The remaining defendants have participated in copying these protected stories in the infringing movie, have published and distributed the infringing novel and motion picture, and have titled the movie so as to confuse consumers and unfairly trade on CDEL’s goodwill. 2. Defendant Mitch Cullin grew up in Santa Fe, New Mexico, and through his father became acquainted with the noted Sherlockian scholar and collector John Bennett Shaw, who also lived in Santa Fe.     SECTION 5: CHINA’S DOMESTIC INFORMATION CONTROLS, GLOBAL MEDIA INFLUENCE, AND CYBER DIPLOMACY Key Findings • China’s current information controls, including the govern- ment’s new social credit initiative, represent a significant es- calation in censorship, surveillance, and invasion of privacy by the authorities. • The Chinese state’s repression of journalists has expanded to target foreign reporters and their local Chinese staff. It is now much more difficult for all journalists to investigate politically sensitive stories. • The investment activities of large, Chinese Communist Par- ty-linked corporations in the U.S. media industry risk under- mining the independence of film studios by forcing them to consider self-censorship in order to gain access to the Chinese market. • China’s overseas influence operations to pressure foreign media have become much more assertive. In some cases, even without direct pressure by Chinese entities, Western media companies now self-censor out of deference to Chinese sensitivity. • Beijing is promoting its concept of “Internet sovereignty” to jus- tify restrictions on freedom of expression in China. These poli- cies act as trade barriers to U.S. companies through both cen- sorship and restrictions on cross-border data transfers, and they are fundamental points of disagreement between Washington and Beijing. • In its participation in international negotiations on global Inter- net governance, norms in cyberspace, and cybersecurity, Beijing seeks to ensure continued control of networks and information in China and to reduce the risk of actions by other countries that are not in its interest. Fearing that international law will be used by other countries against China, Beijing is unwilling to agree on specific applications of international law to cyberspace.

The previous year had seen the Seagram buyout of MCA-Universal, Time Warner’s purchase of the massive Turner Broadcasting System, and the launch of Dream- Works, the first new movie studio since the classical era. Then on August 1 came the bombshell that provoked Gabler’s editorial. Disney announced the acquisition of ABC and its parent conglomerate, Cap Cities, in a $19 billion deal – the second- largest merger in US history, which created the world’s largest media company. Disney CEO Michael Eisner also disclosed a quarter-billion-dollar deal with Mike Ovitz of Hollywood’s top talent agency, Creative Artists, to leave CAA and run the Disney empire. For Gabler, the Disney deals confirmed “a fundamental shift in the balance of power in Hollywood – really the third revolution in the relationship between industry forces.” Revolution I occurred nearly a century before with the formation of the Hollywood studios and the creation of a “system” that enabled them to con- trol the movie industry from the 1920s through the 1940s. Revolution II came with the postwar rise of television and the dismantling of the studio system by the courts, which allowed a new breed of talent brokers, “most notably Lew Wasserman of the Music Corporation of America [MCA],” to usurp control of the film industry.

    Re-defining the Independent Film Value Chain A paper by Peter Bloore Introduction: An industry value chain or system could be summarized as a connected series of activities, that combine to create and deliver a product (or value) to customers. These activities could include research and development, manufacturing, packaging, marketing, and distribution. Strictly speaking, a value chain represents those activities as carried out within a single company, and a value system represents those activities being carried out by a series of different businesses or freelancers, acting together to create and deliver the product. The value chain and system has already been applied by business academics and consultants in various sectors, including for example the automobile industry and food processing and retail sector (Lynch 2006, pg 203-6). It can also be applied to the film industry. In the US studio system a film is often developed, produced, distributed and exploited without leaving a single integrated company or consortium: a simple corporate value chain. This is also the case with a small number of international studio-style companies.1 However the independent feature film production and distribution sector (the prevalent model outside America) is a value system business, in that a feature film is not made and delivered to its final audience by a single company. Instead there is a chain of companies, businesses, and freelancers, all working on different elements of the production and exploitation process, and adding value in different ways along the chain. Furthermore once the film is exploited, the money handed over by the consumer (whether it be in return for a cinema ticket, DVD purchase or online download) is subject to various revenue shares or commissions as it passes back through the chain, which then complicates the revenue flow.

It argues that these industries are becoming more closely integrated with one another both materially and aesthetically, and that this in turn is leading to the denationalization of individual films and film industries on both sides of the Pacific. The article explores how globalization is experienced differently by different film industries – and by different sectors within individual industries – and how it entails both losses and opportunities for Asian film makers. Taking the contemporary Hollywood and East Asian martial arts film as an exemplary cultural style of globalization, it also looks at how integration involves both cultural homogenization and the production of difference. Specific topics discussed include the growth of Hollywood’s Asian markets, Jackie Chan and the flow of Hong Kong talent into Hollywood, Hollywood remakes of South Korean movies, the resurgence of Asian film industries, Hollywood’s local-language film production and Zhang Yimou’s Hero.
