At the meeting of the Council and of the Ministers of Education meeting within the Council , held on 27 June 1980 , the Netherlands delegation introduced a statement to the effect " that substantial . progress should be made in the field of the academic recognition of diplomas alongside the mutual recognition of diplomas ( whether . university or otherwise ), right of establishment and freedom to pro vide services ". The Council took note of this statement and the Education Committee was instructed to study this question in the light of the comments made . This statement followed examination / . of the progress report prepared by the Education Committee on , ■ , the implementation of the action programme in the field of education, embodied in the Resolution of the Council and of the Ministers of Education meeting within the Council adopted on 9 February 1976 . A 2 . The latter Resolution had identified as one of its six major \ themes the necessity to promote cooperation in the field of , higher education . In particular , paragraph IV . 16 of the action programme provided for action " to be undertaken at Community level to increase the possibilities for the academic recognition of diplomas and study periods and studies . carried out . In particular , a report should be drawn up analysing the^current situation with regard to the academic recognition of diplomas and containing- proposals for the imprpvement of the situation and , if necessary, for the development of a network of agreements * and consultations between those responsible for education policy and cooperation between higher education institutions to facilitate the recognition of periods of study and studies carried out . 3 . The Council Resolution of 6 June 1974 ( 2 ) on the mutual recognition of diplomas , certificates and other evidence of formal qualifications in Section I , acknowledged the positive contribution that educational policies should make towards the freedom of establishment", in par ticular with regard to the . liberal professions . In addition, the . Council acknowledged that Directives on the right of establishment , in particular concerning the liberal professions , were of importance in connection witli education policies .. The preamble to the Treaty establishing the European Economic Community ,*^* affirmed the determination cf the High Contracting Parties to " lay the foundations of an ever closer union among the peoples of Europe", and their resolution "to ensure the economic and social progress of their countries by common action to eliminate the barriers which divide Europe". In Article 3 Section ( c ), one of the principal activities of the' Community to this end was " the abolition of obstacles to freedom of movement for persons ". 5 . These objectives are developed more fully in terms of their application in subsequent articles of the Treaty . Article 49 provides for the Council to issue directives or make regulations setting out the measures required to bring about freedom of movement for workers, in particular by systematically and progressively abolishing all restrictions regarding the free choice of efifployment . Article 57.1 , moreover, provides that " in order to make it easier for persons to take up and pursue activities as self-employed persons, the Council may issue directives for the mutual recognition of diplomas , certi ficates and other evidence of formal qualifications ." These already . , . ( 4 ) , ... ( 5 ) . - ( 6 ) exist in respect of doctors, dentists, veterinary surgeons, nurses ^ and midwivesf^ Draft directives for other liberal professions aire in various stages of consideration in the Council . Reference should also be made to Article 128 of the Treaty which requires the Council to " Lay down general principles for implementing a common vocational training policy" as one of the means of developing national economies and the common market . The Council Decision of ( 9 ) 2 April 1963 laid down general principles for implementing a common vocational training policy , and in particular the eighth principle provided for such a policy to " be so framed as to enable levels of training to be harmonized progressively" and for " the mutual recognition of certificates and other documents confirming completion of vocational training ." 7 . In addition to the foregoing Community instruments , a number of European conventions have been adopted by the Council of Europe and UNESCO , which have been taken fully into account in the elaboration of this communication . a ) The Council of Europe 's Convention oh the equivalence of diplomas leading to admission to universities ,^?^ and the protocol to ( 11 ) this Convention , to which all Member States of the European < Community are signatories , provide that anyone who has obtained the requisite qualification for admission to a higher education institution in his own country will be admitted ( subject to the availability of places ), to similar institutions in other member countries on the basis of the mutual recognition and acceptance V ' - - of the equivalence of his qualification . / - * b ) The European Convention on the equivalence of periods of university study , ( 12 ) provides for the recognition of a period of study spent by a student in a university of another member country, as being equivalent to a similar period spent in the home university , especially in the field of foreign languages . No 63 of 20.04.1963 ( 10 ) European Treaty Series no 15 / Paris , 11.12.1953 ( 11 ) European Treaty Series no 49, Strasbourg , 03.03.1964 ( 12 ) European Treaty Series no 21 , Paris , 15.12.1956 c ) The European Conv ntion on the academic recognition of university < 1 : > qualifications , ~ provides for the academic recognition of foreign university qualifications for the purposes of pursuing further university studies or the use of academic titles conferred by foreign universities . d ) The UNESCO Convention oh the recognition of studies and of diplomas ( IM in higher education in countries in the European region , provides for the recognition of university entrance qualifications to permit the holders to pursue studies in higher education institutions in the member countries ( subject to the availability of places ) and to the fulfilling of any special linguistic requirements . AIMS AND NEEDS 8 . It is useful to identify five separate levels at which the question of the relative value of qualifications or of periods of study may arise , namely : - entry into a first higher education course in another Member State ; - transfer , without loss of acquired rights , from a higher education course commenced in one Member State , to a similar course in another Member State ; - pursuit, of postgraduate studies or research in another Member State ; - taking up employment or self-employed activities in one Member State with qualifications acquired in another Member State ; - career development and progression in another Member State . 9 . It is essential to underline the importance of academic recognition (a mutual comparability of standards , based upon adequate and accurate information , and mutual trust ), for the purpose of facilitating mobility between higher* education institutions , and professional recognition, for the purposes of taking up and pursuing the practice of particular occupations which is covered by the provisions of Articles 49 and 57 of the Treaty . ( 13 ) European Treaty Series no 32 , Paris , 14.12.1959 ^ (1 4 ) UNESCO , Paris , 21.12.1979 . ./ In the case of the liberal professions , and in particular those ■ ' which are the subject of Council directives relating to the mutual recognition of diplomas , qualifications obtained as a result of pursuing appropriate courses in higher education institutions form an integral part of those required for access to , and practise of , the professions concerned .
