Since the late 1990s, migrants from Mexico and Central America have been dying by the thousands as they cross into the United States Tthrough the unforgiving deserts and scrubland of the Southwest United States. Agencies along the U.S.-Mexico border have been stretched thin as they have tried to save migrants in distress and, when those efforts fail, identify the deceased and return their remains to their loved ones. In 2013, with support from the Ford Foundation, the Police Executive Research Forum (PERF) began to explore the issue of migrant deaths along the Southwestern border and identify strategies to reduce these fatalities. PERF staff members travelled to Mexico City and South Texas to meet with practitioners and conducted in-depth interviews of experts and stakeholders from nonprofit organizations, local and federal law enforcement agencies, medical examiners’ offices, and universities. After gathering input from these representatives, PERF held an unprecedented, multi-state, multi-agency meeting in Wash- ington, D.C. on June 1, 2016 to discuss interdisciplinary partnership-building and strategies to reduce migrant deaths and improve processes for identifying and repatriating migrants’ remains. This report is the result of PERF’s efforts. It highlights the factors that contribute to the migrant deaths crisis; identifies the key stakeholders in the field and the resources that they represent; examines the partnership-building efforts that are already in place along the border to increase successful rescues of migrants in distress and improve identifications of those who perish; and presents new opportunities for collaboration and information-sharing moving forward. This report serves as a chronicle of the efforts of practitioners in the field, highlights the crisis of migrant deaths in the Southwest, and proposes short-term and long-term solutions for practitioners and policy-makers. It is important to recognize that the migrant deaths crisis is a large-scale humanitarian issue. More than 6,500 migrants have died along the U.S-Mexican border since 1998, and that number is almost certainly an underestimate of the scale of the tragedy. While this report provides guidance on how to reduce these deaths now, in the current legal environment, the real solution lies in comprehensive immi- gration reform legislation that will provide new pathways to legal immigration and reduce incentives for attempting dangerous illegal border crossings. INTRODUCTION 5 SECTION I: Migrant Deaths Along the Southwest Border etween 1998 and 2015, more than 6,500 migrants died along the U.S.-Mexico border.1 The highest number of fatalities in that period was in 2005, when 492 migrants lost their lives.2 The number Bof deaths per year has fluctuated since then, dropping to 240 in 2015. Death rates have remained stubbornly high during the last decade even as the number of migrants crossing the border has declined and the United States has experienced a net loss of Mexican immigrants.3, 4, 5 “The Southwest Border Strategy” Many place the blame for these migrant deaths squarely on immigration-control policies, saying that they have tightened restrictions on who is allowed to migrate into the United States legally while not addressing the push factors driving migrants from their home countries. Perhaps chief among these is the “Southwest Border Strategy,” implemented in 1994. It was meant to strengthen border security and close well-established migration corridors between Mexico and the United States. High frequency-low volume importations such as ones through our mail system pose a considerable cumulative threat. These shipments contribute towards supplying the Australian market and exacerbate social problems within Australia associated with drug harm. Seizing these smaller importations can impact on disrupting the drug trade. The AFP and other Australian law enforcement agencies are well aware of this method of drug importation and are committed to targeting and combating it. The AFP works alongside its partner agencies on this matter, including Border Force and state and territory police. While it is not an offence to access websites that provide access to sellers of illegal substances, it is an offence to import or attempt to import a border controlled drug including synthetic drugs into Australia purchased from such a website. Offenders should be aware that if they seek to import illicit and synthetic drugs they will be subject of law enforcement scrutiny and investigation. Recently, a national co-ordinated policing campaign focused on detecting drugs being distributed via the Australian postal service saw a total of 62 illicit drugs or illegally obtained prescription medications seized by police. Operation Vitreus was co-ordinated by the National Methylamphetamine Strategy Group, which is currently lead by SA Police (SAPOL), but involved all State and Territory police agencies, working in conjunction with the Australian Federal Police, Australian Border Force (ABF), the Australian Criminal Intelligence Commission and AUSTRAC.

    Border Violence Prevention Council FACT SHEET Building on the principles of co-responsibility for and co-management of our shared border espoused in coordination mechanisms like the 21st Century Border Management Initiative and the High Level Economic Dialogue, the United States and Mexico created the Border Violence Prevention Council. The Council is co- led by U.S. Customs and Border Protection (CBP), the Secretariat of Foreign Relations (SRE) of Mexico, and the Federal Police of Mexico, and includes the participation of other U.S. Department of Homeland Security components, the U.S. Department of State, and the Secretariat of Governance of Mexico. The Border Violence Prevention Council is a policy-level decision making body that promotes initiatives aimed at preventing incidents of border violence through collaborative efforts, joint public engagement campaigns, increased transparency and information exchange, and the sharing of best practices. The Council has met four times, most recently on November 3, 2016, where we noted significant past accomplishments, including: Undertaking actions to increase the U.S. Department of Homeland Security’s and CBP’s accountability, transparency, and notification regarding use of force cases. Increasing the understanding of use of force policies and officer training efforts in both countries, which included policy and technical discussions, exchanges of information and visits to each other’s enforcement training centers.     Australian Law Enforcement In Australia, no one is above the law and all are subject to the law. This is called the rule of law. For the rule of law to be effective, it requires the law of the land to be known and followed by all citizens. An important component of maintaining Australia’s justice system is law enforcement, which ensures that everyone follows the law. Federal, state, and territory law enforcement services protect the community by preserving the peace, upholding the law, develop and run programs in crime prevention, aid in emergencies, and manage emergency incidents. Law enforcement agencies are subject and accountable to the law and have a responsibility to enforce legislation, which is passed through the different levels of governance in Australian society. Their origins began with the arrival of convicts on the First Fleet from England, back in 1788. And whilst the new settlement began as a penal colony, the evolution of the colony into a free society began developing as early as two weeks, when legal processes were put into effect to resolve any disputes and grievances that had arisen amongst the new inhabitants, including convicts. The relevant legal framework is based on rules and regulations established by the International Civil Aviation Organization (ICAO) and the European Union (EU) as well as the German Aviation Security Act (hereinafter: LuftSiG).     Foreword By Dr. Karen Finkenbinder Michael Burgoyne has made a valuable contribution to stabilization. The 21st century requires a new way of thinking. U.S. experts such as David Bayley, Robert Perito, and Michael Dziedzic have discussed a security gap in post-conflict and failed states, and promoted ways to close it. The U.S. model of decentralized policing is not it. Rather, as Burgoyne notes, we must look to our partners that have Gendarmerie Type Forces (GTF) – Stability Police Forces. Though others may be able to do stability policing in the short-term, Stability Police made up of GTF are the best approach. They have extensive expertise and experience policing civilian communities (the latter lacking in military forces), often in high-crime and insecure environments. As Burgoyne rightly observes, “the military lacks expertise in policing and law enforcement which can create a counterproductive outcome when training foreign police forces. Even military police lack the community policing knowledge resident in European SPFs.” Rather than enable minimally qualified U.S. contractors or use military personnel, the United States should continue to partner with the Center of Excellence for Stability Policing Units (CoESPU) in Vicenza, Italy, an organization that includes GTF officers from many countries and develops international stability police. Similarly, the United States should support the development of the NATO Stability Police Concept that envisions military forces quickly transitioning to stability police who either replace or reinforce indigenous forces. And, the United States should support efforts by the European Gendarmerie Forces (EUROGENDFOR) to enable their deployment in support of European partners.
