2. PURPOSE Main reason why the position exists, within what context and what the overall end result is. Under the direction of the Deputy Sheriff, Sergeant, the Deputy Sheriff is a uniformed Peace Officer responsible through statutory authority for: security, prisoner management, and civil enforcement duties in relation to the Justice of the Peace Court, , and Nunavut Court of Appeal at the Nunavut Justice Centre in Iqaluit and circuit court sittings throughout the Territory.

Deputy Sheriffs rotate through four units operating within the Sheriff’s Office and are responsible for performing the duties in each unit covering provost prisoner management, court facility security and equipment control, civil enforcement and jury and document administration. Deputy Sheriffs, as Peace Officers, operate under section 2 of the Criminal Code of Canada and section 77 the Judicature Act of Nunavut. They are armed with weapons and force option tools and may be required to use necessary force in the execution of their duties to protect people from grievous bodily harm or death.

The Deputy Sheriff performs a key role of being one of the first points of contact for Legal professionals, members of the RCMP, the media and the public upon entering the Justice Centre; initiates communication and provides assistance in directing patrons to court resources. Responsible for the day to day security of buildings occupied by the Judiciary, Court Services personnel, Quasi-Judicial staff, counsel and court operations throughout the Territory of Nunavut (including 24 circuit court locations outside Iqaluit).

In addition, the incumbent provides quasi-legal services to patrons on behalf of the Nunavut Court of Justice and administered by the Office of the Sheriff including acting as support for the Sheriff. 3. The Deputy Sheriff is a uniformed Peace Officer and ensures the safety and security of all members of the general public, court staff, judiciary, legal professionals that work and attend the Nunavut Justice Centre in Iqaluit as well as in 24 other communities as serviced by regular Court Circuit and Jury Trial Court sittings by ensuring all security issues, legislation, bylaws, safety and fire regulations and other Court Services policies and rules are adhered to.

Officer pursuant to Section 2 of the Criminal Code and is armed with weapons and force option tools and may be required to use necessary force in the execution of their duties. This appointment requires the exercise of powers and functions and duties in accordance with the law and judicially established practices and procedures. As such, in accordance with legislation, judicially established practices and procedures, and territorial and national safety and security standards the incumbent must be fully aware of and able to implement requirements of various statutes.

Provost Prisoner Management Unit: Under the supervision of the Deputy Sheriff Sergeant (D/S Sergeant) and Sheriff, the incumbent works as assigned within the Unit which is responsible for prisoner transportation between correctional facilities and police cells and the Nunavut Justice Centre in Iqaluit. The incumbent must comply with all SOP, policies and schedules to transport prisoners between facilities and to transfer of prisoners securely within the Nunavut Justice Centre.

Facility Security & Equipment Control Unit: Under the supervision of the Deputy Sheriff Sergeant (D/S Sergeant) and Sheriff, the incumbent works as assigned within the Unit to ensure court security and undertake search gate duties. The incumbent is responsible for must comply with all SOP, policies and schedules when working within the Unit. The Incumbent also ensures that proper review and documentation of the signing out of equipment from the Sheriff’s desk by members of the Sheriff’s Office or Registry staff.

Jury and Document Administration Unit: Under the supervision of the Deputy Sheriff Sergeant (D/S Sergeant) and Sheriff, the incumbent works as assigned within the Unit to ensure proper administration and conduct of jury trials in Nunavut in compliance with obligations under the Jury Act. The incumbent attends at all assigned jury trials to ensure legislatively obligated duties by the Sheriff’s office are complete to ensure proper functioning and completion of jury trials throughout the territory. The incumbent also follows all procedures and best practices for exhibit control. The incumbent is required to ensure the proper security of and to maintain accurate records and tracking of, Court Exhibits as per policies, applicable legislative authorities and standard operating procedures (SOPs). This includes firearms and other weapons tendered as Court Exhibits. The incumbent also follows the SOPs and policies to secure, maintain accurate records (electronic database) and track Search Warrants and Information to Obtain Search Warrant. The Incumbent is responsible to follow all the SOPs and policies to maintain accurate records and tracks Wills deposited with the Nunavut Court of Justice. The incumbent acts as a Commissioners of Oaths or reviews and witnesses court documents with offenders as directed and maintains best practices swearing documents as part of his/her daily duties.

Civil Enforcement Unit: Under the supervision of the Deputy Sheriff Sergeant (D/S Sergeant) and Sheriff, the incumbent works as assigned within the Unit to ensure proper administration and execution of civil enforcement duties at the Nunavut Court of Justice. The incumbent is responsible for complying with all SOPs and policies and ensuring compliance with all statutory authorities and rules that set out the obligations impacting the duties of the Unit.

Work assignments occur in circumstances that are generally unstructured because of the changing operational demands of the position. The Deputy Sheriff is responsible for performing a variety of functions to achieve the objectives of each Unit within the Sheriff’s

office. Duties performed involve weighting and evaluating factors requiring judgment, analytical ability and problem solving. The incumbent’s determinations in relation to the operations and assignment of duties affect the efficacy of litigation and the use of judicial resources.

Deputy Sheriff’s in the Sheriff’s office may travel with the circuit court to 24 remote communities throughout Nunavut.

4. RESPONSIBILITIES Describe major responsibilities and target accomplishments expected of the position. List the responsibilities that have the greatest impact on the organization first and describe them in a way that answers why the duties of the position are being performed. For a supervisory or management position, indicate the subordinate position(s) through which objectives are accomplished. The incumbent provides Sheriff and security services to members of the judiciary, staff and the public at the Nunavut Court of Justice and for Court Services facilities by:

1. Providing facility security and equipment control at all locations where the Nunavut Court of Justice sits including the Nunavut Justice Centre in Iqaluit and at 24 circuit court locations. This includes performing search gate duties and attending as assigned at court sittings. The incumbent will respond, in compliance with all SOPs, operational standards, use of force models, and policies, to incidents of violence and threats to safety. Such duties may involve effecting arrests as a peace officer, consulting with RCMP, Crown, Defence and other Justice stakeholders and removing persons from court sittings at the direction of a Judge. The incumbent is responsible for the proper documentation of all incidents and security reports in compliance with SOPs and policies. The incumbent is responsible for maintaining all appropriate paperwork and reporting issues to the D/S Sergeant or Sheriff in a timely fashion. The incumbent is also responsible for ensuring the security of court equipment by properly logging the movement of court equipment that is used by the Office of the Sheriff and Registry.

2. Providing proper provost prisoner management by following all SOPs, policies and schedules to ensure proper and secure transportation of prisoners between correctional facilities/police cells and court locations and within the Nunavut Justice Centre. Such duties require compliance with all policies, operational standards and use of force models. The incumbent is responsible for maintaining all appropriate paperwork and reporting issues to the D/S Sergeant or Sheriff in a timely fashion.

3. Providing Jury and document administration by following all SOPs, policies and statutory procedures to ensure proper Jury trials can proceed as scheduled including ensuring proper and timely service of jury summons, excusing potential jurors as appropriate, and undertaking security reviews for upcoming trials as requested. The incumbent performs all duties required under the Jury Act at all assigned jury trial sittings of the Nunavut Court of Justice. In addition, the incumbent is responsible for following all SOPs and policies relating to the acceptance and retention of Information to Obtain search warrants, wills deposited with the NCJ, and for the security and control of all exhibits filed with the NCJ. The Incumbent also commissions documents as part of their operational duties to ensure proper security within court facilities.

4. Ensuring proper Civil Enforcement of all matters coming before the Sheriff’s office including effecting lawful seizure and evictions based on the instruction of counsel and upon receipt of lawful writs and orders. The incumbent is responsible for verifying, and complying with, all orders and writs and ensures all actions taken on enforcement files comply with statutory obligations under appropriate legislation. Also, for ensuring proper records are maintained within the office of the Sheriff including accurately recording financial transactions mandated under various statutes such as the collection of fines and garnished funds.

5. The incumbent, as assigned undertakes financial administration duties in relation to financial processing including accepting payments into court, garnishee monies and proceeds of sale under varying legislation, the Rules of Court or by Order of a Judge. In addition, the incumbent provides accounting functions and bank reconciliations of the NCJ and Sheriff Trust Accounts and making the disbursements of trust monies in according to law. The incumbent also receives funds and balances the Sheriffs impress account with daily cash receipts from the Office of the Sheriff.

6. Works collaboratively with the D/S Sergeant, the Sheriff, the Executive Legal Officer Court Administration and the Manager, Civil Registry and Sheriff Services to assist in the maintenance of records and the verification of court records and civil enforcement documents prepared by the Sheriff’s Office. Assists as required to help the Manager, Court Information and Contract Services identify errors and areas of concern in the training for Deputy Sheriffs.

7. Responds to enquiries in person or over the phone regarding case status, fine collection, and process service. Assists the public and legal professionals in providing information and direction to ensure court documents are processed and executed correctly pursuant to Rules of Court, procedures, legislation and NCJ practice directives

8. Responsible for providing ongoing, effective, and accurate communication with judges, lawyers, government officials, and members of the public and acting in a manner consistent with the role of an Officer of the Nunavut Court of Justice at all times.

9. Acts as D/S Sergeant, when required.

5. KNOWLEDGE, SKILLS AND ABILITIES Describe the level of knowledge, experience and abilities that are required for satisfactory job performance. The incumbent must have working knowledge of court administration, practices, and procedures. A sound working knowledge of the Criminal Code of Canada, Canadian Charter

of Rights and Freedoms, the Judicature Act, the Jury Act, the Creditors Relief Act, and the Seizures Act as required, as well as a working knowledge of the Rules of Court including dealing with the deposit into Court and payment out of monies. The incumbent must have knowledge of specific statutes governing the processing of monies, i.e. The Criminal Code of Canada, Creditors Relief Act, Workers’ Compensation Act, The Labour Standards Act etc.

The incumbent must have sound working knowledge of sections 494 & 495 of the Criminal Code of Canada and be familiar with the relevant sections of the Canadian Charter of Rights and Freedoms pertaining to arrest and detention.

The incumbent must be able to perform complex bookkeeping functions manually and electronically in accordance with statutory duties, judicially-established procedures and divisional policies. There is no limitation on the amount of money that may require processing by the incumbent.

The incumbent must enjoy good physical health and must be capable of dealing effectively with confrontational situations that may require appropriate use of force options which could include the use of Force Options (self-defence), Oleoresin Capsicum (OC) Spray, Batons and other methods or equipment where authorized by law. Failure to act in an appropriate fashion during a critical incident could result in dire consequences to stakeholders and the Deputy Sheriff resulting in grievous bodily harm or death.

To perform the duties of Deputy Sheriff and Peace Officer, the incumbent must successfully complete within the probationary period or as soon thereafter as training is provided and re- certify Force Response Options training every two years or as required. The incumbent must successfully complete all training identified via the Nunavut Sheriff Training Program guidelines within identified timeframes as required which includes training on the legal process that guides the duties of the office of the Sheriff, Provost Prisoner Training, First Aid, CPR and Automated External Defibrillator (AED) certificates and must maintain certification credentials during the employment period or as directed.

The incumbent will be required to perform general manual labour duties including heavy lifting to perform seizures and to assist judiciary and court staff with court luggage; loading and unloading vehicles and delivery/retrieval from airport for court travel.

The Sheriff may, at times be required to engage in physically strenuous activities such as running, restraining, and handcuffing inmates. The Sheriff is expected to meet and maintain a level of physical fitness that permits the safe and effective participation in the execution of these duties. The incumbent has a good understanding of computerized programs and is able to organize diverse tasks to meet regular deadlines. The incumbent will be required to learn Government of Nunavut standardized computerized accounting, court database and case management programs.

The incumbent must possess excellent verbal and written communication skills including problem-solving and decision-making skills in relation to security issues and dealing with members of the judiciary, lawyers, government officials and the public. The incumbent must be able to prepare written, well-documented incident reports on request.

The incumbent is required to handle all matters in strict confidence and is expected to use discretion in maintaining a high degree of professionalism to conduct him/herself in a manner consistent with the role of a Peace Officer and as an employee of the Nunavut Court of Justice at all times.

The incumbent must possess excellent interpersonal and conflict resolution skills.

Possess valid Class 5 Drivers License and be able to qualify for a Class 4 Drivers License which the incumbent may be required to obtain within probationary period.

The incumbent must meet eligibility and screening criteria for appointment as a Peace Officer and Deputy Sheriff and pass a criminal record check.

Required: A minimum Grade 12 Education or equivalent.

Preferred: 1 year experience in court administration or security training/certification (i.e. National Use of Force Model etc.). An equivalent combination of education and experience may be acceptable.

A capacity to communicate in , Inuinnaqtun and/or French would be an asset in allowing the incumbent to explain and clarify situations or issues to clients and/or the general public.

6. WORKING CONDITIONS List the unavoidable, externally imposed conditions under which the work must be performed and which create hardship for the incumbent. Express frequency, duration and intensity of each occurrence in measurable time (e.g. every day, two or three times a week, 5 hours a day).

Physical Demands Indicate the nature of physical demands and the frequency and duration of occurrences leading to physical fatigue or physical stress. The requirement of providing security for the court and its stakeholders demand that the incumbent is physically capable of such provision, including the ability to subdue and restrain hostile individuals or prisoners and/or using necessary force options when required.

The incumbent must be able to lift and carry a minimum of 50kg.The position frequently deals with unpleasant, upset, hostile, angry and potentially violent clients, in court, in the holding cells and on the street on a regular basis. The incumbent is required to control, prevent and physically restrain hostile and dangerous behaviour.

The incumbent must be capable of performing Use of Force with any defensive tools that are supplied. Many of the tasks of the position will involve the use of a VDT and may cause eye strain. The position may also require that the incumbent be available to work irregular shifts including after normal working hours or complete overtime with little or no advance notice to accomplish program objectives.

Attendance at court proceedings can result in lengthy periods of sitting and/or standing for many

The incumbent is required to frequently change positions (from sitting to standing) and will be required to attend to security screening duties resulting in standing for several hours per day, over a period of several days.

Due to the need for security presence in the Court facilities the successful candidate may be required to work a flexible work schedule covering the period from 0800 – 1730 and be required to work overtime and extended hours frequently with little or no advance notice.

Environmental Conditions Indicate the nature of adverse environmental conditions to which the jobholder is exposed, and the frequency and duration of exposures. Include conditions that increase the risk of accident, ill health, or physical discomfort. The work environment and potential dynamics of frequent client contact, public accessibility to the courtroom and exposure to prisoner holding cells could present stressful and confrontational situations. The incumbent will be exposed to graphic and emotional content and material which may cause emotional anxiety and stress.

The incumbent will find the demands in terms of volume and accuracy may create stress from time to time. Many job functions will be time sensitive, creating stress on the incumbent. Extensive travel may inflict stress on domestic relationships and arrangements.

There is potential for confrontations during many aspects of the Deputy Sheriff’s functions in Court or on circuit, especially while dealing with highly emotional individuals or individuals who are under the influence of drugs and/or alcohol.

The incumbent may deal with armed individuals with intent on harming themselves or others. The incumbent may deal with individuals with dangerous infections (i.e. HIV, Hepatitis).

The incumbent may, while in the execution of their duties may be exposed to Oleoresin Capsicum (OC) Spray or other toxic substances. During an emergency, the incumbent could be exposed to smoke or other dangerous environmental conditions.

The incumbent will frequently fly in small, fixed wing aircraft for several hours in various types of weather conditions. The seating may be uncomfortable and cool. The incumbent may have to travel on court circuits on short notice when staff resources are unavailable.

The incumbent generally works in an interior environment, however while serving court documents such as jury summons or legal process the incumbent will be exposed to severe weather conditions requiring incumbent to drive court vehicles in inclement road conditions.

The incumbent will use a VDT and read and handle paper documents regularly. The careful review of documents and use of the VDT may cause eye strain.

Sensory Demands Indicate the nature of demands on the jobholder’s senses. These demands can be in the form of making judgements to discern something through touch, smell, sight, and/or hearing. It may include concentrated levels of attention to details though one or more of the incumbents’ senses. The incumbent requires a heightened sense of situational awareness while engaged in duties that involve multi-tasking in a busy open public environment while constantly being on the alert. The incumbent must be able to deal with stressful and confrontational situations with sound

judgment and calm responses.

The incumbent is expected to be vigilant at all times and be aware of any potential security risks or threats and be prepared to act upon them immediately. The incumbent requires excellent observational skills to constantly perform threat assessments based on non-verbal cues and body language.

The incumbent must also be able to scrutinize legal documents rapidly and constantly, as well as listen carefully to requests. The demand for accuracy in interpreting Court Orders and in the giving of information and advice in relation to practices and procedures in relation to Sheriff services requires a great deal of reading and concentration. The incumbent must listen carefully and remain alert to the requests of Judges, lawyers, the police and members of the public.

Mental Demands Indicate conditions within the job that may lead to mental or emotional fatigue that would increase the risk of such things as tension or anxiety. As a uniformed officer the incumbent is under constant scrutiny from the stakeholders and members of the public. The incumbent is required to maintain integrity and professionalism at all times as an Officer of the Court (on and off the job). The high profile and sensitive nature of the institution and its work can cause emotional fatigue. The graphic and emotional content of many court proceedings may cause emotional anxiety and stress. The potential of highly stressful and confrontational situations in providing security to the Nunavut Court of Justice is constant. The incumbent must possess sound judgment and the skills necessary to de-escalate or control those situations. Confrontational situations may have an impact on personal and social life.

The position often deals with unpleasant, upset, hostile, angry and potentially violent clients, in court, in the holding cells and on the street on a regular basis. Verbal abuse and threats are not uncommon. When the incumbent is called upon to act, he or she must act in a dignified and professional manner at all times, including in the face of physical and verbal abuse.

Note keeping and report writing functions require 100% accuracy. The incumbent must be capable of adapting to changing legal, administrative and judicial directions as the need arises. Many job functions will be time-sensitive creating stress on the incumbent. Preparing high- quality written work under tight deadlines for senior management or the Court can lead to mental and emotional fatigue.

The incumbent will be required to wear a duty uniform of the Nunavut Sheriffs including Soft Body Armour and Duty Belt including handcuffs, baton, portable radio and OC spray.
