HIGHWAYS ACT 1986

PARISH WALK (, , , , , AND PEEL) ORDER 201.0

Coming into Operation:26lune 2010

The Department of Infrastructure makes this Order under Section 38 of the Highways Act 1986'.

1 Title This Order is the (Marown, Santon, Malew, Arbory, Rushen, Patrick and Peel) Order 201.0.

2 Commencement This Order comes into operation on the26 June 2010.

3 Interpretation In this Order-

"closure period" means any period during which an authorisation under article 2 is in force in relation to the Parish Walk or any part of the Parish Walk;

"Parish Walk day" means Saturday 26June 20L0 and Sunday 27 June2010;

"Parish Walk period" means the hours roads are closed to vehicular traffic or subject to one way restrictions as detailed in columns 4 and 5 of schedules 1 and2 or until the roads are officially notified as opened in accordance with article 9;

"Parish Walk route" means the lengths of roads specified in schedules 1 and 2;

"one way period" means the hours vehicles are required to travel in the direction specified in schedule 2 or until the roads are officially notified as opened in accordance with article 9;

"promoter" means the Manx Harriers Athletic Club;

"senior police officer" means a member of the Constabulary of the rank of ìergeant or above who is authorised by the Chief Constable tb act as senior police officer under this Order.

'1986 c.IT ,s12002/3113 Price:85p Price Code A 4 Authorisation of use of roads for the Parish Walk (1) The promoter is authorised to use the roads specified in schedules 1 and 2 for the Parish Walk on the day and times specified in column 3 of schedules 1, and2.

(2) The promoter may for any reason cancel the Parish Walk, or any section of the Parish Walk.

(3) Where the promoter cancels the Parish Walk or any section of the Parish Waik under paragraph (2) and notifies the senior police officer of such cancellation the relevant authorisation under paragraph (1) of this article shall cease to have effect so far as it relates to the Parish Waik or section of the Parish Walk.

5 Suspension of right of way etc. Subject to article 6, during the closure period in relation to the part of the Parish Walk route specified in schedule 1 no traffic may pass over it.

6 Exemptions from article 5 Articles 3 and 5 does not apply to the following vehicles-

(a) vehicles approved by the promoters or the senior police officer for the conveyance of persons;

(Ð appointed by the promoter as officials for the purpose of the Parish Walk;

(ii) constables;

(iii) Persons lawfully taking part in the Parish Walk and their attendants;

(iv) emergency service vehicles;

(") persons requiring access to properties situated thereon; and

(vi) public service vehicles.

7 Imposition of One Way Traffic Subject to article 6, during the one way period in relation to the part of the Parish Walk specified in schedule 2 trafhc must travel only in the direction specified in column 6 of the schedule.

8 Publicity for cancellation etc. Where the senior police officer is notified of the cancellation of the Parish Walk or a section of the Parish Walk under article 4(3), he or she must take such measures as he or she considers appropriate to inform the public of the effect of it.

9 Notification of end of closure or one-way provisio (1) At the end of each section of the Parish Walk period specified in schedule L and schedule 2.

2 (a) the promoters, or

(b) the senior police officer after consulting the promoters,

(i) must remove all signage and open the roads to normal traffic;

(ii) rnust make such provisions as seem expedient for giving official notification to the public of the conclusion of the Parish Walk and the opening of that section of the Parish Walk route to traffic.

1,0 Erection of barriers and signs (1) The promoter must ensure that barriers, diversion signs and closure signs are erected and rnaintained on all roads leading on to the roads specified in schedule 1 and schedule 2 immediately before, or as soon as possible after, the beginning of every closure period.

(2) The barriers referred to in paragraph (1) must consist of-

(a) tubular steel structures supplied by the Department and to which signs approved by the Department have been attached;

(b) if the Department so directs for any particular location, a banner stating "Road Closed" in red letters on white background, and suspended from a rope, high visibility traffic tape or a tubular steel structure; and

(") closure signs of the size, colour and type show in diagram 616 (no entry for vehicular traffic) in schedule 2 to the Traffic Regulations and General Directions 20022.

(3) The promoter must ensure that all signage is removed at the end of every race for which an authorisation under article 4 is in force.

1'1, Insurance The promoter must secure the following insurance and indemnities-

(1) against injury and damage to persons or property arising out of the conduct of the Parish Walk;

(2) any claims or liability on the Department arising from the conduct of the Parish Walk.

EXPLANATORY NOTE (This note is not a part of the Order)

The effect of this Order is to close or impose one way restrictions on sections of road, for safety reasons, in the parishes of Braddan, Marown, Santon, Malew, Arbory, Rushen and Patrick and the town of Peel for various periods of time to enable the Parish Walk to take place.
