Dear Mr. Finch,

I am to refer to the above referenced application for a waste water discharge licence relating to agglomeration named Malahide and to thank you for submitting the necessary information which has enabled the Agency to confirm that the application complies with the requirements of Regulation 15 & 16 of the Waste Water Discharge (Authorisation) Regulations 2007. The stage has now been reached where the Agency is giving detailed consideration to the application and to complete this task the following information, particulars and evidence are required in accordance with Regulation 20( 1) of the Regulations.

REGULATION 20(1) - FURTHER INFORMATION, PARTICULARS AND EVIDENCE

1. Specify the design standards for the following parameters: BOD, COD, total suspended solids, phosphorus, dissolved inorganic nitrogen, ammonia and total nitrogen for the Malahide waste water treatment plant (WWTP). Provide an assessment of the impact of the current discharge from Malahide WWTP, using achievable effluent quality standards having regard to the European Communities Environmental Objectives (Surface Waters) Regulations 2009 (S.I. No. 272 of 2009). The findings of hydrodynamic dispersion modelling studies may be used in this regard. The assessment shall consider other discharges to the Estuary and shall include an assessment of the impact of the discharge on indigenous fish species and also migratory fish species which pass through the Estuary en route to the Ward and Broadmeadow Rivers.

Provide an update on the status of improvements works as part of the Malahide Foul Drainage Upgrade Scheme including the installation of a new gravity main to relieve the overflows which are acting as secondary discharges in the town and the investigation of the network to propose a solution to the overflows acting as secondary discharges in the Kinsealy Lane area.

3. Urban Waste Water Treatment Regulation compliance data for 2008, supplied by the Office of Environmental Enforcement, indicates that the plant is failing to achieve compliance with the limit for suspended solids (35mg/l) with results ranging from lOmg/l to 110mg/l recorded during 2008. Please comment on the measures implemented or proposed (with timescales) in order to maintain compliance with UWWT Regulations 2001 and 2004.

4. Provide any additional environmental monitoring information which has been obtained but not previously forwarded to the Agency as part of the application. An assessment of the results should also be provided.

In the case where any drawings already submitted are subject to revision consequent on this request for further information, a revised drawing should be prepared in each case. It is not sufficient to annotate the original drawing with a textual correction. Where such revised drawings are submitted, provide a list of drawing titles, drawing numbers and revision status, which correlates the revised drawings with the superseded versions.

Your reply to this notice should include a revised non-technical summary which reflects the further information you supply in compliance with the notice, insofar as that information impinges on the relevant non-technical summary.

Please supply the information in the form of a one original plus one copy within one month of the date of this notice. In addition please submit two copies of the requested information in electronic searchable PDF format on a CD-ROM to the Agency. Please note that all mapddrawings should not exceed A3 in size.

In the event that you are not in a position to submit the above information to the Agency within the one month period, please revert to the Apency before the expiry of the one month period, requestinp an additional period, not exceeding 3 months, under Regulation 20(2)(c), within which to submit the necessary information.
