MARQUETTE LAW REVIEW Volume 82 Spring 1999 Number 3 CONVENTIONAL WISDOM: THE COURTROOM TRIAL IN AMERICAN POPULAR CULTURE* DAVID RAY PAPKE** The courtroom trial takes place not only in actual courthouses but also in literature, film, and television. And indeed, while only a minor- ity of Americans have participated in or even watched a real trial, nearly all have read or watched multiple trials in the courthouses of popular culture. This pervasive engagement with fictional and symbolic court- room trials must influence what the public expects both in actual court- rooms and in American society as a whole. This essay has three parts. Part One seeks to establish how ubiqui- tous the image of the courtroom trial has been and remains in American literature, film, and television. -

They were like two hummingbirds who had also never met. ... He fell for her like his heart was a mob informant, and she was the East River. ... Even in his last years, Granddad had a mind like a steel trap, only one that had been left out so long, it had rusted shut. ... Shots rang out, as shots are wont to do. ...The plan was simple, like my brother-in-law Phil. But unlike Phil, this plan just might work. ...He was as lame as a duck. See the list. Those Bedroom Eyes - William, a Harvard psychology professor is having trouble dealing with life after the death of his wife when he meets a beautiful woman named Ali. As their relationship grows, he begins to question her secretive past, which he discovers is linked to a series of murders that the police are investigating. Written by Anonymous. He tried to commit suicide. Afterwards they make love on board the train. A classy prostitute, calling herself Kiss and Die Eyes", shoots her customers to death. Her face is not seen, so the question is whether the woman on the Train and "Bedroom Eyes" are the same person. I am not really a fan of romantic films. I can reveal so much that Rogers' character suffers from multiple personality disorder. She has been abused by her father as a little girl. The film had been better if her Kiss and Die personalities had been the opposites of each other. Her "normal" personality is also unchaste She makes love on a train with a stranger she just met. This weakens the story. Tippi Hedren's character in "Marnie" was frigid. Joanne Woodward's characters in "The Three Faces of Eve" were different, only one of them was flirtatious. I don't know why the script writer decided to make her two personalities so similar. -
