Failing which, your intention will be rejected. General Instructions 1. This tender exercise will be conducted on an online Ariba platform. Purpose The purpose of this tender process is to procure tender offers from contractors to perform all works required in connection with tender for construction of substation civil works in Bintulu Region (Bintulu Town, Tatau, Kuala Tatau, Sebauh, Ulu Sebauh, Samalaju, Sg Asap, Bakun, Murum, Belaga and inclusive all outstation areas under Bintulu jurisdiction). 2. Background Sarawak Energy is wholly-owned by the state government of Sarawak and is responsible for the generation, transmission and distribution of electricity to industrial and residential customers within Sarawak. Sarawak Energy has a proud history of more than 70 years of service to the Sarawak community and now provides electricity to more than 500,000 account holders. Commercial basis for tender offers Tender offers shall be submitted in accordance with the requirements set out in the tender documents. The conditions of contract are based upon Sarawak Energy’s standard terms and supported by contract appendices that collectively set out and describe Sarawak Energy’s requirements for the works. This is an Annual Contract. DESCRIPTION / SPECIFICATIONS (I) The Works to be provided by Annual Contractor include the following: • Construction of brick walled type substation; • Construction of chain link fencing type substation; • Construction of transformer and switchgear foundation; • Construction of concrete bases for LT pillar and metering unit; • Earth filling and turfing for the substation site; • Construction of access road and concrete walkway crossing and; • Minor civil repair work in Bintulu Region. (Bintulu Region covers Bintulu Town, Tatau, Kuala Tatau, Sebauh, Samalaju, Sg Asap, Bakun, Murum, Belaga and all outstation areas under Bintulu jurisdiction) • Zone A (Bintulu Town) • Zone B (Sebauh, Ulu Sebauh, Tatau, Kuala Tatau & Samalaju) • Zone C (Sg. Asap, Bakun, Murum & Belaga) (II) Penalties The following penalties shall be imposed by the Company on the Contractor for failing to comply with the Contract Specifications and requirements. The penalty monies shall be deducted from monies due or which may become due to the Contractor. (a) Work progress/completion target The Contractor shall complete the works within the agreed completion period failing which a penalty of RM100.00 per day per location for the number of days. (b) Clearance of site upon job completion The Contractor shall clear away and remove all debris immediately after completion, failing which the Company shall impose a penalty charge of RM200.00 per incident. (c) Submission of monthly work reports and checklists The Company will impose the following penalties for failure to submit the monthly work reports and checklists as follow: • RM50.00 per day for the first 5 days after the due date. • RM150.00 per day for the next consecutive 10 days. • Forfeit the whole monthly contract charges if no report is received 15 days after the due date. (d) Failure to attend mandatory safety briefing by the Company for any new worker assigned to perform the contract works shall impose RM 200.00 per person. (e) Noncompliance Noncompliance with all the applicable legal requirements of Malaysia (Sarawak), local authority regulations, SEB’s safety rules, SEB’s life saving rules and instruction shall subject the Contractor to the following actions from the Company: I. For first noncompliance, SEB shall issue a letter of warning and the Contractor shall implement the corrective actions within the specified period of time. II. For first repeating noncompliance or failure in implementing the required corrective action within the specified period of time given in (i), the Contractor shall be issued with a second warning letter and a fine not exceeding Five Thousand Ringgit Malaysia (RM5,000) for every noncompliance or failure in implementing the required corrective action within the specified period. SEB shall determine and deduct the actual amount of the penalty from the Contractor’s contract payment claim. III. For the second repeating noncompliance or failure in implementing the required corrective action within the specified period of time given in (ii), the Contractor shall be issued with a letter of final warning and a fine not exceeding Fifty Thousand Ringgit Malaysia (RM50,000) for every noncompliance or in implementing the required corrective action within the specified period. SEB shall determine and deduct the actual amount of the penalty from the Contractor’s contract payment claim. IV. For the third repeating noncompliance or failure in implementing the required corrective action within the specified period of time given in (iii), the contract with the Contractor shall be terminated. .
