Pre qualification Criteria:

1. Tenderer should be in line of mechanized housekeeping business. Audited balance sheet giving complete details of turnover (housekeeping/cleaning) Assets and list of clients etc. to be enclosed for a minimum period of 3 years along with ITCC. 34

2. Tenderer shall have a minimum experience of 3 years continuously in housekeeping in a hospital of repute (Min 800 beds and heaving a turnover of at least 1 crore in the same.

3. Latest satisfactory performance certificate from such organization will have to be provided with the application form.

4. Tenderer shall provide copies of their registration with PF, ESIC, Service Tax, PAN, Labour license, Commercial Tax along with the application.

Offer Validity :

The offer should remain valid for a period of three months from the date of opening of tender. GMC shall not be responsible for any delay in receiving the tenders and reserves the right to accept/reject any part of/all the offer without assigning reasons what so ever.

Enevelope B: Financial Bid

(i) Price Bid shall be in second envelope containing the filled up schedule of rates duly superscribed as price bid, Tender No. Name of Work and the address of the party shall be mentioned on the envelope top. (ii) All tenderers are required to read tender documents carefully before quoting rates and submission of tender. (iii) It will be taken that (a) tender documents have been fully read and understood by the Tenderers and (b) the parties have duly visited the work site, irrespective of the fact whether they have done so or not and claim on this account shall not be entertained at later date. (iv) The rates shall be filled in figures and word. Cutting and overwriting shall be avoided and if occurs all corrections/cutting shall be signed and authenticated by the Contractor/Agency without fail. All pages of schedule of rates shall be duly signed and stamped by the Contractor/Agency. (v) Conditional Tender will not be accepted. (vi) Tender without EMD & Tender documents fee will not be accepted.

TERMS AND CONDITIONS OF CONTRACT FOR PROVIDING HOUSEKEEPING SERVICES AT GANDHI MEDICAL COLLEGE AND ASSOCIATED HOSPITAL OF HAMIDIA AND SULTANIA

1) SCOPE OF WORK

To execute and maintain the housekeeping services at Gandhi Medical College & Associated Hospital of Hamidia & Sultania premises and the surrounding areas within the boundary wall of campus.

The job function is to keep Gandhi Medical College & Associated Hospital of Hamidia & Sultania premises including the surrounding areas within the boundary wall under the contract neat, clean and tidy every day throughout 24 hours and keeping them in hygienic and sanitary conditions of high standard by utilizing latest technology modern cleaning machines/equipments.

The morning shift effective cleaning has to be ensured one hour before the working hours of the concerned department. i) The approx floor area of Hospital, : ……………………... R&T centre and auditorium ii) The approx road length : …………………….. iii) Approx total campus area : …………………….. iv) The approx. manpower : 200(±10%)

Note – Increase or decrease of manpower to the extent of 10% can be done anytime during the tender tenure by mutual consent.

DURATION OF CONTRACT:

a) The contract period will be for three years form the date of award of contract, however it will be initially for one year and will be extendable after recommendation of a committee framed by Dean, GMC, Bhopal. b) The contract period may be extended for any further period (s) after expiration of the above stipulated period on mutually agreed basis. In case contract lasts for full stipulated time as above and no notice of termination has been served by either party, the contract shall be deemed to be continuing till it is formally renewed or terminated by the parties to the contract. c) GMC for reason whatsoever and of which the GMC shall be the sole judge may terminate this contract by giving notice of 30 days and the contractor/Agency and his staff shall vacate the site/work place immediately on the expiry of such notice. d) Notice period by the Contractor during the execution of contract will be 90 days on/after confirmation. In the event of such termination of the contract, the Contractor/Agency shall be paid for all the work executed upto the period of termination including refund of security deposit, subject to deduction of any penalties, other recoveries etc. within a period of two months at the discretion of the Dean of GMC. e) At the end of Ist year, renewal of tender for 2nd year would be done by a hike of 10% in the total tender cost by mutual consent. No further addition of payment shall be made. Similarly at the end of 2nd year the renewal for 3rd year would be done by hiking 10% of the total tender cost. C: SECURITY DEPOSIT:

The contractor shall deposit an interest free cash security of Rs. 5,00,000/- (Rs. Five Lacs only) which will be refunded to him subject to the full and final settlement of all liabilities under this agreement, after the expiry/termination of the contract. The contractor will not have any right for claim the interest on this security deposit which was held by GMC during the period of contract.

D: INSURANCE:

The Contractor shall keep his manpower, tools, equipment and all other items insured comprehensively against all risks of what so ever in nature including third party risks at his own cost although these might be physically located at Gandhi Medical College & Associated Hospital of Hamidia & Sultania premises during the tenure of the contract.

E: CONTRACTOR’S OBLIGATIONS :

The contractor will provide as per cost decleared: (i) All Housekeeping services material including disinfectants, deodrants, detergents, antiseptics, glass cleaning & floor cleaning liquids, floor polishing material, carbolic & nephthalence ball etc or any other material required for his work and directed by the officer incharge. The consumable of the reputed brands only will be allowed for use in the Hospital.

(ii) Equipment & appliances like pans, baskets, bucket, drums wheel barrows, trolleys, vans, carts, spades, bamboo’s dusters, mops, brushes, brooms, vacuum cleaners, floor scrubber, floor polishing machine, road cleaning, flippers, motorised drain pipe cleaning m/c, High pressure jet cleaning m/c, sofa cum carpet shampooing m/c, Heavy duty collection and disposal bags etc. (iii) The Contractor is expected to use modern cleaning methods. (iv) Sets of uniform to his workers as approved by the hospital (Both males & Females) While on duty. Sufficient number of uniforms would have to be provided so that the worker is never without uniform. It will be strictly monitored & severe fine will be imposed if worker is found without uniform. (v) The work of Contractor will be inspected/monitored under the control by the representative of Hospital. In case of default, penaulty may be levied on the contractor for which no arbitration shall be considered. (vi) The contractor shall be liable to pay compensation for any loss and damage caused to the property of the Gandhi Medical College & Associated Hospital of Hamidia & Sultania or its patients by the contractor or his workers. (vii) The contractor shall be personally responsible for the conduct of his staff and in case of any complaint against any of his staff, contractor will be under obligation to change the worker when instructed by GMC authority. The contractor shall observe all the laws and will himself be responsible with regard to staff on the roll of the contractor what-so-ever. (viii) The contractor and his staff shall follow the rules and regulation of the GMC in force and instructions issued from time to time and GMC will be free to take action against the contractor for violating the same. (ix) The contractor is not allowed to alter the scope and specification. He should not add any condition of his own. (x) Agency shall make arrangements of providing contract labour as and when required will perform their duties as per the directions instruction/orders laid down by GMC authority for each individual department. (xi) Within 24 hours of receiving the requisition from the GMC authority will provide additional personnel as and when required by the GMC at the same rate as specified in this agreement. (xii) All personnel may be interviewed and screened by the authorized representative of the Dean GMC and after his approval only the personnel will be deployed on duty. (xiii) Agency shall not increase or decrease the total number of personnel without the prior approval of Dean GMC’s authorized representative. (xiv) Any personal found misfit or including into indiscipline Act or found medically unfit, shall be immediately removed and immediate replacement accordingly shall be made by the Agency at the same time at no extra cost. (xv) Representative of the Agency shall meet authorized Officer daily to apprise the position and situation and or to discuss any matter concerning their personnel. (xvi) All the personnel will have to submit a bio-data and recent pass port size photograph, medical fitness certificate, police verification report and photocopy of discharge book at the expenses of agency to the authorized representatives for records. (xvii) All Agency personnel shall be in possession of identify card worn on their uniform while on duty. 42

4) GENERAL TERMS & CONDITIONS OF CONTRACT FOR HOUSEKEEPING SERVICES:-

A: PROHIBITIONS AGAINST SUB-CONTRACTING: It is agreed and understood by GMC authorities and contractor that this contract shall not be transferable and no job arising under this contract be sub-contracted by the contractor. B: STATUTORY OBLIGATIONS: a) The contractor will have to abide by the provisions of labour abolition and regulation act 1970, minimum wages act PF & ESI and other statutory labour laws, rules, regulations as applicable in state of Madhya Pradesh. Any liability arising on the Gandhi Medical College & Associated Hospital of Hamidia & Sultania as principle employer shall be deducted from the bills of the contractor and it the full amount is not recovered , then the same shall be recovered from the security deposit of the contractor. The contractor shall be personally responsible for the conduct of his staff and in case of any complaint he will be under obligation to change the worker when instructed by GMC’s authority. b) The PF & ESI shall be deposited on monthly basis within the stipulated time period for a particular month and a copy of challan/receipt from bank shall be deposited alongwith the final bill of that particular month. C: PROHIBITION REGARDING REPRESENTATION THROUGH LAWYER: i) No party shall be allowed to be represented by a lawyer during any investigation, enquiry, appeal or any other proceedings. ii) Terms and conditions of the licenser may be unilaterally modified by the GMC authority as and when necessary without affecting the basic nature of this contract. D: INSTITUTE’S AND CONTRACTOR’S OBLIGATIONS: i) The GMC authority shall not pay any compensation in respect of any injury or death caused to the workers of the contractor. It will be sole responsibility of the contractor to follow the Workmen’s Compensation act. ii) The contractor will provide sets of uniform and the identity cards to his workers as approved by the GMC authority (both male & female) for wearing while on duty. Sufficient numbers of uniforms would have to be provided so that worker is always with clean uniform. It will be stricktly monitored and fine will be imposed if workers are found without or dirty uniform. iii) The contractor or his representative shall daily report to the authorities of GMC or his representative and take instructions every day form him for the work on a Book/Register maintained by the contractor exclusively for

the purpose. He shall preserve the said book and produce the same as and when required. iv) Routine notices/instructions will be given by the GMC authorities/Officer nominated by the Dean. v) The suitable storage place at one location will be provided by GMC authority free of cost. However, GMC shall not be responsible for any loss, breakage or theft of contractor’s material for which he has to make his own secured arrangements for storage.

vi) The GMC will not charge any amount from the contractor for water or/and electricity supplied for housekeeping activities under the contract. However it is the responsibility for the contractor to use optimum water & electricity for housekeeping services, any negligence/misuse noticed the penaulty may be levied by GMC authority. vii) The payment will be made by the GMC through cheque/Bank Draft payable at Bhopal to the Contractor every month after submission of proper bill duly verified by the authorized representative of GMC. viii) The workers posted/engaged in the Housekeeping services of Gandhi Medical College & Associated Hospital Of Hamidia & Sultania campus by the contractor, shall remain his employees and shall not be deemed to be or treated as the employees of the GMC and shall not claim any salary, damages, compensation or anything arising out of their employment/duty at the Gandhi Medical College & Associated Hospital Of Hamidia & Sultania campus under this contract. ix) Terms and conditions of the contract may be modified by the GMC authority without effecting the basic nature of contract. All conditions as per the Tender documents will also be applicable. E: FORCE MAJURE: Not withstanding anything contained in this contract, the contract shall be subject to force majure i.e. acts of god or the acts which are beyond the control and diligence of the parties. Any preach or violation of the contract on account of civil commotion, fire, floods, strikes, internal disturbance or external aggression would not render the parties liable for any deduction or penaulty whatsoever. It is also understood and agreed by the contractor that the present contract is being entered in or in connection with the work and business of the GMC as aforementioned and in the event of any partial/total closure of the business/operations of the GMC reduction of work, business or requirement for any reason whatsoever, the GMC shall be free to terminate the contract or amend the contract as may be deemed fit at its sole discretion of Dean of GMC. The contractor shall not be entitled to receive any compensation whatsoever on account of above. F: ARBITRATION: It has been mutually agreed between the parties that all differences and dispute arising during the contract period regarding interpretation of contract shall be solved by mutual discussions. In the event of differences or dispute remaining unresolved, the same shall be referred for arbitration to the Chairman, Autonoumus GMC Society & Commissioner (Revenue) Bhopal and his decision shall be final and shall be binding on all parties. G: PEOSECUTION LIABILITY/LIABILITY FOR ANY CLAIM:

It shall be personal responsibility of the contractor to ensure the execution of the contract in conformity with various statutory provisions effecting the contract form time to time. In case of any breach, violation/contraception or infringement, whatsoever the contractor shall alone be liable for prosecution to the exclusion of all. H: JURISDICTION: This contract shall be deemed to have been concluded at Bhopal for all purpose and therefore only courts of Bhopal shall be having the jurisdiction for the purpose of any adjudication where some dispute/difference remain unsolved inspite of arbitration.

MISCELLANEOUS: The contractor shall provide timely and right information to GMC authority whenever, required/asked from the contractor and that in case of any wrong information given by the contractor the contract shall be liable to be terminated.
