AN ACT TO REPEAL AND RE-ENACT SECTIONS $1105 OF CHAPTER 1, TITLE 2, AND $5101 OF CHAPTER 5, TITLE 3, AND $6103 OF CHAPTER 6, TITLE 3, OF THE GUAM CODE ANNOTATED AND TO AMEND SECTIONS $7105 OF CHAPTER 7, TITLE 3, AND $16301 (e) ARTICLE 3 OF CHAPTER 16, TITLE 3, OF THE GUAM CODE ANNOTATED, RELATIVE TO AMENDING THE TERM OF OFFICE FROM TWO YEARS TO FOUR YEARS AND TO PROVIDE FOR STAGGERED TERMS FOR MEMBERS OF THE GUAM LEGISLATURE.

A public hearing was conducted by the Committee on Rules, Natural Resources & Federal, Foreign and Micronesian Affairs in the Legislature's Public Hearing Room on April 16, 2009 on Bill No. 049 (COR). Committee Chairperson Senator Rory J. Respicio called the hearing to order at 9 a.m.

Oral testimony was presented by Mr. Julian Janssen who said that Bill No. 049 (COR) was not a good idea. He favored extending Senatorial terms to four years but opposed staggered terms for members of the Legislature. He suggested instead that a constitution for Guam would be a better approach.

Mr. Janssen said that staggering the terms of Senators, with eight being selected during Gubernatorial election years and seven being selected in the off years, would result in a drop-off of public interest during off-year elections, especially since fewer seats would be available. Mr. Janssen also suggested moving from at-large elections to district elections.

Sen. Guthertz said that districting was tried in the past and struck down by the court because one-man, one-vote didn't work. She noted problems in district elections for the former Territorial Board of Education. She said that the population shifts frequently, and that it would always be difficult to accurately pinpoint village representation.

Sen. Guthertz said she was delegate to Guam's Constitutional Convention and that one of the proposals for the constitution, which came from the late Dr. Antonio Yamashita, was to do what Bill No. 049 (COR) would do. The main idea was to divert attention of Senators from elections to public policy. Sen. Guthertz acknowledged the difficulty in facing elections every other year. She said that the bill could help in shifting the focus of the government to one that was more long-term, because elections every two years is too short for long range planning. Sen. Guthertz disagreed with Janssen's claim that having just seven seats in an election was a disincentive to voters. She said that there was always a lot of interest even in non-gubernatorial election years.

Sen. Aguon complemented Mr. Janssen for speaking out, and said that extending terms makes a lot of sense, but for those not sitting in the position it might not always make sense. He said that the Governor, Lieutenant Governor, Public Auditor and Attorney General all served four year terms. Mayors and Vice Mayors also serve four years, so perhaps senators should as well.

He said that Senators would have to decide if the public should decide the issue or if the Senators themselves should do it. Sen. Aguon pointed out that Guam's voter turnout is double the turnout across the country. People of Guam take politics seriously, so there should be no concern with a disincentive to voters.

Sen. Palacios commented that he shared the observation of the Bill's author about the concentration of work in the first year of the term is the nature of every elective position, especially those running for re-election. He said this didn't mean that people cannot work during election years, But it was the nature of the competition and there are so many distractions when running for office. He said he was in support of extending terms because he is generally in support of three years of concentrated time working on issues.

Mr. Janssen said he agreed in extending the term of office but didn't agree in staggering terms.

There being no further testimony presented, Chairperson Respicio declared Bill No. 049 (COR) was publicly heard and that written and electronic testimony would be accepted for ten working days following the hearing.

FINDINGS: The Committee on Rules, Natural Resources and Federal, Foreign & Micronesian Affairs finds that it agrees that a constitution for Guam defining the terms for members of the Legislature would be the best solution to lengthen Senatorial terms, but it is a long-term solution and cannot be addressed by local legislation.

The Committee disagrees that having only seven Senatorial seats available in an off-year election would result in a large drop-off in public interest. There is a generally high turnout of Guam voters even in off-year elections, and because Mayors and Vice Mayors are also elected in off-years, public interest continues to be high. RECOMMENDATION: The Committee on Rules, Natural Resources and Federal, Foreign & Micronesian Affairs recommends the following amendment to Bill No. 049 (COR):

1. Implementation of the provisions of Bill No. 049 (COR) shall commence with the General Election of 2012 instead of 2010, to prevent Senators from possibly extending their own terms in office.

The Committee on Rules, Natural Resources and Federal, Foreign & Micronesian Affairs hereby reports out Bill No. 049 (COR) with the recommendation to do pass as amended.

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. I Liheslaturan Guahan finds that four-year terms allow

3 Senators time for essential legislative work, without reelection in a short

4 two years. Instead of working to raise election funds every two years,

5 Senators in four-year terms may concentrate on Legislative work. Longer

6 terms allow senators to take responsibility for measures over time, making

7 senators largely independent of special interests. Concerning the public,

8 voters will still have the ability to vote for elected officials every two years

9 due to the constitutional casting of lots. Staggered terms every two even

1 0 years for seven or eight Senatorial positions will create more candidates

11 that run for Legislative office.

1 1 It is, therefore, the intent of I Liheslatura to amend the terms of

2 Senatorial office from two years to four years and to provide for staggered

3 terms for members of the Guam Legislature.

4 Section 2. § 1105 of Chapter 1, Title 2, Guam Code Annotated is

5 repealed and re-enacted to read:

6 "§ 1105. Senators, Terms of.

7 (a) Pursuant to Section 10 (d) of the Organic Act of Guam, the

8 general election for the office of Senator of the Guam Legislature shall

9 be held in even-numbered years on the Tuesday next after the first

10 Monday in November.

11 (b) In the general election of 2012, fifteen (15) persons shall be

12 elected Senators to the Guam Legislature. Of that number eight (8)

13 shall be elected to a term of four years, the term to commence at 10

14 a.m. on the first Monday in January of 2013 and to end at 9:59 a.m. on

15 the first Monday in January 2017. The other seven (7) persons elected

16 Senator shall serve a term of two years, the term to commence at 10

17 a.m. on the first Monday in January of 2013 and to end at 9:59a.m. on

18 the first Monday in January of 2015.

19 (c) Commencing in 2012 and continuing every four years

20 thereafter eight (8) persons shall be elected to a term of four years as

21 Senators of the Guam Legislature, the term to commence at 10 a.m.

2 1 on the first Monday in January following the election and continuing

2 until 9:59 a.m. of the first Monday in January four years after the

3 election. The decision of which persons shall serve terms of two years

4 shall be as provided by § 5101 Chapter 5 Title 3 of the Guam Code

5 Annotated.

6 (d) Commencing in 2014 and continuing every four years

7 thereafter seven (7) persons shall be elected to a term of four years as

8 Senators of the Guam Legislature, the term to commence at 10 a.m.

9 on the first Monday in January following the election and continuing

10 until 9:59 a.m. of the first Monday in January four years after the

11 election."

12 Section 3. § 5101 of Chapter 5, Title 3, Guam Code Annotated is

1 3 repealed and re-enacted to read:

14 "§ 5101 General Elections for Legislature.

15 (a) General Election for the Guam Legislature shall be held on

16 Tuesday next after the first Monday in November every two years in

1 7 even-numbered years. In 2012, eight (8) persons shall be elected to a

18 term of four years and seven (7) persons shall be elected to a term of

19 two years. In 2014 and every fourth year thereafter seven (7) persons

20 shall be elected to a term of four years and in 2016 and every fourth

21 year thereafter eight (8) persons shall be elected to a term of four

3 1 years. (b) Within ten (10) days of the declaration of the results of the

2 election for the Legislature in 2012, the Commission shall choose by

3 lot in the same fashion by which ballot placement is determined, the

4 eight (8) persons elected to terms of four years and the seven (7)

5 persons elected to terms of two years. Any person who is successful

6 in contesting the declaration of any person shall serve the same term

7 as would have been served by the first person declared elected by the

8 Commission."

9 Section 4. § 6103 of Chapter 6, Title 3, Guam Code Annotated is

1 0 repealed and re-enacted to read:

11 ''§ 6103 Terms of Office.

12 In 2012 eight (8) persons elected to the Legislature shall serve a

1 3 term of four years and seven (7) persons shall serve a term of two

14 years. In 2014 and every fourth year thereafter seven (7) persons shall

15 be elected to a term of four years and in 2016 and every fourth year

16 thereafter eight (8) persons shall be elected to a term of four years."

17 Section 5. § 7105 of Chapter 7, Title 3, Guam Code Annotated is

1 8 amended to read:

19 "§ 7105 Order of Names on Ballot- Legislature.

20 The Commission shall prepare the ballot in such a manner that

21 a nominee's name shall appear under the name of the ,

4 1 if any, sponsoring such nominee.

2 In all elections, the names of all nominees or candidates for a

3 specific office shall be listed in a random manner. Each contestant for

4 any office under a party or independent designation shall be listed

5 according to lot drawn by the Election Commission. All drawings for

6 ballot position shall be done publicly and persons appearing on the

7 ballot shall be specifically invited to attend. The drawings for ballot

8 placement shall be accomplished as soon as is reasonably possible

9 after the identity of the persons to appear on the ballot is known to

1 0 the Election Commission.

11 The names of the nominees shall appear in columns vertically

1 2 in such order as is determined by lot.

13 Columns for recognized political parties shall be listed on the

14 basis of the number of [nominees elected to] seats held in the

15 Legislature [at the last preceding regular general] as of October 1 in

16 the year of the election in descending order from left to right; last

1 7 shall appear the names of those nominees not sponsored by any

18 political party, which shall appear under the designation

19 "Independent". The names of all nominees holding the office for

20 which they are seeking election shall have the word INCUMBENT

21 printed immediately after them."

5 1 Section 6. § 16301 (e) of Chapter 16, Title 3, of the Guam Code

2 Annotated is repealed and re-enacted to read:

3 11 § 16301 Form of Primary Election Ballot (e).

4 The ballot shall be divided so that the party holding the

5 greatest number of seats in the Legislature as of August 1 in the year

6 of the election shall appear first on the left on the ballot below the

7 words, in bold face type, " PARTY PRIMARY CANDIDATES";

8 The ballot for each office for which party nominations are

9 sought shall contain instructions to the voters as to the maximum

1 0 number of candidates that may be selected for that office; that party's

11 candidates for nomination for each office shall be listed on the ballot

12 in random order in a manner similar to that established for General

13 Election Ballot listing and placement;"

25 Section 4. §6103 of Chapter 6, Title 3, Guam Code Annotated is 26 repealed and re-enacted to read: 27 "§6103 Terms of Office.

3 1 In 2010 eight (8) persons elected to the Legislature shall serve a

2 term of four years and seven (7) persons shall serve a term of two 3 years. In 2012 and every fourth year thereafter seven (7) persons shall

4 be elected to a term of four years and in 2014 and every fourth year 5 thereafter eight (8) persons shall be elected to a term of four years." 6 Section 5. § 7105 of Chapter 7, Title 3, Guam Code Annotated is

7 amended to read: 8 "§71 05 Order of Names on Ballot - Legislature. 9 The Commission shall prepare the ballot in such a manner that

10 a nominee's name shall appear under the name of the political party, if 11 any, sponsoring such nominee.
