or other works until the details of the proposed footpath/cycle link between the site and the proposed residential development, approved under reference 14/00854/OUTMAJ, have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. Thereafter the approved footpath/cycle link shall be implemented prior to the first use of the development.

12 Unless otherwise approved in writing by the Local Planning Authority, there shall be no excavation or other groundworks, except for investigative works, or the depositing of material on the site in connection with the construction of the access road or building(s) or other works until: (i) The details of the required highway improvement works, listed below, have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. (ii) An independent Stage 2 Safety Audit has been carried out in accordance with HD19/03 - Road Safety Audit or any superseding regulations. (iii) A programme for the completion of the proposed works has been submitted. The required highway improvements shall include: a. Provision of a right turn lane on Otley Road.

13 Unless otherwise approved in writing by the Local Planning Authority in consultation with the Highway Authority, the development shall not be brought into use until the following highway works have been constructed in accordance with the details approved in writing by the Local Planning Authority under condition number 12: a. Provision of a right turn lane on Otley Road.

14 There shall be no access or egress by any vehicles between the highway and the application site until: (i) full technical details relating to the bridging/culverting of the watercourse adjacent to the site have been submitted to, and approved in writing by, the Local Planning Authority in consultation with the Highway Authority; and (ii) The surface water ditch at Otley Road has been piped in accordance with the approved details unless otherwise approved in writing by the Local Planning Authority.

15 There shall be no access or egress by any vehicles between the highway and the application site until details of the precautions to be taken to prevent the deposit of mud, grit and dirt on public highways by vehicles travelling to and from the site have been submitted to and approved in writing by the Local Planning Authority in consultation with the Highway Authority. These facilities shall include the provision of wheel washing facilities where considered necessary by the Local Planning Authority in consultation with the Highway Authority. These precautions shall be made available before any excavation or depositing of material in connection with the construction commences on the site and be kept available and in full working order and used until such time as the Local Planning Authority in consultation with the Highway Authority agrees in writing to their withdrawal.

16 Unless approved otherwise in writing by the Local Planning Authority there shall be no establishment of a site compound, site clearance, demolition, excavation or depositing of material in connection with the construction on the site until proposals have been submitted to and approved in writing by the Local Planning Authority for the provision of: (i) on-site parking capable of accommodating all staff and sub-contractors vehicles clear of the public highway (ii) on-site materials storage area capable of accommodating all materials required for the operation of the site. The approved areas shall be kept available for their intended use at all times that construction works are in operation.

17 A detailed scheme for landscaping, including the planting of trees and or shrubs and the use of surface materials shall be submitted to the Local Planning Authority and no development shall take place until the Local Planning Authority have approved a landscaping scheme; such scheme shall specify materials, species, tree and plant sizes, numbers and planting densities, and the timing of implementation of the scheme, including any earthworks required.

18 In the event of failure of any trees or shrubs, planted in accordance with any scheme approved by the Local Planning Authority, to survive for a period of five years from the date of the completion of implementation of that scheme, such trees or shrubs shall be replaced by the developer with such live specimens of such species in such number as may be approved by the Local Planning Authority.

19 No removal of shrubs or hedges shall be undertaken (for access or any other purposes) without the written approval of the local planning authority. No hedgerow shall be removed during the main birds nesting season (March-August inclusively) unless a survey by a suitably qualified ecologist demonstrates that no actively nesting birds are present.

20 Further surveys shall be undertaken for water voles and for Himalayan balsam at an appropriate time of year and the results submitted for the written approval of the LPA prior to the commencement of any works including for access and site investigation.

21 Unless otherwise agreed by the Local Planning Authority, development other than that required to be carried out as part of an approved scheme of remediation must not commence until sections 1 to 4 have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until section 4 has been complied with in relation to that contamination.

1. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination;

(ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * groundwaters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority in accordance with section 3.

1. SITE CHARACTERISATION An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include:

(i) a survey of the extent, scale and nature of contamination;

(ii) an assessment of the potential risks to: * human health, * property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, * adjoining land, * ground waters and surface waters * ecological systems * archaeological sites and ancient monuments;

(iii) an appraisal of remedial options, and proposal of the preferred option(s).

This must be conducted in accordance with DEFRA and the Environment Agency's 'Model Procedures for the Management of Land Contamination, CLR 11'.

2. SUBMISSION OF REMEDIATION SCHEME A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.

3. IMPLEMENTATION OF APPROVED REMEDIATION SCHEME The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise approved in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works.

Following completion of measures identified in the approved remediation scheme, a verification report that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority.

4. REPORTING OF UNEXPECTED CONTAMINATION In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirement of section 1, and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of section 2, which is subject to the approval in writing of the Local Planning Authority.

4 A scheme for the integration of bat roosting opportunities into the new bridge shall be submitted for the written approval of the local planning authority prior to the commencement of works.

INFORMATIVES

1. No works are to be undertaken which will create an obstruction, either permanent or temporary, to the Public Right of Way adjacent to the proposed development.

Applicants are advised to contact the County Council's Access and Public Rights of team at County Hall, Northallerton via [email protected] to obtain up-to-date information regarding the line of the route of the way. The applicant should discuss with the Highway Authority any proposals for altering the route.

In addition to the above information, we would like to add that we would welcome a bridge at this location. However we would like to express our disappointment that the planned bridge does not consider access for equestrian or bicycle usage as there is a bridleway in the same area. We would also like to express our concern with regards to the bridge design including steps at either end. This does not give much consideration to less able users. 2. The formal consent of the Agency will be required under the Water Resources Act 1991, for any works in, over, under the River Wharfe (which is classified as a main river) or within 8m of the top of bank/toe of a defence, under the Yorkshire Byelaws.

3. Recent EA fisheries surveys have found Salmon Parr below Otley weir (Leeds), but non above. This clearly demonstrates that this weir is a significant barrier to migrating fish. As part of the development of the old Garnett's paper mill, a new fish pass is to be built at Otley which will allow upstream passage to the next weir at Burley.

It is vital that the weir at Burley has a fish pass installed to allow further upstream migration to the headwaters of the River Wharfe to allow the Salmon and Trout to spawn. Working in partnership with the new footbridge project could yield construction savings and expand this project into something that is more than just 'people access'.

The provision of multi-species fish passage in this location would accord with the aims and objectives of national planning policy as set out in the National Planning Policy Framework (NPPF) and the Natural Environment and Rural Communities Act 2006. It would provide a net gain to biodiversity and help restore a coherent ecological network with the River Wharfe. Reconnecting fish passage will make the ecology of the River Wharfe more resilient to current and future pressures, including climate change.

The NPPF paragraphs 109 recognises that the planning system should aim to conserve and enhance biodiversity, the natural and local environment by minimising impacts on biodiversity and providing for net gains in biodiversity where possible. Paragraph 118 of the NPPF also states that opportunities to incorporate biodiversity in and around developments should be encouraged. Making the weir passable to fish would restore the longitudinal connectivity of the river corridor, enabling natural fish movements to take place along the river in line with NPPF.
