3 The Regional Balance of Presidential Tickets in Ghanaian Elections: Analysis of the 2008 General Elections Ziblim Iddi Introduction Ghana’s Fourth Republican Constitution prescribed a hybrid of the presidential and parliamentary systems of government to be practiced in a multi-party democracy. This is a clear departure from the country’s previous attempt at constitutional government in the first three republics. The country experimented with the presidential system of government in the first and third republics, and practiced the parliamentary system under the second republic. It is reported that the constitutional experts assembled by the Provisional National Defense Council (PNDC) government to produce a draft constitution for the fourth republic were guided by the lessons learned under the first three republican constitutions. For example, the requirement that the majority of ministers of state shall be appointed from among members of Parliament as prescribed by Article 78 of the 1992 constitution was recommended because of lessons learned under the third republican constitution. The president, under the third republic, failed to get his budget passed by parliament in 1981. This was largely blamed on the fact that no member of parliament was a minister of state under the 1979 constitution. The framers of the 1992 constitution, therefore, recommended hybridization to cure the mischief of members of parliament of the ruling party sabotaging the president’s agenda. Nonetheless, Ghana’s current hybrid system of government could easily pass for a presidential system (Ninsin 2008). 64 Issues in Ghana’s Electoral Politics The institutional arrangement and power dynamics between the executive and the legislature sanctioned by the 1992 constitution has inadvertently created what is gradually becoming an ‘imperial presidency’ in Ghana. -

I spent the last three summers learning traditional dance- drumming in Ghana, West Africa. I focus primarily on two schools that I have significant recent experience with: the Dagbe Arts Centre in Kopeyia and the Dagara Music and Arts Center in Medie. While at Dagbe, I studied the music and dance of the Anlo-Ewe ethnic group, a people who live primarily in the Volta region of South-eastern Ghana, but who also inhabit neighboring countries as far as Togo and Benin. I took classes and lessons with the staff as well as with the director of Dagbe, Emmanuel Agbeli, a teacher and performer of Ewe dance-drumming. His father, Godwin Agbeli, founded the Dagbe Arts Centre in order to teach others, including foreigners, the musical styles, dances, and diverse artistic cultures of the Ewe people. The Dagara Music and Arts Center was founded by Bernard Woma, a master drummer and gyil (xylophone) player. The DMC or Dagara Music Center is situated in the town of Medie just outside of Accra. Mr. Woma hosts primarily international students at his compound, focusing on various musical styles, including his own culture, the Dagara, in addition music and dance of the Dagbamba, Ewe, and Ga ethnic groups. -

Data from the country’s Statistical Service indicates that as of 2010, 71.2% of the population was Christian, 17.6% was Muslim, and 5.2% were adherents of traditional religious beliefs. Non-believers accounted for only 5.3%. Believers other than believers of the three main religions were less than 1%. Despite the diversity, the country has enjoyed peaceful co-existence among all sects and denominations; sectarian violence is a rare phenomenon. Controversies about religious discrimination and stereotypes, and government over indulgence of religion are, however, not uncommon. This article examines the vexed question of separation of church and state in Ghana. It seeks to identify what the country’s religious identity is —whether secular or otherwise—and the implication of that identity for religious expression in public life. Government Denies Existence of Political Prisoners
August 12, 1991 Ghana Government Denies Existence of Political Prisoners Minister Says Detainees "Safer" in Custody Introduction Ghana's ruling Provisional National Defence Council (PNDC), chaired by Flt. Lt. Jerry Rawlings, has claimed -- for the third time in as many years -- that Ghana has no political prisoners. In a radio interview on May 31, Secretary for Foreign Affairs Obed Asamoah, argued that some detainees -- whom he characterized as "subversives" -- are being kept in custody for their own good. He added that if they were brought to trial, they would be convicted and executed. The first claim is deliberately misleading. Africa Watch knows of the existence of a number of detainees incarcerated in Ghana, though it is difficult to estimate the exact number in the light of government denials. One group -- of ten detainees -- was moved to different prisons on the same day -- January 14, 1991. One member of this group is known to have been held without charge or trial since November 1982. Their detentions have never been officially explained. The minister's argument that detainees are better protected in custody amounts to a manifest presumption of guilt, and makes it unlikely that any detainee in Ghana can now receive a fair trial. The government's denial is also contradicted by the publication on May 30 of a list of 76 "political prisoners and other detainees" by the opposition Movement for Freedom and Justice (MFJ). According to the MFJ's information at the time, none of the 76 had been charged or tried. The PNDC Secretary for the Interior, Nana Akuoku Sarpong, has characterized the list as a mixture of "lies and half truths," calculated to discredit the government. -

Pempel Professor Jason Wittenberg Professor Saira Mohamed Spring 2018 Abstract Autocratic Courts in Africa by Fiona Feiang Shen-Bayh Doctor of Philosophy in Political Science University of California, Berkeley Professor Leonardo Arriola, Chair This dissertation examines how judicial institutions in sub-Saharan Africa were used to both legitimize repression and maintain autocratic survival during the postcolonial period, as well as the enduring legacies of these tactics on post-autocratic rule of law. When autocrats turn to courts, these moves are often heralded as signs of democratic opening. However, courts can also become forums of repression, where political rivals are criminally prosecuted for anti-regime behavior. Despite these trends, courts remain relatively understudied in repression research. In fact, conventional definitions of repression are almost exclusively extrajudicial, defined as the arbitrary use of coercive violence to threaten or intimidate its target. While a separate scholarship on authoritarian judiciaries draws attention to the autocratic functions of law and order, these findings tend to be disconnected from research on repression. This has limited theory-building on how and why courts are used to contain democratic dissent. To analyze the politicization of courts in comparative and historical perspective, I develop a theoretical framework that extends beyond conventional notions of judicial independence, re- conceptualizing judicial power along the following three dimensions: jurisdiction, function, and compliance.
