Bethel Arnadi as President of the Pan-African Parliament in South Africa over the weekend. He further thanked other stakeholders that assisted Nigeria in achieving this feat. (b) Democracy Day 2012: The Deputy Senate President congratulated the Senate and the entire nation over the attainment of thirteen (13) years of uninterrupted democracy in Nigeria which took place on Tuesday, 29th May, 2012. He hoped and prayed that the country will continue to enjoy the dividends of democracy and peaceful co-existence. 6. Petitions: (1) Rising on Rule 41, Senator Helen U. Esuene (Akwa Ibom South) drew the attention of the Senate to a petition from her constituent, Ndanyong-Mong Okuwa, over wrongful dismissal from the services of the Nigerian Export Promotion Council. She urged the Senate to look into the matter. Petition Laid and accordingly referred to the Committee on Ethics, Privileges and Public Petitions [Rule 41 (3)J to report within two(2) weeks. 7. Privilege: Rising on Rule IS, Senator Kabiru I. Gaya (Kano South) drew the attention of the Senate to various Newspapers Publications, especially the Leadership newspaper of the 28th May, 2012, The Nation Newspaper of 30th May, 2012, and The Daily Trust Newspaper of 30th May, 2012. In the various publications, it was alleged that Members of the Joint Committee on Establishment and Public Services; and States and Local Governments investigating the administration of pension in Nigeria, collected bribe of Three Billion Naira (N3b) through Senator Kabiru Gaya. He informed the Senate that the allegation was malicious, false and unfounded since the source quoted by the newspapers denied giving bribe to anybody. He urged the Senate to investigate the allegation through the Ethics, Privileges and Public Petition Committee since the allegations in those publications breached his privilege as a Senator and the Senate as a whole. It was therefore not surprising that the National Institute for Legislative Studies (NILS) in its latest report conducted in 2014 revealed that Nigeria has the of the Federal Republic of Nigeria requires the legislators to gain the requisite experience to effectively lowest retention rate of lawmakers in the national parliament in the world. The 1999 Constitution discharges their mandate. Consequently, there is decision not to limit the number of times a performing legislator could be re-elected. Despite this, the electorates have the constitutional right to elect or re-elect a legislator. The incessant high turnover of National Assembly members provides a new challenge to democracy. That is, at the inception, one would wonder the level of constructive contributions that would be expected from inexperienced legislators. Re-election of a legislator should under normal circumstance be based on his or her performance and contribution in lawmaking process, representation and oversight functions as well as constituency accountability.     G.J.I.S.S.,Vol.3(4):116-121 (July-August, 2014) ISSN: 2319-8834 PLEA BARGAIN AND THE ANTI-CORRUPTION CAMPAIGN IN NIGERIA LINUS Y.AKOR, Ph.D Department of Sociology,Faculty of Social Sciences, Kogi State University Anyigba, Nigeria ABSTRACT This paper interrogated the pros and cons of the application of plea bargain by the Economic and Financial Crimes Commission (EFCC) to recover looted funds from high profile corrupt public and private sector officials in Nigeria. This is against the groundswell of public outcry by many Nigerians among them, Justice Dahiru Musdapha, the immediate past Chief Justice of Nigeria (CJN) and Senator David Mark, current President of the Nigerian Senate against this mode of punishment which is seen as a decoy by members of the political and business class to “tradeoff” their criminality by merely pleading guilty to corruption charges in exchange for lighter sentences. This study relied on secondary literature sources such as book, reports, newspapers, magazines and the internet for its data. Findings from the study indicated that the application of plea bargain in respect of very serious criminal cases bordering on corruption is tainted with a flavour of compromise. The study discovered that plea bargain is discriminatory against the poor in Nigeria who plead guilty to offences for which they were charged and treated summarily while the rich who plea-bargained were treated compassionately. It was further discovered that the use of plea bargain is haphazard without clear-cut parameters for effective implementation, assessment and appreciation. The paper recommends the immediate amendment of all existing laws on plea bargain to provide stiffer penalties for all categories of corrupt offenders.

    VOLUME 11 NO 1 31 FEDERALISM, POWER SHARING AND THE 2011 PRESIDENTIAL ELECTION IN NIGERIA Emmanuel Remi Aiyede ABSTRACT Power sharing has become a prominent feature of post-election conflict management practice in Africa in recent times. A study of the Nigerian experience provides useful lessons about the theory and practice of power sharing in a divided society with a federal system. Nigeria instituted the ‘zoning with rotation’ principle to shore up the affirmative action/federal character principle earlier devised to manage the inter-ethnic tensions that followed the crisis thrown up by the annulment of the presidential elections of 12 June 1993. This article examines the challenges and debates over power sharing in the build-up to the 2011 elections as a result of the entrance of Goodluck Jonathan (a southerner) into the presidential race, made possible by the death of President Umar Musa Yar’Adua (a northerner) in a clear upset of the power-sharing arrangement. It argues that while the ‘zoning with rotation’ principle remains useful for stability and representation in Nigeria its sustenance depends on its flexible application and the creativity of the elites as they negotiate and manage the power disequilibrium that results from perceived access or lack of access of segments of Nigerian society to top political office. The Nigerian case shows that the ‘zoning with rotation’ principle is problematic as a long-term solution because it constrains the notion of free political competition and the uncertain outcomes that are central to democracy. INTRODUCTION At the heart of the search for a solution to what Ayoade (1998, p 106) describes as ‘representational equity’ in Nigeria is the preference of the political elite for power sharing.
