THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING: 10 O R D E R The learned counsel for the petitioners suBmits that in the present petitions, he has challenged the constitutional validity of the Karnataka Private Aided Educational Institutions Employees (Regulation of Pay, Pension and other Benefits) Act, 2014. According to the learned counsel, the issue raised in the present petitions was also raised in W.P. No.21216 of 2014 and connected matters. The said writ petitions have Been decided By this Court By order dated 10-7-2015. By the said order, the co-ordinate Bench has struck down the said Act as Being unconstitutional. 2. The operative portion of the said order is as under: (i) Writ Petitions are hereBy allowed. 11 (ii) The Karnataka Private Aided Educational Institutions Employees (Regulation of Pay, Pension and other Benefits) Act, 2014 (Karnataka Act No.07/2014) is hereBy struck down as ultravires of Constitution of India as it is opposed to Article 14 of Constitution of India and also encroaches upon the judicial powers of the Courts as discussed herein aBove. (iii) Respondent – State shall continue to pay salary or pension as the case may Be, to petitioners and similarly placed persons as was Being paid pursuant to its earlier orders or in other words, as it was Being paid prior to impugned enactment. 12 OR Respondent - State shall comply with the directions already issued By this Court extending the monetary Benefits and treating the petitioners working in Private Aided Educational Institutions on par with the employees working in Government Institutions. (iv) In the event of respondent – State having recovered any amount/s pursuant to the impugned enactment, same is hereBy ordered to Be refunded to the respective petitioner/s By the State expeditiously, at any rate within eight weeks from the date of receipt of certified copy of this order. 13 3. Therefore, the learned counsel for the petitioners suBmits that the present petitions are equally covered By the said order.

    BHADRA VOLUNTARY RELOCATION INDIA INDIA FOREWORD During my tenure as Director Project Tiger in the Ministry of Environment and Forests, Govt. of India, I had the privilege of participating in voluntary relocation of villages from Bhadra Tiger Reserve. As nearly two decades have passed, whatever is written below is from my memory only. Mr Yatish Kumar was the Field Director of Bhadra Tiger Reserve and Mr Gopalakrishne Gowda was the Collector of Chikmagalur District of Karnataka during voluntary relocation in Bhadra Tiger Reserve. This Sanctuary was notified as a Tiger Reserve in the year 1998. After the notification as tiger reserve, it was necessary to relocate the existing villages as the entire population with their cattle were dependent on the Tiger Reserve. The area which I saw in the year 1998 was very rich in flora and fauna. Excellent bamboo forests were available but it had fire hazard too because of the presence of villagers and their cattle. Tiger population was estimated by Dr. Ullas Karanth and his love for this area was due to highly rich biodiversity. Ultimately, resulted in relocation of all the villages from within the reserve. Dr Karanth, a devoted biologist was a close friend of mine and during his visit to Delhi he proposed relocation of villages. As the Director of Project Tiger, I was looking at voluntary relocation of villages for tribals only from inside Tiger Reserve by de-notifying suitable areas of forests for relocation, but in this case the villagers were to be relocated by purchasing a revenue land which was very expensive.

While the policies and processes emanating from this paradigm have produced positive conservation outcomes for some Protected Areas, livelihood outcomes for the displaced people have seldom been as positive. This article examines whether the impoverishment risks arising from conservation-induced displacement tend to vary with the degree of marginalisation of the displaced community. In this light, this article examines in detail the impact on livelihood of conservation-induced displacement in two Protected Areas (PAs) of India. The article posits that understanding the dynamic livelihood context of displaced communities, especially the ecological base of their livelihoods, is critical to any assessment of their pre- and post-displacement livelihood strategies and livelihood outcomes (such as income, poverty, food security and health). A variety of livelihood parameters, including compensation received, consumption fl ows, agricultural production, monetary income, food security, headcount ratio of poverty and overall poverty indices have been studied, to understand the extent to which key livelihood risks arising out of displacement are addressed by the rehabilitation package and process in the two PAs. The Sahariya is a forest-dependent Adivasi community living in and around the Kuno Wildlife Sanctuary in the semi-arid tropical region of Madhya Pradesh.

Results of the study indicated that 60 plant species belonging to 50 genera and 35 families were used for preparing at least 78 herbal drugs by the medicine men. Among the plant species, the utilization of leaves of Centella asiatica, roots of Ichnocarpus frutescens and decoction of leaves of Bambusa arundinacea in the treatment of jaundice, diabetes and for expulsion of placenta in human’s and animals, respectively, are note worthy. Apart from the above, a few drugs formulated by the local people are not known to literature. According to a CAMP survey, Tylophora indica and Artocarpus hirsutus are vulnerable while, Dipterocarpus indicus and Rauwolfia serpentina are endangered and Spondias pinnata is a lower risk category plant. The information collected from these ‘local specialists’ enriches the countrywide database on the availability of biodiversity resources and gives full credit to the origin of information at different levels.     BRIEF NOTE ON UPPER BHADRA PROJECT Upper Bhadra Project is a major lift irrigation Scheme under implementation in the central region of Karnataka State. It envisages lifting upto17.40 TMC of water in first stage from Tunga river to existing Bhadra reservoir and lifting 29.90 TMC of water in second stage from Bhadra reservoir to Tunnel near Ajjampura, in Tungabhadra sub-basin of Krishna basin. After Tunnel, it is planned to irrigate an extent of 2,25,515 ha by micro irrigation in districts of Chikmagalur, Chitradurga, Tumkur and Davangere. The primary objective of the project is providing sustainable irrigation facility in khariff season and the other objective of the project is to recharge the ground water table and provide drinking water by filling 367 tanks in drought-prone taluks of the above said districts. Lately it is gaining the name of Pepper Kingdom, owing to the immense increase in earnings by this product in the district. Although per capita income is around 1.18 lakhs, disparities within the population is highly visible, mostly due to the fact that bulk of district GDP comes from Services sector like, Exports, Trade, Banking and Hospitality sector, in which larger population does not participate. The three distinctly different agro-climatic zones of the district also contribute to income disparities in the rural areas, with a sparsely populated hilly and Malnad region, that contribute income from plantations have a higher per capita earning than the plains of Central dry zone of Kadur taluk and Southern Transitional Zone of Tarikere and eastern parts of Chikkamagaluru taluk. High rainfall of Malnad region varying between 1900 mm to 3500 mm and scanty rains in Kadur and Tarikere taluks between 600 mm and 700 mm not only cause income disparities, but also challenges in distribution of water for agriculture and domestic use purposes, so much so some of the villages in high rainfall zone and scanty rainfall regions face drinking water issues in summer. The district has seized the Prime Minister’s Krishi Sinchayee Yojana as an opportunity to plan for better use of rain water for agriculture, domestic, livestock, industrial and other uses.
