Recreation Director Cynthia Williams presented an award received by the Glynn County Recreation Department from the Georgia

Recreation and Parks Association, which she planned to have framed so it could be put on display in the Court House.

I{HEREAS. or May 12, L992, the citizens of Glynn County enjoyed a once in a Iifetime opportunity when they welcomed the Spanish replicas of the historic seagoing vessels the Nina, Pinta and Santa Haria to The Golden Isles of Georgia; and

WHEREAS, the opportunity of sharing in the 500th celebration of Christopher Columbus, and acknowledging the Spanish heritage and presenee in the early history of the State of Georgia and the County of Glynn presented a unique educational opportunity for young students, adults and visitors; and

I|HEREAS, The St. Simons Island Chamber of Conunerce, under the expert leadership of Uildred Wilcox did an outstanding job of orchestrating this event and making it, an occasion that GIynn County wiII long remember.

NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED, by the Board of Commissioners, GIynn County, Georgia. this 5th day of November, 1992, that we present this Resolution to l,tillie Wilcox and the st. $imons Island Chamber of Conunerce, for efficiently staging this historic event which was enjoyed by a tremendous number of citizens and visitors of The Golden Isles. ***

Ms. Wilcox's mother, Mildred Huie, a well known local artist, presented a framed painting of the Historic Court House to the Commission as a gift. Mrs. Iluie commented that she was born the same year the Historic CourL House was constructed, and painting this beautiful structure for the Commission was a labor of love.

GLYNN COUNTY ADA GRIEVANCEPROCEDURE

Glynn County Board of Commissioners has adopted an internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by the U.S' Department of Justice regulations implementing Title II of the Americans with Disabilities Act. Title II states, in part, that "no otherwise qualified disabled individual shaIl, soIeIy by reason of such disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination" in programs or activities sponsored by a public entity.

Complaints should be addressed to: Becky Rowell, P. O. Box 879, Brunswick, Georgia 31521, who has been designated to eoordinate ADA compliance efforts.

1. A complaint should be filed in writing, contain the name and address of the person filing it, and briefly described the aI leged violation of the regulations. The Board of Commissioners wilI be notified immediately of any complaint(s) filed.

2. A complaint should be filed within fifteen days (15) after the complainant becomes aware of the alleged violation. (Processing of allegations of discrimination which occurred before this grievance procedure was in place will be considered on a case-by-case basis. )

3. An investigation, as may be appropriate, shall follow a filing of complaint. The investigation shall be conducted by Becky RowelI . ARTICLE I - NAME

Section 1. The name of this organization shal 1 be the Citizens SoIid Waste Management Advisory Committee (hereinafter the "committee").

ARTICLE II - PURPOSE

Section I. The purpose of this committee is:

A. To institute and carry out a process of analyzing solid waste alternatives and policies, and to recommend solutions for responsible and cost effective solid waste management to the Glynn County Board of Commissioners and the County Administrator.

B. To develop a plan to educate the citizenry of Glynn County concerning the costs and Iiabilities of managing the waste they produce, and to promote solid waste management practices which encourage public participation in solid waste management programs.

ARTICLE III - MEMBERSHIP

Section t. The Committee shal I consist of not more than twenty-one (21) members, being representative of business and industry, education, community organizations, and the citizenry at-large. Members who have an interest in or experience with solid waste management shall be appointed by the GIynn County Board of Commissioners.

Section 2, Non-voting ex-officio members, ES deemed appropriate, may be designated by the Committee and/or the Glynn County Board of Commissioners.

Section 3. !,lembers shall serve for terms of three (3) years or until their successor is appointed, except that the initial terms shall be staggered as stated herein. All subseguent appointments for full or partially expired terms shall be made by the Glynn County Board of Commissioners. No person may serve more than two (2) consecutive tul1 terms on the Committee. Terms of office will began to run effective January 1, 1993.

Section 2. Vacancies in office shalI be fil1ed immediately by regular election procedures.

Section 3. The Chairperson shall preside at all meetings, cal I special meeti[9s, render reports, appoint subeommittees and designate a specific member or members to perform Committee functions. A GIynn County Administration staff person will function as secretary in keeping committee minutes and providing clerical support as necessary.

Section 4. The Vice-Chairperson shal I perform the duties of the Chairperson in his or her absence, and assist the Chairperson as requested at other times.

Section 5. Officers shal I not receive compensation for service as an officer.

ARTICLE V - MEETINGS

Section I Regular meetings of the Committee shall be held on the second and fourth Thursdays of each month at 4:30 p.m. at the old Courthouse, or a location designated by the Chairperson. The membership will receive seven days written notice of al ] meetings. A regular meeting may be cancelled by the Chairperson with prior notice to the membership forty-eight (48) hours prior to the time of the meeting.

Section 2. Special meetings may be called by the Chairperson at his or her discretion, or at the request of two or more members. Every effort will be made to give forty-eight (48) hours notice, either in writing or by phone, of the time and place of such meetings.

Section 3. Fifty-one percent of the membership of the committee shall constitute a quorum. Actions of the Committee shal 1 be accomplished at any meeting by simple majority vote of those present.

Section 4. If any member of the Committee misses three (3) consecutive meeLings without providing notification by letter or phone to the Chairperson and/or staff, the Chairperson shall notify the member in writingr that unless he/she attends the next regularly scheduled meeting, the Chairperson must recommend his/her resignation from the Committee.

ARTICLE VI - COMMITTEES Section 1. The Executive Committee, a standing committee, shalI consist of the officers, and staff as ex-officio members, and shal I determine the responsibilities of any other committees formed.

Section 2. The Chairman, in consultation with the Executive Committee, rndy appoint subcommittees as may, from time to time, be needed or advisable. Such subcommittees may include members not serving on the Committee.

ARTICLE VII - PARLIAMENTARYAUTHORITY

Section 1. Any rules of parliamentary procedure not covered by these by*laws shall be governed by the latest edition of "Robert's RuIes of order".

Corps of Encrineers will Attach Tidal Gauqe Monitorinq Equipment to the St. Simons Pier.

Harbor Pilot Edwin Fendig urged the Commission to take

positive action on request submitted by the U. S. Corps of Engineers

for permission to install Tidal Guage Monitoring Equipment on the St.

Simons Pier and in the New Casino Building. He explained that the

presence of this equipment would enable the Corps to dredge more

efficiently and economically, and harbor pilots would have an added

measure of safety in being able to access this equipment by radio

when taking ships through the channel with a minimum of clearance.

A motion was made by Commissioner Boyne and seconded by

Commissioner Dismer accepting Mr. Fendig's recommendation and

approving request of the U. S. Corps of Engineers to locate Tida1

Guage Monitoring Equipment in the New Casino Building and on the St.

Simons Pier.

Unanimously adopted.

Green Ribbon Committee Addresses Several Issues.

On behalf of the Green Ribbon Committee, Bob Drury

addressed several issues he considered important to the County. He

read excerpts from the Georgia Constitution which he said guaranteed

al 1 citizens certain rights, and he read a prepared statement

regarding questions of his credibility. l,[r. Drury related that he

had submitted a complaint in writing against Ed SteIle and Charles

stewart, and Staff had been remiss in allowing those issues to ga

unaddressed.

Following a presentation by Randall Morris and BiII Parker

on behalf of the Brunswick and Glynn County Development Authority, a

motion was made by Commissioner Hardman and seconded by Commissioner

1) That in consideration of current payments, the County agrees to accept two annual payments of $95,000 each as payment in full for a receivable of #2L7,700; and

2) Authorizing transfer of the 15-acre Blueberry Road Tract and the 28-acre Fuel Farm Tract to the Development Authority, subject to review and approval by the County Attorney.

Stanley Whitt asked the Commission to oppose the Jekyl I IsIand Authority's proposal to develop a facility on the south end of the Island to dock ships.

A motion was made by Commissioner l'{oore and seconded by

Commissioner Hardman that a Ietter be forwarded to the Corps of

Engineers stating the Commission's objection to Jeky1l Island being used as the site for this docking activity, particularly since years of effort had gone into development of port facilities in Brunswick and on Colonels Island, and asking them to consider these alternate sites.

Chairman Tillman said he would talk to the Governor in an effort to get a IocaI citizen appointed to the Jekyl I Island

Authority.

Wetlands Task Force.

Ronnie Perry, Chairman of the Wetlands Task Force, asked that the Wetlands Task Foree either sunset, oy that the Commission appoint new members - possibly after the first of the year when the new Commission would be sitting.

Chairman Tillman asked Mr. perry to bring this recommendation before the new commission in January of 1993.

Jazz Festival at Gascoiqne Bluff.

A motion was made by Commissioner Boyne and seconded by

Commissioner Dismer granting Harry Aiken's request to hold a Jazz and

Seafood Festival at Gascoigne B1uff on November 2I, L992, subject to the County Attorney's approval of insurance documents and, if needed, a hold harmless agreement.

Unanimously adopted.

Airport Road Proiect.

County Engineer Ray Richard presented information on the

$600,000.00 Airport Road Concept PIan recommendedby the St. Simons

Island Transportation Study Committee.

Tad Meeks described the proposed project as an overkill, and suggested that another public hearing be held on St. Simons

IsIand in the evening hours. Bob Drury questioned public hearing requirements as related to use of federal and/or state money for this project.

Commissioner Moore responded that the Commission had voted three years earlier not to use federal or state funds for any of the major road projects on St. Simons Island, so that total control could be retained by the County. Engineering Consultant Dan Altobelli concurred that the Commission had decided to make these local projects, however, public hearings had already been held which held the door open in the future for state and federal funding. Jim Robertson discussed tree survey requirements, and Mr.

Richard responded that three oak trees near Demere Annex were in question on this project, and the Transportation Committee recommended that they be transplanted.

Commissioner Dismer said his original concept in recommending improvements to Airport Road had been simply to divert tratfic from Demere Road along BIoody Marsh curve to Airport Road by modifying both ends of Airport Road and the curbs at a maximum cost of $f00,000.00. He described the 5600,000.00 plan as being ahead of its time, and suggested sticking to basic improvements which would save Iives and protect the trees.

Betsy Ellzey asked if the road projects on st. Simons

Island were going to be a part of the federal highway system. Mr.

Altobelli replied that there were no federal roads - only city, county or state - and all the roads on St. Simons Is1and were County

Roads. Ms. Ellzey then asked why 5a1es Tax money was designated for the Airport Road project when dirt roads in Harrington and Jewtown remained unpaved. Commissioner Moore replied that the County had paved all public roads that had been brought up to standard on St.

Simons Island, and the unpaved roads referred to by Ms. Ellzey were private roads.

Chairman Tillman brought the discussion of this proposed project to a close.

1993 Liquor, Beer and Wine License Renewals.

Attorney CaIdweII said they preferred not to be burdened by a reversionary clause, and they favored approaching this concept from a contractual standpoint should the Authority cease its operations.

2-3-19 Transferability.

No license for the sale of alcoholic beverages shalI be transferred from one Iocation to another. The holder of any license issued under this Ordinance must inform the Finance Director of Glynn County in writing whenever such owner selIs, surrenders, Ioses or transfers in any way any ownership interest or managerial rights with respect to the establishment for which the license is issued. No license for the sale of alcoholic beverages shall be transferred or continued after a Iicensee dies or severs their ownership of the licensed establishment except as provided herein:

(a) In the case of the death of a licensee, the establishment sha1I be allowed to continue to sell alcoholic beverages for a period of thirty (30) days from the date of death of the licensee or any one of the licensees or until the expiration of the existing Iicense or until the approval of a new license for the establishment, whichever occurs first.

(b) In the event that a licensee who holds a license with other licensees severs his association with a licensed establishment, the establishment may continue to seIl alcoholic beverages for a period of thirty (30) days from the date of surrender or the date determined by the Glynn County Finance Director to be the date of severanee based upCIna reasonable interpretation of the information available to him. PROVIDED,HOWEVER, that no such continued sales shall be allowed until such time as an application for a transfer to the name(s) of the new owners shall have been filed with Glynn County. Such application for transfer shall set forth the new ownership of the establishment or the licensed corporation, name the severed licensees and provide such information as the GIynn County F'inance Director shal1 request to document the change of interest, control or ownership. For purposes of this ordinance, a severance shall have occurred when any partner or joint venturer or other holder of a Iicense shal I have sold his ownership interest in said Iicensed establishment except that no severance shall have occurred where the licensee is a corporation and less than 204 of any class of stock of the corporation shall be sold. A name change without any transfer of stock of any corporation or ownership of any partnership shal 1 not be a severance.

(c) Except as provided herein, Eoy change in the ownership of an entity holding a license shall cancel and revoke any alcoholic beverage license issued by clynn County for the establishment automatical 1y, without the necessity for any hearing.

(d) A transfer fee of S100.00 and an investigation fee of $250.00 per Iicense to be transferred shall accompany any application for transfer.

(e) No license shall be transferred if any prospective owner fails to meet the requirements of a licensee as set forth in this Code of ordinances or in state law at the time of transfer.

(f) Any violation of this section shaII result in revocation of the license for the establishment involved and a fine up to S1,000.00 or up to sixty (60) days imprisonment or both for both the old and the new ownership.

by Forestry for the remainder of the fiscal year so this individual

Ietter for the Chairman's signature authorizing the Sheriff not to bid in pending tax deed on Escambia/Brunswick Wood preserving property for the County, because of potential hazard associated with the property.

Corps of Enqineers Dredqe Site.

County Attorney Gary Moore said he had received a document from the Corps of Engineers announcing their intent to continue disposing of materials dredged from the channel at an off-shore dump site, and the Commission had until November 12 to make comments on this proposal.

Commissioner Moore said she intended to personally write a

Ietter to the Corps objecting to this dredge material being placed outside the sand sharing system.

Chairman Tillman said he did not feel competent enough to say what should be done on this issue, and no position was taken by the Commission.

Ouitclaim Deed to Estate of Ida Mae Turner.

under Major Wright Road to his property.

f) Purchase 5'x 6' or 7' nylon flags to f1y at Demere Annex and Neptune Park;

2) Installation of new cleats higher up on the flag poles so the flags could not be accessed except by ladder; and

3) Relocation of lighting to top of building so people would not stumble over the Iights, and installation of photo electric cells so the flags could fly day and night.

Chairman Tillman approved Commissioner Boyne's suggestion

signatures of people requesting better service for their money from

Rentavisi on.

representatives Bob Hymsomand Leonard Tow on a personal basis about

Administrator Stewart advised that he had received a copy of a letter written by U. S. Corps of Engineers Representative,

Colonel Holzwarth, to Department of Transportation Commissioner,

Wayne Shackelford, stating that Glynn County owed the Corps

S90,446.66 (representing 2L.4 percent of the work actually performed) for work on the 933 Beach Nourishment Project.

A motion was made by Commissioner Boyne and seconded by

Commissioner Moore authorizing Administrator Stewart and Attorney

Moore to prepare a Ietter to the Corps for the Chairman's signature, with a copy to Mr. Shackelford, stating that Glynn County wanted the remaining funds held in escrow by DOT returned to the County for use in defeasing the Beach Nourishment Bonds.
