GLOSSARY Affected Persons Affected persons (APs) are the members of the affected households those who experience full or partial, permanent or temporary physical displacement (relocation, loss of residential land, or loss of shelter) and economic displacement (loss of land, assets, access to assets, income sources, or means of livelihoods) resulting from (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Although this definition of affected person is at variance with the usage in the SPS-2009, this is how it is understood and officially used in , and it is not different from ‘displaced person’ defined in the SPS-2009. Affected households A household consists of one or more people who live in the same dwelling and also share at meals or living accommodation, and may consist of a single family. In the project, household is the unit for compensation and all the members in a household are considered as affected persons. Compensation Payment for an asset to be acquired or affected by a project at replacement cost. Cut-off-date The date after which people will not be considered eligible for compensation i.e. they are not included in the list of AHs as defined by the census. If the country expropriation law does not specify a cut-off date, normally, the cut-off date is the date of the detailed measurement survey which will be based on the detailed and final engineering design. Economic Loss of land, assets, access to assets, income sources, or means of Displacement livelihoods as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Entitlement The range of measures comprising cost of compensation, relocation cost, income rehabilitation assistance, transfer assistance, income substitution, and relocation which are due to /business restoration which are due to AH, depending on the type and degree nature of their losses, to restore their social and economic base. All entitlements will be given to all affected households as per the entitlement matrix. Inventory of loss The inventory of assets getting affected by project. Land The process whereby a person is compelled by a public agency to acquisition alienate all or part of the land s/he owns or possesses, to the ownership and possession of that agency, for public purposes, in return for fair compensation.

Land Use rights According to Land Code (article 17) real persons (can have the land plot under the right of lifelong inheritable possession and land parcel use transferred as descent. This right is given to individual residential housing construction and collective gardening and vineyard (orchards), peasant farms. Juridical persons (enterprises, stores, and business) can possess land parcels according to the right to permanent possession, permanent use, temporary use, lease and property. In two above cases when person wants to sell the Property (land and building), he will sell the building & structure and subsequently land parcel will be sold as an attachment (right is being sold). Leaseholder Juridical person (farm) running agricultural production with the use of land parcels granted to him on a long-term lease. Lease term is limited up to fifty years but not less than for ten years. Leaseholder cannot sell - buy, mortgage, present, exchange the land Low income Low-income households are classified as households where the monthly per capita income is less than US$ 2 per capita per day). Makhallya Is a local level community-based organization recognized official by the GoU that serves as the interface between state and community and is responsible for facilitating a range of social support facilities and ensuring the internal social and cultural cohesiveness of its members. Replacement Replacement cost is the principle to be complied with in cost compensating for lost assets. Calculation of which should include: (i) fair market value; (ii) transaction costs; (iii) interest accrued, (iv) transitional and restoration costs; and (v) other applicable payments, if any. Where market conditions are absent or in a formative stage, APs and host populations will be consulted to obtain adequate information about recent land transactions, land value by types, land titles, land use, cropping patterns and crop production, availability of land in the project area and region, and other related information. Baseline data on housing, house types, and construction materials will also be collected. Qualified and experienced experts will undertake the valuation of acquired assets. In applying this method of valuation, depreciation of structures and assets should not be taken into account. 1. INTRODUCTION AND BACKGROUND TO THE PROJECT

1.1. Project overview and history

1. This Corrective Action Plan for Land Acquisition and Resettlement (CAP) has been prepared for the component of the sub-project "Construction and Rehabilitation of Transmission Mains from VU-1 to VU-3" under the "Second Tashkent Province Water Supply Development Project" which is funded by the Asian Development Bank (ADB) and includes construction and rehabilitation of water intake and delivery facilities, water conduits and water distribution networks in rural and urban settlements of two districts, Yangiyul and districts in Tashkent Province of the Republic of Uzbekistan

2. The proposed project has been prepared in accordance with the Decree of the Republic of Uzbekistan № 516 on 20.06.2019: "On measures to implement the Second Water Supply Development Project of Tashkent province, funded by the Asian Development Bank". The project was developed to address the problems of shortages, poor quality and maintenance of water supply systems in two districts of Tashkent province of the Republic of Uzbekistan, such as Yangiyul and Chinaz. Alternative technical options were analyzed and the optimal design solution for the drinking water supply system based on efficient investment and operating costs and reduction of social and environmental impacts was identified.

3. Virtually all of the large and small groundwater intake facilities in the two districts are operating at regimes significantly less than designed. Due to lack of maintenance, the distribution systems are gradually becoming obsolete and in need of repair. Chlorination systems either do not function or do not even exist in small groundwater intake systems, while many of the larger systems are in need of substantial reconstruction or replacement. The head water production, transmission and distribution facilities of the two districts are largely out of service as a result of poor maintenance. Consequently, the level of water loss is assessed as high.

4. In 2020, in accordance with the initial feasibility study of the project, a LARP was developed, approved and made public in June, and compensation fully paid in November 2020. According to the LARP, 6 farmers of Yangiyul district and 1 farmer of Zangiota district were affected by temporary impacts.

5. However, in 2021, due to changes in the Project Feasibility Study, the project was updated and, accordingly, the detailed design revealed that the right-of-way needed to be extended which resulted in creating some new affected persons.

6. Temporary land acquisition includes the loss of land temporarily required during construction, which will result in the loss of crops for one season as a result of the construction of the water pipeline.

7. This Corrective Action Plan (CAP) is prepared to address the new impacts resulting from technical changes to the project submitted by contractors and confirmed by the design institute.

8. Pursuant to the Loan Agreement, if any unforeseen environmental or social risks or impacts occur during construction, implementation or operation of the Project that have not been addressed in the IEE, EMP and LARP, the Uzsuvtaminot Agency is required to timely inform ADB of the occurrence of such risks or impacts, with a detailed description of the event and a proposed corrective action plan (CAP).

1.2. Project Components

9. The construction work on this project is divided into 8 contracts: • Reconstruction of water intake facilities "VU-1"; • Construction of 16.9 km of water pipeline from the "VU-1" water intake facilities to the WDC "VU-3" ; • Construction of 48.2 km of water pipeline from the "VU-3" WDC to the WDC "Chinaz" , reconstruction of the WDC "VU-3" ; • Construction and reconstruction of 79.5 km of water pipelines of WDC "VU-1" and "VU-3"; • Construction and reconstruction of 4 WDC and 112 km of water supply networks in Yangiyul district; • Construction and reconstruction of 7 WDC and water towers, and 97 km of water supply networks in Yangiyul district; • Construction and reconstruction of 5 WDCs and 113.5 kilometers of water supply networks in ; • Construction and reconstruction of 5 WDCs and 164 km of water supply networks in Chinaz District; Construction and reconstruction of 5 WDCs and 164 km of water supply networks in Chinaz district.

10. The physical components and necessary physical works to develop the distribution system will require the temporary alienation of about 4 hectares of land, including 3.14 hectares in Yangiyul district and 0.86 hectares in Chinaz district, according to the data obtained from the technical team, which are presented in (Table 1).

1.3. Changes in the project

11. For the subproject "Construction of 16.9 km of water pipeline from the water intake facilities "VU-1" to "VU-3", LARP was prepared in 2020; it was approved and disclosed in June 2020. Compensation had been paid in November 2020. The LARP includes the temporary impact of land acquisition as a result of the construction of the network and the reconstruction of the conduit. The LARP defines compensation and resettlement assistance requirements for the affected persons (APs).

12. Due to the technical changes that have been made, the width of the strip for the of the water pipeline route was widened according to the standards of linear structures for two conduits from d-426 to d-720 inclusive - up to 35 meters and corrective measures have been taken to compensate the additionally affected households.

13. In this connection, a corrective decision of the hokim of Zangiota district on land allocation for the water pipeline from WDC VU-1 to WDC VU-3 with the length of 16.9 km was made to 35 meters (Annex 1).

14. Due to the technical changes made to the project, the impact on the access points was fully investigated and this corrective action plan (CAP) has been prepared.

15. In April 2021, an additional decision was made by the khokim of Zangiata district on the transfer of land for water supply. In this CAP - 4 Affected persons are farmers who are temporarily affected by the water supply.

2. THE SCALE OF LAND ACQUISITION AND INVOLUNTARY RESETTLEMENT

2.1 General Information

16. This subproject does not require a permanent allocation/acquisition of land; there is only a temporary allocation of land. Impacts caused by land requisition are temporary.

17. This component of the project includes only temporary land acquisition required during construction, which will result in loss of crops for one season (temporary) as a result of water pipeline laying. The approximate width of the network right-of-way was expanded from 20-28 meters to 35 meters in the flat agricultural area, the width of the right-of-way was minimized in the populated areas. The assessment was carried out on the affected land plots, and a census of the affected farms was also carried out.

2.2 Impact assessment approach and methodology

18. In order to accurately assess the impacts resulting from the temporary land acquisition, the following steps have been taken: • Identification of affected lands: Based on the land allocation documents issued by the Khokimiat and the cadastral office, a list of affected assets/land plots was prepared. The data were verified directly at the sites during the measurement and census. • Inventory of losses /detailed measurement survey (DMS) to measure area, land type and other assets, as well as to identify the farms that would be affected by the temporary land acquisition. Data on affected crops and trees are based on land acquisition documents and compensation calculations, which were then verified through direct inventory observation at the site. • A census of affected people to count 100% of the affected persons and gather information on their socio-economic status affected by the project, at levels such as education, livelihoods, sources of income, levels of poverty/income. This will help understand the potential impact of the loss (temporary) of land plots on affected people and identify options for compensation for damages. Research has been conducted on the gender and water use of the project-affected people. • Consultations with all project interested parties, including affected persons, state organizations (khokimiyats, mahalla committees) and other affected parties carried out; • Evaluation rate compensation based on a compensation matrix for farms that are affected by temporary land acquisition.

2.3 Temporary impact

19. In accordance with the decision of the hokim, the project affects 4 farmers who rent land from the state for farming, which amounts to 7.76 hectares of agricultural land in the Zangiota district. Reference: Table.2

2.4 Area of temporarily affected land plots

20. This CAP addresses the additionally affected land and households.

21. Land under temporary impact has two types of categorization, such as (i) irrigated/agricultural land and (ii) orchards. Of the 7.76 ha of land affected, 7.24 ha (92%) is irrigated/agricultural land and 0.52 ha (8%) is garden land.

22. After the pipe work is done, the land will be handed over to the khokimiat (who will return it to the farmers) in a restored form to continue agricultural activities. The contractor is responsible for the restoration of temporarily used land.

23. The amount of land loss due to temporary requisitioning for project construction is insignificant and proportional to the size of the farmers' land lease.

2.5 Loss of crops due to land acquisition

24. According to the results of the study, it was found that various types of crops will be affected as a result of land acquisition. These crops include wheat, potatoes, and vegetables.

2.6 Loss of trees

25. During installation of the water pipeline the orchard (pears and apples) of one farm OOO "Hanifa biznes solution" - 0.52 ha will be affected. After the installation of the pipeline, these lands will be returned to the farmers and can be used, including at the farmers' discretion, for planting gardens in accordance with sanitary norms. On the given plot the farmer has planted 200 pear trees, 40 apples trees.

26. The farmer has enough vacant areas to plant similar fruit trees. The areas where trees are lost do not account for more than 10% of the total area leased to farmers. Thus, an additional 240 fruit trees will be affected.

2.7 Impact on sources of income

27. The census shows that there are 11 agricultural workers who depend on permanent employment and employ 71 people seasonally, of whom 58 are men and 24 are women. Agricultural workers will not lose their source of income on a permanent basis, except for some temporary loss of income if crops are lost during construction. Seasonal workers, are hired during the planting/harvesting seasons and sometimes between the two seasons to weed and irrigate crops. Such seasonal agricultural workers are not expected to lose their source of livelihood because they are not hired on a permanent basis, and they cannot be hired if it is clear that crops will be lost. It turns out that all agricultural workers are seasonal, and they are not affected by loss of livelihood because of the project. Seasonal workers are selected from the labor market by potential employers based on their needs.

2.8 General information about the consequences

28. Farmers will be able to use the land after construction and will be able to use it for crops, trees, because the land taken on a temporary basis will be returned to AP. The duration of construction work at each site (excavation, compaction, pipe laying, backfilling, etc.) is up to 1

10 year. Contractors are responsible for ensuring that the land is restored to its original condition so that the AP can resume agricultural activities. The following table summarizes the impacts.

29. The district department of agriculture under the khokimiyat made a proposal to pay compensation according to calculations prepared by the financial department of the khokimiyat because farmers who had already sown this year, as well as land users and the khokimiyat, had not been notified earlier by the employer or contractors of the impending impacts. Compensation will be paid at the Contractor's expense.

3. SOCIO-ECONOMIC INFORMATION AND CHARACTERISTICS OF PERSONS AFFECTED BY THE PROJECT

3.1 General Information

30. Presented is an analysis of key field data collected through a census survey of project- affected farm households' socio-economic characteristics of project-affected persons, at such levels as education, livelihoods, sources of income, poverty/income levels, and types of housing.

31. After obtaining the necessary survey maps, finding out the affected farms and signing the decision by district khokims on the lands temporarily taken away from the tenants, a census and research was conducted in order to prepare this document.

32. The methodology of the field work included conducting an inventory of losses taking into account the census and socio-economic survey of AP, which consisted of interviews and discussions with the owners of the farms affected by the project (April - May 2021).

33. In this CAP, the census and socio-economic survey (SES) covered 4 AP - farmers who are temporarily affected by the project due to the construction of the water pipeline in the Zangiota district.

34. All 4 APs are farmers, which equates to individual entrepreneur. The income of the farm listed in the tables below, is the net income of the farmer, that is AP (after paying salaries of employees and permanent workers and all payments of taxes and expenses for the maintenance of the farm). From which it follows that the income of AP is more than, low income - no more than $2 per day ($60 per month).

35. Under the rules, low-income families are classified by mahalla committees as those with a monthly per capita income less than the equivalent of 52.7% of the minimum wage. The new minimum wage as of February 1, 2020 is 679,330 Uzsums. Accordingly, the poverty line is 358,007 Uzsums (approximately $1.26 per capita per day).

36. None of the 4 APs fall under the vulnerable person status. None of the APs are classified as low-income households, female-headed households, elderly-headed households, or households with persons with disabilities.

3.2 Affected persons

37. The census and socio-economic survey of affected persons was conducted in April 2021, after the decision of the hokim of Zangiata district to transfer land for the water pipeline.

38. The total number of project affected persons is 4 persons - farmers, who use land under lease agreement for agricultural needs. Summary information about temporarily affected people is given in Table 4 below.

39. In this CAP, the census and SES covered 4 APs - farmers who are temporarily affected due to the water pipeline.

3.3 Affected persons

40. 3 farmers (tenants) are men, and one is a woman.

3.4 Age and marital status of those affected

41. As shown in Table 5 below, the age distribution of respondents shows that the group aged 36-55 is the most representative group. The average age of the AP is 46 years old.

42. All APs are married - 100%.

3.5 The level of education of the APs

43. The general level of education is quite high among APs (Table 6). The majority of APs have higher education (75%). 25% of APs have secondary education.

3.6 Type of employment of the affected persons

44. The main occupation of the affected persons is the cultivation of crops and gardening - 4 Affected Persons (100%). Three out of four, which is 75% of the farmers, are engaged in the cultivation of wheat, vegetables, potatoes. One out of four that compiles 25% is engaged in horticulture.

3.7 Loss of trees

45. Orchards of 0.52 hectares will be temporarily affected during pipe laying.

4. PUBLIC DISCLOSURE, CONSULTATION AND PUBLIC PARTICIPATION

4.1 General Information

46. Stakeholders were consulted:

• Consultations were held with employees of khokimiyats (in consequence of constant rotation) - informing about the project and the consequences of the project – additionally affected persons. • Together with the staff of agriculture, cadastral department and Suvokov, meetings were organized with AP - farmers, for more detailed discussion of the land affected by the project. • Separately, consultations were held for those affected by temporary land acquisition during the census and socio-economic study. Meetings were held both in the khokimiyats of districts and at the sites of water pipeline (directly in the farms), both group meetings and individual consultations.

4.2 Community consultations

47. Together with the staff of cadastral department and Suvtayminat LLC meetings were organized with the APs - farmers to discuss in more detail the land temporarily affected by the project:

• May 12 - meeting with the head of the Department of Agriculture and Water Management of Zangiota district, • May 19 - meeting with farmers with a subsequent visit to the site of the pipeline. In view of the current restrictions on movement and visiting workplaces, imposed due to the situation with coronavirus infection COVID-19, online consultations were held - by phone in April - May 2021.

48. During the census and socio-economic research were held consultations with the APs. The purpose - the census, informing about the right to compensation, advice on the collection of documents for compensation for temporary allocation of land. Meetings were held both in khokimiyats districts and directly in farms, both group meetings and individual consultations.

4.3 Results of public consultations

49. Most APs are aware of the project as a result of the preliminary technical studies and route surveys. Consultation is an ongoing process where people learn more about the project during the detailed design phase. People support the project because they do not have a good and reliable drinking water supply, an improved drinking water supply will improve their health and ease the burden of water scarcity that most people face. AP expect to be compensated for the loss of trees and crops want the loss to be compensated in cash by bank transfer. People want advance notice to be given before construction work begins. Most of them prefer monetary compensation in case of temporary impacts. All issues related to compensation should be fairly and clearly discussed with the affected people.

4.4 Strategy for future consultations

50. Consultation will continue throughout the project cycle.

4.5 Disclosure of information

51. Information about the project will be disseminated through disclosure of resettlement planning documents. A copy of the draft CAP (full text of the report) will also be translated into the

local language and will be presented at the district level, especially in the Khokimiyat after approval.

52. The detailed report will be available to the APs at any time. The CAP will be published on the ADB website (in English) and on the Agency's website (in English, Russian) after approval.

5. COMPENSATION CALCULATION FOR TEMPORARY LAND ACQUISION

5.1 Eligibility

53. AP in the right to receive compensation under the project are tenants of land plots (farmers) - 4 persons.

54. They are entitled to compensation for temporary land acquisition (loss of income), as well as the replacement value of trees.

5.2 Last date of record

55. For purposes of this CAP, the final eligibility date and the beginning of the census are the date of the Hokim's decision, April 20, 2021.

5.3 Entitlements Matrix and Compensation Calculation

56. The feasibility study phase of the LARP included a detailed entitlement matrix that considered the full range of project impacts and set compensation standards. The rights matrix of this CAP is based on this and only considers the specific impacts caused by the project. According to the matrix of entitlements, compensation was calculated (Compensation at the replacement value of primary (and secondary crops, if any) on the affected land plots based on 1 year of production costs (costs), as well as an allowance equal to 1 year of average net profit for the last 3 years.). The calculation of costs and loss of profit is fixed in the decision of the deputy khokim of the district. And these costs are summarized and calculated in Appendix 1. Since the khokimiyat and farmers were not notified beforehand about the planned works, and farmers had already sown on the land this year.

57. The district department of agriculture made a proposal to pay compensation based on calculations prepared by the accounting department of that department, since farmers had sown this year. The land users and khokimiyats were not notified in advance by the Employer or contractors of the impending impacts. A letter with calculations was received.

5.4 Total cost of land acquisition and resettlement

58. The total cost of land acquisition and resettlement is 320 657 348 (three hundred twenty million six hundred fifty-seven thousand three hundred forty-eight sum), (which is USD 30 538,80.) This amount includes a 10% reserve amount for possible additional costs in the future. Uzsuvtaminot guarantees that all necessary funds will be added to the project budget in advance in order to avoid possible delays in compensation payments.

6. IMPLEMENTATION SCHEDULE

59. The time for implementation of the CAP will be scheduled in accordance with the overall project schedule. All actions related to land acquisition and resettlement have been planned to ensure payment of compensation for land acquisition and commencement of construction works. Public consultation, monitoring and grievance redress will be carried out periodically throughout the project.

60. This CAP will be sent to ADB for review and concurrence, after which it will be published on ADB website as well as on the IA website. Construction of this subproject is proposed to begin in July- August 2021, and it is anticipated that this CAP will be implemented in July 2021.
