Under the Personal Property Securities Act 1999, a repairer’s lien over goods takes priority over any security interest in the same goods. Because of the nature of their work, ordinary security interests taken by repairers are likely to lose in any priority dispute. This paper addresses two broad points within this issue. Did the municipal utility provide the owner notice of the tenant’s past due balance(s) within 14 days of being late? (If utility failed to notify the owner then utility cannot tax lien the owner for that amount ever.) October 1st utility creates listing of all accounts with outstanding balances.
