THAT Council approves the Rotary Sunrise Club of Qualicum Beach for a one-time subsidy for the use of the Civic Centre on March 19, 2016, for their annual dinner and dance by charging a reduced rate of $958.00, plus applicable taxes, as opposed to the regular rate of $1114.17 plus applicable taxes, resulting in a $156.00 subsidy.

THAT Council approves the Rotary Club of Qualicum Beach for a one-time subsidy for the use of the Civic Centre on April 9, 2016, for their annual 'Winefest' by charging a reduced rate of $874.00, plus applicable taxes, as opposed to the regular rate of $1,310.00 plus applicable taxes, resulting in a $436.00 subsidy.

Wendy Maurer, 215 Elizabeth Avenue, provided a written submission noting her opposition for an additional weekly market in Qualicum Beach and suggested everyone work together to find an effective solution.

Mimi Shewchuk, 579 Sumac Drive, Qualicum Beach Farmers' Market (QBFM) Manager, noted that the QBFM's motivation to request an additional market came from their customers' request for a mid week market to 'top up' on fresh produce.

Mariane Sadik, artisan, spoke about the survey results conducted by the Town noting that 57% of respondents were in support of a Wednesday evening market and she also spoke about the right to an earn an adequate standard of living.

Leona Matte, 355 Dorset Road, also spoke about the survey results conducted by the Town noting that 57% of respondents supported the Wednesday market and further commented that the residents should have access to farm fresh produce.

Bobbie Williams, 1425 Reef Road, Nanoose, spoke in favour of a mid week market and the benefits of direct sales for farmers, cutting out the middle man and the coupon program.

Jean Young, 218 Fifth Avenue West, spoke as a business owner of 17 years in Qualicum Beach noting that there are markets in the region every day. The QBDBA were working to create a venue on Thursday evenings for everyone to participate in. Ms. Young encouraged the farmers to join the Thursday night market.

Lorne MacCallum, Dashwood, President of the QBFM, commented on the success of the Saturday Farmers' Market. Mr. MacCallum also noted that he had been a vendor at the Thursday night market in 2014 and it was not successful for them.

Resident at 822 Memorial Avenue, spoke as a vendor at the Thursday night market in favour of keeping the Thursday night market. The resident also expressed disappointment with the recent decision to not allow dogs at the Farmers' Market.

Connie Kuramoto, 238 Kenmuir Road, spoke about implementing an agriculture plan, the success of the Qualicum Beach Farmers' Market and the promotion of fresh food.

COMMENTS FROM THE GALLERY • Carol Dowe, 512 Hawthorne Drive, thanked Chief Darryl Kohse for his presentation to the Qualicum Woods residents on fire safety in and around the Heritage Forest.

• Paul Anders, 610 Sumac Drive, expressed his disappointment with Council's rejection of the LiveWell Cohousing proposal.

• Wendy Maurer, 215 Elizabeth Avenue, spoke as a community member commending the developers of the proposed cohousing development for including the community through the process. Ms. Maurer also commented on the length of time spent by the developer on the proposal and Council's unwillingness to let it get to the public input stage.

• Joseph Leskosek, 484 Mill Road, questioned the comments made by Dave Wood regarding the Thursday night market in order to confirm its cancellation.

We are here this evening on behalf of residents of Qualicum Beach to ask Town Council to (1) reinstate Airport Noise Abatement Procedures in the Canada Flight Supplement for the Qualicum Beach Airport and (2) to consult with residents on airport operations and plans.

The Canada Flight Supplement (CFS) is a catalogue of every aerodrome in Canada and contains data on runways, facilities, communications, regulations and procedures for every airport. The current CFS does not have any Noise Abatement Procedures for Qualicum Beach Airport. The Airport currently has only Night Restrictions for the purpose of restricting landings and takeoffs between 10:00 pm and 6:00 am local time. This means that aircraft can takeoff or land as early as 6:00 am and make noise (ie run-ups) even earlier. "Night Restrictions" are a local regulation and are not enforceable by Canada Aviation Regulations (CARs). "Noise Abatement Procedures" are enforceable through Transport Canada's CARs 602.105. (Attachment A)

In the past, the Qualicum Beach Airport did have Noise Abatement Procedures that restricted landings, takeoffs and noise (ie run-ups) between the hours of 10:00 pm and 7:00 am local time, except Medevac and PPR flights (prior permission required). (Attachment A)

We request that a Noise Abatement Procedure, restricting hours of operation between 10:00 pm and 7:00 am, be reinstated in the CFS as soon as possible. The attached petition of Qualicum Beach residents shows the high level of concern that local residents have about this matter.

The Town of Qualicum Beach has a Noise Control Bylaw #552 which prohibits noise that disrupts community peace and quiet, including a prohibition of construction, maintenance and industrial work noise between 8:00 pm and 7:00 am. (Attachment B). It is reasonable to expect that airport noise be restricted to a 7:00 am start as well. The hundreds of residents living in the area of the airport and under flight paths deserve the same consideration.

The current early morning flights from Qualicum Beach are unique in central Vancouver Island. Other area communities and regional airlines do not have scheduled flights before 7:00 am. (Attachment C) Providing early morning flights for the occasional convenience of a few customers does not warrant the daily disruption of early morning peace and quiet of hundreds of our local residents. Airline passengers have numerous alternatives. And KD Air and Orca can alter their schedules to fit in with those of other regional airlines and communities, and adhere to a 7:00 am restriction. (see Attachment D)

The Qualicum Beach Airport is unusual in that it is located in such close proximity to many residential neighbourhoods. Because of this, it is necessary to include input from area residents on airport operations and noise. For example, in March of this year, Council asked staff to draw up a new Airport Plan (Attachment E). Local residents must be consulted in matters like this. (submission continued on page 2) PAGE 1 Transport Canada suggests airport management consult with community representatives on airport operations, particularly with regard to noise management. (Attachment F). Qualicum Beach needs an Airport Committee so that Council and Airport Management can hear from the nearby residents and not just the Aero Club and aviation and airport businesses.

Industrialization and expansion of airport operations is not in the best interests of Qualicum Beach. Increasing airport hours, operations and businesses may generate some revenue for the Town but it also increases expenses for maintenance, upgrades and services to runway, apron, taxiways, buildings, vehicle parking, lighting, approach and landing systems, security, insurance, administration etc. Airport expansion and industrialization would not benefit our residents' quality of life and it would most likely not benefit the Town economically either. It is in the best interest of the Town of Qualicum Beach and the entire community to have fair and reasonable regulations and guidelines that consider aviation businesses, recreational pilots and local residents.

Today's airport is nothing like the airport of 10 to 20 years ago. Today, the airport has longer hours of operation, expanded facilities, two commercial airlines, three helicopter companies and multiple aviation businesses. Where does it stop?

Council has the authority and, indeed, Council has the responsibility to include residents in plans and decisions on airport operations. We request that Council begin this process with a reinstatement of Airport Noise Abatement Procedures. (see example in Attachment G)

• Implement a noise abatement restriction of 10:00 pm to 7:00 am local time.

• Employ restrictions and guidelines on low altitude flight and climb-out headings over built up areas.

• Monitor airport operations and noise and enforce regulations.

• Consult local residents on airport operations and facilities by including local residents in an airport committee, so that staff and council get advice and direction from all stakeholders.

Correspondence from the Transport Canada Civil Aviation Centre explains some of the terminology used in the CFS (Canada Flight Supplement). • Currently, the CFS does not have any Noise Abatement Procedures for Qualicum Beach. • The CFS does list Night Restrictions for Qualicum Beach for the purpose of landings and takeoffs at the airport during the hours 06-14Z or lOpm-6am local time. • Noise Abatement Procedures are pursuant to 602.105 of CARs and are enforceable. • Night Restrictions are a local procedure and are not enforceable by CARs. • Definition of Noise Abatement includes noise from an aircraft whether the aircraft is on the ground or airborne. Copies of CFS pages on the Qualicum Beach Airport show: • The Qualicum Beach Airport did have Noise Abatement Procedures that restricted landings, takeoffs and noise (ie run-ups) between 10 pm and 7 am local time. • The CFS procedures for Qualicum Beach have been changed to allow earlier aircraft movements and noise at the airport. • The earlier procedures did include take-off and climb-out heading restrictions so as to avoid noise sensitive areas. Current procedures do not.

Note: • Town Bylaw #457.08 of March 8, 2010 on Airport Establishment and Operations states: (1) aircraft landings or takeoffs are not permitted at the Airport between the hours of 2200 and 0600 hours and (2) aircraft engines shall not be run up or tested at the Airport between the hours of 2200 and 0600 hours. • This bylaw appears to differ from the CFS Night Restrictions re aircraft noise on the ground.

The current "night restrictions" found in the CFS are there for the purpose of landings and take-offs at the airport during the hours indicated in the CFS (06-14Z).

Only Medevac flights or flights that have received prior permission or "PPR" from the Airport Operator may take-off or land during this time frame.

Furthermore, if the Abbreviated Precision Approach Path Indicator system (APAPI) is unserviceable at night, then night landings at the airport are prohibited entirely.

NOTE: PPR means "prior permission required".

The Qualicum Beach Airport does not currently have "Noise Abatement Procedures" in place.

The difference between the two is, a "restriction" in the CFS is considered to be a "local procedure" and is not made pursu- ant to a regulation therefore, it is not enforceable by the CARs.

Noise Abatement Procedures are made pursuant to 602.105 of the CARs and are therefore enforceable.

TOWN OF QUAUCUM BEACH BYLAW NO. 552

A Bylaw to regulate noise, nuisance and disturbances within the Town of Qualicum Beach.

WHEREAS, under the provisions of Section 932 of the Municipal Act, Chapter 290 of the Revised Statutes of 1979, the Council of the Town of Qualicum Beach is empowered to enact a bylaw to:

1. Prevent, abate and prohibit nuisances and provide for the recovery of the cost of abatement of nuisances from the persons causing the nuisance or other persons described in the bylaw;

2. Regulate or prohibit the making or causing of noises or sounds in or on a highway or elsewhere in the Town which disturb, or tend to disturb the quiet, peace, rest, enjoyment, comfort or convenience of the neighbourhood, or of persons in the vicinity or which Council believes are objectionable or liable to disturb the quiet, peace, rest, enjoyment, comfort or convenience of individuals or the public and may make different regulations or prohibitions for different a erf.• areas of the Town. 3. Prevent or prohibit persons from shouting, using megaphones and making other noise in or at or on streets, wharves, docks, piers, railway stations or other public places.

4. Prevent vice, drunkenness, profane swearing or indecent, obscene, blasphemous or grossly insulting language or other immorality and indecency.

NOW, THEREFORE, the Council of the Town of Qualicum Beach, in open meeting assembled, Enacts as follows:

PART 1. - DEFINITIONS 1.1 "Authorized Person" shall include the following: a) a member of the R.C.M.Police b) a Bylaw Enforcement Officer c) a Special Constable d) an Auxiliary Constable e) an Animal Control Officer

1.2 "Council" shall mean the Municipal Council of the Town of Qualicum Beach.

1.3 "Tcun" shall mean the Town of Qualicum Beach.

1.4 "Utility" shall include a company which provides water, sewer, electrical, gas, telephone, cable service or other utility services.

PART 2- GENWALRECULtTIONS

2.1 No person shall make or cause, or allow or permit to be made or caused (552.01) in or on, or over, any property, any noise which disturbs or tends to disturb the quiet, peace, rest, enjoyment, comfort, or convenience of any person or persons In the neighbourhood or vicinity.

2.2 No person shall keep or harbour, within the municipal boundaries of the Town, any animal which, by it's calls, cries or any other vocal noise, disturbs the quiet, peace, rest, enjoyment, comfort or convenience of any person or persons in the neighbourhood or vicinity.

2.3 No person shall use or operate any automobile, motorcycle, bus or other vehicle: rb* a) so as to cause the tires to squeal or otherwise make an offensive noise;

b) so as to cause engine retarding doylies, which creates a noise which Council believes to be objectionab:a, to be used within the Municipal boundaries of the Town.

0) so as to create the amplified sound of a radio, television, tape (552.03) player, compact disc player or other sound playback device or amplification equipment, or the sound of a musical instrument that emanates from a vehicle or motor vehicle which can easily be heard by someone outside the vehicle.

2.4 No owner, occupier or tenant of property shall allow or permit or be a party to vice, drunkenness, profane swearing or indecent, obscene, blasphemous or grossly insulting language or other immorality or indecency.

PART 3- EXCEFT

3.1 Nothing in this bylaw shall preclude:

3.1.1 The operation of emergency equipment or any emergency vehicle by an authorized perz on. r"' PAGE

3.1.2 Any act of maintenance or repair being carried out by employees or contractors of the Town, the Ministry of Transportation and Highways, or any Public or Private Utility.

3.1.3 Snow removal or dust clearing operations, provided that in the case of private parking lots such actions are commenced within thirty (30) minutes after the close of business for the day.

3.1.4 Golf course mowing, between sunrise and sunset, in periods governed by .

3.1.5 Any maintenance or repairs or construction or industrial work, to property by the owner, occupier or their agent between the hours of 7:00 a.m. and 8:00 p.m. of the same day.

3.1.6 The operation of a public transportation system.

3.1.7 The operation of a public address system required under a Building, Fire Code or any bylaw of the Town

3.1.8 Any person from functioning within the limits of a permit issued under the Fire or Traffic bylaws of the Town.

PART 4- RIGHT OF ENTRY

4.1 Every authorized person may enter at all reasonable times on any property that is subject to this bylaw, to ascertain whether the regulations of this bylaw are being observed.

PART 5- PENALTY SECTION

5.1 Every person who violates any of the provisions of this bylaw or who suffers or permits any act or thing to be done in contravention or violation of any of the provisions of this bylaw, or who neglects to do or refrains from doing anything required to be done by any of the provisions of this bylaw is guilty of an offence against this bylaw and liable, upon summary conviction, to a fine not exceeding Two Thousand Dollars ($2000.00).

5.2 Each day that a violation continues to exist shall constitute a separate offence.

PART 6- SEVERABILITY

6.1 If any section or lesser portion of this bylaw is held to be invalid by a Court, such invalidity shall not affect the remaining portions of the bylaw.

7.1 Town of Qualicum Beach Bylaw No. 206 is hereby repealed.

PART 8- BYLAW NO. 552

8.1 This bylaw may be cited for all purposes as "Town of Qualicum Beach Noise Control Bylaw No. 552, 1994.

Noise management is a complex issue with many variables: passengers want shorter flights; pilots want easier access to airports and fewer route limitations; airlines want to reduce fuel consumption and greenhouse gas emissions; and, developing countries need time to bring national fleets up to international aircraft noise standards. These factors must be considered when evaluating noise reduction strategies to benefit residents in areas exposed to aircraft noise.

Transport Canada and other responsible third parties have three principal noise reduction strategies: reducing the noise at the source, managing operational procedures and managing land-use in the vicinity of airports.

Reduction at source

Transport Canada's noise standards and all Canadian aircraft are fully compliant with rigorous international standards. Transport Canada ensures compliance with the noise standards through the aircraft certification process. The ICAO noise standards are adopted into the Canadian Aviation Regulations, which set the standards for aircraft noise levels permitted in Canada.

In 1996, in line with an ICAO resolution,, Canada implemented a regulation that introduced the phase out of older, noisier aircraft Canada completed the phase out in 2002. Since that time, ICAO has introduced stricter noise standards. The airworthiness certification process requires aircraft to be compliant with these noise standards.

Aircraft operational procedures

Local representatives can reduce aircraft noise by modifying aircraft operational procedures, including adding operating restrictions and noise abatement operational procedures. Examples of such activities include controlling the use of runways and routes or adjusting procedures for take-oM approach and landing

These restrictions and procedures help aircraft operations at an airport comply with that airport's surrounding area.

Transport Canada enforces and oversees changes to these restrictions and procedures. Day-to-day operations are handled locally at the airports and through NAV CANADA.

29 Airports should establish a noise management committee (comprised of air operators, airport tenants, as well as civic and citizen representatives) to deal with noise concerns. At major airports, Transport Canada also provides a member to the committee. The committee develops any needed noise abatement proposals after it carries out an extensive consultation process with the local community and aviation stakeholders.

Proposals are then forwarded to regional Transport Canada offices where they are reviewed and forwarded to headquarters (HQ) with a regional recommendation. At HQ, the Domestic Aircraft Noise and Emissions Committee (D- ANEC) studies the proposal. If all affected parties agree with the proposal, instructions are issued to the regional office to proceed with publication of the measure. If a dissenting position is taken, then D-ANEC prepares briefing material and sends it with a recommendation to the Civil Aviation Regulatory Committee, which renders a decision.

Aircraft operators must comply with the noise operating restrictions and noise abatement procedures, which are published by NAV CANADA in the Canada Air Pilot and the Canadian Flight Supplement. Penalties for violated these procedures and restrictions can be as high as $5,000 for an individual and $25,000 for a company, per violation. NAV CANADA updates these publications every 56 days to ensure flights are compliant with the latest operating standards.

Land-use planning and management

Transport Canada helps aviation planners and those responsible for development of lands adjacent to airports to implement smart zoning practices and properly manage land-use in the vicinity of airports.

Transport Canada uses a Noise Exposure Forecast (NEF) system to provide a measurement of the actual and forecasted aircraft noise in the vicinity of airports. This system factors in the subjective reactions of the human ear to specific aircraft noise stimulus: loudness, frequency, duration, time of occurrence, tone, etc.

This metric allows us to predict a community's response to aircraft noise. If the NEF level is greater than 35, complaints are likely to be high. Anything above 25 is likely to produce some level of annoyance. Land planners can use this system to ensure that land use in the vicinity of an airport is compatible with that airport.

Through the system, municipalities and local governments receive a basis for zoning and residents receive details of what may be expected in certain areas. The system prevents future complications.

Transport Canada recommends that where the NEF exceeds 30. new residential development should not proceed. If it does, regardless of this caution, a detailed noise analysis should be conducted and noise reduction practices should be implemented. In this scenario, it is the developer's duty to inform all prospective residents of possible irritants.

In addition, Transport Canada recognizes that often provincial and municipal authorities require projections beyond five years for land-use planning, where conditions are certain to be different from today. For these purposes, Transport Canada uses the Noise Exposure Projection. The NEP projects aircraft movements and other changing variables ten to twenty years ahead, giving authorities a further perspective for zoning.

NOISE ABATEMENT PROCEDURE AND NOISE CONTROL MEASURE REVIEW WORKING GROUP TERMS OF REFERENCE

(A glossary of terms can be found in ASD Appendix A)

Background: In 1991, the Air Transport Association of Canada (ATAC) approached Transport Canada with the suggestion that the Government enact a phase out of older noisier jet aircraft in Canada, in a similar manner as was done in the United States. ATAC advised that, as part of a phase out, it was seeking from Transport Canada a commitment to review all proposed new noise-based restrictions at airports.

The negotiated agreement between ATAC and Transport Canada resulted in enactment of a regulation requiring operators to phase out the operation of Chapter 2 aircraft in Canada by April 1, 2002. The phase out regulation was preceded by the introduction of a consultation require- ment for implementation of any new noise restrictions proposed by airports. This led to the intro- duction of the Noise Abatement Checklist that now appears in the Aeronautical Information Pub- lication (AIP). This checklist is the mechanism that ensures consultation on new noise re- strictions is carried out with all affected parties and that the cost impacts and benefits, where ap- plicable, of a proposed measure are known. Proposals are subsequently approved at the Part VI Technical Committee of the Canadian Aviation RAgulatory Council meetings.

Transport Canada is the approval authority for the implementation of enforceable noise abate- ment procedures in Canada. This authority is vested in the Minister by the provisions of the Aer- onautics Act and Canadian Aviation Regulation (CAR) 602.105. The provisions of this regulation stipulate that noise abatement procedures and noise control requirements, if published in the Canada Air Pilot or Canada Flight Supplement, are mandatory.

In response to concerns expressed by air operators and airport management over the perceived shortcomings of the existing Noise Abatement Checklist, it has been decided to convene a gov- ernment stakeholder working group under the auspices of the Aircraft Noise and Emissions Committee (ANEC) to examine the checklist requirements and the process associated with the implementation of new noise control measures. Furthermore, international activities underway to deal with the development and implementation of more stringent aircraft noise certification re- quirements may provide increased impetus for this review.

In the wake of the devolution of airports and air navigation services, the relationship between air operators, airport authorities and government have changed fundamentally. Transport Canada's role changed from owner-operator to regulator of airports and air navigation and, to landlord for the 26 national airports.

Municipal Governments now either own and operate airports or they nominate Directors to Air- port Authority Boards. Airport Authorities are responsible for a local noise management commit- tee to deal with mitigating noise from "the take-off, ascent, descent, approach and terminal phases of flight."

Noise Abatement Procedure: An aircraft operational procedure that is designed to limit the amount of noise emitted by an aircraft as a result of using that procedure. These procedures can occur whether the aircraft is on the ground or airborne.

Runway Use Restriction: A measure that restricts the use of a runway or an airport by designated aircraft types or specified types of operations.

Noise Control Measures: A generic term that includes either or both Noise Abatement Procedures and Runway use Restrictions meanings in addition to any other noise-based measure.

Noise Management Program: The compendium of activities in effect at an airport to address aircraft noise concerns. These include Noise Control Measures and land use activities.

PA 34 PETITION ON QUALICUM BEACH AIRPORT NOISE

This attached petition was done in June and July 2015.

• Several Qualicum Beach neighbourhoods were visited, but none were canvassed completely.

• Parts of Evergreen, Chartwell and other nearby neighbourhood areas were visited.

• The petition is a sampling of residences from a variety of areas, some closer to the airport than others.

• The petitioners are adversely effected by airport noise and the disruption it causes.

• Aircraft noise on the ground is problematic in areas close to the airport.

• Early morning noise from aircraft on the ground and in the air is especially disruptive.

• Noise from airborne aircraft as they climb to altitude at full throttle is problematic to many residents.

When aircraft take-off rwy 29 and climb-out to the right instead of the left (as in past CFS procedures), the plane is at low altitude and directly overhead the residents of Evergreen, Garden, Hollywood and other built-up residential areas.

On Behalf of the Qualicum Beach Farmers Market we would like to thank you for your motion to allow the QBFM to hold a Wednesday evening Farmers Market. We truly believe this will benefit the Town of Qualicum Beach and the community.

The unfortunate cancellation of the Thursday night market now has created another situation that we might be able to address. We are quite concerned for the vendors of the Thursday night market, as we are aware that many vendors make their living by attending markets. In light of this cancellation, which I understand was a surprise to the vendors, we would like to ask the council to allow the QBFM Wednesday evening market to have artisans, this allowing the vendors who have lost an opportunity to sell in Qualicum Beach the ability to attend the Wednesday night market. The Market manager has already received calls from four vendors who are searching for another location during the week in Qualicum Beach, hopefully this is a way for us to try and address that situation.

Update on Natural Gas Operating Agreement

Your Executive is pleased to advise that all agreements with eligible municipalities within AVICC have now been approved by the 8CUC, and that the 3% fee on gas supplied with your municipality will begin to be collected as of September oi, 2015. Revised revenue projections for monies collected in 2015 and to be paid in 2016 are attached.

This marks the successful conclusion of a process initiated over four years ago with the aim of correcting an historic inequity within AVICC that occurred, without consultation, in 1987. This successful conclusion results from the perseverance arid dedication of many parties over the years. In particular, I should like to single out the role played by the City of Nanaimo in leading the charge, and never forgetting what was lost; or ever giving up seeking redress over the decades.

More recently, it has been the cohesiveness and resolve of the entire AVICC membership working towards a shared strategic goal that has resulted in this positive outcome. It shows what can be done with a shared common vision, a well thought out implementation plan and a sustained and focused effort.

•As the lead political appointee on this file, it is my pleasure to have served you and I am proud of what we have collectively accomplished here.

AND: TOWN OF QUALICUM BEACH ("TQB")

BACKGROUND

Whereas the United Nations Educational Scientific and Cultural Organization (UNESCO) has recognized and designated the Mount Arrowsmith Biosphere Region to ensure environmental, economic and social (including cultural and spiritual) sustainability through: 1. the development and coordination of a worldwide network of places acting as demonstration areas and learning sites with the aim of maintaining and developing ecological and cultural diversity, and securing ecosystem services for human well-being; 2. the development and integration of knowledge, including science, to advance our understanding of interactions between people and the rest of nature, and; 3. building global capacity for the management of complex socio-ecological systems, particularly through encouraging greater dialogue at the science-policy interface; environmental education; and multi-media outreach to the wider community.

And whereas VIU and TQB share similar interests, concerns, expertise, and goals in the nature of:

• Supporting the mandate and goals of the UNESCO Mount Arrowsmith Biosphere Region (MABR) designation, and; • Enhancing the regional benefits that derive from such a designation.

The purpose of this Memorandum of Understanding ("MOU") is to establish a foundation for regional cooperation between VIU and TQB in areas of mutual benefit and interest that pertain to the MABR.

GOALS

• Promote the Mandate and Goals of the UNESCO designation in general and the MABR in particular; • Explore and promote ways and means of enhancing the role of the MABR within the region; • Promote the cultural, economic, environmental and social health of the region as they pertain to the MABR; • Identify community engagement opportunities and associated research that relate to the mandate of the MABR; • Ensure that the TQB's Plans, Policies and Bylaws frame future discussions of the parties as they relate to the MABR; • Identify potential sources of funding to undertake MABR-related initiatives, including but not limited to communications, community engagement, events, UNESCO liaison, research and travel; • Expand the mutual interests of the Parties to include other MABR partners, including but not limited to First Nations, Regional District, resource users, landowners and other key stakeholders who have an interest in the MABR, and; h of each year. • Prepare a Review of Accomplishments and Revised Action Steps by November 30

FINANCIAL CONSIDERATIONS

Each Party will pay all of its own costs and expenses concerning all activities and matters under this MOU. This MOU does not impose any financial liability or responsibility on either Party with respect to the costs or expenses of the other.

CONFIDENTIAL AND PROPRIETARY INFORMATION

Each Party is responsible for disclosing when information is confidential or proprietary to the other party. Both Parties are responsible for taking reasonable measures to protect the other Party's confidential and proprietary information.

PUBLICITY All publications and publicity, regardless of media, with respect to this MOU requires the expressed written consent of both Parties prior to being issued.

RELATIONSHIP The Parties are entering into this MOU as independent entities. Nothing in this MOU constitutes any Party to be an agent or partner of the other party in any respect and neither Party will have any authority whatsoever with respect to the property or business of the other Party.

This MOU does not preclude either Party from seeking or negotiating other similar arrangements with other entities. PAG E 3 Memorandum of Understanding

LICENSING

No license or conveyance of any rights to either Party under any business contracts, copyrights, or other form of intellectual property is granted or implied by the exchange of any information between the

Parties.

TERM, TERMINATION and AMENDMENT

This MOU is effective from the date written above and will continue until either party provides 30 days written notice to the other.

This MOU will be reviewed, amended or terminated as needed. Any amendment of this MOU must be in writing and signed by both parties.

LEGAL EFFECT

This MOU specifies general areas of potential exchange and cooperation and merely sets out the general basis upon which we intend to proceed. Except for the sections titled Financial Considerations, Confidential and Proprietary Information, and Publicity, this MOU is a non-binding agreement between the Parties and does not commit the Parties to enter into any binding or legal arrangements. The sections entitled Financial Considerations, Confidential and Proprietary Information, and Publicity will each be binding upon us and will be governed as to their interpretation and effect by the law of the Province of British Columbia, Canada.

The Parties will cooperate fully with each other and, should Projects or Initiatives of mutual interest be identified, the Parties will prepare or have prepared a formal Agreement embodying the covenants, terms and conditions that they have negotiated regarding these Projects or Initiatives, forming separate Agreements outside this MOU.

PURPOSE: To establish the 2016 schedule of regular Council meetings and Committee of the Whole meetings (if required).

BACKGROUND: The Community Charter (CC) requires that Council meet regularly in accordance with its Procedure Bylaw. Through its Procedure Bylaw, Council must establish meeting procedures, and provide notice of meetings. According to the CC, the public must also be provided with a schedule of the regular Council meeting and be notified of the availability of the schedule. The Town of Qualicum Beach Council Procedure Bylaw No. 674, 2013, states that Council shall establish annually, by resolution, a schedule of regular Council meetings that shall begin at Town of Qualicum Beach September 14, 2015 Regular Council Meeting —2016 Regular Council Meeting Schedule Page 2 of 3 7:00 pm and be held within Town Hall except when Council resolves to hold meetings elsewhere. The Bylaw also states that Council will prepare annually, on or before January 1, a schedule of regular Council meetings and will give notice annually, on or before December 1st of the availability of the schedule.

The Community Charter establishes that a special Council meeting is a Council meeting other than a regular meeting or an adjourned meeting. Council's practice has been to hold a special Council meeting on the Wednesday morning before the regular Council meeting if there are any items that require closing the meeting to the public, (e.g. land matters, legal matters, labour, etc.) as listed in the CC, and at other times, when required. However, as a special meeting, these dates are not included in the schedule of regular meetings but notice of a special meeting is given in advance or all members of Council must be in attendance to waive notice. The schedule of regular Council meetings currently available to the public shows the meetings for 2015, as approved by Council resolution April 13, 2015 as amended.

PROJECT INFORMATION: Staff have prepared the draft schedule of regular Council meetings for 2016, as listed in the recommendation and on the attached posting schedule, after considering the 2016 schedule for statutory holidays, conference schedules (UBCM and AVICC), and past practice. The draft schedule includes a total of 15 regular meetings in 2016. Additional meetings can be called as special meetings, if required.

In addition, staff has established 12 Committee of the Whole Meetings (if required) throughout 2016. Staff recommend establishing the schedule. Once established, the schedule will be emailed to the Council agenda distribution list, will be available on the Town's website and will be posted on Town bulletin boards. Availability of the schedule will be published in the newspaper. In accordance with the Procedure Bylaw, after Council establishes the schedule: Council can, by resolution, vary the date or time of a meeting or cancel a meeting, provided that two meetings in a row are not cancelled; the Mayor can postpone a meeting to a different date, time or place, provided that the Corporate Administrator is given at least 2 days' written notice. The Corporate Administrator must post a notice, as soon as possible, when any revisions to the schedule are approved.

ALTERNATIVES: 1. Amend the draft schedule of regular Council meetings by adding, deleting or amending meeting dates or meeting locations, and establish the amended draft schedule.

RECOMMENDATION: THAT Council approves the St. Stephen's United Church for a one-time subsidy for the use of the Civic Centre on December 12, 2016, for a Community Carol Sing by charging a reduced rate of $379.00, plus applicable taxes, as opposed to the regular rate of $716.00, plus applicable taxes, resulting in a $337.00 subsidy.

THAT Council approves the Qualicum Beach Chamber of Commerce for a one- time subsidy for the use of the Civic Centre on February 17, 2016, for their annual Community Awards ceremony by charging a reduced rate of $368.00, plus applicable taxes, as opposed to the regular rate of $576.00, plus applicable taxes, resulting in a $208.00 subsidy.

THAT Council approves the Rotary Sunrise Club of Qualicum Beach for a one- time subsidy for the use of the Civic Centre on March 19, 2016, for their annual dinner and dance by charging a reduced rate of $958.00, plus applicable taxes, as opposed to the regular rate of $1114.17 plus applicable taxes, resulting in a $156.00 subsidy.

THAT Council approves the Rotary Club of Qualicum Beach for a one-time subsidy for the use of the Civic Centre on April 9, 2016, for their annual 'Winefest' by charging a reduced rate of $874.00, plus applicable taxes, as opposed to the regular rate of $1,310.00 plus applicable taxes, resulting in a $436.00 subsidy.

THAT Council approves the Qualicum Beach Chamber of Commerce for a one- time subsidy for the use of the Civic Centre on May 18, 2016, for their annual joint meeting by charging a reduced rate of $312.00, plus applicable taxes, as opposed to the regular rate of $587.00, plus applicable taxes, resulting in a $275.00 subsidy.

BACKGROUND The Town policy states that applications will be considered for a specific event that benefits the residents of the Town of Qualicum Beach. Applicants must be locally- based and that their efforts are community-based in nature. If the primary purpose of

SUMMARY Five applications for subsidy were submitted for use of the Civic Centre. Applications are evaluated based on the current Town policy and budget implications. Staff encourages use of the Civic Centre and Community Hall and makes every effort to accommodate organizations in their events. The above recommendations result in a total of $1,412.00 in subsidies for use of the Civic Centre bringing a diverse range of events and opportunities for our community.

PURPOSE To provide Council with the August Fire Rescue Department report.

BACKGROUND The Qualicum Beach Fire Department services the Town of Qualicum Beach and Regional District areas of approximately 34.5 square kilometres with an estimated population of 10,500 in the fire protection area. Fire Rescue services range from structure fires, interface fires, automobile accidents and specialized service.

SUMMARY Between August 1 and August 31, 2015 the department has had a total of 23 calls of service. The following is a breakdown of the incidents. 6 Motor Vehicle Accidents 9 Duty Officers 3 Medical Aids 1 Hydro Related Incident 3 Alarm Activations 1 Brush Fire Incident Staff Hours: 14 hours, 25 minutes Average Response Time: 7.79 minutes TOTAL CALLS OF SERVICE: Calls of Service 2015. There has been a total of 175 responses since December 1, 2014. The following is a breakdown of total incidents in 2015 to date. December 2014 - 11 incidents May 2015 - 24 incidents January 2015 - 13 incidents (11 incidents reported) June 2015 - 24 incidents February 2015 - 18 incidents (16 incidents reported) July 2015 - 30 incidents March 2015 - 17 incidents April 2015- 15 incidents

REPORT ANALYSIS There are two reports attached. The first is an Unaudited Preliminary Consolidated Statement of Financial Position (Balance Sheet). This essentially lists the Town's assets and liabilities as at July 31, 2015. Please note that there have been no accrual adjustments made for the 2015 balances. For example, the utility bills will be sent out in October for the period May 1 to September 30, 2015. Three months of this bill, May 1 to July 31, 2014, relates to this July 31, 2015 Statement of Financial Position. These types of accrual adjustments are only done at year end.

The second attached report is the Financial Plan report listing revenues and expenditures to July 31, 2015 with a comparison to July 31, 2014.

RECOMMENDATIONS: (1) THAT the bylaw entitled "Town of Qualicum Beach 2016 Taxation Exemption Bylaw No. 701, 2015" be introduced and read a first time. (2) THAT the bylaw entitled "Town of Qualicum Beach 2016 Taxation Exemption (Places of Worship) Bylaw No. 702,2015" be introduced and read a first time. PURPOSE: To exempt certain properties from municipal property taxes for the 2016 tax year.

BACKGROUND: Section 220 of the Community Charter provides for statutory tax exemptions for a range of properties including those held or used by the province, local governments, libraries, hospitals, schools, cemeteries and places for public worship. For some properties, such as those used for public worship, the statutory exemption is limited to the building and land beneath the building; however, the land surrounding the building and land or ancillary buildings attached to the place of worship, may also be given permissive exemption by Council. Section 224 of the Community Charter provides Council with the authority to grant permissive tax exemptions (PTE) for properties used by a variety of non-profit organizations and for some properties which are additional to the Section 220 statutory exemptions, such as church halls or land around surrounding places for public worship and privately-run schools. Council may exempt a property for a single year or a period of up to ten years, exempting lands or improvements, or both (including portions of lands or improvements) from municipal property taxes, subject to specific conditions and adoption of a bylaw. The decision to grant a PTE is at Council's discretion, provided that the qualifying criteria specified in the Community Charter (s. 224 - 225) is established to Council's satisfaction. There is no obligation to give an exemption. The onus is on each organization requesting a PTE to demonstrate how they meet the eligibility criteria in the Community Charter. Eligible examples include property owned/held by a charitable, philanthropic or other not for profit corporation and used for that purpose; owned/held by a local government or authority and used for that purpose; owned, used or occupied by a religious organization for the purpose of their Church or occupied for public worship; owned/held by an athletic or service club or association for public park, athletic or recreation purposes, etc. PAGE 3) Town of Qualicum Beach September 14, 2015 Regular Council Agenda — Property Tax Exemption Bylaws Page 2 of 3

The Community Charter also requires the Town to publish notice of Council's intention to adopt a PTE bylaw. The notice must identify the property, the proposed exemption, the number of years for which the exemption may be provided, and provide an estimate of the amount of taxes that would be imposed on the property if it were not exempt for the year in which the proposed bylaw is to take effect and the following two years. The bylaw must be adopted by October 31 in the year before which the exemption applies. While Section 224 permits exemption from municipal taxes, there are similar provisions in other taxing authority legislation to extend the exemption to those levies. The Community Charter provides that a PTE bylaw ceases to apply to property, the use or ownership of which no longer conforms to the conditions necessary to qualify for exemption, and after this, the property is liable to taxation. In 2007, section 165 of the Community Charter was amended to include a requirement that municipalities set out their objectives and policies related to the use of the permissive tax exemptions in their annual financial plan. The Town's Financial Plan (2015-2019) Bylaw No. 694, 2014 states: "The Town of Qualicum Beach annually exempts from property taxes those properties that are non-profit in nature and provide a community benefit as determined by Council. Places of public worship are also exempted. These properties are annually advertised and then exempted by bylaw." The Town also publishes a Statement of Property Tax Exemptions in the Annual Report, in accordance with section 98(2)(b) of the Community Charter, listing the properties exempted, the organization benefitting, and the value of the permissive property tax exemption. In 2009, Council adopted Bylaw No. 646 (copy attached), exempting the Island Corridor Foundation properties for ten years (2010-2019), therefore, those properties are not included in the attached bylaws but are included in the Annual Report list of exempted properties and will be until the Town's commitment is fulfilled in 2019. Other municipalities along the rail line have also adopted 10-year tax exemptions for ICF, e.g. City of Parksville adopted Bylaw No. 1474 in 2011, exempting ICF lands from municipal property taxes from 2011 - 2021. Historically, as there has been little change in entities and the list of properties that are included in the exemption bylaws, there is no annual application process. Staff prepare the draft bylaws for Council consideration, after considering any new facilities or operations, requests for amendments, and a review of the prior year's list to confirm that the non-profit entity is still in operation on the site.

PROJECT INFORMATION: Staff has prepared the PTE bylaws required to provide for property tax exemption for one year (2016). If the PTE bylaws are given first reading, the bylaws will be presented for additional readings at subsequent Council meetings, and the statutory notice will be advertised two times before presenting the bylaws to Council for consideration of adoption. Attached is a draft of the notice, detailing the estimated amount of taxes that would be foregone. The two bylaws must be adopted on or before October 31, 2015 to exempt properties from 2016 taxes. ALTERNATIVES • Amend the bylaws by adding or deleting properties, or instructing staff to add conditions or other criteria, for example, not providing PTE for a specific class of property • Begin a program of reducing the level of property tax exemptions, by instructing staff to prepare a draft policy to implement an application process and provide guidelines for Council to evaluate applications, prioritize by criteria, or establish a cap. Some of these local governments may also be offering grants-in-aid (which the Town of Qualicum Beach does not) that may offset a reduced level of property tax exemptions. • Other direction of Council.

A BYLAW TO EXEMPT PROPERTY FROM TAXATION

WHEREAS, Section 224(2)(a)(i)(c) of the Community Charter provides that Council may exempt from taxation land or improvements that are owned or held by a charitable, philanthropic or other not-for-profit corporation;

AND WHEREAS, Section 224(2)(i) of the Community Charter provides that Council may exempt from taxation land or improvements owned or held by an athletic or service club or association and used as a public park or recreation ground or for public athletic or recreational purposes;

AND WHEREAS, Section 225(b) of the Community Charter provides that Council may exempt from taxation heritage property;

AND WHEREAS, Section 224(4)(c) states that a bylaw does not apply to taxation in a calendar year unless it comes into force on or before October 31st in the preceding year;

NOW THEREFORE, the Council of the Town of Qualicum Beach, in open meeting assembled, enacts as follows: 1.
