Dear Mrs. Rossler,

With reference to Decision 41 COM 7B.34 adopted in Krakow 2017, and the recommendations by the Reactive Monitoring Mission (held in April 2017), I take this opportunity to submit a Progress Report on the current situation concerning the state of conservation of the World Heritage property ''Natural and Cultural Heritage of the Ohrid region".

Let us take this occasion to once more express our firm dedication in the implementation of the World Heritage Convention.

National authorities are ready to provide further information on any issues related to the World Heritage Site "Natural and Cultural Heritage of the Ohrid Region", all necessary clarification about the undertaken activities· and to further improve its content upon derivation ofUNESCO suggestions.

State of Conservation Report on the implementation of the recommendations from the Decision of the UNESCO World Heritage Committee adopted at its 41't session (Krakow, Poland

This report has been prepared in compliance with the Decision of the UNESCO World Heritage ommittee (41 COM 7B.34) on the status ofthe World Heritage property- Natural and Cultural Heritage o the Ohrid Region (Republic of Macedonia) (C/N 99ter), adopted at the 41st session of the World eritage Committee held in Krakow, Poland. The Decision was adopted based of the recommendations of t e Reactive Monitoring Mission ofUNESCOIICOMOS/IUCN to the property, which took place in April 2 17.

The Government of the Republic of Macedonia has reviewed the recommendations set forth in t e Decision of the World Heritage Committee (Krakow, 2017) that refer to the Natural and Cultural eritage ofthe Ohrid Region, and being fully committed to the preservation of the integrity ofthe natural a d cultural properties in the Ohrid region, undertakes concrete steps, in compliance with the UNESCO r commendations.

Short summary of the Report

The Ohrid Region, situated on the shores of , is one of the most representative regions i the Republic of Macedonia due to the great concentration of natural and cultural values. Beginning om the historical monuments of the town of Ohrid, as its centre, than the town of Struga, located along t e banks ofthe Crn Drim River, which flows out ofthe lake, the several fishermen's settlements located n the coast, as well as the richness of archaeological sites, Christian spiritual centres, Ottoman onuments, characteristic architecture and rich tradition, the Ohrid Region possesses an Outstanding niversal Value, which is a result of human impacts and natural phenomena.

In 1979, the UNESCO World Heritage Committee decided to inscribe the Ohrid Region on the orld Heritage List as a natural heritage under criterion (iii), that is, today criterion (vii), while in 1980 t e world heritage property was extended to include the cultural heritage criteria (i), (iii) and (iv), and was i scribed in the category of mixed World Heritage properties. In 2009, at its 33rd session (21-30 June 009, Seville, Spain), the UNESCO World Heritage Committee adopted the proposed modification of the oundaries of the Natural and Cultural Heritage of the Ohrid Region, thus encompassing a greater part of t e Galichica National Park.

This report has been prepared in compliance with the Decision of the World Heritage Committee ( 1 COM 7B.34), on the state of conservatQon of the World Heritage property -Natural and Cultural eritage of the Ohrid Region (Republic of Macedonia) (C/N 99ter), adopted at the 41st session of the orld Heritage Committee in Krakow, Poland (20 17). The decision was adopted in response to the latest evelopment and infrastructural planning projects that could have a negative impact on the Outstanding niversal Value of the World Heritage property, as well as on the observations of the Reactive onitoring Mission, which took place in April 2017.

Upon the Krakow Decision, the Report had been submitted to the World Heritage Centre in ebruary 2018. That RepOii presented the progress made concerning the steps undertaken and the degree f implementation of the recommendations of UNESCO's Reactive Monitoring Mission, in the scope of he protection of the natural and cultural heritage in the region.

2 The preservation of the integrity and authenticity of the natural and cultural heritage in the Ohrid r gion is a high priority of the Government of the Republic of Macedonia and a topic of interest of state a thorities, the civil society sector and the wider public. Along with the Government, also the Parliament o the Republic of Macedonia had shown an exceptional interest and initiated activities related to this t pic. Namely, a group of MPs and civic organizations had formed an informal group called Friends of t e Ohrid Region, which intercedes for the Ohrid Region in the Parliament and in front of the public. dditionally, in May-June 2018, the Parliament has held an oversight hearing on the state of conservation o the property and has submitted its opinions and conclusion to the Government with the scope of p eserving the Outstanding Universal Values in the region.

Within the process of extending the Natural and Cultural Heritage of the Ohrid Region also on the t rritory of the Republic of Albania, the Republic of Macedonia had involved its experts and emonstrated a significant interest by becoming a part of the process of preparation of the nomination !e. In this regard, the Republic of Macedonia has expressed its consent on the extension of the property y sending a letter for support that had been submitted to the World Heritage Centre in April 2018.

The cooperation with Albania was also accentuated concerning the undertaking of future steps for t e joint protection of the property, by employing a participatory approach in the quest for joint anagement models of the natural and cultural heritage of the Ohrid region as a whole, encompassing all ake Ohrid region values, for the present and future generations.

During the period from the visit of the Mission (April 20 l 7) to the preparation of the State of onservation Report, parliamentary and local elections, and shortly later a referendum (September 2018) ere held in the Republic of Macedonia, resulting in changes at central and local level, but also impacting e timeframe and slowing down the activities for acting upon the Decision. The Government, along with he sectoral authorities and institutions, within the short period of time following the parliamentary lections, seriously devoted itself to reviewing and revising part of the activities envisaged for the Ohrid egion and started to adopt decisions aiming to provide a balance between the future development of the egion focused on the preservation of the historically Outstanding Universal Values of the Natural and ultural Heritage of the Ohrid Region as a World Heritage property. This was an additional and time­ onsuming procedure that had reflected on the implementation of a part of the envisaged activities.

The Government of the Republic of Macedonia, at its 40th session held on 28.11.2017, reviewed nd adopted the Information on the Decision of the UNESCO World Heritage Committee adopted at its 1" session (Krakow, Poland 20 17) regarding the status of the Natural and Cultural Heritage of the hrid Region -a property inscribed on the World Heritage List, that was followed by many actions for lfilment of the Mission's recommendations and implementation of the World Heritage Committee

An inter-sectoral working group received a mandate from the Government to coordinate the implementation of the Decision and the recommendations. ln cooperation with all relevant competent institutions and the local self-government, this working group had prepared the State of Conservation Report. The updated Repmi on the implementation of the recommendations from the Decision, as well as the undertaken actions, had been adopted by the Government at its 105th session held on 27.11.2018.

3. Notes with appreciation the steps taken by the State Party in relation to:

a) The finalization of the process of preparing the Management plan for the property, and the preparation of the Draft Plan of Integrated Protection for the Old Town Nucleus of Ohrid,

b) The establishment of the management committee to coordinate the activities related to the Natural and Cultural Heritage of the Ohrid region, as a management structure to control development pressures and interventions at the property,

c) The development of detailed urban plans for each of the 19 complexes, which are part of the monumental ensemble, in line with the existing regulatory framework, to ensure the enforcement of provisions and the control of activities that might impact the Outstanding Universal Value (OUV) ofthe property;

a) The Government of the Republic of Macedonia, acting upon the Decision of the World eritage Committee, and noting the weaknesses and shortcomings of certain planning documents, began ith their revision. The revision encompassed the activities assessed to be having a negative impact on he values of the property and they had been either halted or new appropriate solutions had been sought or their implementation- such that would not endanger the status of the property (infrastructure projects, rban development etc.).

b) The Commission for Management and Coordination of the Activities Related to the Natural and Cultural Heritage of the Ohrid Region, which, in accordance with the Law on the Management of the atural and Cultural Heritage ofthe Ohrid Region, was established in April 2017, and later on revised by the Government of the Republic of Macedonia, had been actively working within its given competences, which mainly referred to the urban development and the new urban planning documents, submitted for review by municipalities of Ohrid, Struga and Debrca. The main goal guiding the Commission's work in the adoption of its decision, was to find a manner to implement the activities for an adequate management of the natural and cultural heritage of the Ohrid region, respecting the recommendations of the Reactive Monitoring Mission and the Decision of the 41st session of the World Heritage Committee - 41 COM 7B.34.

c) Reviewing the state of the planning documentation with the scope of preparing detailed plans for 19 complexes in the monumental ensemble Old Town Nucleus ofOhrid, many discrepancies with the other planning documents within the region had been noted. Out of this reason, it had been assessed that it would be advisable to make a complete revision and hannonization of all planning documents, that would permit a subsequent preparation of detailed urban plans for 19 complexes. The Institute for Protection of Monuments of Culture and Museum - Ohrid, had undertaken preparatory activities for the commencement of the preparation of Protective Conservation Bases for 19 complexes in the Old Town Nucleus of Ohrid, but due to the complexity of their preparation with updated cadaster bases that are necessary for the preparation of detailed urban plans, this activity will be implemented in the upcoming period. In the meantime, as a mechanism for implementation of the protection, the measures that are being undertaken in the Old Town Nucleus of Ohrid, are being perfonned in accordance with the national 4 1 gislation and the Plan for Integrated Protection ofthe Old Town Nucleus ofOhrid (Annex 1: Decision fir adoption of the Plan for Integrated Protection ofthe Old Town Nucleus ofOhrid).

In order to achieve a controlled urban development of the region, initiated a p ocedure for securing finances for the preparation of urban planning documentation for all rural s ttlements in the municipality, as well as for all lakeside settlements on Lake Ohrid (Ljubanishta, rpejca, Peshtani, Elshani, etc.), which will make a contribution towards the complete and c ntrolled protection of the lakeshore belt.

Having in mind that the preparation and adoption of planning documentation is a complex and I ngthy process, the local self-government, the Commission for Management of the Natural and Cultural eritage of the Ohrid Region and all relevant competent institutions, will utilize all positive legal echanisms for an appropriate protection ofthe world heritage- The Natural and Cultural Heritage of the hrid Region.

4. Reiterates the request to the State Party to develop a Strategic Environmental Assessment (SEA) that comprehensively assesses the cumulative impacts of all infrastructure and development plans and other major projects on the property's Outstanding Universal Value (OUV), based on the recommendations and advice provided by the 2017 Mission, as well as any necessary Heritage Impact Assessments (HIA), and to submit them to the World Heritage Centre for review by the Advisory Bodies, before any further work is undertaken;

The preparation of the Strategic Environmental Assessment (SEA) for the envisaged i frastructural projects within the boundaries of the property, which, according to the recommendations of he Mission, should be prepared for the Management Plan for the Natural and Cultural Heritage of the hrid region, is ongoing. The necessity to revise the Management Plan for the Natural and Cultural eritage of the Ohrid region is closely linked with the preparation of the SEA and that is why it is oreseen that their preparation and adoption should be running in parallel. This activity was, to an extent, lowed down as a result ofthe recent political events in the Republic of Macedonia.

However, the procedure for initiation of the preparation of the SEA is in a final phase (the endering procedure for selection of a team of experts for preparation of the SEA had been finalized) and e can expect its preparation in the upcoming period. The interlinked revision of Management Plan for he Natural and Cultural Heritage of the Ohrid Region and the preparation of the SEA, had imposed the eed of a certain period of time for the harmonization of these two planning documents. This activity is lly supported by the Government of the Republic of Macedonia, which had entrusted the Ministry of ulture for the procedures regarding the p11eparation of the Strategic Environmental Assessment (SEA) and the Management Plan for the Natural and Cultural Heritage of the Ohrid Region, including the foreseen infrastructural projects within the boundaries of the property.

Although it had been initially foreseen that the revision of the Management Plan for the Natural and Cultural Heritage of the Ohrid Region along with the preparation of a SEA for the Plan, to be finalized by the end of October 2018, the given reasons had slowed down these activities. Upon the finalization of these documents, they will be submitted to the UNESCO World Heritage Committee and its Advisory Bodies for review.

5 5. Requests the State Party to halt the construction projects of the sub-sections (a) and (g) of the A3 road and the Galichica Ski Centre within the boundaries ofthe property, which may have a negative impact on its Outstanding Universal Value (OUV);

Regarding the expressway A3 whose construction was associated to changes of the Management Ian for the National Park Galichica, i.e. with a change to the protection zoning, the Government of the epublic of Macedonia had adopted a Conclusion by which it adopts the Information for Halting of the rocedure for Changes of the Management Plan for the National Park Galichica (no.44-7453/l-17 of 0 .03.2018), in line with the recommendations of the UNESCO World Heritage Committee, Krakow, Poland, 2017. Based on this Conclusion, the Management Board of the Public Institution National Park " alichica", had adopted a Decision to halt the procedure for changes of the Management Plan for the ational Park Galichica for the period 20 I 1-2020 (no.02-90/3 of 06.03.2018). In this manner, the p ocedure which would have enabled new zoning of the National Park, and which could have enabled the c nstruction of the quoted projects (Ski Centre and A3 expressway) was halted. With the adoption of this ecision, the present zoning of the National Par Galichica was maintained and the possible negative i pact on the Outstanding Universal Value of the natural and cultural heritage of the Ohrid region had b en eliminated.

The decision not to change the protection zoning of the National Park "Galichica", means, at the s me time, complete halting of the procedures concerning the planned infrastructure projects, namely the c nstruction of the A3 expressway, section Ohrid-Peshtani (as a second phase and the construction of the s ction Peshtani-border with the Republic of Albania), and the Ski Centre on the slopes ofGalichica. This eans that the revision of sub-sections (a) and (e) is no longer relevant for discussion. In line with the r quest of the Government of the Republic of Macedonia, the funder of these projects - the European Bank for Reconstruction and Development (EBRD) withdrew the package of funds intended for the a ovementioned projects and redirected them for rehabilitation of the state road network in the Republic o Macedonia outside the boundaries of the Ohrid region. (Annex 2: Conclusion ofthe Draft-Minutes of t e Fifty-Eight Session of the Government of the Republic of Macedonia, held on 6.3.2018, no. 44- 7 5311-17 of 6.3.2018; and Annex 3: Decision for halting of the procedure for changes of the anagement Planfor the National Park Galichica.for the period 2011-2020, no. 02-90/3 of6.3.2018).

6. Also requests the State Party to urgently undertake a comprehensive comparative study of alternative routes for the railway ofthe Pan-European Corridor VIII, including those that do not pass in close vicinity P.f the lakeshore, and in particular avoiding one of the last well-preserved stretches of the lakeshore on the Albanian- Macedonian border;

Taking into consideration the vulnerability of the tenitory through which the route ofthe railroad p sses and the possible environmental impacts, primarily on Lake Ohrid, the Public Enterprise " acedonian Railroads" considered possible alternative solutions for the route of the railroad. However, c 11ain technical obstacles prevent the complete change of the route - inadequate configuration of the t nain (some positions of the route are conditioned by the configuration of the tenain, that is, the aximum allowed inclination for the construction of this type of projects), as well as the conditionality ith the place of connection with the railroad in the Republic of Albania, that is, the existing railway frastructure on Albanian side.

Namely, the reason for selection of this route is the Agreement dated back to the period of c mmencement of the activities for construction of the railway corridor VIII. High representatives ofthe t o interested pruiies, the Republic of Macedonia and the Republic of Albania had agreed that the point

6 of connection should be at Lin on the Albanian side with coordinates X=469421.669 Y=549002.836 at a height elevation H=722.28 m.

From a design point of view, it is possible to reach the previously defined point of contact with at elevation angle and the connecting of the localities Struga-Radozhda- border with the Republic of lbania, only via the indicated corridor. At the same time, the highway Struga-border with the Republic of Albania - Corridor VIII also has to be taken into consideration. Based on these considerations, the preparation of an executive project and the other necessary documentation for construction and s pervision of a new railway line Kichevo-lborder with the Republic of Albania, as a part of Corridor III, has commenced.

In 2010 a Project feasibility study, a Conceptual design, a Cost-benefit analysis, as well as an nvironmental Impact Assessment Study for the implementation of the Project-Construction of a ailway Line, as a part of Corridor VIII, Kichevo-Lin (border with Albania), had been prepared by the ulgarian consulting company EUROTRANS PROEKT.

In the course of 2010-2011, the SEA study went through a complete procedure for SEA in the inistry of Environment and Physical Planning. A public debate and communication with the s akeholders had been organized in two towns (Kichevo and Struga) and all competent ministries and odies had been contacted.

The SEA study had been confirmed also with a Decision issued by the Ministry of Environment nd Physical Planning in accordance with the Study no. 11-1420/1 of09.02.2011.

The SEA study was prepared by a big team of experts (biologists, hydrologists, pedologists, resters, experts who have modelled the impacts ofnoise and vibrations, chemists, ecologists, geologists, s ciologists and GIS experts), and who have studied all aspects (media of the environment, socio­ conomic and cultural aspects, as well as the aspects referring to the tradition of the area etc.), in order to repare a compact report on the state of the environment, mainly due to the fact that a part of the route s ans within or borders the Ohrid region, which is of great protection interest for the Republic of acedonia. Based on the good image of the state of the researched corridor of the railroad and the micro­ ! cation (500 meters to the left and the right from the central axis of the railroad) and the macro-location fthe area, the possible impacts stemming from the implementation of the Pan-European railroad corridor III-section Kichevo-Radozhda-Lin have been identified, both in the construction and operational phase, nd they had been extensively elaborated in the SEA study for this concrete project. The assessment of t e possible impacts was made in line with the international conventions and agreements for protection of t e environment and especially those referring to the protection of biodiversity, the habitats, the landscape nd the cultural heritage, but also in line with national standards. The measures for mitigation and voidance of possible impacts had been structured and dimensioned in a manner that could offer complete rotection of the cultural and natural property Lake Ohrid (Ohrid region). They had been included in the anagement Plan for the Environment that is a comprising part of the SEA study.

During the phase of preparation of the conceptual design and the executive project for the railway ection Kichevo-Radozhda, the proposed measures for protection had been taken into consideration and a anagement Plan for the Environment had been prepared. The later includes: Management Plan for oise, Management Plan for Soils and Erosions, Management Plan for Plants, Management Plan for nimals, Waste Management Plan, Management Plan for Hazardous Matters and Leakages, Management Ian for the Public and a Management Plan for Fires and Incidents. The mentioned plans will represent a ommitment for implementation for the future subject who will construct the railroad, while the adequate ·mplementation of the plans will be monitored by a supervisory body and by the competent inspection ervices. 7 All of this is the foundation for the future protection from possible degradation of all of the s ·gnificant parts of the protected cultural and natural heritage of Lake Ohrid and the region. Provided that 11 of these measures are to be fully implemented, the identified possible impacts on the ecosystem of ake Ohrid and the wider area will be reduced and will become neglectable.

We would like to underline that the recommendation of the Reactive Monitoring Mission to repare a comparative study (analysis) for alternative routes in order to avoid the lakeshore at the lbanian-Macedonian border would only bt; possible with a new corridor. This would require a new greement between the two interested parties (the Republic of Macedonia and the Republic of Albania) r determining a new linkage and a new connection point, and this would require a new study, a new onceptual design and a new Executive project, leading to new and additional finances that should be rovided by the Government of the Republic of Macedonia.

Based on the prepared SEA study, the preparation of the conceptual design and the final project at respect all proposed measures for protection of the cultural and natural heritage of Lake Ohrid has ontinued. It is our opinion that the proposed route is fully appropriate and meets the strict criteria.

7. Further requests the State Party to fully implement all the recommendations of the 2017 Mission;

The actions undertaken in compliance the Recommendations contained in the Report of the eactive Monitoring Mission of UNESCO, ICOMOS and IUCN and the Decision of the UNESCO World eritage Committee, adopted at its 41st session, concerning the state of conservation of the natural and ultural heritage of the Ohrid region, were in the main focus of the Republic of Macedonia within the eporting period. Many activities had been undertaken by the competent ministries and institutions in iew of implementing the requirements indicated by the Reactive Monitoring Mission as being of utmost ignificance in the process of preservation of the Outstanding Universal Values ofthe natural and cultural eritage of the Ohrid region.

Expressing its dedication but also concern for the condition of the natural and cultural heritage of he Ohrid Region, the Parliament of the Republic of Macedonia, in June 2018, organized several days of n Oversight Hearing, including all competent ministries, state institutions and the local community, hich had resulted in defining the weaknesses and needs for the future activities that should be ndertaken in view of protecting the natural and cultural heritage of the Ohrid region http://www. sobranie.mk/20 16-2020-srm-ns article-zakl ucoci -od-nadzornata-rasprava-na-komisij ata -za­ ultura-za-ohridskiot-re ion.ns x).

The Report of the Reactive Mo!llitoring Mission of April 2017, included the following ecommendations, for which we offer our comments:

Recommendation 1:

The development of comparative analysis and the reviewing and finding of alternative routes for he European corridor Vlll in order to mitigate the negative impact that this corridor would have on the utstanding Universal Values had been elaborated above in this Report (more details are given in point ).

8 Recommendation 2 and 3:

Concerning the Recommendations of the Reactive Monitoring Mission for the construction of the ighway A2 Trebenishte-Struga, as well as the construction of the section Struga-border with the epublic of Albania, we would like to inform that they have been fully implemented. An expert opinion ad been submitted to the UNESCO World Heritage Centre in June 2018 (no. 34-380/64 of22.06.2018) long with a clear map of failures and a clear map of the section within the boundaries of the World eritage - the Natural and Cultural Heritage of the Ohrid Region. We still have not received any omments from the Advisory Bodies ICOMOS and TUCN referring to this submitted documentation. ( nnex 4: Expert opinion ji-om the Construction Institute ''Macedonia" for highway A2).

Recommendation 4 and 5:

The construction of the express roaol A3, as well as the Ski Centre within the boundaries of the ational Park Galichica had been fully halted. The implementation of the project for construction of the xpress road A3 had been halted and the provided funds for this project have been redirected for the ehabilitation of the existent state road network in the Republic of Macedonia.

Recommendation 6:

The Republic of Macedonia actively works on preserving the lakeshore belt and establishing rder in the urban transfonnation within the boundaries of the World Heritage -Natural and Cultural eritage of the Ohrid Region - until the adoption of the relevant planning documents that will regulate he works in the region on the long run.

In this context, the Republic of Macedonia faces many legal obstacles (in accordance with the xistent national legislation), the owners' rights, already initiated procedures etc. Understanding the eriousness of the remark on the excessive urban transformation ofthe area, stemming from the badly led rocess of urban planning in the past, Ohrid municipality undertakes activities aiming at halting the egradation of the area and providing quality urban planning which has as a final goal the protection of he Outstanding Universal Values ofthe Ohrid region:

In the period between November 2017 and October 2018, no urban plans had been adopted;

All urban plans that are in procedu11e are being submitted to the Commission for Management of the Natural and Cultural Heritage of the Ohrid Region, which reviews the submitted planning documents earnestly. The seriousness of the approach, the control of the urban development and the transformation within the boundaries of the World Heritage is confirmed by the fact that within this given period the majority of the urban plans had not been adopted, since they have not been approved by the Commission. In this manner, a controlled implementation of the recommendation for a moratorium is being achieved, by fully respecting the national legislation and the avoidance of possible legal consequences related to owners' rights in view of the already commenced processes and procedutes.

In this regard, the Council of Ohrid municipality at its session of 30.10.2018 had rejected the proposed Decision for the Draft Detailed Urban Plan in the central town area of the city. This

9 means that by using the legal mechanisms, the implementation of the moratorium, i.e. the maximal control of the urban planning, slowly achieves its results.

The main actor in the overall contwl of the urban development in the Ohrid region was the ommission for the Management of the Natural and Cultural heritage of the Ohrid Region, which, since i s establishment until today, reviewed 33 requests for preparation of planning documents (detailed urban lans, local urban planning documentation, state urban planning documentation etc.). There had been a ositive answer to only 8 requests (for whose implementation it had been determined that will not have a etrimental impact on the values of the region), while the remaining 25 requests had not been accepted d they were retumed to those who had prepared them for amendments or they had been rejected if they ere assessed as plans that would have a negative impact on the Outstanding Universal Values of the roperty. In this manner (with imposed control) we have made a contribution to the slow decrease of the rban pressures.

Recommendation 7:

The finalizing of the draft Management Plan for the Natural and Cultural Heritage is in a final hase. Having in mind all the changes that emanated from the recommendations of the Reactive onitoring Mission, and which were to be implemented by the Republic of Macedonia, there was a ecessity to make a complete revision of the given planning documents, including the Management Plan. n view of enhancing the protection of the World Heritage, a Plan for Integrated Protection of the Old own Nucleus of Ohrid had been prepared and adopted by the competent protection institutions. It epresents a mechanism for implementation of the integrated approach in the protection of cultural eritage.

The preparation of the draft Strategy for Development of in Ohrid, also a significant trategic document that should contribute towards a controlled touristic development in the region, had een stopped since the prepared draft document was not based on the Outstanding Universal Values of the egion and was not in line with the Mission recommendations. Therefore, it had been decided that a new Strategy for Development of Tourism that would meet the necessary criteria should be prepared.

Assessing the state of the natural and cultural heritage of the Ohrid region, as well as the weakness of the Law on the Management of the Natural and Cultural Heritage of the Ohrid Region, adopted in 2010, it had been decided to prepare a new law and to find mechanisms that would enhance the management structure, defining the competences and responsibilities of all stakeholders.

The draft law sets appropriate mechanisms for decision-making and management, but also determines the competences and the composition of the Commission for Management of the Natural and Cultural Heritage of the Ohrid Region by introducing a genuine pmiicipative approach for the management of the property with active inclusion of the local communities and civil society organizations. At the same time, there will be formal legal preconditions created through the integrated management of the natural and cultural heritage, in order to prevent activities that have a negative impact on the Outstanding Universal Values, as well as for undertaking measures for its active inclusion in the life ofthe community as a factor for sustainable development. The new draft law offers a possibility for the future joint management of the natural and cultural heritage of the Ohrid region and strengthening of the cross-border cooperation with the Republic of Albania.

The draft law is in a phase of a public debate before its final adoption by the Government and the Parliament ofthe Republic of Macedonia.

10 Recommendation 8:

The cumulative impacts of all infrastructure projects and the projects for urban and coastal evelopment, which could have an impact on the Outstanding Universal Values of the property will be t ken into consideration during the preparation of the SEA and the Management Plan for the Natural and ultural Heritage of the Ohrid Region. Upon the preparation of these documents, they will be submitted t the World Heritage Centre for review by the Advisory Bodies TCOMOS and TUCN (in compliance ith paragraph 172 of the Operational Guidelines).

Recommendation 9:

The situation with the illegal constructions within the boundaries of the protected area and their t eatment is directly linked with the Law on Illegal Constructions ("Official Gazette of RM" no. 23/11, 4/11, 155/12, 72/13, 44114, 115114, 199114, 124/15, 129/15, 217115 and 31/16).

From the aspect of cultural heritage protection, the determination of the legal status of an illegal onstruction, the control and the decision-making are performed at several levels -the competent heritage rotection institution issues its professional Opinion concerning the fact whether the construction in case, in view of its location, disrupts the values of the property or not, and consequently, whether that onstruction can be legalized or not. Upon the receipt of such an expert opinion, the Directorate for rotection of Cultural Heritage, decides whether to issue a consent or not to, for the establishment of the ega! status of the illegal construction.

The illegal constructions within the boundaries of the protected property -Natural and Cultural eritage of the Ohrid Region, especially in the old town nucleuses of Ohrid and Struga, as well as in the ational Park Galichica, which are not in line with the above quoted law and disrupt the integrity of the rotected property, are not being legalized, and they are passed on to the competences of the construction nspection, which acts according to the law.

Recommendation 10:

The defining of the buffer zone is a partially complex process having in mind the complexity of he region, but also the territory which should be a part of the buffer zone. The competent institutions initiated a scanning process for the area which should become a part of the buffer zone (according to the Mission recommendation, it would be ideal to include Lake Prespa in order to make a connection of the Ohrid-Prespa ecosystem and the remaining part of the National Park Galichica). However, it is necessary to make a complete overview of the territory which should be included as a buffer zone, having in mind the national legislation, the capacities ofthe resources in those territories (which include areas belonging to other municipalities). The possibility to include a wider territory within the buffer zone will be analysed also in the proscribed procedure of the Operational Guidelines. The proposal for the buffer zone will be submitted to the World Heritage Centre for adoption.

We should also note that the Insti!ute for Protection of Monuments of Culture and Museum - Ohrid in cooperation with the Directorate for Protection of Cultural Heritage had performed a complete revision - updating of the inventory of immovable cultural heritage properties (including also archaeological sites), on the entire territory of the protected area of the Ohrid region (municipalities

11 hrid, Struga and Debrca), as well as a revision of their condition, which will enable a comprehensive verview of the needs for their further protection in the future.

Recommendation 11:

The given change of the Law on the Management of the Natural and Cultural Heritage of the hrid Region, also defines the managemen~ structures and decision-making mechanisms in the Ohrid egion (more details in the comments on recommendation 7).

As a positive outcome, we would li,ke to emphasize that upon an initiative of the civil society ector, the Ministry of Environment and Physical Planning, by an Information adopted by the overnment of the Republic of Macedonia, had initiated the process of proclaiming Lake Ohrid and trudenchishko Blato as a landscape with a higher degree of protection.

Recommendation 12:

More details on the cooperation with the Republic of Albania are given in point 8.

Recommendation 13:

The project documentation for finalization, rehabilitation of the wastewater treatment collector nd reconstruction/expansion of the station for purification of waste waters was prepared with financial ssistance from the EU, secured through the IPA 1 instrument, but so far, no funding for its "mplementation had been secured. In 2018 this project was added to the list of priority projects by the ational Investment Committee and talks were initiated for securing finances with several international mancial institutions and donors.

Ohrid municipality in cooperation with the Government of the Republic of Macedonia, ndertakes serious steps towards the improvement and overcoming of the problem with the collector ystem, which is also a great threat for Lake Ohrid. In that regard, there was a division made of the inter­ unicipal public enterprise of Ohrid and Struga municipalities "Proakva", with which, in future, the anagement of the collector system will be taken over by a national (state) enterprise.

Recommendation 14:

In the Report from February 2018 it had been stated that an "Environmental Protection Study for he Museum on Water at the site Plocha Mikjov Grad"', in the Bay of the Bones at Lake Ohrid, was repared for the project Museum on Water "Bay of the Bones" (no.03/0611127 dated 03.12.2008 prepared y FARMAHEM from ). The Directorate for Environment at the Ministry of Environment and hysical Planning adopted a Decision on the approval of the Environmental Protection Study, which oncluded that the construction of the Mus,eum at the site Plocha Mikjov Grad at Lake Ohrid will not ave significant impacts on the environment,

In order to check the chemical substances used during the reconstruction of the museum in the ay of the Bones, i.e. their impact on the quality of lake water and the wildlife in the lake (as a 12 r commendation from the Reactive Monitoring Mission), the Hydrobiological Institute from Ohrid erformed a thorough analysis which confirmed that there is no negative impact on the water quality aving in mind that the results from the microbiological and physical/chemical parameters, indicated that t e water quality is mainly in the 1st class, (Annex 5: Report on the performed microbiological and hysical and chemical analysis of the water from the Museum on Water "Bay of the Bones"- Gradishte, hrid, No. 03-36713 of25.10.2018).

Recommendation 15:

Concerning this recommendation by the Reactive Monitoring Mission of UNESCO, we are t ansmitting the complete information from AD ELEM Macedonian Power Plants, which is the r sponsible company for the monitoring of the level of Lake Ohrid and the monitoring and control of the ischarge of lake water into the Cm Drim River.

The measures for stabilization of the water level of Lake Ohrid and the regular monitoring and ontrol of the discharge of lake water into the Crn Drim River is an established practice and such easurements are performed daily by measuring the elevation points of Lake Ohrid. This is carried out ontinuously twice a day at a certain measuring point on the shore of the lake.

The level of Lake Ohrid is maintained between the legally prescribed elevation points from 93.10 m to 693.75 m, and up to 694.00 m in exceptional cases during hydrologically extremely wet ears, which are elevation points listed in the Water Management Permit of AD ELEM, issued by the inistry of Environment and Physical Planning of the Republic of Macedonia (no. UP1-11-21/16 dated 5.09.2017).

The regular monitoring of the water level of Lake Ohrid is among the main priorities of AD LEM in the upcoming period (http://www.elem.com.mk/?page%20id=7223).

Municipalities of Ohrid, Struga and Debrca, with financial support from UNDP, started to i plement a project that foresees the returning of the Sateska River to its old riverbed. This is a significant step forward the resolution of the problem with one of the biggest polluters of Lake Ohrid - t e Sateska River. The project will be implemented in cooperation with the Ministry of Environment and hysical Planning, JSC Water Economy and ELEM, experts from ECO-teams as well as non­ overnmental organizations. Due to the scale and the large finances needed, the project will be i plemented in several phases - in the first phase financed by the UNDP, there will be an executive roject prepared, cleaning of the old riverbed and construction of a diversion structure that would control t e flow of the river. It will be followed by the phases for regulating of the upper flow of the Sateska iver with procedures for cleaning of the riverbed, forestation of the slopes in order for the quantities of ud that are entering the river to be lowered and improvement of the communication between the two iver shores (Annex 6: Letter from UNDP).

Recommendation 16:

The Ministry of Environment and Physical Planning in line with the prepared planning ocumentation for the implementation of an integrated regional waste management system in the outhwest planning region (including tendering documentation for the closing and repair of the non­ tandard landfills and illegal landfills) had had several meetings with potential donors for financing of the 13 ctivities for the implementation of this project. Namely, because it is a sum of about 10.000.000 EUR for a total of 12 non-standard landfills and 84 illegal landfills, including the one at Bukovo), the Ministry f Environment and Physical Planning makes efforts to secure these funds through grants or credits, ecause the municipalities in the region do not have sufficient finances and human resources for solving his problem.

Ohrid municipality in cooperation with the Ministry of Environment and Physical Planning had malized the activities for clearing and repair of the illegal landfill at the locality Maucker, in the vicinity f Ohrid. The fieldwork included flattening of a surface of 16.000 m2 construction debris and 7.000 m2 ood quality soil had been placed over. This location will be regularly maintained in order to prevent ture deposition of debris and its re-transformation into a landfill once again.

Recommendation 17:

The monitoring of Lake Ohrid had been elaborated in the State of Conservation Report submitted o the UNESCO World Heritage Centre in February 2018. Regarding the coverage of the components and he continuity, the monitoring of Lake Ohrid is the one that is the most complete, while the tributaries in he watershed of the Ohrid and Prespa Lakes are the least covered by monitoring. Concerning the onitoring of invasive species, the PSI Hydro biological Institute - Ohrid is a pioneer in the Republic of acedonia.

Although the primary goal of the institution is the monitoring of the chemical and biological characteristics of the natural aquatic ecosystems in Macedonia, there are still gaps in the data series due to the lack of funds and the lack of a National Strategy for Long-Term and Complex Monitoring of the Ohrid- Prespa region as a whole.

The monitoring of selected EU wild species of aquatic plants, birds and animals was carried out during the summer of 2017, within the framework of a GIZ project for monitoring of the biodiversity in the Skadar, Ohrid and Prespa Lakes, in the watershed of the Drim River. The monitoring was carried out by experts from EURONATUR- the Republic of Germany, the Macedonian Ecological Society from the Republic of Macedonia, the PI National Park Galichica - Ohrid, NM Lake Prespa and NP Ezerani - Municipality of Resen and a representative from the Department of Nature at the Ministry of Environment and Physical Planning.

Recommendation 18:

The motor traffic is a global problem in almost all protected city nucleuses where everyday living takes place. In the scope of implementing measures that would mitigate the traffic pressure in the old part of the town, Ohrid municipality had introduced a new parking system with a special restrictive traffic regime in the old part of town. In spite of the numerous obstructions, Ohrid municipality continues to implement this new system, which had greatly reduced the intensity of traffic in the central area and in the old part ofOhrid.

Having in mind that a complete ban for traft1c in the protected nucleus is almost impossible, Ohrid municipality initiated the preparation of a Study that would find modalities for a permanent solution for the traffic problem in the old town nucleus of Ohrid. In order to reduce the traffic congestion,

14 ne of the central streets in Ohrid ("Kej Makedonija") was transformed into a pedestrian zone at the Ieasure ofthe citizens and the tourists.

Recommendation 19:

As it had been stated in the Report on the implementation of the recommendations ofthe Reactive onitoring Mission submitted in February 2018, the measures for prevention of the loss of archaeological emains, as well as the deterioration of architectural and urban planning coherence are regulated with the 1 gal provisions contained in the Law on Protection of Cultural Heritage ("Official Gazette of RM" no. 0/04, 115/07, 18/11, 148111,23113, 137113, 164/13,38/14,44/14, 199/14, 104/15, 154/15, 192115,39/16 nd 11118). In that regard, the Directorate for Protection of Cultural Heritage is currently implementing e legal provisions, meaning that all archaeological researches are carried out by experts and institutions ased on a permit issued by the Directorate which, among other things, determines the area in which the rchaeological researches can be carried out, the type and scope of the works, as well as the conditions nder which they can be carried out. The archaeological researches are carried out in accordance with the issued permit and the appropriate methodology.

In accordance with the Law on Protection of Cultural Heritage, and in order to create permanent conomic and other social conditions for the preservation, revitalization and functional use of the 'mmovable cultural heritage, its protection is one of the basic goals of spatial and urban planning. Hence, ·n the spatial and urban planning, depending on the type and the area of the plan, an obligatory coverage d respect of the immovable properties is ensured, which likewise includes the archaeological remains rotected under the provisions of the Law. Regarding the planning, landscaping and use of the space, a rotection regime is developed according to appropriate protection and conservation bases for cultural eritage (documentation basis for the treatment of the immovable cultural heritage in the spatial and rban plans). When preparing the draft of the spatial and urban plan, the designer of the plan is obliged to espect the protection and conservation bases for protection of cultural heritage. In cases when an urban lan has not been adopted, the conditions for constructing a building or undertaking measures of direct rotection that directly or indirectly threatens the integrity of the protected property, i.e. the protected rea, there are mandatory set conditions for protection and conservation contained within. They prescribe he actions that can or cannot be taken when reaching the integrity of the protected property.

During the reporting period, the Institute for Protection of Monuments of Culture and Museum­ hrid, had not issued any positive opinion for upgrades/extensions of buildings in the old town nucleus of hrid in the protected monumental ensemble.

These procedures are carried out through the institutions of protection, that is, the NI Institute for rotection of Monuments of Culture and Museum - Ohrid, responsible for the territory of the Ohrid egion.

The procedures for controlling the construction works in cases when archaeological remains are discovered is regulated by the Law on Protection of Cultural Heritage. If, during the performance of construction, agricultural or other works an archaeological site or objects of archaeological significance are discovered, the contractor, according to the legal provisions, is obliged to immediately report the discovery, stop the works and secure the site from possible damages, destruction and unauthorized access, as well as to preserve the discovered objects at the site and in the state in which they were found. The competent national institution for protection, in this case the Institute for Protection of Monuments of Culture and Museum - Ohrid, immediately or no later than the following day upon receiving the notification of the chance discovery of archaeological remains, canies out a commission inspection, that 15 i , determines whether it is a matter of an chance find and a property under temporary protection and i entities the discovered remains, after which it takes responsibility for preserving the site and the ndings in the state in which they had been discovered. The procedure continues with proposing easures for the treatment of the discovered archaeological remains. Depending on the nature of the iscovered site and the works that are being performed, it can be decided that the performance of the orks continues under the archaeological supervision of the competent institutions for protection or a ecision can be adopted on a temporary halt of the works and the performance of protective excavations d researches can be imposed, as well as theundertaking other measures of protection.

This legal obligation is regularly implemented by the competent institutions for protection of c ltural heritage, as well as by the investors during the execution of the construction works. In this regard, hen designing any kind of infrastructure project, the investor requires an opinion from the competent rotection services on the possible existence of cultural heritage (archaeological sites) on the envisaged r ute/location. If there are indications for existence of an archaeological site, the location is investigated rst. Then, depending on the results and the significance of the site, future measures that should be ndertaken by the investor are prescribed (in cooperation with the competent institutions for protection of ultural heritage) - complete investigation and freeing up of the area for further construction, or s spending the works and finding another solution, that is, changing the location/route.

8. Encourages the State Parties of the Republic of Albania and the Former Yugoslav Republic of Macedonia, with the support of the World Heritage Centre and the Advisory Bodies, to continue to cooperate in the framework of the so-called "Upstream Process" which will lead towards the preparation of a new nomination for a transboundary extension of the property to include the Albanian part of Lake Ohrid in order to strengthen the Outstanding Universal Values, including its conditions of integrity;

Upon the finalization of the "Upstream" process, which had included the project "Towards trengthened Governance of the Shared Transboundary Natural and Cultural Heritage of the Lake Ohrid egion ", the cooperation with the Republic of Albania continues in the scope of building institutional elations and defining a platform with the goal to strengthen the cross-border cooperation for the reservation of the natural and cultural values of the region of Lake Ohrid. The Republic of Macedonia ad strongly supported the Nomination for the extension of the protected property also on Albanian side hich rounds up the process of integrity of the property that is significant for the overall protection of the ultural and natural heritage of Ohrid region.

In the scope of deepening the cooperation with the related institutions in the Republic of Albania, ere was a joint meeting organized with the Mission for evaluation of the Nomination file for extension fthe prope1ty and the Albanian side, where the commitments and dedication from both parties for future uitful cooperation have been expressed. The finalization of the nomination file for extension and its cceptance by the UNESCO World Heritage Committee will enable improved conditions for a successful joint management and protection not only of Lake Ohrid, but also of the overall natural and cultural eritage of the region of Lake Ohrid.

Ohrid Municipality had enhanced its cross-border cooperation with the Republic of Albania in iew of an integral protection of Lake Ohrid though the preparation of joint project proposals and joint pplications to the European Union programmes (mainly in the Cross Border Cooperation EU rogramme).

16 As it had been stated in the previous Report (February 2018), the project for evaluation of the iodiversity of the Drim basin continues, as a complex component of the project CORDA ( ttp://drincorda.org/gef-supported-drin-project). Within this project, there are activities for preparing a anagement plan for the basin of Lake ,Ohrid (within the Drim process), which is yet another s rategically signitkant document that will enable additional protection of Lake Ohrid and future evelopment of the region as a whole.

11. Finally requests the State Party to submit, by 1 December 2018, an updated report on e state of conservation of the property and the implementation of the above, for examination by e World Heritage Committee at its 43rd session in 2019.

In accordance with Decision no. 41 COM 7B.34 of the World Heritage Committee, adopted at the 41st session in Krakow in July 2017, the Republic of Macedonia submits the State of Conservation Report o the protection of the natural and cultural heritage of the Ohrid region by 1 December 2018, based on t e guidelines given in the Decision. The Report had been compiled based on information and documents a ailable in the Republic of Macedonia at national and local level, with full inclusion of all relevant inistries, national institutions and the local communities.

Other protection issues identified by the State Party that could have an impact on the Outstanding Universal Value of the property:

The competent national and local institutions had been working continuously and with dedication o the protection of the natural and cultw-ai heritage of the Ohrid region. There had been maximum a tention dedicated to identifying circumstances on the tenitory of the Ohrid region, that could have a n gative impact on its integrity and the Outstanding Universal Value.

In accordance with Paragraph 172 of the Operational Guide, indicate potential major restorations, alterations and/or new constructions within the scope of the protected area, the contact zone and/or corridors and other areas where these developments would have an impact on the Outstanding Universal Value of the World Heritage property, including its integrity and authenticity.

The Republic of Macedonia undertakes all the appropriate measures and actions for the lfillment of the protection measures. The Republic of Macedonia will continue to inform the UNESCO orld Heritage Centre on the future progress and all future infrastructure plans that could affect the utstanding Universal Value of the Natural and Cultural Heritage of the Ohrid region, in compliance with t e Operational Guidelines (Paragraph 172). * * * The State of Conservation Report had been adopted by the Government of the Republic of acedonia at its 105t 11 session, from 27.11.2018.

* * * 17 The Republic of Macedonia agrees that the Progress Report on the Implementation of the ecommendations from the Decision of the UNESCO World Heritage Committee adopted at its 41st ession (Krakow, Poland 2017) on the status of the Natural and Cultural Heritage of the Ohrid egion - property inscribed on the UENSCO World Heritage List, to be fully published on the NESCO World Heritage Centre website.!

EXPERT OPINION ON THE UNESCO RECOMMENDATIONS MADE BY CIVIL ENGINEERING "MACEDONIA" (CEIM) JSC SKOPJE

RECOMMENDATION 1. The mission recalls t hat updated information on any plans for this road needs to be submitted to t he World Heritage Centre, in line with paragraph 172 of the Operational Guidelines.

Expert opinion from CEIM:

Acco rding to the guides of the Minist ry of Transport and Communications, during the process of project approval of documentation for the Infrastructure Project for the interchange Trebenishta, project documentation for Infrastructure Project for Highway A2, Trebenishta-Struga section from km. 0 + 0.00 to km 8 + 072.04 was submitted as well as Infrastructure Project for the D1 landfill on the highway A2, the Trebenista-Struga section from km 0 + 0.00 to km 0 + 193.85 to the Nat ional Commission of UNESCO by letter No.005-27 I 33 from 04.07.

With answer no. 25711 from 11.01.2017, we were informed that we shouldn't submit materials until the implementation of the Reactive Monitoring Mission of UNESCO.

By letter No.34-130 I 27 from 20.03.2017, we we re notified and invited as an invo luntary party.

We t hink that we have acted upon RECOMMENDATION 1.

RECOMMENDATION 2. The Fifth national report to the Convention on Biological Diversity (Ministry of Environment and Physical Planning, 2014) noted that two ecological corridors, Treska (Podvis) and llinska-Stogovo mountains have t he potential to be disrupted due to the A2 construction. The report also noted the need for construction of several underground passages and at least two green passages to allow connectivity.

EXPERT OPINION FROM CEIM:

In accordance with the Draft Biod iversity Assessment Report (developed by CEIM in accordance with the EBRD criteria and submitted on 11.03.2016 to PESR), the project area does not identify bio-corridors of large mammals, which is confirmed with the biocorridor map of the National Environmental Development Project network in the Republic of Macedonia (MAK-NEN), in the realization of the Macedonian Ecological Society and the European Center for Nature Conservation (ECNC) in cooperation with the MoEPP, 2008- 2011. Th e eco logica l corridors, Treska (Podvis) and the mountain llinska-Stogovo emphasized in the recommendation, are at a minimum distance of~ 20km from the Trebenista-Struga road section. Taking into account this fact, as well as the fact t hat the above mentioned two ecologica l corridors are actually important for the exchange t he genetic material and the movement of large mammals (Brown bear, Balkan lynx, etc.) that are not characteristic of the project region, we conclude that there is no potential for disturbing their structure and functionality. In response to RECOMMENDATION No.4, it is stated that the projected omissions are satisfactory for the terrestrial animals in the habitats along the road corridor.

RECOMMENDATION 3. This remark does not apply to the eastern part of the property, where the ra ilway is potentially planned closer to the lakeshore and

w here A2 highway route is not traced yet. However, any continuat ion of A2 into the M acedonian Albanian should not pass along the lakeshore, in line w ith the recommendations adopted by the WHC at its 38th Session.

EXPERT OPINION FROM CEIM:

In the Enviro nmenta l Impact Assessment Study (approved by the MoEPP 11-4329 I 2 from 26.08.2016) prepared by CE IM, potential impacts as we ll as measures for mitigation of t he impacts on the underground and surface waters, the landsca pe and habitats I, during the preparation and afte r in operational phase and of the project have bee n perform ed. It should also be stated t hat the planned section is at a dist ance of ~ 3 km from the coast of Lake Ohrid and adequate preca utionary measures fo r the Contractor for construction activities are provided, and for the operational phase t here are hydrotechnica l so lutions that are mad e according to stand ards. Namely, fo r 8 km, there are 88 oil catcher and 46 drain age culve rts.

RECOMMENDATION 4. Ensure t hat sufficient passages for people and w ildlife are provided that should be wide and high enough t o enable smooth crossing by t heir use rs, and which should include at least one of the pipe culverts every kilometre with a diameter of t wo meters.

EXPERT OPINION FROM CEIM :

For small mammals, am phibians and reptiles that are typica l re presentatives of the fauna in project area, drainages culverts can mitigate the potent ial harm ful effects of the road corridor by providing a vital link between fragmented habitats. As Ant hony P. Clevenger(2002) state, to improve connectivity and reduce isolation, road construction should include crossings that should have the appropriate dimensions.

In t he literary overview of "DESIGN ELEM ENTS OF WILDLI FE CROSSIN G STR UCTUR ES " prepa red by Heather R. et al., which is also a sublimate of the existing Rule books on Animal Crossings, the stand ard dimension of pipe culverts for small mammals, amphibians and re ptiles are: height (ft) 1.64 (O .Sm) - 3.28 (1m) and w idth of 1.64ft (0.5m) - 3.28 (1m). They should be set at a distance of 262.5 (80) - 328ft (90m), and the material from w hi ch it is made should be concrete or polymers.

During terrain reconnaissa nce of the roa d corridor Trebenista- Struga, experts determined: number of pipe culverts, t heir type and size and therefore for the entire section, a total of 46 (forty six) culverts has been provided, which mea ns that roa d co rridor o f ~ 8 km has a pipe culverts (which animal ca n use as passage) with dimensions of minimum 1m at every 17m of the road.

With this we conclude that hydrotechnica l solutions, i. e. 46 pipe culve rts (with a function of anima l crossings) of which 39 BCC have dimension

RECOMMENDATION 5. Upgrade the existing road between Struga and the Albanian border, rather than tracing a new highway, in view of the fragility of the environment in t hat part of the property, and to the closeness of the lake

EXPERT OPINION FROM CE IM:

The section for which we have prepared documentation is from Trebenishta to Struga, and the RECOMMENDATION 5 concerns another section, ie the section from Struga to Kafasan .

RECOMMENDATION 6. In case of new archaeological findings during the construction works, suspend all construction until the necessary research and inventory work has been carried out.

EXPERT OPINION FROM CEIM:

In the Environmental Impact Assessment Study (approved by the MoEPP 11-4329 I 2 of 26.08.2016) as we ll as the special Heritage Impact Assessm ent Report (submitted to PESR in May 2016) both made by CEIM, potential impact s are foreseen as well as measures to mitigate the impacts on the cultural heritage. Namely, it was noted that in case of new archaeological findings during the construction works, it is necessary to suspend the construction works until the necessary research is carried out by the appropriate services.

RECOMMENDATION 7. Recommendation 3) Assess the cumulative impacts of the railway and highway A2 on the Outstanding Universal Value (OUV) of the property, and justify the choice of not pairing them, or not changing their alignments in order to bring them closer in the northern part of the property

EXPERT OPINION FROM CEIM:

The assessment of the impacts of the A2 highway, section Trebenishta-Struga on the region's Outstanding Universal Va lue {OUV) has been elaborated in severa l studies such as EIA, SEA, draft Biodiversity Assessment report and Heritage Impact Assessment report. Three alternatives for section Trebenishta­ Struga have been considered and the most favorable alternative is the one that is most distant from the Lake Ohrid shore, which owns the OUV. Also, the design of the Trebenishta-Struga section was completed in 2006, in contrast to the design of the railway station which completed 2017/18. In addition, if the Contractor complies with the precautionary measures provided for in these studies, as well as in the EIA Study for the railway line, the impacts are expected to be negligible.

RECOMMENDATION 8. The overall proposed route for highway A2 Trebeniste­ Struga could be considered as acceptable in the plain of Crn Drim and Sateska rivers, if sufficient passages (both for people and animals) are established along the route that should be broad and high enough to allow the smooth crossing of the users. Moreover, in case that new archaeological remains are found during the construction works, the project should cease until necessary research is implemented.

RECOMMENDATION 9. The mission highlighted that the combined impact of the conjunction of highway A2 and the railway in the same site, which has not been taken into account by any of t he projects, needs to be considered.

FOR CONDUCTED MICROBIOLOGICAL AND PHYSIC-CHEMICAL ANALYSIS OF THE WATER AT THE MUSEUM ON WATER - BAY OF THE BONES, GRADISHTE, OHRlD

In order to assess the quality of the shoreline water (littoral zone) from Lake Ohrid, based on physic-chemical and microbiological parameters, at the locality of auto camp Gradishte, or more precisely near the Museum on Water - Bay of the Bones, approximately close to the small cottages of the lake dwelling, on 13 .06.20 18 there has been conducted sampling of water samples from three sites, including:

The samples for analysis of the investigated parameters have been collected by Ruttner bottle (Hydro-bios. Kiel, Germany) and adequately loaded in reagent bottles in accordance to the standards to processing and analysis of certain parameters. The collected samples have been analyzed from microbiological and physic-chemical point of view, in accordance to the world known and accepted standard methods which are app lied in the investigations of water, as well as the Macedonian Directive for categori zation of waters (Official Gazette ofR.M. No. 18/99).

Microbiological analysis

The research comprised parameters of sanitary and ecological aspect, including total number of co li form bacteria, Escherichia coli, Enterococcus and heterotrophic bacteria - at 22 degrees Celsius (psychrophilic bacteria). The obtained results from the microbiological analysis of water from the investigated sites from Lake Ohrid are represented by the table below.

In the complex assessment of the status of water quality, microbiological indicators have a very important role. Bacteria are the ideal sensor for indicating microbial contamination of surface water bodies because they are the first to respond to changing environmental conditions. Heterotrophic bacteria (organotrophs, chemoorganatrophs, saprophytes) are the most widespread group of bacteria in nature by type of metabolism. For these bacteria, organic matter is a source of C02 and energy. The concentration of organic matter corresponds to the presence of heterotrophic bacteria, i.e. they are indicators of organic pollution. According to the obtained results for heterotrophic bacteria, it can be noticed that the values are relatively low and are approximate to the three measuring points - within the limits of 306 to 398 bacteria in milliliter of water. The presence of coliform bacteria is recorded in the three water samples, and their values range from 4 1 to 148 bacteria in 100 milliliters ofwater. The presence ofthe indicatoroffresh fecal contamination, Escherichia coli, is recorded in water from the three sites, al though in a small number that ranges from I to 12 bacteria in I 00 milliliters of water. Enterococci are also present in all water samples, although with relatively small values ranging from 4 to 19 bacteria in 100 milliliters of water. However, the presence of enterococci in the water, Escherichia coli and total coliforms (although in relatively small quantities) indicate fecal pollution as a result of bathers and divers who were present in the lake water during the collection. New EU expert proposals (Kavka & Poetch, 2002) that give a classification according to fecal contamination (E. coli , Enterococci and total coliforms) and organic pollution (hetero atrophy at 22 OC). This classification for microbiological contamination is based on bacteriological standard parameters and is a synthesis, i.e. modification accord ing to Kavka ( 1975), Kavka & Poetch (2002) and EU-Bathing Water Quality Directive 2006/7 I EC. Based on this classification of the waters, the water from Lake Ohrid at the three investigated localities near Grad ishte, before the lake dwelling, based on all investigated and noted parameters is classi tied un der class r.

Physic-chemical analysis

The physic-chemical analysis comprises investigations which include parameters which would yield in a realistic image of the condition of the waters - analyzed from organic and nutrient loading point of view. The obtained results based on the physic-chemical analysis are represented by the table below.

The obtained results for the concentration of dissolved oxygen from the analyzed water samples indicate that the water from the three measuring points is well oxygenated and according to the Classification of Waters, it belongs to I class. The values obtained for biochemical oxygen consumption, an indicator of organic pollution in aquatic ecosystems, according to the Water Classification Regulation (Official Gazette of the Republic of Macedonia No. 18/99), indicate the quality of class I in the investigated measuring points. The obtained values for the content of organic biodegradable substances (represented as consumption of KMn04) under the Water Classification Regulation indicate that the quality of water in the investigated sites, on the basis of this parameter, belongs to the II class. In the samples of water collected from the subject sites there has been conducted categorization on the basis of nutrient concentrations, total nitrogen and total phosphorus, according to the Directive on Water Categorization (Official Gazette of the Republic of Macedonia No. 18/99). The analyzes showed that nitrogen forms in nitrogen samples, nitrates, nitrites and nitrogen in Kjeldah l are present in water samples. The presence of ammoniacal nitrogen in the samples is not registered. Based on the obtained values for total nitrogen, according to the Directive on Classification of Waters, the water from the investigated sites indicates to the quali ty from the 1-11 class. According to the concentrations of total phosphorus, the water from all three measuring points belongs to II class. In order to estimate quantitatively the trophic state, an index of trophic state is calculated, which is a multidimensional trophic concept and includes aspects of the nutri ent load, concentration of nutrients, primary production, lake morphometry (Carlson, 1977). The trophic state index calculated on the basis of the concentration of total phosphorus indicates the oligotrophic character of the water in this region, more precisely in the investigated sites. Based on the calculated values for the total suspended matter in the analyzed samples as well as the total dry residue after evaporation, all subject sites have water quality from the first class.

Based on the obtained results from the microbiological and physic-chemical parameters, it can be generally concluded that at the moment of research, the water at the investigated sites is of first class. According to some parameters, which indicate to nutrient loading (total nitrogen and total ph9sphorous) the water is classified under class II. Since the collection of the samples has been conducted in summer period when there is increased •

frequency of tourists in the area, the increased values for nitrogen and phosphorous is expected. Likewise, the same explanation is truthful for the detected coliform bacteria, E. Coli and enterococci (although all of them have been registered in small numbers). Although in this period the water is of good quality, continuous and complete monitoring of the water and sediment from the whole Lake Ohrid is necessary (not only in this coastal part), in order to fully understand the situation and to take appropriate measures for protection.

BRIEFER: OHRID LAKE PRESERVATION THROUGH MANAGEMENT OF THE TRIBUTARY RIVERS

PROJECT INFO: Project “Improving the management of protected areas” is financed by the European Union, through IPA II – Sector operational programme for Environment and Climate Action 2014- 2020 and implemented by the United Nations Development Programme (UNDP) in close cooperation with the Ministry of Environment and Physical Planning

Municipalities of Ohrid, Struga and Debrca applyed a joint project for immediate actions for improving the quality of the Lake Ohrid waters. The project is focused on Sateska river and mitigation measures that will decrease the pollution of the lake and littoral that is negatively affecting the biodiversity of the lake and the quality of the water.

Brief history about the problem In 1961/2, the River Sateska was diverted from its natural path into the River Black Drim and instead routed into Lake Ohrid, and now it enters on the northern shore between the cities of Ohrid and Struga. The diversion was motivated by three main considerations:  to reduce the sediment load in Globočica Reservoir;  to secure the hydroelectric potential of dams on the River Black Drim; and  to drain Struga Marsh wetland areas.1

It is estimated that annualy some 120.000m3 of sediment enters the Ohrid lake, and because of this reason many of the habitats were lost and the lake shore has been changed. Additionally 39% of the total phosphorus that enters the lake comes from Sateska river and the phosphorous is the base of the eutrophication process in the lake.

Expected results

The general objective of the project is to undertake measures and actions for protection and conservation of natural heritage (geodiversity, biological and landscape diversity) by regulation of the old river bed of the Sateska river and prevention of distribution of sediment from the existing river bed into the Ohrid lake waters in order to mitigate the risks of sedimentation of the littoral area of the lake.

UNDP has conducted activities such as geodesy surveying of the rivers Crn Drim and Sateska that will result with hydraulic modeling and proposed intervention measures for prevention of degradation and pollution of the Ohrid lake.

It is expected that first phase of the project (hard) intervention measures will be realised through the project activities that will include: 1. Improvement of the hydraulic capacity of Crni Drim 2. Improving Sateska's hydraulic capacity at critical parts (natural riverbed) 3. Reconstruction (adaptation) of the diversion structure at Volino

Additionally, it is necessary that further intervention measures (barriers, antierosion measures, etc) are undertaken in future in the upstream river bed of River Sateska, where the sedimet is generated.

EXPERT OPINION ON THE UNESCO RECOMMENDATIONS MADE BY CIVIL ENGINEERING "MACEDONIA" (CEIM) JSC SKOPJE

RECOMMENDATION 1. The mission recalls t hat updated information on any plans for this road needs to be submitted to t he World Heritage Centre, in line with paragraph 172 of the Operational Guidelines.

Expert opinion from CEIM:

Acco rding to the guides of the Minist ry of Transport and Communications, during the process of project approval of documentation for the Infrastructure Project for the interchange Trebenishta, project documentation for Infrastructure Project for Highway A2, Trebenishta-Struga section from km. 0 + 0.00 to km 8 + 072.04 was submitted as well as Infrastructure Project for the D1 landfill on the highway A2, the Trebenista-Struga section from km 0 + 0.00 to km 0 + 193.85 to the Nat ional Commission of UNESCO by letter No.005-27 I 33 from 04.07.

With answer no. 25711 from 11.01.2017, we were informed that we shouldn't submit materials until the implementation of the Reactive Monitoring Mission of UNESCO.

By letter No.34-130 I 27 from 20.03.2017, we we re notified and invited as an invo luntary party.

We t hink that we have acted upon RECOMMENDATION 1.

RECOMMENDATION 2. The Fifth national report to the Convention on Biological Diversity (Ministry of Environment and Physical Planning, 2014) noted that two ecological corridors, Treska (Podvis) and llinska-Stogovo mountains have t he potential to be disrupted due to the A2 construction. The report also noted the need for construction of several underground passages and at least two green passages to allow connectivity.

EXPERT OPINION FROM CEIM:

In accordance with the Draft Biod iversity Assessment Report (developed by CEIM in accordance with the EBRD criteria and submitted on 11.03.2016 to PESR), the project area does not identify bio-corridors of large mammals, which is confirmed with the biocorridor map of the National Environmental Development Project network in the Republic of Macedonia (MAK-NEN), in the realization of the Macedonian Ecological Society and the European Center for Nature Conservation (ECNC) in cooperation with the MoEPP, 2008- 2011. Th e eco logica l corridors, Treska (Podvis) and the mountain llinska-Stogovo emphasized in the recommendation, are at a minimum distance of~ 20km from the Trebenista-Struga road section. Taking into account this fact, as well as the fact t hat the above mentioned two ecologica l corridors are actually important for the exchange t he genetic material and the movement of large mammals (Brown bear, Balkan lynx, etc.) that are not characteristic of the project region, we conclude that there is no potential for disturbing their structure and functionality. In response to RECOMMENDATION No.4, it is stated that the projected omissions are satisfactory for the terrestrial animals in the habitats along the road corridor.

In the Enviro nmenta l Impact Assessment Study (approved by the MoEPP 11-4329 I 2 from 26.08.2016) prepared by CE IM, potential impacts as we ll as measures for mitigation of t he impacts on the underground and surface waters, the landsca pe and habitats I, during the preparation and afte r in operational phase and of the project have bee n perform ed. It should also be stated t hat the planned section is at a dist ance of ~ 3 km from the coast of Lake Ohrid and adequate preca utionary measures fo r the Contractor for construction activities are provided, and for the operational phase t here are hydrotechnica l so lutions that are mad e according to stand ards. Namely, fo r 8 km, there are 88 oil catcher and 46 drain age culve rts.

RECOMMENDATION 4. Ensure t hat sufficient passages for people and w ildlife are provided that should be wide and high enough t o enable smooth crossing by t heir use rs, and which should include at least one of the pipe culverts every kilometre with a diameter of t wo meters.

EXPERT OPINION FROM CEIM :

For small mammals, am phibians and reptiles that are typica l re presentatives of the fauna in project area, drainages culverts can mitigate the potent ial harm ful effects of the road corridor by providing a vital link between fragmented habitats. As Ant hony P. Clevenger(2002) state, to improve connectivity and reduce isolation, road construction should include crossings that should have the appropriate dimensions.

In t he literary overview of "DESIGN ELEM ENTS OF WILDLI FE CROSSIN G STR UCTUR ES " prepa red by Heather R. et al., which is also a sublimate of the existing Rule books on Animal Crossings, the stand ard dimension of pipe culverts for small mammals, amphibians and re ptiles are: height (ft) 1.64 (O .Sm) - 3.28 (1m) and w idth of 1.64ft (0.5m) - 3.28 (1m). They should be set at a distance of 262.5 (80) - 328ft (90m), and the material from w hi ch it is made should be concrete or polymers.

During terrain reconnaissa nce of the roa d corridor Trebenista- Struga, experts determined: number of pipe culverts, t heir type and size and therefore for the entire section, a total of 46 (forty six) culverts has been provided, which mea ns that roa d co rridor o f ~ 8 km has a pipe culverts (which animal ca n use as passage) with dimensions of minimum 1m at every 17m of the road.

With this we conclude that hydrotechnica l solutions, i. e. 46 pipe culve rts (with a function of anima l crossings) of which 39 BCC have dimension

RECOMMENDATION 7. Recommendation 3) Assess the cumulative impacts of the railway and highway A2 on the Outstanding Universal Value (OUV) of the property, and justify the choice of not pairing them, or not changing their alignments in order to bring them closer in the northern part of the property

EXPERT OPINION FROM CEIM:

The assessment of the impacts of the A2 highway, section Trebenishta-Struga on the region's Outstanding Universal Va lue {OUV) has been elaborated in severa l studies such as EIA, SEA, draft Biodiversity Assessment report and Heritage Impact Assessment report. Three alternatives for section Trebenishta­ Struga have been considered and the most favorable alternative is the one that is most distant from the Lake Ohrid shore, which owns the OUV. Also, the design of the Trebenishta-Struga section was completed in 2006, in contrast to the design of the railway station which completed 2017/18. In addition, if the Contractor complies with the precautionary measures provided for in these studies, as well as in the EIA Study for the railway line, the impacts are expected to be negligible.

RECOMMENDATION 8. The overall proposed route for highway A2 Trebeniste­ Struga could be considered as acceptable in the plain of Crn Drim and Sateska rivers, if sufficient passages (both for people and animals) are established along the route that should be broad and high enough to allow the smooth crossing of the users. Moreover, in case that new archaeological remains are found during the construction works, the project should cease until necessary research is implemented.

BRIEFER: OHRID LAKE PRESERVATION THROUGH MANAGEMENT OF THE TRIBUTARY RIVERS

PROJECT INFO: Project “Improving the management of protected areas” is financed by the European Union, through IPA II – Sector operational programme for Environment and Climate Action 2014- 2020 and implemented by the United Nations Development Programme (UNDP) in close cooperation with the Ministry of Environment and Physical Planning

Municipalities of Ohrid, Struga and Debrca applyed a joint project for immediate actions for improving the quality of the Lake Ohrid waters. The project is focused on Sateska river and mitigation measures that will decrease the pollution of the lake and littoral that is negatively affecting the biodiversity of the lake and the quality of the water.

Brief history about the problem In 1961/2, the River Sateska was diverted from its natural path into the River Black Drim and instead routed into Lake Ohrid, and now it enters on the northern shore between the cities of Ohrid and Struga. The diversion was motivated by three main considerations:  to reduce the sediment load in Globočica Reservoir;  to secure the hydroelectric potential of dams on the River Black Drim; and  to drain Struga Marsh wetland areas.1

It is estimated that annualy some 120.000m3 of sediment enters the Ohrid lake, and because of this reason many of the habitats were lost and the lake shore has been changed. Additionally 39% of the total phosphorus that enters the lake comes from Sateska river and the phosphorous is the base of the eutrophication process in the lake.

Expected results

The general objective of the project is to undertake measures and actions for protection and conservation of natural heritage (geodiversity, biological and landscape diversity) by regulation of the old river bed of the Sateska river and prevention of distribution of sediment from the existing river bed into the Ohrid lake waters in order to mitigate the risks of sedimentation of the littoral area of the lake.

UNDP has conducted activities such as geodesy surveying of the rivers Crn Drim and Sateska that will result with hydraulic modeling and proposed intervention measures for prevention of degradation and pollution of the Ohrid lake.

It is expected that first phase of the project (hard) intervention measures will be realised through the project activities that will include: 1. Improvement of the hydraulic capacity of Crni Drim 2. Improving Sateska's hydraulic capacity at critical parts (natural riverbed) 3. Reconstruction (adaptation) of the diversion structure at Volino
