TUNISIA 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Tunisia is a constitutional republic with a multiparty, unicameral parliamentary system and a president with powers specified in the constitution. During the year the country held parliamentary and presidential elections in the first transition of power since its first democratic elections in 2014. On October 6, the country held open and competitive parliamentary elections that resulted in the Nahda Party winning a plurality of the votes, granting the party the opportunity to form a new government. President Kais Saied, an independent candidate without a political party, came to office on October 23 after winning the country’s second democratic presidential elections. On July 25, President Caid Essebsi died of natural causes and power transferred to Speaker of Parliament Mohamed Ennaceur as acting president for the three months prior to the election of President Saied on October 13. The Ministry of Interior holds legal authority and responsibility for law enforcement. The ministry oversees the National Police, which has primary responsibility for law enforcement in the major cities, and the National Guard (gendarmerie), which oversees border security and patrols smaller towns and rural areas. Civilian authorities maintained effective control over the security forces. Significant human rights issues included reports of unlawful or arbitrary killings, primarily by terrorist groups; allegations of torture by government agents, which reportedly decreased during the year; arbitrary arrests and detentions of suspects under antiterrorism or emergency laws; undue restrictions on freedom of expression and the press, including criminalization of libel; corruption, although the government took steps to combat it; societal violence and threats of violence targeting lesbian, gay, bisexual, transgender, and intersex (LGBTI) persons; and criminalization of consensual same-sex sexual conduct that resulted in arrests and abuse by security forces. -

Contents 1. Overview 2. Structural factors 3. Proximate factors 4. References 1. Overview There has been much analysis of the causes and rapid spread of the 2011 Arab Spring (or Arab uprisings). General consensus emerges on a combination of political, economic and social factors as being critical. These can be divided into: a) structural, long-standing, underlying factors that led to a build-up of popular anger and frustration in Arab countries; and b) proximate, more immediate factors that transformed localised protests into nationwide movements, and fanned uprisings across the region. While there are common factors, the literature also stresses the importance of looking at each country and each uprising in its own context. The uprisings were profoundly different, focused on domestic, national issues, and the precise mix of structural and proximate factors was specific to each country (Delacoura, 2012). There were also some factors unique to the individual countries involved. In Bahrain, for example, grievances on the part of the Shia majority against a Sunni monarchy seen as engaged in demographic manipulation (e.g. importing Sunnis and offering them Bahraini citizenship) aimed at perpetuating an unequal state of affairs, played a significant role (ICG, 2011c). The literature acknowledges that identification of structural and proximate factors can go only so far in explaining the causes and timing of the Arab uprisings: ‘Ultimately, we may have to accept that the rebellions were spontaneous popular events’ (Delacoura, 2012: p. -

As it turns out, an understanding of these dynamics involves not only the tightly interwoven net of economic and political motives and actions, it also is necessary to understand the working of ideological warfare (including religions) in a new age of information and communication technology. Thus there is the intermediate step of an ‘Islamic Winter’ between the ‘Arab Spring’ and the ‘North-African Exodus’. Introduction This chapter sets out to explain the recent dramatic events in the Mediterranean and European area in a broader context. To understand what currently manifests itself as the emergence of a political and military entity called Islamic State, why masses of refugees from the Middle-East and North Africa are heading to EU member states, how the future states on the Southern coast of the Mediterranean can be built to enable a peaceful cooperation with Europa, for all these burning questions a closer look at the long-run economic and political development since the end of World War 2 is necessary. -

The gender assessments and policy monitoring carried out by Women2030 partners assessed the situation of women in the target countries regarding political participation, violence against women, redistributive and economic justice, climate and environmental justice and gender stereotypes. The report highlights where Africa stands on the realization of gender equality through the lens of community-based data gathered by Women2030 partners. Women CSOs Networking to Realize the Sustainable Development Goals (SDGs) also known as the Women2030 project is a 5-year (2016-2020) global project supported by the European Commission and implemented by a coalition of 5 global and regional gender and women-focused organizations which WEP is a part of. The government of Bashar al-Assad has largely won, but the cost has been steep. The economy is shattered, there are more than 5 million Syrian refugees abroad, and the government lacks the resources to rebuild. Any chance that the Syrian opposition could compel the regime to negotiate a national unity government that limited or ended Assad’s role collapsed with the entry of the Russian military in mid- 2015 and the Obama administration’s decision not to counter-escalate. The country remains divided into three zones, each in the hands of a different group and supported by foreign forces. The first, under government control with backing from Iran and Russia, encompasses much of the country, and all of its major cities. The second, in the east, is in the hands of a Kurdish-Arab force backed by the U.S. The third, in the northwest, is under Turkish control, with a mix of opposition forces dominated by Islamic extremists. The Syrian government will not accept partition and is ultimately likely to reassert its control in the eastern and northwestern zones. -

Institutional Changes in the Maghreb: Toward a Modern Gender Regime? Valentine M. Moghadam Professor of Sociology and International Affairs Northeastern University [email protected] DRAFT – December 2016 Abstract The countries of the Maghreb – Algeria, Morocco, and Tunisia – are part of the Middle East and North Africa region, which is widely assumed to be resistant to women’s equality and empowerment. And yet, the region has experienced significant changes in women’s legal status, political participation, and social positions, along with continued contention over Muslim family law and women’s equal citizenship. Do the institutional and normative changes signal a shift in the “gender regime” from patriarchal to modern? To what extent have women’s rights organizations contributed to such changes? While mapping the changes that have occurred, and offering some comparisons to Egypt, another North African country that has seen fewer legal and normative changes in the direction of women’s equality, the paper identifies the persistent constraints that prevent both the empowerment of all women and broader socio-political transformation. The paper draws on the author’s research in and on the region since the early 1990s, analysis of patterns and trends since the Arab Spring of 2011, and the relevant secondary sources. Introduction The Middle East and North Africa region (MENA) is widely assumed to be resistant to women’s equality and empowerment. Many scholars have identified conservative social norms, patriarchal cultural practices, and the dominance of Islam as barriers to women’s empowerment and gender equality (Alexander and Welzel 2011; Ciftci 2010; Donno and Russett 2004; Fish 2002; Inglehart and Norris 2003; Rizzo et al 2007).
