THE CORPORATION OF THE MUNICIPALITY OF SIOUX LOOKOUT

BY-LAW NO. 93-15

BEING A BY-LAW TO APPROVE PLAN OF SUBDIVISION APPLICATION NO. S01-15 ( DISTRICT SERVICES BOARD (KDSB)), BEING AN APPLICATION FOR DRAFT PLAN APPROVAL OF A 12-LOT PLAN OF SUBDIVISION IN HUDSON (BERNIER CRESCENT)

WHEREAS pursuant to Section 51(7) of the Planning Act, RSO 1990, cP13, and 0. Reg. 353/02, s. 3, whereby the Minister of Municipal Affairs & Housing has delegated authority to approve plans of subdivision to The Corporation of the Municipality of Sioux Lookout; and

WHEREAS The Corporation of the Municipality of Sioux Lookout has received an application for approval of a plan of subdivision (Application No. S01/15) from the Services Board for a twelve (12) lot plan of subdivision on Bernier Crescent in Hudson; and

WHEREAS The Corporation of the Municipality of Sioux Lookout has completed the required due diligence for land use planning approvals, including the holding of a public meeting on said application on October 21 st, 2015; and

WHEREAS the Council of The Corporation of the Municipality of Sioux Lookout deems it advisable and expedient to approve Plan of Subdivision Application No. S01-15 with certain conditions;

NOW THEREFORE, the Council of The Corporation of the Municipality of Sioux Lookout ENACTS AS FOLLOWS:

1. THAT draft plan approval is hereby given to Plan of Subdivision Application No. S01-15, being a 12 lot plan of subdivision as set out in Schedule "A" to this By-law.

2. THAT Plan of Subdivision Application No. S01-15 is hereby approved with such conditions as set out in Schedule "B" to this By-law.

3. THAT Schedule "A" and Schedule "B" are and form part of this By-law.

4. THAT the Mayor and the Clerk are authorized to sign the Final Plan of Subdivision prior to registration.

5. THAT this By-law shall come into force and take effect on the date of its final passing.

READ A FIRST, SECOND AND THIRD TIME AND PASSED THIS EIGHTEENTH DAY OF NOVEMBER, 2015.

010-1604 SCHEDULE "B" TO BY-LAW NO. 93-15

Conditions of approval for Plan of Subdivision Application No. S01-15 (Kenora District Services Board (KDSB)):

1. That a final plan of subdivision be prepared by an Land Surveyor (OLS) in a form acceptable for registration with the Land Titles Office.

2. That the road allowance (Bernier Crescent) be transferred to The Corporation of the Municipality of Sioux Lookout (at KDSB's cost).

3. That the subject property be rezoned to reflect the lot sizes and set-backs as detailed in the Planning Report dated September 17, 2015.

Note: The applicant has five (5) years to meet the conditions of approval, ending November 18, 2020.
