If exact date is not known, you must reflect the year. _________ The following guide is provided to determine if you meet the residency requirement or not: a) that the applicant was in the relevant Territory at the beginning of the period of three years ending with the date of the application, (this is unwaivable) and that the number of days on which he/she was absent from the Territory in that period does not exceed 270; and b) That the number of days on which the applicant was absent from that Territory in the period of twelve months prior to the application date does not exceed 90; and c) That the applicant was not at any time in the period of twelve months prior to the application date subject under the immigration laws to any restriction on the period for which he/she might remain in that Territory; and d) That the applicant was not at any time in the period of three years in that territory prior to the application date in breach of the immigration laws. If you were or are outside the Territory for an extensive period for educational / medical purposes, original documentation to support this must be provided by the university or college / medical facility. This information must stipulate the length of time that you were away or expect to be away to achieve your degree / complete medical treatment. Note: The applicant’s principal home must be in the Territory. The “Territory” meaning the Cayman Islands and intend to continue residing in the Cayman Islands for the forseeable future. Go to Section 7 *Unwaivable Requirement: For example: If applicant departed the Cayman Islands on the March 3, 2011 and did not return until the March 17, 2011, he/she would not be eligible to apply for Naturalisation until after the March 17, 2014. Naturalisation as a British Overseas Territories Citizen is at the discretion of the Home Secretary in the United Kingdom and, in the case of the Cayman Islands, that power has been delegated to the Governor of the Territory. The grant of citizenship is on the basis of several factors, including:- •complying with the unwaivable requirement, •complying with the residency requirements, •the intention to remain in the Territory, •sufficient knowledge of the English language, •being of good character. 7 Referees This section of the form is to be filled in by the applicant’s referees who must be a British Overseas Territories Citizen of the Cayman Islands aged 25 or over and listed on the Electoral Register. Introduction Hungdah Chiu* I. HISTORICAL BACKGROUND Great Britain annexed the island of Hong Kong under the 1842 Treaty of Nanking' after it defeated China in the Opium War of 1839-42. Controversies arising from attempts to open Canton (Guangdong) to for- eign trade resulted in an Anglo-French expedition against Peking in 1858. The 1860 Treaty of Peking2 ending this conflict forced China to cede the Kowloon Peninsula, facing the island of Hong Kong, to Great Britain.
