The eleC brity Behind the Brand International Protection of the Right of Publicity Abstract Part I of the article provides an overview of the right of publicity and its history. It presents the importance of this right, particularly for celebrities, and it focuses on the influence of the entertainment and sports industries in a global economy. Then, it analyzes the major differences in level of protection, scope and length, starting with the United States. Then it uses the standard in the United States and compares it with the protection offered in 22 selected jurisdictions based on a survey report by Kenyon & Kenyon titled Getting the Deal Through. Then, it addresses potential challenges to the current approach and the issues that arise from having different standards in every jurisdiction. -

Each match is more than just a game. A match can and has represented old battles that never die completely. The Celtic–Rangers rivalry is more than a cross-town rivalry, but a representation of the unfinished political fight over the Protestant Reformation.2 The Barcelona–Real Madrid rivalry represents a long-running nationalist fight between Castilian and Catalonian Spaniards.3 Celtic’s long running rivalry with Rangers Football Club (FC) is just another part of the centuries-old rivalry between Northern Irish Catholics and Protestants.4 While one’s club is a representation of his or her nation and tribe, it is also a business, as shown by the globalization of the sport.5 And just like any business, occasionally there are financial issues. -

Off Pitch: Football’s financial integrity weaknesses, and how to strengthen them Matt Andrews and Peter Harrington CID Working Paper No. 311 January 2016 Copyright 2016 Andrews, Matt; Harrington, Peter; and the President and Fellows oF Harvard College Working Papers Center for International Development at Harvard University Off Pitch: Football’s financial integrity weaknesses, and how to strengthen them Matt Andrews and Peter Harrington1 Abstract Men’s professional football is the biggest sport in the world, producing (by our estimate) US $33 billion a year. All is not well in the sector, however, with regular scandals raising questions about the role of money in the sport. The 2015 turmoil around FIFA is obviously the most well known example, creating a crisis in confidence in the sector. This study examines these questions, and the financial integrity weaknesses they reveal; it also offers ideas to strengthen the weaknesses. The study argues that football’s financial integrity weaknesses extend far beyond FIFA. These weaknesses have emerged largely because the sector is dominated by a small elite of clubs, players and owners centered in Europe’s top leagues. The thousands of clubs beyond this elite have very little resources, constituting a vast base of ‘have-nots’ in football’s financial pyramid. This pyramid developed in recent decades, fuelled by concentrated growth in new revenue sources (like sponsorships, and broadcasting). The growth has also led to increasingly complex transactions—in player transfers, club ownership and financing (and more)—and an expansion in opportunities for illicit practices like match-fixing, money laundering and human trafficking. We argue that football’s governing bodies – including FIFA – helped establish this pyramid. -

The match brings together Frank Rijkaard, who won the UEFA Champions League as a player in 1995, and José Mourinho, the former member of the FC Barcelona coaching staff who went on to lead FC Porto to triumph in the competition last year. He re-encounters the club where he worked alongside Sir Bobby Robson and Louis van Gaal in a fiercely competitive tie which will attract sell-out crowds in Barcelona and London as the leaders of the English and Spanish leagues battle for a place among the last eight. As if extra spice were needed, FC Barcelona’s midfielder Deco also re-encounters the coach who helped him to win the European crown last season. Two thrilling matches are in prospect. For this match a ‘security cushion’ will mean that some seats on the top tier will remain empty but the stadium is otherwise expected to be full. A total of 4,750 tickets have been made available to Chelsea FC, meaning that the home club has had to re-locate 3,469 season ticket holders. For the return leg at Stamford Bridge, over 2,000 FC Barcelona fans are expected to make the trip to London – which will signify the Catalan club’s most numerous support of the campaign. -
