This hearing is for the purpose of receiving the semi-annual re- port of the Bureau of Consumer Financial Protection. Walking in through the hallway I have never seen such a crowd- ed hallway. Rarely have I seen so much excitement. So just in case you thought Mr. Zuckerberg was appearing in this hearing room, he will be across the hallway. Having said that, I now recognize myself for 3 minutes to give an opening statement. This morning we welcome home Mick Mulvaney, a highly re- spected former Member of this very committee, the director of the OMB, and the acting director of the Bureau of Consumer Financial Protection. He is here to deliver the Bureau’s latest semi-annual report to Congress. When Richard Cordray was director of CFPB I maintained it was perhaps the single most powerful and unaccountable agency in the history of the republic. Now that Mick Mulvaney is acting director, I still maintain that the CFPB is the most powerful and unaccount- able agency in the history of the republic. The CFPB is unaccount- able to the President, because the director can only be removed for cause. The CFPB is unaccountable to Congress because it deter- mines its own funding stream. The CFPB is unaccountable to the courts because it benefits from the Chevron doctrine. The CFPB is unaccountable to, well, the CFPB, because there is really not even a ‘‘them.’’ In this case, there just happens to be a ‘‘him.’’ No com- mission, no board, no effective oversight. So powerful is the CFPB director that he alone has been granted the unprecedented power to declare any mortgage, credit card, or bank account unfair or abusive, at which point Americans can’t have them if they need them, want them, and can afford them. The fact that the CFPB director has such power is itself unfair and abusive, and is an affront to the personal freedom of every Amer- ican citizen. While the Bureau retains all of these unbridled powers and re- mains unaccountable under Acting Director Mulvaney, there is one distinction: Director Cordray often acted unlawfully; Acting Direc- tor Mulvaney acts lawfully. What a welcome change. For example, in the PHH case, the facts show that Mr. Cordray unilaterally reversed decades of accepted law with regards to RESPA (Real Estate Settlement Procedures Act), and did so with- out formal rulemaking. No comment, no due process, no notice. Then, to make matters worse, Mr. Cordray attempted to apply these new—this new rogue standard retroactively. Fortunately, these actions were held unlawful by the D.C. Court of Appeals. And that is just one example. We also know that, in many respects, consumers have been harmed by the CFPB. One example, according to researchers at the University of Maryland, the CFPB’s Qualified Mortgage (QM) rule harmed middle-income borrowers who not only—quote—didn’t ob- tain cheaper mortgages, but were cut out of the mortgage market altogether. But I must admit it is sheer irony and great comic relief to see the wailing and gnashing of teeth of many of my Democratic col- leagues who now denounce the unaccountable nature of the CFPB, but only because now a Republican is in control. I ask: Where have you been? The good news is we have an acting director before us today who is actually asking our assistance in reforming the CFPB. And if our Democrat colleagues wish for the Bureau to be accountable and re- sponsive, please work with us to ensure we do just that. Chairman HENSARLING. I now yield to the Ranking Member for her opening statement. Ms. WATERS. Thank you very much, Mr. Chairman. If I may, I would like to say at the outset that Mr. Mulvaney is not the acting director of the Consumer Financial Protection Bureau. He was ille- gally appointed by President Trump in a move that blatantly con- tradicts the Dodd-Frank statute, which is very clear that the dep- uty director of the agency shall serve as acting director in the case of absence or unavailability of the director. Nevertheless, given the many impactful and, indeed, harmful decisions Mr. Mulvaney is making with regard to the Consumer Bureau, it is necessary for us to en- gage with him in an oversight capacity here today, while the courts decide who should actually be in charge. I am very concerned about Mr. Mulvaney’s actions, and have serious questions that he must address in his testimony.

    Fair Debt Collection Practices Act CFPB Annual Report 2017 1 March 2017 Message from Richard Cordray Director of the CFPB The year 2017 marks the fortieth anniversary of the enactment of the Fair Debt Collection Practices Act (“FDCPA”). In enacting that law, Congress found “abundant evidence of the use of abusive, deceptive, and unfair debt collection practices by many debt collectors” and enacted the law to put an end to such practices and assure “that those debt collectors who refrain from using abusive debt collection practices are not competitively disadvantaged.” Much has changed in the ensuing forty years in the ways in which debt is collected and even in the types of entities engaged in debt collection. But the Act remains as important today as it was the day that it was signed into law. The Consumer Financial Protection Bureau (“Bureau” or “CFPB”) is the only federal government agency dedicated solely to consumer financial protection. Among our important responsibilities is administering and enforcing the FDCPA. We recognize that debt collection is a necessary part of a functioning financial system. At the same time, we recognize that illegal practices have no place in the debt collection process, and that if such practices are not stopped, those collectors seeking to adhere to the law will find themselves at a competitive disadvantage. It is therefore vitally important that the protections built into the FDCPA are vigorously enforced. The Bureau is authorized to do so along with our partners at the Federal Trade Commission (“FTC”). In 2016, the Bureau and the FTC took important steps to vindicate the rights set forth in the FDCPA.

    Brian Deese’s Policy Record Hurt The Most Vulnerable From 2008 - 2016, Brian Deese rose from a law student to a Presidential advisor on fiscal policy, climate change, and trade. Deese’s personal geniality and intelligence drove this rise — but a review of his policy positions reveals a history of backing wildly incorrect conventional wisdom convivial to the powers that be. We agree with the Action Center on Race and the Economy that Brian Deese should not ​ ​ be appointed to lead the National Economic Council, or indeed any other economic or regulatory policy position. He has a demonstrated track record of furthering dangerously concentrated private financial power, supporting anti-factual austerity policies, tolerating and abetting climate change, and generally refusing to stand up to powerful interests when the situation demands it. FINANCIAL STABILITY Deese is currently a public spokesman for BlackRock, the world’s largest asset manager which has at least a 5 percent stake in more than 97.5 percent of the global S&P 500. Deese is especially involved with BlackRock’s efforts to “greenwash” its status as the world’s largest investor in fossil fuels — Deese claims these criticisms are unfair since “we [BlackRock] own the market across the spectrum,” including in green energy. This supposed defense of the firm points to the fact that BlackRock is, in fact, “the new money trust” in the words of the American Economic Liberties Project: a titanic financial monopoly that is too big to fail, too big to manage, and too big to exist. The Dodd-Frank Act, which regulated Too Big To Fail institutions through a new Financial Stability Oversight Council, was one of the Obama administration’s signature achievements.

    JOHNSON_PREPROOF_PERMA (DO NOT DELETE) 5/10/2017 11:23 PM PROSECUTING CREDITORS AND PROTECTING CONSUMERS: CRACKING DOWN ON CREDITORS THAT EXTORT VIA DEBT CRIMINALIZATION PRACTICES CREOLA JOHNSON* I INTRODUCTION Searching online for the words “consumer,” “arrested,” and “debtor’s prison,” reveals numerous news stories about individuals who have been arrested over unpaid credit card debt, payday loans, and other consumer debts. For instance, Joy Ulhmeyer, while driving home to Richland, Minnesota, was arrested during a traffic stop and spent sixteen hours in jail before discovering that her arrest stemmed from unpaid credit card debt.1 Christina McHan, a Texas resident, was arrested and spent a night in jail after Cash Biz filed a criminal complaint against her for defaulting on a $200 payday loan.2 Similarly, Antonio Walker was arrested during a traffic stop in Norfolk, Virginia.3 In a criminal complaint filed against him, Colortyme claimed that Mr. Walker had failed to return a dinette set after defaulting on his rent-to-own (RTO) payments.4 Even Copyright © 2017 Creola Johnson. Through the Dodd-Frank Wall Street Reform and Consumer Protection Act, the Bureau was created to stand on the side of consumers and ensure they are treated fairly in the financial marketplace. Since we opened our doors, we have been focused on making consumer financial markets work better for the American people, and helping consumers improve their financial lives. In this, our eleventh Semi-Annual Report to Congress, we provide an update on the Bureau’s efforts to achieve this vital mission. Through fair rules, consistent oversight, appropriate enforcement of the law, and broad-based consumer engagement, the Bureau is helping to restore American families’ trust in consumer financial markets, protect consumers from improper conduct, and ensure access to fair, transparent, and competitive markets. In the six months covered by this report, our supervisory actions resulted in financial institutions providing more than $6.2 million in redress to over 16,549 consumers. During that timeframe we also announced orders through enforcement actions for approximately $200 million in total relief for consumers who fell victim to various violations of consumer financial protection laws, along with over $43 million in civil money penalties.

Yellen, Secretary of the Treasury On January 26, 2021, Janet Yellen was sworn in as the 78th Secretary of the Treasury of the United States. An economist by training, she took office after almost fifty years in academia and public service. She is the first person in American history to have led the White House Council of Economic Advisors, the Federal Reserve, and the Treasury Department. Janet Louise Yellen was born in Bay Ridge, Brooklyn in 1946. Her mother, Anna Ruth, was an elementary school teacher while her father, Julius, worked as a family physician, treating patients out of the ground floor of the family’s brownstone. In 1967, Secretary Yellen graduated from Brown University and went on to earn her PhD at Yale. She was an assistant professor at Harvard until 1976 when she began working at the Federal Reserve Board. There, in the Fed’s cafeteria, she met fellow economist, George Akerlof. Janet and George would marry later that year. They would go on to have a son, Robert, now also an economics professor. In 1980, Secretary Yellen joined the faculty of the University of California at Berkeley, where she became the Eugene E. and Catherine M. Trefethen Professor of Business and Professor of Economics. She is Professor Emeritus at the university. Secretary Yellen’s scholarship has focused on a range of issues pertaining to labor and macroeconomics. Her work on “efficiency wages” with her husband George Akerlof studied why firms often choose to pay more than the minimum needed to hire employees.

    Russia and the IMF: A Sordid Tale of Moral Hazard STEFAN HEDLUND T he first summer of the new millennium was marked by renewed controversy around the issue of Russia's relation to the International Monetary Fund (IMF). As Swiss prosecutors pressed on with their probes into alleged Russian money laundering, suspicions again carne to the fore that billions of dollars of IMF funds intended to support the rutile had been illicitly diverted via a maze of accounts in Western banks, notably the scandal-ridden Bank of New York. Although allegations of this type constitute a serious embarrassment to those concerned, there appears to be little danger of anyone's actually having to accept personal blame. Given the massive amounts of money involved, the investigations are likely to drag on for many years, as are the debates on what really happened. But few if any significant truths or admissions of guilt are likely to come on record. There is, quite simply, too much high-level politics involved for truth or justice to prevail. However, there may be some benefit in mapping, as far as possible, the story of IMF involvement in Russia, how it unfolded, and how it was brought to such an embarrassing end. 1 argue that there have been significant problems of moral hazard involved that should have been taken into account from the outset. The merits of the argument should be sought in a different direction from sim- ply looking for the trail of a few billion dollars that are missing. At stake is the very essence of Western relations to Russia, at a crucial point in that country's development.
