Kennedy Building 950 Pennsylvania Ave, NW Washington, DC 20530 Dear Attomey General Holder, I write to request that the Department of Justice review election inegularities during the 2010 general election on Guam that have been raised by the Democratic Party of Guam. The Democratic Party of Guam seeks to address complaints made by Guam voters who contend that they were disenfranchised during the voting process in violation of Guam law. I also urge a review of whether any federal voting rights laws were systematically violated during the electoral process on Guam. On April 12,2012, the Dernocratic Party of Guam formally requested that I work with the relevant federal officials to address the allegations of ballot tally inconsistencies and to address other specific concerns that are outlined in Cuam Democratic Party Resolution No. 03-20l2.The resolution states that registered voters were improperly purged from the election registry. Further, the Party raises concems that the security of the ballots may have been compromised. These allegations, among others, are contained in Resolution03-2012. A copy of the resolution is enclosed for your reference. I am also concerned that the votes of several U.S. servicemembers who were serving off-island were only counted for the federal election (the non-voting Delegate to Congress) but not for the local offices (Covernor and Legislature). Prior to Guam's general election, the U.S. District Court of Guam ruled (Civil Case No. 10-00025) that the Guam Election Commission (GEC) was in violation of the Uniformed and Overseas Citizens Absentee Voting Act of 1986. The Court found that the GEC did not mail out absentee ballots and informational packets within the timeframe required by statute. The Court ordered the GEC to extend the deadline by trvo weeks for receipt of absentee ballots cast on or prior to the general election date. While I recognize that the District Court only has jurisdiction over federal elections and could only order the GEC to extend the deadline for the Cuam Delegate race, I am concerned that votes of several U.S. servicemembers serving abroad were counted for a federal race, but the same ballots were not counted for the tocal offices. Holder May 1,2012 Page2 of2 The Democratic Party of Guam's concerns and the concems raised in their resolution should be reviewed to ensure that Guam voters were not disenfranchised during 2010 election. It is in the interest of the people of Guam that concerns raised by a major political party regarding election irregularities should be addressed. I appreciate your consideration of this matter.
