MacLennan York University Abstract Radio broadcasting spread quickly across southern Canada in the 1920s and 1930s through the licensing of private independent stations, supplemented from 1932 by the Canadian Radio Broadcasting Commission and by its successor, the Canadian Broadcasting Corporation, from 1936. Broadcasting in the Canadian North did not follow the same trajectory of development. The North was first served by the Royal Canadian Corps of Signals that operated the Northwest Territories and Yukon Radio System from 1923 until 1959. The northern Canadian radio stations then became part of the CBC. This work explores the resistance to the CBC Northern Broadcasting Plan of 1974, which envisaged a physical expansion of the network. Southern programming was extended to the North; however, indigenous culture and language made local northern programmes more popular. Efforts to reinforce local programming and stations were resisted by the network, while community groups in turn rebuffed the network’s efforts to expand and establish its programming in the North, by persisting in attempts to establish a larger base for community radio.     PART TWO the policy and regulatory landscape 274 Since the beginning of the Republic, government policies have affected—sometimes profoundly— the evolution of the news media. What follows is a description and evaluation of FCC and other governmental policies that have shaped—and that continue to shape—the news media landscape and the provision of civically important information to citizens on a community level and nationwide. We focus on those policies that relate to the concerns raised in Part One, especially regarding the health of local information, news, and journalism. We have tried to critically evaluate the FCC’s own role. While some FCC policies have helped, some have not—and crafting sound policy going forward requires the Commission to understand why. Sociologist Paul Starr has argued that we are currently in a rare “constitutive moment,” when today’s decisions will shape media industry evolution for decades to come. Given the seismic nature of today’s changes, it is imperative that we be conscious of what our policies are and what they are attempting to achieve.     Local Content Rules in Broadcasting Drafted by Ken Bhattacharjee, Legal Officer, and revised by Toby Mendel, Head of Law Programme ARTICLE 19 March 2001 Introduction Many countries have local content rules in the broadcasting sector to protect and promote local programming. It is argued that these rules are necessary because international markets favour countries with large and well-developed broadcasting and production sectors, whose programmes can easily displace local programmes in countries with smaller, less developed sectors. However, at the same time, these rules are sometimes criticised for being a breach of the guarantee of freedom of expression, for restraining trade and for regulating the flow of foreign information into a country. The purpose of this paper is to examine international standards and comparative best practice for local content rules and their status in relation to guarantees of freedom of expression. Under international law, it is well established that pluralism is an important aspect of freedom of expression. As such, local content rules which promote diversity of expression can be consistent with freedom of expression. In order to be legitimate, local content rules should: • aim to promote pluralism; • be implemented by appropriate legal means; • be realistic and practicable, and based on suitable criteria, in the sense of being tailored to specific broadcasting sectors and their particular needs; and • be implemented progressively. The Need for Local Content Rules Many countries have passed laws to protect and promote both the local broadcasting sector and local programming.
