Admitted rightS 41360 of 2005 filed by Bombay Burmah Trading Corporation challenging the proposal for revision of lease rent, show (A) Zamin Singampatti Village Part II Survey Number 251 cause notice for termination of lease and Mandamus claiming Rights: patta respectively. The Hon’ble High Court by common Zamin Singampatti Village Part II Survey No.251 is order dated 1-9-2017 passed in the above said case registered as “Forest” (å¶‚èŠð†ìè£´) in ‘A’ register. Bombay was pleased to reject the claims made by M/s. Bombay Burmah Trading Corporation is a lessee under the lease Burmah Trading Corporation and granted a part relief deed dated 12-02-1929 for 99 years executed between namely that the Bombay Burmah Trading Corporation shall the Singampatti Zamindar and the company and the area remain in possession of the leased area till 11-02-2028 as under lease is 8373.57 acres (3388.78.0 Hectare). Bombay ordered by the Board of Revenue under Section 19A of the Burmah Trading Corporation filed a claim petition No.5/79 Tamil Nadu Estate (Abolition and Conversion into Ryotwari) Under Section 10 of the Tamil Nadu Forest Act 1882, Act, 1948 (Tamil Nadu Act XXVI of 1948). (Tamil Nadu Act V of 1882) to hold and exclude the Accordingly, as directed by the Hon’ble High Court above said land from the limits of proposed Reserved the Survey No.251 of Zamin Singampatti village part II is Forest. As against the said order of the District Court or termination of lease , whichever is earlier, after which Bombay Burmah Trading Corporation has preferred revision Bombay Burmah Trading Corporation shall have no rights in in CRP(MD) 2745 of 2015 on the file of Madurai Bench the Zamin Singampatti village part II Survey No. 251 and of Madras High Court, which was later transferred to the in pursuance of Hon’ble High court order dated 01-09-2017, Principal Bench and directed to be tagged along with the the said claim will cease to exist. 3 other writ petitions namely WP Nos.41358, 41359 and (B) rIGHTS OF WAY:

3 Earthen road allowed to Balatheertha Vinayagar Temple An Earthen road over a distance of 12.15 km length and 1.80m width is allowed to Survey No 245 of Zamin Singampatti village. The Balatheertha Vinayagar Temple is situated as an enclave within the Forest block. It starts from the Karaiyar river bridge situated in the junction of northern boundary of Singampatti forest block and southern boundary of Papanasam reserved forest and runs towards west to over a distance of 3.75 km then turns towards south and runs over a distance of 4.10 km then turn towards north, runs over a distance of 4.40 km and reaches the Balatheertha Vinayagar Temple. 4 The Public road from Manimuthar to Kuthiraivetti and Nalumukku to Veerapuli Reserved Forests boundary Zamin Singampatti Village Part II Survey No.251 is registered as “Forest” (xJ¡f¥g£lfhL) in ‘A’ register. Bombay Burmah Trading Corporation is a lessee under the lease deed dated 12-02-1929 for 99 years executed between the Singampatti Zamindar and the company and the area under lease is 8373.57 acres (3388.78.0Ha). Bombay Burmah Trading Corporation filed a claim petition No.5/79 U/S.10 of the Tamil Nadu Forest Act1882 (Tamil Nadu Act V of 1882) to hold and exclude the above said land from the limits of proposed Reserved Forest. Finally the Forest Settlement Officer rejected the claim of the company in proceeding No.5368/08 dated 06-01-2010 under Section 10 of Tamil Nadu Forest Act 1882 (Tamil Nadu Act V of 1882).. Against the Forest Settlement Officer’s order, the Bombay Burmah Trading Corporation filed an appeal in District Court, Tirunelveli in CMA 4/2010 which was also dismissed by the District Court by judgment dated 1-9-2015. As against the said order of the District Court, Bombay Burmah Trading Corporation has preferred revision in CRP(MD) 2745 of 2015 on the file of Madurai Bench of Madras High Court, which was later transferred to the Principal Benchand directed to be tagged along with the 3 other writ petitions namely WP Nos.41358, 41359 and 41360 of 2005 filed by Bombay Burmah Trading Corporation challenging the proposal for revision of lease rent, show causenotice for termination of lease and Mandamus claiming patta respectively. The Hon’ble High Court by common order dated 1-9-2017 passed in the above said case was pleased to reject the claims made by M/s. Bombay Burmah Trading Corporation and granted a part relief namely that the Bombay Burmah Trading Corporation shall remain in possession of the leased area till 11-02-2028 as ordered by the Board of Revenue under Section 19A of the Tamil Nadu Estate (Abolition and Conversion into Ryotwari) Act, 1948 (Tamil Nadu Act XXVI of 1948). For the Survey No 251 of Zamin Singampatti Village, way of 3 meters width and 40 Kms length from Manimuthar check post to Kuthiraivetti black topped road and 3 meter width, 2 Km length from Nalumukku to Kalakad Reserved Forest boundary in light of Hon’ble High court order dated 01-09-2017the right of way is admitted till 11-02-2028 or termination of the lease,whichever is earlier. (A) Manimuthar check post to Kuthiraivetti road,- The road starts from Manimuthar Forest Check post at Manimuthar dam in Survey No 234 of Zamin Singampatti village and runs towards south upto Manimuthar falls bridge over a distance of 4.30 km. Then runs towards west over a distance of 12.60km and reaches boundary of leased out land of Bombay Burmah Trading Corporation then the road runs towards west over 14.20km distance through Manjolai tea estate, Kakkachi estate and reaches the junction of Nalumukku, then the road turns towards north and runs through Oothu, over a distance of 8.90 km and reaches Kuthiraivetti. (B) Nalumukku Junction to Veerapuli Reserved Forests boundary,- This road starts from the junction of Nalummuku and run towards south over a distance of 1.90km and reaches the boundary of Veerapuli Reserved Forests. The above two roads are allowed to be used by Tamil Nadu Electricity Board and Tamil Nadu Government Transport Corporation, after due permission from Forest Department. Cart Track allowed to Patta land of Thiru Kalyana Venkatraman and Laxmi Narayanan: A cart track over a distance 2km length and 3m width is allowed to reach the Survey No. 247 of Zamin Singampatti Village, to use by the pattadhar Thiru Kalyana Venkatraman and Laxmi Narayanan. 7 Blacktopped road allowed to Sorimuthu Ayyanar Temple: Survey No 243/1 Sorimuthu Ayyanar Temple, Survey No 243/2 Resting shed (éLÂ) and Survey No. 243/3 Chatram (r¤Âu«) of Zamin Singampatti Village are situated as enclave within the Singampatti forest block. The northern boundary of this area shares the southern boundary of Papanasam Reserved Forests Upper Slope. There is already an existing blacktopped road to reach this area through Papanasam Reserved Forests and it is being used by devotees. Hence allowing of another new right of way within Singampatti Forest block doesn’t arise.
