The March 2 incident between Michael Day, an Admissions and Records employee at San Jose State University, and SJSU student Wesley Flowers resulted in the arrest of Day on charges of dis- turbing the peace for his use of fighting words. It. Bruce Lowe of the University Police said a person can be charged with fighting words if he uses "offensive words in a public place which are inherently likely to provoke an immediate violent reaction." Flowers was trying to enter the Admissions building after closing and scuffled with Day who was exiting the building. In the UPD report, Day is alleged to have called Flowers a racial epithet.
