Blackstone As Architect: Constructing the Commentaries Blackstone as Architect: Constructing the Commentaries Wilfrid Prest* On January 28, 1746, as Cumberland's forces pursued the retreating Jacobite army into Scotland, a twenty-three year old newly-minted Bachelor of Civil Law and junior fellow of All Souls College sat down to write a characteristically cheerful letter to his lawyer uncle Seymour Richmond, shortly after reaching "my new Habitation (which is at Mr Stoke's a Limner in Arundel St)."' In the light of what is becoming clear about William Blackstone's own accomplishments and interests in draftsmanship and the visual arts, his choice of London lodgings was perhaps not entirely accidental. Be that as it may, this report on what was seemingly Blackstone's first serious encounter with the common law (even though he had by now accumulated a full five years' standing at the Middle Temple), exudes a jaunty self-confidence, couched in topically martial language: "I have stormed one Book of Littleton, & opened my Trenches before ye 2d; and I can with Pleasure say I have met with no Difficulty of Consequence...." Yale Journal of Law & the Humanities, Vol. 15, Iss. 1 [2003], Art. 3 Yale Journal of Law & the Humanities [Vol. 15:103 common law's notoriously arid mysteries held no terrors for a person of his intellectual precocity, William went on to muse in more general terms about the nature of the body of knowledge with which he was now becoming acquainted, as it would seem for the first time: I have sometimes thought that ye Common Law, as it stood in Littleton's Days, resembled a regular Edifice where ye Apartments were [?purposely: word crossed through] disposed, leading one into another without Confusion, where every part was subservient to ye whole, all uniting in one beautiful Symmetry, & every Room had its distinct Office allotted to it. But, as it is now, swoln, shrunk, curtailed, enlarged, altered & mangled by various & contradictory Statutes &c; it resembles ye same Edifice, with many of its most useful Parts pulled down, with preposterous Additions in other Places of different Materials & coarse Workmanship according to Whim, or Prejudice, or private Convenience of ye Builders. By which means the Communication of ye Parts is destroyed, & their Harmony quite annihilated; & now it remains a huge, irregular Pile, with many noble Apartments, tho' awkwardly put together, and some of them of no visible Use at present. But if one desires to know why they were built, to what End or Use, how they communicated with ye rest & ye like; he must necessarily carry in his Head ye Model of ye old House, which will be ye only Clew to guide him thro' this new Labyrinth.2 This passage bears quoting at length, if only to indicate the remarkably detailed elaboration of its extended architectural metaphor, which to the best of my knowledge is unique, both in terms of scale and concrete specificity, among the writings of English common lawyers between the sixteenth and eighteenth centuries. True, William Lambard opened the dedicatory epistle of his Archaionomiawith an extended figure of speech comparing laws to the walls of a city,' while Sir Edward Coke famously pronounced in his First Institutes that "the knowledge of the law is like a deepe well, out of which each man draweth according to the strength of his understanding,"' and Matthew Hale's posthumously published 2. SIR EDWARD COKE, THE FIRST PART OF THE INSTITUTES OF THE LAWES OF ENGLAND; OR A COMMENTARIE UPON LITTLETON at fol.71a (London, Society of Stationers 1628). https://digitalcommons.law.yale.edu/yjlh/vol15/iss1/3 2 Prest: Blackstone as Architect 2003] Prest History of the Common Law of Englandrefers to the "common law" as "the complection and Constitution of the English Commonwealth."5 But these are little more than passing allusions and figures of speech, comparable to (if more approbatory than) the title of John Arbuthnot's extended political satire of 1712, Law Is a Bottomless Pit, or the proverbial likening of law to a cobweb, in which flies are caught but hornets go free, or alternatively where lawyer-spiders trap client-flies.6 Slightly closer to the point is a passage from Law or a Discourse Thereof by Henry Finch, a work which Blackstone himself would later single out as "a treatise of a very different character" from all its predecessors, due to Finch's "happy progress in reducing the elements of the law from their former chaos to a regular methodical science":7 "He that will take the whole body of the law before him, and go really and judicially to work, must not lay the foundation of his building in estates, tenures, the gift of writ and such like, but at those current and sound principles our bookes are full of."8 Yet even this, although nearer the form and sense of Blackstone's analogy, is an isolated departure from the usual practice of English legal writers of the period, who generally and typically refer to the common law in less imaginative, more abstract or prosaic terms, as a body of rules or precepts, compounded of custom, statute, judicial and professional learning, and reason, reflecting more or less closely the law of nature and nations.' Even the Yorkshire gentleman-lawyer Christopher Tancred invoked only a loose metaphorical association between laws and buildings when he made the claim that it is, "as absurd to think, that an antient Structure of human laws shou'd be as compleat as those of later date, so much to be improv'd by long experience, as that a House, contriv'd after the Old Fashion, can 5. ' 0 This paper aims to outline the nature and scope of Blackstone's architectural interests and to provide some tentative evaluation of their significance for our understanding of his life, thought, and writings. As will become apparent from Part II below, the architectonic analogy employed at the outset of Blackstone's common law studies was something more than mere ornament or literary conceit. But before venturing into that hitherto unexplored territory, some historiographical background may be helpful. I The past quarter-century has seen the emergence and acceptance of numerous interdisciplinary approaches to the history of law and legal institutions, coupled with a markedly greater willingness on the part of historians to take into account and come to terms with the law's cultural, economic, political, and social dimensions.

Recent research has shown that Stukeley was a polymath, whose related interests in astrology, Newtonian natural history and theol- ogy formed part of a broader Enlightenment world view.2 Yet, in the lengthy scholarship on Stukeley, insufficient attention has been paid to his interest in another intellectu- al and aesthetic pursuit of eighteenth-century cognoscenti: garden design.3 Stukeley’s voluminous manuscripts attest to his role as an avid designer of gardens, landscapes and garden build- ings. His own homes were the subjects of his most interesting achievements, including his hermitages at Kentish Town (1760), Stamford (Barnhill, 1744 and Austin Street 1737), and Grantham (1727).4 In this, Stukeley can be located among a number of ‘gentleman gardeners’ in the first half of the eighteenth century from the middling classes and the aristocracy.5 He toured gardens regularly, and recorded many of them in his books, journals and cor- respondence. His 1724 Itinerarium Curiosum recounts his impressions of gardens, including the recent work at Blenheim Palace and the ‘ha-ha’ in particular, and his unpublished notebooks contain a number of sketches such as the gardens at Grimsthorpe, Lincs., where he was a reg- ular visitor.6 Stukeley also designed a handful of garden buildings, apparently as gifts for friends and acquaintances.

Both architects developed architectural theories regarding the universal origins of architecture in an attempt to establish order as well as transcend the emerging historicism of the early nineteenth century. There are strong parallels between Soane's use of architectural narrative and his discussion of architectural 'model' in relation to Gandy's understanding of 'trans-historical' architecture. The primary textual sources discussed in this thesis include Soane's Lectures on Architecture, delivered at the Royal Academy from 1809 to 1836, and Gandy's unpublished treatise entitled the Art, Philosophy, and Science of Architecture, circa 1826.

The original steel-engraved plate in this set is by ‘Phiz’ (Hablot Knight Browne), who was Dickens’ friend and the most highly regarded illustrator of his works.

Stunt Some ten years ago when my book From Awakening to Secession was published, I had to concede defeat over the identities of some shadowy figures, who appeared in its pages and who, I had to admit, were little more than names. In 2010, much more information (especially genealogical) has found its way onto the web and my search skills are greatly improved. One of these unknown characters was a loyal English friend of the Bourg-de-Four Assembly (later known as La Pélisserie) in Geneva. In his account of the early Genevan réveil, one of the earliest members of that assembly, Émile Guers, briefly referred to Eliza Cooke as one who in the early days of persecution (c.1820) ‘stayed with us for a long period of time and whose memory will always remain precious to those who knew her’. He also recorded that, shortly before her death, she had contributed £500 towards the building of the Pélisserie assembly in 1837. Her home at Hilton Park, outside Wolverthampton, is also mentioned in the Mémoires of Ami Bost, who visited England in 1835 and was nursed through a serious illness there by Eliza Cooke and her niece.     Notes on Contributors / Remembering Roy Porter Not only was Roy Porter a brilliant scholar and a dedicated colleague, he was also a remarkable, generous and idiosyncratic individual – in fact, he was exactly the kind of person about whom Roy himself loved to write. We were all lucky that our lives were enriched by his presence. In this section, conventionally reserved for descriptions of ourselves, many of us have also added favourite memories of Roy, or moments when his influence shaped our ideas and careers. Roberta Bivins is Wellcome Lecturer in the History of Medicine at Cardiff University. The topic of her most recent book,Alternative Medicine? A Global Approach (2007), was suggested to her by Roy Porter many years ago. She is now studying the reciprocal impact of immigration and medical research/healthcare delivery in the US and UK since the Second World War. ‘As a nervous PhD student, I came to Roy via the most tenuous of connections: my American supervisor happened to know Roy’s wife. It is typical of his generosity that Roy invited me to London sight unseen, simply as a favour to his wife’s acquaintance. Dutifully, he scheduled regular lunches with me to check on my progress.     HISTORIES OF BRITISH ART 1660-1735 RECONSTRUCTION AND TRANSFORMATION ABSTRACTS OF PAPERS Day 1 (Thursday) Panel 1 Netherlandish influences on British Art Sander Karst (University of Utrecht) ‘The participation of Dutch Migrant artists in the London art market at the end of the seventeenth century’ In this paper presentation I will focus on the many Dutch migrant artists who participated in the London art market at the end of the seventeenth century. During this period London started to take over from Amsterdam as Europe’s most important economic centre. Due to an economic depression in the Dutch Republic, the demand for paintings in the republic decreased, the Dutch art market collapsed and many artists were forced to seek their fortune abroad. Most of them migrated to London. In London these Dutch artists found a new market for their paintings and anticipated the increasing demand for luxury products among London’s inhabitants. Whereas in the Dutch Republic pictures auctions had been organised from the early seventeenth century onwards and had enabled artists to produce their paintings on speculation, in London similar market conditions only began to emerge during the 1670s. For my masterthesis I made an analysis of as set of 132 London auction catalogues which cover the period between May 1689 and March 1692 (British Library, shelfmark 1402.g.1). This analysis demonstrates that 49% percent of all paintings which were offered at these auctions, and which were attributed to a specific artists, were produced by Dutch migrant artists. 1 During my paper presentation I will explain this analysis and will argue that the market for contemporary paintings was dominated by London-based Dutch artists.
