STATE OF NEW HAMPSHIRE AGENCY REAL PROPERTY REPORTS REQUIRED BY RSA 4:39-e FOR THE FISCAL YEAR ENDED JUNE 30, 2021 4:39-e Real Property Owned or Leased by State Agencies; Reporting Requirement. I. On or before July 1, 2013, and biennially thereafter, each state agency, as defined in RSA 21-G:5, III, shall make a report identifying all real property owned by the agency. For each parcel of land owned by the agency, the report shall include any reversionary provisions or other deed restrictions, conservation or other easements, lease arrangements with third-party tenants, and any other agreement or encumbrance that may affect the future sale of the property, but only to the extent known by the agency or as may be determined through reasonable efforts. For each building or parcel of land leased to a third party by the agency, the report shall include the lease term. This section shall not apply to infrastructure properties used as the public rights-of-way for roads, highways, bridges, railroads, rail trails, rest areas, park and rides, or turnpike toll operations. II. Each state agency shall file the report with the commissioner of the department of administrative services. The commissioner of the department of administrative services shall compile the reports from each agency and file a consolidated set of agency reports with the governor, the senate president, the speaker of the house of representatives, the chairperson of the senate capital budget committee, the chairperson of the house public works and highways committee, and the chairperson of the long range capital planning and utilization committee established in RSA 17-M:1. III. The commissioner of the department of administrative services shall develop a standard format for agencies to use in submitting the report required under this section. The form of the report shall not be considered a rule subject to the provisions of RSA 541-A. (Source. 2012, 254:1, eff. June 18, 2012. 2019, 91:1, eff. Aug. 17, 2019.) Introduction and Notes In developing a standard format for all agencies to use in submitting the report required by RSA 4:39-e, Administrative Services (DAS) staff designed and constructed a central state real property database to receive, store, maintain and manage information on all real property assets owned or leased by the State of New Hampshire, and from which all agency reports are generated. Various upgrades and enhancements to the data management application are ongoing. In general, the real property database project continues to progress toward the goal of providing a powerful and useful tool for more efficient and effective real property asset management, long-term planning, reporting, and interagency coordination to be used by the legislature, the executive administration, individual agencies, and the general public. Notes on certain limitations of the 2021 reports: 1. The statute requires each agency to identify “all real property owned by the agency” in its report. Although a few agencies do manage other classes of real property assets, such as dams and conservation easements, this set of reports is limited to land and building assets only. 2. All data contained in these reports is presented as entered in the database by each agency. Each agency is responsible for maintaining the accuracy and completeness of its data in the database. DAS has been advised by multiple agencies that some of their assets have been excluded as a result of technical issues presented by the disparate data storage media or formats that they employ. For example, the Department of Transportation has indicated in past reporting years that its data excludes: sand/gravel pits, sand/salt sheds, storage sheds, railroad corridor land, and “infrastructure properties used as the right of way for Roads, Bridges, Railroads, Rest Areas, Park and Ride or Turnpike Toll Operations that are either fully constructed or in Project Development.” Certain other agencies have provided incomplete data on their reported assets for similar technical reasons. 3. The statute requires each agency to report known or easily discoverable information on the status of title and title encumbrances for every single real property asset owned by the agency. However, many agencies simply lack sufficient personnel or the real estate expertise necessary to achieve full compliance with the statute. 4. Several assets have been reported in whole or in part by more than one agency, signaling a need for greater interagency coordination in real property asset management and reporting. 5. Agencies that claim to own or lease no land or buildings are omitted from the following reports. 6. Neither the database nor the following reports should be relied upon as a complete or accurate source of current land title information. Any party seeking such information is strongly advised to search in the registry of deeds for the county in which the corresponding property is located, which is the primary definitive source of such information in New Hampshire.
