Penalty. 1 FOR REFERENCE ONLY (April 2017) RURAL GOVERNMENT ORDINANCE (Cap. 132) TUARAN DISTRICT COUNCIL (TAMU) BY-LAWS 1958 (G.N.S 96 of 1958) In exercise of the powers conferred upon it by subsection (1) of section 15 of the Rural Government Ordinance, and all other powers thereunto it enabling, the Tuaran District Council has made the following by-laws: Title and application. 1. These by-laws may be cited as the Tuaran District Council (Tamu) By-laws 1958 and shall apply to all tamu established in the Tuaran local area. Interpretation. 2. In these By-laws — "tamu" shall mean the open-air markets established by the Tuaran District Council at the following places — Tuaran Tamu Ground, Tamparuli Tamu Ground, Tenghilan Tamu Ground, Berungis Tamu Ground, Topokon Tamu Ground, Kiulu Tamu Ground, Kalawat Tamu Ground, Selupoh Tamu Ground. 2 FOR REFERENCE ONLY (April 2017) Licence. 3. No person shall sell any commodity in any tamu without a licence which may be issued by the President or the Deputy President of the District Council in his discretion, and subject to such conditions as he may see fit to impose. Appeal. 4. Any person whose application for a licence has been refused may appeal to the District Council at its next meeting, and the decision of the District Council shall be final. Fees. 5. The following fees by way of stallage shall be paid for licences issued under by- law 3 — (a) for a licence to sell cloth and … RM7.00 per month general merchandise of all kinds not being of local manufacture (b) for a licence to sell fruits, … RM0.25 per month vegetables, dried or fresh fish, betel-nut, salt, cakes and any other local products otherwise than from a stall (c) for a licence to sell tobacco … RM1.00 per month (d) for any other licence … RM4.00 per month Tamu Master. 6. The District Council may appoint any person to be Tamu Master for any tamu, who shall be charged with the keeping of order in and the general management of the tamu. 3 FOR REFERENCE ONLY (April 2017) Penalty. 7. Any person who — (a) sells any commodity in any tamu without a licence issued under these By-laws; or (b) takes or attempts to take into any tamu any intoxicating liquor; or (c) has in his possession in any tamu any firework, firearm or any offensive weapon; or (d) being a licensee fails to comply with any lawful direction of the Tamu Master, shall be guilty of an offence against these By-laws and shall be liable to a fine of twenty-five ringgit or one month’s imprisonment. 4 .
