Boundaries The boundaries form part of the freehold title and are the responsibility of your landlord. The Landlord The owner of the FREEHOLD is Gainsborough Court (Seven) Management Company Limited and this is the landlord. The landlord may employ an agent to collect rent and/or service charges. Term The lease was initially granted for a term of 999 years from 1st January 1980. This means that it has another 975 years left to run. The term will expire on 31st December 2978 at which point ownership of the flat will revert to the landlord. In the meantime, as the remaining term diminishes so does the value of the property. At present the remaining term is perfectly adequate however there are two key stages to consider: 80 years remaining – under the law you are entitled to have your lease extended by up to 90 years, provided you have owned the property for at least two years. In return, the landlord is entitled to demand a premium. The calculation that should be used to arrive at the premium is complex and is generally carried out by a specialist surveyor but suffice it to say it can be several thousand pounds. If there are less than 80 years on the lease the surveyor is obliged to take into account the “marriage value”, that is to say the increase in value of the flat as a result of the lease having been extended.
