RESOLVED: Reason for decision: that the application be refused. 1. The dwelling is proposed at a location where it would be visually prominent in a landscape of high visual and sensory quality. The proposed siting, combined with the incongruous design and large scale would unacceptably harm landscape quality contrary to polices DM4 and DM13 of the Powys Local Development Plan (2018), Powys Residential Design Guide (2004), Technical Advice Note 6 (2010) and Planning Policy (Edition 9, 2016).

2. The application fails to demonstrate that the scale of the dwelling reflects the needs of the enterprise or its ability to fund such a property. The proposal therefore fails to comply with Technical Advice Note 6 (2010) and the associated Practice Guidance for Rural Enterprise Dwellings (2011).

3. The design of the proposal by reason of its appearance, scale, height, massing and design detailing fails to complement or enhance the character of the surrounding area and fails to contribute towards the preservation of local distinctiveness and sense of place contrary to policy DM13 of the Powys Local Development Plan (2018), Technical Advice Note 12 (2016) and Planning Policy Wales (Edition 9, 2016).

design, would detract from the setting of Rhysgog, a grade II listed farmhouse, contrary to policy SP7 of the Powys Local Development Plan (2018), the local planning authority’s duty under section 66 of the Planning (Listed Buildings and Conservation Areas) Act 1990, Technical Advice Note 24 (2017) and Planning Policy Wales (Edition 9, 2016).

5. Insufficient information has been submitted with the application to demonstrate that the treatment plant soakaway is sufficiently sized and that ground conditions are suitable for drainage so that the quality of surface and ground waters will not be adversely affected in accordance with Policy DM13 of the Powys Local Development Plan (2018), Welsh Government Circular 008/2018 and Planning Policy Wales (Edition 9, 2016).

8. DECISIONS OF THE HEAD OF REGENERATION AND REGULATORY SERVICES ON DELEGATED APPLICATIONS

The Committee received for information a list of decisions made by the Head of Regeneration and Regulatory Services during the period between 19th October, 2018 to 29th November, 2018. The Lead Professional Development Management noted members’ comments that the format of the document should be improved.

9. APPEAL DECISION

The Committee received a copy of the Minister’s and Planning Inspectorate’s letters regarding the appeal in respect of application P/2014/0672 Land off A44 South West of Llandegley, Llandrindod Wells, Powys, LD1 5UG [Hendy Wind Farm].

Members were advised that although the planning inspector had agreed with the Council and recommended refusal of the application, the Minister had granted permission on the basis of the need for renewable energy. Members were further advised that the Campaign for the Protection of Rural Wales had served papers for a judicial review of the Minister’s decision. In response to members’ questions as to whether enforcement action was appropriate, the Lead Professional Development Management advised that Counsel’s advice had been secured and that the threshold for formal enforcement action had not been reached. This was however being constantly reviewed. A statement had been released to objectors and would be shared with members of the committee. A motion that the Committee write to the Minister seeking recovery of the Council’s costs at the inquiry was lost upon being put to the vote.

P/2017/0078 Glascwm - The Committee was advised that the Council had lost the judicial review in respect of the application for a single dwelling at Glascwm.

11. REVISED TAXI FEES FOR 2019/20

The Committee considered revised fees for the Hackney Carriage and Private Hire Licensing regime, notably operator, vehicle, driver licences and tests to commence from April 2019. The Senior Licensing Officer confirmed that the Section 151 Officer and Deputy Monitoring Officer both approved the report.

The Committee considered adopting the Institute of Licensing document ‘Guidance on determining the suitability of applicants and licensees in the hackney and Private Hire Trades’. The Senior Licensing Officer confirmed that the S151 Officer and Deputy Monitoring Officer approved the report.

Notwithstanding the published Committee Report, it has been brought to the attention of Development Management that a representation expressing an objection was submitted by a third party. Unfortunately, the representation was forwarded to an inaccurate email address and therefore was not received by the handling officer or detailed within the original report. This update report therefore acknowledges receipt of the third party comments and summarises the points raised below;

 Contests that the property has been actively marketed with few adverts in the local papers with no price disclosed.  Property not advertised online.  Property advertised with no land which was part of the original planning application for the granting of the agricultural dwelling.  States that there is demand for agricultural dwellings in the area and lists two dwellings sold in the last few years.

Notwithstanding the concerns expressed, Officers remain satisfied that the removal of the condition has been justified by robust evidence and therefore complies with planning policy.
