SAFEGUARDING THE ENEMY WITHIN: THE NEED FOR PROCEDURAL PROTECTIONS FOR U.S. CITIZENS DETAINED AS ENEMY COMBATANTS UNDER EX PARTE QUIRIN Thomas J. Lepri* INTRODUCTION On September 11, 2001, terrorist attacks took the lives of more than 3,000 people in New York City, Washington, D.C., and rural Pennsylvania.' The federal government reacted swiftly. On September 18, Congress authorized President George W. Bush "to use all necessary and appropriate force against those nations, organizations, or persons he determine[d] planned, authorized, committed, or aided the terrorist attacks. ' '2 Two months later, President Bush issued a military order authorizing the creation of military tribunals to try non-U.S. citizens who belonged to the al Qaeda terrorist group and "engaged in, aided or abetted, or conspired to commit" certain acts of terrorism against the United States.' Both the military order and the September 18 Congressional Authorization were designed with an eye toward the war in Afghanistan. At the same time, law enforcement officials were forced to deal with domestic threats that lacked precedent in recent history. In response to these threats, a "parallel system" of justice has developed wherein the government has claimed the authority to detain indefinitely individuals suspected of terrorist activity, including U.S. citizens, as "enemy combatants. '4 The most visible application of this doctrine thus far has been the case of Jose Padilla.5 In early May 2002, the FBI arrested Padilla in * J.D. Candidate, 2004, Fordham University School of Law. The rough outlines of Padilla's life are well known by now. An American citizen, Padilla was born in Brooklyn, New York, and moved to Chicago with his family when he was four years old.7 While some neighbors knew him as "Pucho," an affable child and good student,' he became familiar to Chicago law enforcement authorities in the 1980s as a local gang member, according to government officials.9 In 1983, when Padilla was twelve years old, a jury convicted him of murder in Chicago."' He was imprisoned until his eighteenth birthday." In 1991, he went to prison in Florida on charges of aggravated assault and firing a handgun. 2 After his release, he began referring to himself as Ibrahim Padilla and moved to Egypt. 3 His 4 mother reportedly feared he had joined a cult. According to the government, Padilla afterwards traveled to Pakistan, Saudi Arabia, and Afghanistan." In Afghanistan in 2001, he met with al Qaeda lieutenant Abu Zubaydah, with whom he developed a plan to build and detonate a radiological bomb in the United States. The plan allegedly included stealing radioactive7 material from within the United States once Padilla had returned. 6. The U.S. Marshals Service held him as a material witness in a grand jury investigation 9 until June 9, when he was transferred to a Charleston, South Carolina, Navy brig, where he has remained without access to counsel and without being formally charged.2z The government has justified curtailing Padilla's Fifth and Sixth Amendment rights by declaring him an "enemy combatant," a term that has lain dormant in the United States judicial system for the last sixty years, and whose meaning is extremely unclear.2' Under the enemy combatants doctrine, the government claims the right to detain U.S. citizens indefinitely without charging them. This Note addresses the government's application of the enemy combatants doctrine to detain suspected terrorists. Part I explores the judicial origins of the term "enemy combatants" and its cognate in international law, "unlawful combatants. ' 22 Part I also examines the Foreign Intelligence Surveillance Act as an example of a congressional attempt to provide detailed procedural safeguards against executive abuse in national security matters.23 Part II discusses the main questions posed by two recent enemy combatant cases, Hamdi v. Rumsfeld 4 and Padilla v. Bush25 : What procedural protections should suspected enemy combatants have, and by what standard should the government's determination that an individual is an enemy combatant be reviewed? Part II also discusses the benefits and pitfalls of the clear alternative to enemy combatant detentions: affording suspects the full protections of the normal rules of civil procedure.26 Finally, Part II examines civilian trials, such as the trials of the 1993 World Trade Center bombing conspirators and the 1998 embassy bombers.27 Part III proposes a set of procedural safeguards to the unsettled questions presented by Hamdi and Padilla.2" It does so by using the law of war and the procedures codified in the Foreign Intelligence Surveillance Act as models. This report describes the procedures used by the World War II military tribunal to try the eight Germans, the habeas corpus petition to the Supreme Court, and the resulting convictions and executions. Why was the tribunal created, and why were its deliberations kept secret? How have scholars evaluated the Court’s decision in Ex parte Quirin (1942)? The decision was unanimous, but archival records reveal division and disagreement among the Justices. Also covered in this report is a second effort by Germany two years later to send saboteurs to the United States. The two men captured in this operation were tried by a military tribunal, but under conditions and procedures that substantially reduced the roles of the President and the Attorney General. Those changes resulted from disputes within the Administration, especially between the War Department and the Justice Department.

It is time to take a step back from 9/11 and begin to evaluate the enemy combatant legal regime on a broader, more systemic basis, and to understand its application to future conflicts. A leading precedent ripe for reconsideration is Ex parte Quirin, a World War II-era case in which the Supreme Court held that saboteurs admittedly employed by an enemy nation's military had a right to access civilian courts during wartime to challenge their trial before a military commission.

Kacprowski* I. INTRODUCTION Jose Padilla is an American citizen.' The United States govern- ment took Padilla into custody on American soil in May 2002, and it has classified him as an enemy combatant, asserting that it can detain him indefinitely without charging him with any crime.2 Yaser Hamdi is also an American citizen who has been detained since Fall 2001, has been classified as an enemy combatant, and has yet to be charged with a crime.3 In Padilla v. Bush4, the District Court for the Southern Dis- trict of New York, like the Hamdi court, decided that because of the present war on terrorism, the government had the authority to classify citizens as enemy combatants. However, unlike the Hamdi court, the Padilla court ruled that, despite the government's classification of Padilla as an enemy combatant, he should be given access to an attor- ney in the prosecution of his habeas corpus petition and that the court would then review the charges and evidence and decide whether the government properly classified Padilla as an enemy combatant.5 Both the Padilla6 and the Hamdi7 courts applied a Supreme Court case from J.D. Davis* Professor Greg McNeal was an academic consultant to the prosecution during my tenure as the Chief Prosecutor for the military commissions at Guantánamo Bay, Cuba. We had similar perspectives on many issues, and we still confer on detainee matters. I concur with the views expressed in his essay.1 I write to address two issues Professor McNeal identified and com- ment on how they affect the military commissions. First, I examine the case of the Nazi saboteurs—captured, tried, and executed in the span of seven weeks in 1942—and its influence on the decision in 2001 to resurrect military commissions. Second, I assess the conflicting statutory provisions in the Military Commissions Act and the impact on full, fair, and open tri- als. I. ATTEMPTING TO REPEAT HISTORY Professor McNeal argues that the administration chose military com- missions to protect information collected for intelligence (intel) purposes from disclosure. Safeguarding intel, particularly the sources and methods used to acquire information, was a key factor, but I believe the decision had a broader basis heavily influenced by a precedent-setting trial in 1942 that became the template for the President‘s Military Order of November 13, 2001.2 Shortly after midnight the morning of June 13, 1942, four men left a German submarine and came ashore at Amagansett Beach, New York.3 * Morris D. Beginning in 2004, the Supreme Court considered whether these non-citizens were entitled to rights under the Constitution. In deciding that question, the Court compared the facts in the War on Terror cases with World War II cases that dealt with the rights of captured Nazis. Though the cases from World War II denied all protections to nonresident enemies, the Court in 2004 and 2008 determined that detentions in Guantanamo were unique. As such, the Court held that non-citizens detained at Guantanamo had certain constitutional privileges.

From the first decision in 1793 up to the most recent decision the Supreme Court of the United States has had a profound impact on the Constitution. Precedents created by Supreme Court decisions function as one of the most powerful governmental actions. Jonathan Bailey argues “those in the legal field treat Supreme Court decisions with a near‐religious reverence. They are relatively rare decisions passed down from on high that change the rules for everyone all across the country. They can bring clarity, major changes and new opportunities” (Bailey). For all of the power and awe that comes with the Supreme Court, Americans have little to know accurate knowledge about the land’s highest court. According to a 2015 survey released by the Annenberg Public Policy Center: 32% of Americans could not identify the Supreme Court as one of our three branches of government, 28% believe that Congress has full review over all Supreme Court decisions, and 25% believe the court could be eliminated entirely if it made too few popular decisions. Because so few Americans lack solid understanding of how the Supreme Court operates, now is the perfect time for our students to actively focus on the Supreme Court in their debate rounds.

The day the Supreme Court handed down what have collectively become known as the enemy combatant cases—June 28, 2004—was both widely anticipated and widely received as a legal moment of truth for the Bush administration’s war on terrorism. The stakes could not have been higher. The three cases came down in the midst of election-year politics. They each involved challenges by detainees being held by the military without charge or trial or access to counsel. They each divided the Court. And they appeared to validate or reject core arguments that the administration had advanced—and had been slammed for advancing—since the fight against al Qaeda began in earnest after September 11, 2001. The dominant view saw the cases as a major defeat for President George W. Bush—and with good reason. Introduction Late on a moonless night in June 1942, the metal hull of a German submarine scraped the sandy bottom of the Long Island coast.1 The captain, realizing he could proceed no farther, pivoted the vessel parallel to shore to allow for rapid escape in the event of detection.2 A team of four Nazi commandoes emerged from the hatch, and two sailors inflated a rubber boat to ferry them ashore.3 The crew pushed off, trailing a line to guide the sailors’ return after the landing.4 The raft, heavily laden with explosives and gear, found the beach through a thick fog and the four saboteurs scurried ashore.5 The commandoes were instructed to change into civilian dress after disembarkation and bury evidence of their arrival.6 Their mission—for which they had undergone weeks of specialized training in Germany—was to surreptitiously enter the United States and destroy industrial targets deemed valuable to the American war effort.7 Things went awry from the first step on American soil.

    Johnson v. Eisentrager Johnson v. Eisentrager (1950) I. Facts of the case After V.E. day, German nationals stationed in Nanking allegedly passed on Wehrmacht intelligence to the Japanese Empire. They were tried, and twenty- one of them convicted, by a military commission for breach of the terms of the German surrender. They returned to Germany to serve prison terms, in the meantime petitioning the D.C. District Court for habeas corpus hearings. The District Court denied its own jurisdiction on the grounds that the petition was without cause for relief. The Appeals Court reversed, remanding the case back to the District Court to adjudge the petition's merits. II. Legal issue Procedural protections: Art. III, §2., cl. 3; Am. V; Am.
