Carolina, which sank in : 1918, her engines, tackle, appurtenances and : Cargo, : : Defendant. : This matter arises from the Motion to Intervene in the above-captioned case filed by prospective intervenor Rustin Cassway, the vessel RV Explorer and its owner, Research Vessel Explorer, LLC (collectively “Cassway”) [Dkt. 38] and Plaintiff Atlantic Wreck Salvage’s (“AWS”) response and request for sanctions [Dkt. 43]. For the reasons set forth below, the Court denies Cassway’s Motion to Intervene, and declines to award sanctions. I. Factual Background and Procedural History Cassway seeks to intervene in the above-referenced case, where this Court entered default judgment in favor of AWS on July 19, 2017. [Dkt. 21]. The above-captioned case concerns the salvage rights to the wreck of the S.S. Carolina (“the Carolina”). The Carolina was a passenger and cargo steam ship sunk by German gunfire on June 2, 1918 approximately 94 miles southeast of Sandy Hook, New Jersey. [Cassway Mot., Dkt. 38-1 at 5]. The Carolina’s wreck rested unclaimed on the floor of the Atlantic Ocean until John Chatterton located the wreck in 1995 and filed a lawsuit in this Court on November 1, 1995 to arrest the Carolina. Nomination Point of Contact: John Broihahn, State Archeologist, Wisconsin Historical Society, 816 State Street, Madison, WI 53706, (608) 264-6496, [email protected] SECTION II – INTRODUCTION Narrative Description The proposed Wisconsin sanctuary encompasses a key portion of an early transportation corridor that was critical to the expansion of the United States and the development of the agricultural and the industrial core of the Nation. The corridor is marked by 34 known shipwrecks, 122 reported vessel losses, numerous other historic maritime-related features, and communities that have embraced their centuries-long relationship with Lake Michigan. The historic shipwrecks are representative of the vessels that sailed and steamed this corridor, carrying grain and raw materials east as other vessels came west loaded with coal. Many of the shipwrecks retain an unusual degree of architectural integrity, with 14 vessels that are intact. The human history of the lake is intimately intertwined with the natural history. The people living along its shore are and have been influenced by the lake as their activities influenced the character of the lake and its drainage basin. The settlers, along with long-time Native residents, built the industries, harvested the timber, and farmed the fertile soils to create America’s heartland. Figure 1. Built in 1909- 1910 as part of a concerted effort to upgrade the Great Lakes navigation system, the Split Rock Light Station served the ports of Two Harbors and Duluth-Superior. From these ports, tons of iron ore were shipped to eastern industrial states and grain was shipped throughout the Great Lakes.The light station and associated buildings were designated a National Historic Landmark in 2011.
