Republika e Kosovës Republika Kosovo - Republic of Kosovo Kuvendi - Skupština - Assembly ___________________________________________________________________________ Law No. 05/L -046 ON SUPPLEMENTING AND AMENDING THE LAW No. 05/L-001 ON BUDGET OF REPUBLIC OF KOSOVO Assembly of the Republic of Kosovo, Based on Article 65 (1) and (5) of the Constitution of the Republic of Kosovo, Article 25 of Law No. 03 / L-048 on Public Financial Management and Accountability, supplemented and amended by the Law No. 03/L-221, Law No. 04 / L-116 and the Law No.04 / L-194, Adopts LAW ON SUPPLEMENTING AND AMENDING THE LAW No. 05/L-001 ON BUDGET OF REPUBLIC OF KOSOVO Article 1 Purpose With this Law there is supplemented and amended the Law no. 05 / L-001 on the Budget of the Republic of Kosovo. Article 2 Scope The provisions of this Law are binding to all the institutions of the Republic of Kosovo that are treated under this Law. Article 3 1 Definitions 1. Terms used in this Law shall have the following meanings: 1.1. Basic Law – shall mean the Law no. 05/L-001 on Budget of Republic of Kosovo. 2. Other terms used have the meaning specified in the basic Law. Article 4 In Article 12 of the basic Law, there shall be added paragraph 9 as follows: 9. Funds allocated to Contingency and Salaries for the payment of work experience in the economic category "wages and salaries" in the Ministry of Finance, will be transferred by the Ministry to the budget organizations in the same category, in accordance with the decision adopted by the Government of Republic of Kosovo. -

Executive Summary The rule of law, in its most basic form, is based on the principles that society is governed openly and fairly according to widely known and accepted rules; that no one is above the law, including those in authority; and that justice is accessible to all (Bara and Bara, 2017, 24-25; Mavrikos- Adamou, 2014; Memeti, 2014). A country operates under “rule of law” when it has, among other institutions and services, a legislature that enacts laws in accordance with the constitution and human rights; an independent judiciary; effective and accessible legal services; and a legal system guaranteeing equality before the law (Gome, 2017). -

Misioni i Bibliotekës së Kosovës: Raporti i IFLA-s/FAIFE-së, prill 2000: Vlerësimi i përgjithshëm dhe plani i zhvillimit afatshkurtër dhe afatmesëm Nga Carsten Frederiksen dhe Frode Bakken Mision i përbashkët bibliotekar i UNESCO-s, KIE-së dhe IFLA-s/FAIFE-së The remains of the main public library in the municipality of Malishevë (South-Western Kosovo), which was burned down July 1998. 1. Përmbledhje Misioni i Administratës së Përkohshme të Kombeve të Bashkuara në Kosovë dhe profesionistët e bibliotekave në Kosovë përballohen me detyrën madhore të rekonstruktimit të ndërtesave të bibliotekave dhe rithemelimin e shërbimve bibliotekare në të gjitha nivelet. Ky është konkludimi i përgjithshëm prej një vlerësimi të situatës që ka të bëjë me bibliotekat, i kryer mga misioni i përbashkët i UNESCO-s, Këshillit të Evropës (CoE) dhe nga Federatës Ndërkombtare të Shoqatave dhe Institucioneve Bibliotekare, IFLA. Misioni është realizuar në periudhën prej 25 shkurtit, deri më 7 mars, nga z.Carsten Fredriksen, zëvendësdrejtor i Zyrës së IFLA-s/FAIFE-së në Kopenhagë të Danimarkës, dhe z.Frode Bakken, Kryetar i Shoqatës Bibliotekare të Norvegjisë. Misioni ka qenë zemërgjerësisht i përkrahur nga organizatat bibliotekare në Skandinavi. Biblioteka Kombëtare dhe Universitare dhe biblioteka të tjera të veçanta janë duke u shkatërruar, ruajtja e materialeve të shkruara është e rrezikuar dhe sistemet nacionale për t’i regjistruar dhe shprëndarë dokumentet janë praktikisht jashtë funksionit. Pjesë të mëdha të koleksioneve të vlefshme në Bibliotekën Kombëtare dhe Universitare janë larguar dhe, me siguri, janë shkatërruar në periudhën prej 1990-1999. Shumë biblioteka publike dhe shkollore, posaçërisht në fshatëra, janë djegur plotësisht, ndërsa të tjerave u janë marrë dhe shkatërruar koleksionet e librave, ndërsa ato të cilat ende veprojnë vuajnë prej pasojave të gati 10 vjetëve të lënies pas dore të furnizimeve. -
Judicial System and Independence of the Judiciary
Macedonia1 IHF FOCUS: freedom of expression and the media; judicial system and independence of the judiciary; fair trial and detainees’ rights; torture ill-treatment and police misconduct; freedom of religion; national and ethnic minorities; returnees and displaced persons. The political and human rights climate in the Republic of Macedonia was determined in 2003 by the implementation of the Ohrid Framework Agreement2 and by the changes stemming from that agreement. Pursuant to it, the constitution and a series of laws and bylaws were amended, institutional and structural changes were also made. The process of personnel changes in the state, police and army administrations also began in accordance with the changes made to the Constitution and to legislation calling for equitable representation of non-majority communities. Unfortunately, the personnel changes were made in a non-transparent manner, under time pressure, often without previous analysis or appropriate strategy, and without active participation of citizens. And, in light of the fact that these changes were made predominantly based on political party affiliation at all levels, the citizens did not view the changes as related to the implementation of the Ohrid Agreement, but instead as a direct intervention by the ruling political parties in all segments of society. Hence, the changes were seen by the majority Macedonian community as excessive, inappropriate and unlawful, and by the Albanian community as insufficient in terms of utilization of all available human resources. The authorities in power used the Ohrid Agreement as an excuse not to apply and indeed to violate laws regarding criteria for employment in the administration, changes to the State Judicial Council and appointment of Constitutional Court judges. -

Annotation The OSCE Kosovo Verification mission (KVM) was established in October 1998, in order to verify the compliance with the UN Security Council Resolutions relevant to the Kosovo conflict. The breakdown of the peace process in March 1999, lead to the withdrawal of the mission and painted it as a failure. It is surprising, how many authors speak about a failure of the KVM, while giving no reasonable argumentation. This study will try to show, that this negative assessment is largely a product of misinterpretation of the KVM´s mandate and misunderstanding of the very purpose of verification (observation) missions. It was not the task of the KVM to prevent the ceasefire violations, neither to provide a peaceful solution to the conflict. It was to verify (observe) the compliance with the UN Security Council Resolutions. Verification (observation) missions do not seek any concrete achievements (mission goals; as e.g. peacekeeping or peace enforcement missions), their “goal” is their performance.
