TERMS OF REFERENCE

Provision of Services for Conducng Training of Trainers for Local Good Governance Competence Units

1. The Background

The “Enhancing Good Governance and Social Inclusion at Local Level in ” Programme (Swiss PRO) will improve local capacies primarily in 99 local self-governments in Šumadija and Western Serbia, and South and Eastern Serbia regions1 to apply good governance (GG) principles in local policies and regulaons and thus increase social cohesion. The Government of Switzerland has allocated USD 6.9 million for the Programme, with the United Naons Office for Project Services (UNOPS) responsible for its implementaon, in cooperaon with the Standing Conference of Towns and Municipalies (SCTM).

The Programme has to fulfil two main goals: 1. To contribute to the enhancement of organisaons and officials’ knowledge and skills 2. To posively change the scope and quality of public services rendered to cizens, especially to those from excluded groups. Both goals will lead to improved regulaons, instuonal, technical and human capacies for the enhancement of e-services. In addion, capacity building will be provided to local civil society organisaons (CSOs) as well as instuons dealing with social inclusion and gender equality.

Overall, this will contribute to the improved rule of law at the local level, increased accountability, transparency and efficiency and effecveness of the local self-governments (LSGs), and ulmately improvement of quality of life of cizens, especially excluded cizens.

The Programme will coordinate its acvies with the key line-naonal-level instuons, while observing the naonal strategies, laws and relevant development documents, which will contribute to sustainability, ensure naonal ownership and develop naonal capacies. The content and the scope of the Programme will significantly complement the European Union Support to Municipal Development – EU PRO Programme.

2. Introducon to the Intervenon

Implementaon of good governance principles at the local level ensures greater accountability, transparency and efficiency of municipal administraon in the provision of services, and the development of the civil servants’ professional skills and knowledge is the key step in this process.

In the period 2014-2018, the programme preceding the Swiss PRO, European PROGRES, provided comprehensive training for appointed representaves of LSGs on the applicaon of good governance principles at local level, which included five principles of good governance: accountability, efficiency and effecveness, transparency, cizen parcipaon, and non-discriminaon and equality. As a result of this intervenon, a total of 23 local self-governments (LSGs) established Good Governance Competence Units (GGCUs) - permanent working bodies / working groups for good governance in order to form a lasng resource at the local level.

Within the Swiss PRO Programme, representaves of those 23 LSGs had the opportunity to aend training for trainers and gain addional skills needed for further horizontal transfer of acquired knowledge in the field of good governance, but also open opportunies for accreditaon of trainers at the Naonal Academy of Public Administraon (NAPA).

The Swiss PRO Programme connued the pracce of capacity building for good governance in order to integrate the principles into the daily work of LSGs, through a training programme held in the period from June 2019 to March 2021 for 35 LSGs’ representaves.2

The next step is carrying out the training for trainers, as well establishing and instuonalizaon of the resources - GGCUs within LSGs. The Training of Trainers is essenal for GGCUs’ representaves to become adequately equipped for transferring the acquired good governance knowledge and know-how experiences horizontally – within their local administraons and to other local public enes.

Through this intervenon, the Swiss PRO Programme will, in accordance with the Law on Employees in Autonomous Provinces and Local Self Governments3 support up to 32 local staff members4 tha t have previously completed the Swiss PRO training on Good Governance to expand their knowledge and acquire addional training skills.

3. Objecves of the Intervenon

The Overall Objecve is to contribute to enhanced transfer of good governance know-how and strengthened good governance resources at the local level.

The Specific Objecve is to further capacitate the GGCU local experts to become trainers and acquire knowledge and skills for creang and conducng training programmes and transferring horizontal knowledge.

4. The Approach to this Intervenon

The Swiss PRO Programme will through an open and transparent process evaluate, select and contract an eligible service provider (s ee below for details on eligibility) which has responded to the Request for Proposals (RFP), whose integral part is this Terms of Reference (ToR), by subming a valid project proposal, according to the ToR requirements and other provisions set in the RFP.

The contracted service provider will then carry out acvies in accordance with the accepted descripons of acvies and the meframe, in accordance with the submied and approved project proposal.

5 . The Scope of the Intervenon

The contracted service provider will plan and carry out the subsequent acvies that include the following, while in the same me not necessarily being limited to:

The Incepon Phase: I. Study the Swiss PRO Programme document and acquire necessary understanding of the context and the Programme’s objecves. II. Develop and plan a five day (five days in connuity i.e. 32 hours training) training programme - Training of Trainers (ToT), for up to 32 parcipants, Good Governance Competence Units (GGCUs) members, in organising and transferring the acquired GG know-how. Develop training material (focused on good governance principles and examples) and present it to Swiss PRO team for final revision, encompassing as a minimum: ● Training design: main concepts and methodology ● Training delivery process: o Analysis-TNA -basics, objecves, the topic etc. o Elements of andragogy - how to train adults o Designing the training, with how to define objecves (Think, Feel, Do) o Developing all sub-processes, with SMART objecves o Interacve training implementaon/delivery, with the three phases (presenng, processing, applying) o Introducon into basic training tools (role play, NGT, brainstorming etc.) o Basic facilitaon skills o Basic moderaon skills o Feedback, debriefing, evaluaon o Training evaluaon – how-tos, and what to do with the findings III. Develop criteria and methodology for later on selecon of up to 15 out of 32 exisng GGCU local experts with training competences for transferring the GG know-how.

IV. Prepare and mulply all necessary training materials for effecve Training of Trainers (ToT) for up to 32 parcipants. V. Conduct an effecve five day (five days in connuity) ToT for up to 32 parcipants. Period and locaon is to be defined and organised by the Swiss PRO Programme. Connuous presence of all trainers in the selected locality for five days is mandatory. Expenses of trainers will be covered by the service provider (fee, travel, accommodaon etc). VI. Conduct the training evaluaon. VII. Prepare up to 32 individual parcipants profiles on training capacies using adequate and relevant psychometric instrument(s) – one or combinaon of tests such as e.g. Myers-Briggs Type Indicator, Jung Typology Test, 16PF, DISC, SJTI etc., that will provide for evidence-based decision on a parcipant’s suitability for the future role, his/her personal characterisc and aptude, as well as for personalised recommendaons for development of specific skills and a mentorship plan. Auxiliary tools, such as personal SWOT analysis may also be used. VIII. Select and recommend, based on approved methodology, 10-15 out of 32 ToT parcipants, who acquired training competences for transferring the GG know-how. These ToT parcipants will be further supported with the provision of the one day good governance training in their local governments.

The Final Phase: IX. On-line mentoring for 10-15 ToT parcipants according to individual mentorship plans (in total for all parcipants a maximum of 20 consultants days), including support for development of training agenda of the ToT parcipants for provision of one day good governance training in their concrete working environment. X. Mentoring (on-line) of execuon of 10-15 individual one working day trainings in good governance domain in selected local governments (in total for all parcipants a maximum of 15 consultants days). XI. Prepare 10-15 personalised evaluaons of parcipants’ progress on the acquired training capacies and personalised recommendaons for future development of training skills. XII. Prepare and present Final Report with an overview of the key findings, conclusions and recommendaons for future Programme iteraons.

6. Outputs

The contracted service provider is expected to produce a minimum of the following outputs:

In the Incepon Phase: ● A detailed work plan for the implementaon of the assignment and ToT with all technical requirements (number and size of training rooms, necessary equipment, etc.) ● An outline of possible obstacles/risks in performing assignment and a migaon plan

● Developed 32 hours (covering five days in connuity) training programme with prepared training materials as stated in the Secon 5(Scope of Intervenon), point II. ● Methodology for selecon of 10-15 out of 32 ToT parcipants with training competences and clear evidence-based jusficaon for selecon. ● Prepare and submit the Incepon narrave report to Swiss PRO within the 30 calendar days aer the contract is signed.

In the Implementaon Phase: ● Prepare and mulply all necessary materials for effecve ToT ● Conduct an effecve 5-days ToT for up to 32 parcipants ● Prepare and submit the Training Report with an overview of the key findings, conclusions and recommendaons (encompassing also training evaluaon, 32 individual parcipants’ profiles on training capacies with personalised recommendaons and mentorship plans, and selected and recommended 10-15 ToT parcipants who will be further supported with the provision of the one day good governance training in their local governments) ● Prepare and submit the milestones’ narrave report to the Swiss PRO

In the Final Phase: ● Prepare and submit the Mentoring Report including on-line mentoring report, conducted personalised evaluaon of parcipants’ progress on the acquired training capacies and personalised recommendaons for future development of training skills. ● Prepare and submit the final narrave report no later than 30 days aer the end of project acvies. The final report must reflect on measuring and evaluang the overall performance against the set success criteria. The final report must also have a strong secon on conclusions drawn and recommendaons for future steps for capacity building at the local level.

The contracted service provider shall be responsible for: - Costs of the trainers/consultants for the assignment (team leader and team members) - Travel costs/daily allowance/accommodaon for trainers/consultants (team leader and team members) - Assistance in the implementaon of the Contract (administraon, logiscs, communicaon costs, prinng etc). - Any equipment necessary to provide proper working condions for the project team (team leader and team members) under this Contract.

Please note that UNOPS will cover all other costs related to training parcipants, not menoned under this scope of the intervenon (parcipants’ costs as travel, accommodaon, meals, working space/conference room, necessary AV equipment, etc.).

REQUIREMENTS

7. The Eligibility, formal and qualificaon criteria

Eligible to apply to this RFP are Bidders as defined in the document Secon I: Instrucons to Bidders, Arcle 4. Consorums are eligible to apply. All proposals substanally compliant with the formal and eligibility criteria set out in the tender (Secon Formal and Eligibility criteria) will go through subsequent evaluaon.

When the Bidder is a consorum, each of its members must meet the eligibility requirements described therein, and the same applies to subcontractors. All the formal and qualificaon requirements will be considered as mandatory and eliminatory (pass/fail). Qualificaon criteria refer to all consorum members combined.

Each requirement must be verifiable during the evaluaon process. UNOPS reserves the right to perform addional background checks of the informaon presented in the submission or to require the translaon of the submied documents into English.

The proposals will be evaluated against the qualificaon criteria set out in the tender (secon Qualificaon criteria). ● Legal enes and consora with relevant and specific experiences, substanal and provable business/operaonal experience and human and technical capacies relevant to this ToR and qualified to parcipate. ● The Bidder should demonstrate sufficient economic and financial capacies to implement the acvies as described in the ToR, by providing the below required documents proving that the company is legally registered and acve for at least three previous years (each member in case of consorum), with sufficient annual turnover of 5 million RSD minimum (or equivalent in other currency) in any of the years 2018, 2019 or 2020 (combined capacies in case of consorum).

Required documents: ➢ The financial reports for the years 2018, 2019 and 2020, or any other document accepted by the relevant authories, demonstrang the required qualificaons. ➢ Cerficate of incorporaon / business registraon issued by the relevant government body is required (for each member, in case of consora).

The Bidder should demonstrate sufficient technical and professional capacies for the implementaon of this ToR by providing the below required documents which show that the company (single company, loose/strong consorum of 2 or more companies etc.) has ● general capability to implement the project (management and personnel structure, types of acvies undertaken, project management controls, extent to which any work would be subcontracted). ● proven track of records in at least the past three (3) years in the area relevant to this ToR namely, implementaon of professional training programmes (including ToTs) and educaon of

Required documents: ➢ Descripon of the company / consorum and background material to be provided. ➢ Copies of a minimum of two relevant contracts for two different ToT projects, each supported by a reference leer issued by the purchasers of the services, are required. ➢ If accredited, cerficaon(s) of accreditaon issued by the relevant instuons should be provided.

He or she would be directly responsible for the delivery of the expected outcomes and acvies defined by this ToR and must be engaged on the project for at least 50% of his or her total working hours. Methodology of Evaluaon

Evaluaon against technical criteria Only proposals meeng or exceeding the eligibility, formal and qualificaon criteria shall be considered substanally compliant and will be evaluated against the technical criteria set out in the tender (secon Technical criteria).

The proposals will be rated by assigning numeric points, whereas only proposals that meet the minimum technical threshold of 49 points shall be deemed substanally compliant and shall proceed to the evaluaon of financial proposals. Maximum number of points for Technical Proposal is 70.

Technical criteria will be evaluated based on a cumulave analysis methodology. Evaluaon will be conducted based on the cumulave analysis of Technical and Financial Proposals with a weighng of 70% -30% (Technical Proposal-Financial Proposal). The total number of points which an Offeror may obtain for its proposal is as follows: - Technical Proposal = 70 points - Financial Proposal = 30 points

3.2.2. 3.2.4. For each team member that has Accreditaon issued by the Naonal Academy for Public Administraon for the implementaon of professional training programmes of employees in LSGs (the cerficaon of accreditaon should be 2 provided.) - 1 addional point per team member up to maximum of 2 addional points

8. Timeframe

The contract with the service provider is expected to be signed in June 2021 and it will last seven months (one month for preparaon of the Incepon Report and one month for preparaon of the Final Report included).

9. Monitoring and Reporng

The contracted service provider will remain in close contact with appropriate Swiss PRO personnel during the enre process and will discuss and agree all relevant points/steps both during the planning and implementaon stages.

The electronic copies of all reports or any other materials related to the intervenon will be made available to Swiss PRO/UNOPS in English.

The service provider contracted to implement the acvies described in this ToR will be subming to the Swiss PRO: - The Incepon Report within the 30 calendar days aer the contract is signed. - Monthly narrave reports every 5th of each month for the previous month - Milestones narrave reports during the duraon of the project, and - The Final narrave report no later than a calendar month aer the compleon of all acvies.

The methodology, data collected, analysis, reports, recommendaons and other products of this intervenon, will remain the intellectual property of UNOPS.

10. Deliverables

1) Incepon Report – A detailed work plan for implementaon of assignment, including outline of the possible risks and a migaon plan developed; methodology for selecon of up to 15 out of 32 ToT parcipants with training competences and designed training programme with materials. Incepon narrave report submied to and approved by the Swiss PRO Programme.

2) 1st progress report – Prepared and conducted an effecve 5-day Training of Trainers programme. Training Report with an overview of the key findings, conclusions and recommendaons (encompassing training evaluaon, 32 individual parcipants’ profiles on training capacies, and selected and recommended up to 15 ToT parcipants for provision of the one day good governance training in their local governments). The first progress report submied to and approved by the Swiss PRO Programme.

3) Final narrave Report – Mentoring Report including on-line mentoring report, conducted personalised evaluaon of parcipants’ progress on the acquired training capacies and personalised recommendaons for future development of training skills. The Final Narrave Report, including key conclusions and recommendaons for future steps for capacity building at the local level, submied to and approved by the Swiss PRO Programme.

11. Visibility

The contracted service provider will have to be fully compliant with the Communicaon and Visibility guidelines of the Swiss PRO. These will be provided to the Implemenng Party by the Swiss PRO Programme.

12. Final Consideraons

Working languages when contacng Swiss PRO are both English and Serbian. However, all official correspondence should be in English only. Working language of the contracted service provider is English, while in the field will be Serbian, and the suggested staff should have a proficient working level of the Serbian language. The suggested staff must be eligible to work in the Republic of Serbia.
