2. APPROVAL OF MINUTES OF MEETING HELD ON TUESDAY 3 DECEMBER 2013

The minutes of the meeting held on Tuesday 3 December 2013 were approved on the motion of Mr G Malcolmson and seconded by Mr G Feather.

3. MATTERS ARISING FROM THE PREVIOUS MINUTES

. Coastal Erosion at Mail, Cunningsburgh

Andrew Nicolson explained the urgency of the coastal erosion issue at Mail. The windy weather and high seas are damaging the coastline at an alarming rate and it is estimated that since a metre of coast disappeared in the December 2012 winter storms. Two feet of land remains between the coast and the garden wall of the Old Manse. The Old Manse and the former Church Hall are both listed buildings. Mrs Clark to confirm if listed buildings are entitled to any grant assistance relevant to coastal erosion.

Mrs Clark read an email dated 20 December 2013 from Councillor Billy Fox. The letter states that the SIC do not have a statutory obligation to protect private property from coastal erosion.

Mrs Clark to contact Tavish Scott MSP and Alastair Carmichael MP. Andrew Nicolson to seek advice from a specialist contractor.

. Bad Weather Contingency Plan – awaiting draft plan

An email dated 21 January 2014 from Councillor Cecil Smith was read and noted. Mrs Clark to contact Maggie Sandison, Interim Executive Director of Infrastructure Services.

. Gulberwick School Transport – awaiting feedback on pick up points

An email dated 11 December 2013 from Neil Hutcheson, Roads, was read and noted. Mrs Clark awaiting information from Elaine Park, Transport, regarding pick up points on the Shurton road.

. SIC Roads Improvements List – awaiting priority list of improvements from Roads

Nothing to report. Mrs Clark to contact Maggie Sandison, Interim Executive Director of Infrastructure Services.

. Signage at Gulberwick Junctions – awaiting junction sign to be replaced

Mrs Clark advised members that an accident record at the junction would be a ’technical justification’. Mrs Clark also advised that Colin Gair had confirmed that the junction sign had been ordered and should be in place in March 2014.

. Vacancy for Cunningsburgh

It was noted that the next by-election is in March 2014. Mrs Clark to encourage residents to join the Community Council.

. Grit Piles

It was noted that the grit piles had been delivered to Stunken Brae. Mrs Clark to receive confirmation that the grit has been delivered to the old Quarff School Brae.

. Speed Limit at North Gulberwick Junction

Mrs Clark verbally reported that she had spoken to Colin Gair, Roads, regarding the proposed extension of the speed limit at the North Gulberwick junction. He confirmed that the traffic counters are due to be placed in the Spring to monitor traffic numbers. Mrs Clark to request the results.

. Speed Limit Extension at Vestinore, Cunningsburgh

It was noted that there is a speeding issue at the south end of Cunningsburgh. Mrs Clark to request traffic counters in this area.

4. POLICE REPORT

An email dated 21 January 2014 from PC Ian Brown was read and noted. Since the last meeting there had been 72 incidents in the and 11 in the Gulberwick, Quarff & Cunningsburgh areas. Two of which have been reported to the Procurator Fiscal.

Councillor Duncan took this opportunity to advise members of the staff shortage within the police force in Shetland. There are 37 posts in Shetland but 10 of these are currently vacant. He also advised that is very likely that the Police Stations on the isles of , Yell and will close.

5. FINANCE

Mrs Clark verbally reported on the finances of the Community Council. The bank balance at 21 January 2014 was £7,319.10. However, there are unpresented cheques to the total of £1450 to take into consideration.

6. APPLICATIONS FOR GRANTS

There were no applications for grants.

7. PLANNING

a) An application by Mr & Mrs IT Fullerton to demolish an existing croft house and erect a new dwellinghouse at Fladdabister, Cunningsburgh, is pending consideration. b) An application by Mrs W Hunter to install a concrete external access ramp at Hillhead, Easter Quarff, is pending decision.

c) An application by Mr R Watt to erect a double garage at South Brae, Quarff, is pending consideration.

No comments were received. Mrs Clark to feed back accordingly.

8. REFRESH OF THE BLUEPRINT UPDATE

Councillor Duncan advised members that three meetings are due to take place as part of the consultation process. These meetings are as follows:

Sandwick Parent Council – Thursday 30 January 2014 7-9pm Parent Council – Monday 3 February 2014 7-9pm Cunningsburgh Parent Council – Wednesday 5 February 2014 7-9pm

9. SHETLAND FIRE PLAN CONSULTATION MEETING

An email dated 2 January 2014 and a letter dated 19 December 2013 from the Scottish Fire and rescue Service had been circulated to members. The consultation period Local Fire and Rescue Plan for Shetland Islands 2014-2017 ends on 14 February 2014. As part of the consultation there have been well attended public meetings in fire stations across Shetland. The next meeting is in Sandwick on Thursday 24 January at 7pm.

10. AMENDMENT TO COMMUNITY COUNCIL CONSTITUTION – LOCAL ELECTION RULES*

An email dated 17 December 2013 from Anne Cogle, Team Leader – Administration, SIC, had been circulated to members. Members unanimously agreed to adopt the following:

The Community Council adopts the amendments to Sections 5.1 and 5.7 of the Constitution. The revised Sections read as follows:

5.1 Elections to the Community Council shall be held in accordance with the agreed local election rules.

5.7 Apart from casual vacancies occurring within six months of the last day of office of the Community Council, which shall not be filled until the next ordinary election of the Community Council, the Returning Officer, in consultation with the Clerk, shall arrange for a by-election to take place. The by-election procedures shall be in accordance with the agreed Local Election Rules

Chairperson signed the attached form for Mrs Clark to return to Administration.

11. PROPOSED NATIONAL PLANNING FRAMEWORK 3 AND SCOTTISH PLANNING POLICY

An email dated 14 January 2014 from the Scottish Government had been circulated to members and was noted.

12 RESIGNATION OF CLERK

A letter dated 10 January 2014 from Mrs Clark had previously been circulated to members.

Members warmly thanked Mrs Clark for her contribution to the Community Council. She has provided exemplary admin support and her cheerful presence will be missed.

Members agreed that Mrs Clark should continue in post until the current accounts have been audited and the Annual Report completed. It would be useful for the replacement Clerk to shadow Mrs Clark for a few meetings to familiarise themselves with the duties involved.

. Letters of Thanks

An email dated 4 January 2014 from Maurice Mullay of Gulberwick Together was read and noted.

A card dated 14 December 2014 from Andrew Harmsworth of the Wester Quarff Residents was read and noted.

. Review of Traffic Warden Service Provision

A letter dated 24 December 2014 from Wayne Mawson, Assistant Chief Constable, Police , was read and noted. The letter confirms that the role of Traffic Warden has been removed.

. Bus Shelter Request

A letter dated January 2014 from a Gulberwick resident was read and noted. A bus shelter is requested for the top of Shurton Brae for children to wait for the school bus. Councillor Duncan took copies of the letter to pass on to the relevant departments of the SIC.

. Speed Limit at North Gulberwick Junction

Gulberwick Together has been made aware that, at the request of the Community Council, the SIC are considering moving the 40mph speed limit to include the bus stop at the former Observatory housing development. Gulberwick Together members would like to see the North junction included in this change which is approximately 30 yards further than intended. Mrs Clark to contact Roads.

13. DATE OF NEXT MEETING

The next meeting will be held on Tuesday 25 February 2014. The meeting will be held at 7.30pm in the Cunningsburgh School.

You may be aware that the two buildings I mentioned are in an area being affected by coastal erosion. Can you tell me if this will have any effect on the listed status or if there is any help available to owners of listed properties to protect against this type of threat?

I imagine their listed status might be reviewed if one or other were to be damaged such that their historic or architectural value were to be seriously impaired, especially if it appeared likely sympathetic repairs might not be undertaken; Historic Scotland is responsible for listing survey so anyone with concerns could contact that body if that were to happen. There are no longer any grants for listed buildings or coast protection; both grant schemes were cancelled a year or two ago.

At a recent meeting of the Community Council the urgency of the coastal erosion issue at Mail, Cunningsburgh, was highlighted to members.

The recent windy weather and high seas are damaging the coastline at an alarming rate and it is estimated that since 1991 a metre of coast has disappeared. Two feet of land remains between the coast and the garden wall of the Old Manse. The Old Manse and the former Church Hall are both listed buildings.

Information from Councillor Billy Fox confirms that the Shetland Islands Council has no statutory obligation to protect private property from coastal erosion.

However, it was hoped that alternative funding could be sought to avoid the loss of these listed buildings. Are you in a position to help or offer any advice to the residents of the properties affected?

I have written to the councillors from the South Mainland and to those representing Lerwick South concerning the dangerous junction at the Black Gaet. George Smith suggested I should also bring my concerns to you.

My family were involved in the latest accident on Tuesday and their friend Elizabeth Mitchell sustained an accident last year. There have been many more.

I wonder if there is anything which can be done by the SIC or the Police to make this notorious black spot safer? There are so many commuters from the South Mainland who travel to Lerwick every working day and who are at risk.

Hi George

At the time of our meeting on 24 January Colin noted that we did not have the most recent data from the Police. This has now been addressed and the most up to date information regarding accidents on Shetland roads has now been obtained. However this data unfortunately contained errors that has corrupted our database which Colin in currently in the process of sorting out, but is a time consuming process. As soon as this has been completed it is our intention to undertake a full study of the data and the junction with regard to accident trends and any possible engineering solutions that might mitigate these. We will report back as soon as this has been completed.

Dear Community Councillors Proposed Farm Shop & Café in Cunningsburgh We have recently submitted plans to the SIC’s planning department for their consideration of a Farm Shop & Café in Cunningsburgh. Prior to this our architect asked for pre-planning advice. Planning comments were quite positive but roads comments are quite a different matter. They, rightly so, have issues about traffic turning off and onto the main A970. We will endeavour to work with roads to find a suitable solution.

Cunningsburgh has been without a shop for nearly a year now and in our opinion is the worse for it. We need a local point or 'hub' for daily shopping, food and social interaction. We have included a Café as we are quite sure a 'new' local shop cannot be sustainable without it. Also the point needs to be made that there is nowhere to sit down and eat in the South Mainland from Lerwick to Sumburgh Hotel/Airport (unless you leave the main road Warp & Weft which is seasonal and the Spiggie Hotel).

We must stress that our shop is a Farm Shop - there is no dedicated Farm Shop in Shetland. While we will be supplying daily provisions such as milk, bread, eggs, papers, etc. it is our idea to build a shop to sell locally produced meat, (from the new Shetland Abattoir) fish & shell fish, cheese, milk, jams/preserves, bread, eggs, vegetables, fruit, etc. plus goods produced by other like-minded individuals/businesses. We will be employing several staff both full and part time.

We hope to grow the business to have gifts and Shetland produced items. There are 2 units to let/rent in our proposed building and we already have a tenant for one of these.

This project is not going to happen overnight as there is funding to source but we are working on it.

Shetland LEADER Programme 2014-2020

As you may be aware the current LEADER Programme 2008-2013 is now closed. The Programme awarded £2 million of EU and Scottish Government funding to 62 rural community projects throughout Shetland.

We are holding a series of workshops across Shetland to gather information and ideas which we will feed into the next LEADER programme which is due to start next year.

The workshops will take place from 6.30-8.30pm in the following venues:

Levenwick Hall – 19 February Sellafirth Hall, Yell – 20 February Bridge End Hall, Burra – 26 February Bixter Hall – 6 March Voe Hall – 12 March Staney Hill Hall, Lerwick – 13 March

The halls will be open from 5pm to provide an opportunity for participants to meet LEADER partner organisations from both the public and voluntary sectors.

Members of the public are encouraged to attend to identify issues in their local area and share ideas for potential projects which improve life in Shetland. Public input into the approach to be taken at this early stage is essential as it will guide the kind of community projects which are supported through the 2014-2020 Programme

Light refreshments will be provided.

We hope that you will be able to attend. If you are unable to attend the event in your local area then please feel free to attend any other venue.
